The 168th

Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 30th - 31

th January, 2014 at Conference Hall, ERC, NCTE,

15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below

14. At the outset, the Regional Director welcomed all the members of Committee and apprised them about the

provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of

Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due

(i) The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting formal letters from the office of ERC. The replies so

received will also be considered by the committee.

(ii) The cutoff date for grant of recognition for the session 2014-2015 is

3rd

March 2014. The institutions are personally responsible, if loose the

session from 2014-2015 due to non submission/late submission of replies.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs. and the and W.P. (C) No. 5466 of 2013 preferrd by the

institution before the Hon’ble High Court of Delhi at New Delhi, the Committee discussed the matter in detail

and observed as under:

1. As per NCTE Regulation 2009 and subsequently amended on 26.11.2010 under clause 7(1-A)(ii) the

application of the institution was summarily rejected on the following grounds:

(i) Only one set of application received within 07 days from the submission of online

application and the date of dispatch of the application is not known.

2. The institution preferred an appeal to NCTE Hqrs against the said order of ERC’s dated 23.2.2013

and the Appellate Authority also rejected the appeal of the institution and confirm the order of ERC.

3. The institution preferred writ petition W.P. (C) No. 5466 of 2013 preferrd by the institution before

the Hon’ble High Court of Delhi at New Delhi. The Hon’ble High Court of Delhi reminded the

matter to ERC with a direction to issued fresh show cause notice. In view of the above, the committee decided as under:

As per the order of the Hon’ble High Court of Delhi, a fresh show cause notice be issued to the institution.

NCTE Hqrs. vide letter No.A78554 Dt. 3.12.2013 given relaxation to the DIET/DRC/STS of Odisha

as one time major with following direction.

“The procedure for processing the request of the Government of Odisha would be initiated; the

formal letter of approval would however, be issued subject to the following to conditions:

(i) All staff as per the norms and standardsof NCTEis in place by February 2014.

(ii) There is an adequate budgetary allocation in the budget of the State Government for

the year 2014-15, for provision of requisite infrastrucre as per the norms and

standards of NCTE.

2. As per the decision of the ERC in its 166th

meeting held on 19-20 December, 2013, the

Commissioner-cum-Secretary, Department of School and Mass Education, Govt of Odisha vide

letter dated 01.01.2014 was requested to comply the requirement as stated in above paragraph.

And as per the decision of 163rd

ERC meeting VT has been constituted and inspection has

been conducted on 13.01.2014.

clarying that the building work has been completed and submit some bills for purchasing the items

which does not shows that the building construction is completed and equipments like library books,

equipments for all 4 laboratories and multipurpose hall etc are available in the institution.

6. Hence, the committee is not satisfied with the reply of show cause notice submitted by the institution.

In view of the above, the committee decided to re-sent the VT for verification of instructional and infrastrature

facilities at the cost of the institution.
