REGULATIONS IN TERMS OF SECTION 37(3)(0) OF THE NATIONAL NUCLEARREGULATOR ACT, 1999 (ACT NO. 47 OF 1999), ON THE KEEPING OF A RECORD

OF ALL PERSONS IN A NUCLEAR ACCIDENT DEFINED AREA

Under section 37(3)(a) of the National Nuclear Regulator Act, 1999 (Act No. 47 of 1999), theMinister of Minerals and Energy, after consultation with the Board of Directors of the NationalNuclear Regulator, hereby make the regulations in the Schedule.

Definitions

SCHEDULE

1. In these regulations any word or expression to which a meaning has been assigned in the Act,shall have the meaning so assigned.

Responsibilities of the regulator

2. When a nuclear accident has occurred and the regulator has defined the period and the area of thenuclear accident as contemplated in section 37(2)(b) of the Act the regulator must keep a record ofeach person who, according to its information, were within the area so defined at any time during theperiod so defined in the manner as specified in section 3.

Record of persons

3. A documented record of persons shall include but not be limited to the following, whereapplicable-

(a) Full name(b) Gender(e) Age(d) Date of birth(e) Identity number(f) Passport number(g) Physical address(h) Postal address(i) Telephone number(j) Cell phone number(k) Location in the defined area(1) Time period in the defined area(m) Reason for being in the defined area(n) Address and Contact details of a relative

Offence

4. Failure to comply with these regulations shall constitute an offence as contemplated in section52(2) ofthe Act.
