NANCY’S NOTES

PRARA is continuing talks with Allegheny County Fire Marshall

officers concerning Ordinance No. 30-16 Bill No. 9746-16. We have met

twice with them and have another meeting scheduled for the end of June.

Our goal was to have this eliminated but as you know when the county needs

funding it doesn’t really matter how or why, it just is.

On a lighter side we have been able to have input into the frequency of the inspections

and the standards to support the facility safety inspection. We will continue to work with them.

I would also like to thank the Stake Holder members Doug Friend, Bob Cornell, Nate

Croasmun, Dinesh Mittal and Gauttam Patel.

PA Emissions is also in the process of changing the format for re-certification, all testing

will be done on-line. The instruction process will continue as is. They are looking for this to be

in place by 2018. They are expecting to speed up the process by eliminating mailing in tests

and waiting for them to be processed.

Flexibility Act of 2017

H.R. 1180 sponsored by Rep. Martha Roby, R-

Alabama, and co-sponsored by 17 others, would help Ameri-

can workers balance the competing demands of family and

work by giving them flexibility to earn paid time off-time

they can later use for any reason, including family commit-

ments like attending school appointments and caring for a

sick child.

In addition, H.R. 1180 contains critical protections

to ensure employees can continue to choose overtime pay

and to prohibit employers from coercing their employees to

accept compensatory time instead of overtime pay. The bill

would give employees who work more than 40 hours a week

a choice between taking time off or being paid time-and-a-

half for the overtime hours.

The House version, HR 1180, recently passed the

House 229 to 197. Sen. Mike Lee,

R-Utah, has introduced a companion bill (S. 801) in the Sen-

ate.

SSDA-AT supports the Working Families Flexibil-

ity Act of 2017 because it would alter the Fair Labor Stan-

dards Act (FLSA) in a much-needed way to allow certain

employees to choose to take paid time off rather than over-

time pay when working more than 40 hours in a week.

The Administration supports H.R. 1180 and if it

were presented to the President in its current form, his advi-

sors would recommend that he sign the bill into law.

Update On May 24 PPA Panel On Laurel

Pipeline Flow Reversal At Energy Expo

This is an update regarding the panel that PPA

had scheduled to discuss the pipeline reversal

issue this coming Wednesday (May 24 ) in

Hershey.

As the planning for the event unfolded,

Gulf, Monroe and Philadelphia Energy Solu-

tions accepted our invitation to participate;

however, Buckeye Partners declined.

Because our intent was to have a bal-

anced panel for our members to be educated,

we are canceling the panel.

PPA will progress on an independent

endeavor to continue on gathering information

on this critical issue to share with our mem-

bership. However, Ben Brockwell, OPIS, will

be at our Wednesday meeting to speak on this

and other subjects. We encourage members to

attend this important meeting!

As the cost of operating your shop continues to increase, adjustments need to be made to

keep operating in a profitable manner. Rising parts’ prices will add more to your gross even if

your markup remains the same. Unfortunately the charge for labor must be raised to keep up

with the increased costs of technicians, their benefits, new equipment and shop overhead.

I recently surveyed 39 member shops, 15 non-member shops, 10 new car dealerships

and several national chain shops to find out their hourly labor rates. Member shops range from

$60/hr to $110/hr with an average of $83/hr. Non-member shops ranged from $55/hr to $110/

hr with an average of $94/hr. Dealerships ranged from $102/hr to $135/hr with an average of

$112/hr. National chain shops were $100+/hr. The majority of member shops were between

$75/hr and $90/hr. The dealerships were from many areas around the city and were members

multiple location groups. All shops offer package deals and some vary labor rates by type of

job (diagnostics) or vehicle type.

Thanks to everyone who contributed information. Obviously this not a comprehensive

survey but a look at the auto repair business in our area. We hope you find the data helpful.

P.S. A couple of fuel/convenience stores have been visited by an IUP team for an OSHA type

inspection. They received reports detailing issues with MSDS info and employee training.

Gulf Oil Reaches Sponsorship Deal With NHL's Penguins Pact includes in-arena signage.

WELLESLEY HILLS, Mass. — Gulf Oil is going home — sort

of. The oil company has formed a major sponsorship agreement

with the National Hockey League's (NHL) Pittsburgh Penguins.

Gulf's former headquarters was located in Pittsburgh,

and the sponsorship further represents the company's ongoing

investment in the Pennsylvania market and strong commitment

to helping its customers and communities thrive, according to

the company.

At the start of the 2017-2018 season, new Gulf signage

will appear throughout the PPG Paints Arena where the hockey

team plays. The signage includes dasherboards, LED ribbon

boards and digital advertising.

"Gulf Oil has such a rich history of support for the Pittsburgh

region, and we're excited and proud to add their iconic brand to

the Pittsburgh Penguins family," said Terry Kalna, senior vice

president of sales and broadcasting for the Penguins. "We salute

Gulf's continued commitment to the people of western Pennsyl-

vania and look forward to working with them to benefit Pen-

guins fans everywhere."

The sponsorship also includes support of events outside

of hockey, including both community and charitable initiatives.

"By partnering with one of the top hockey teams in the

country, we can engage consumers across the United States and

extend our brand's recognition while continuing to support our

historic home," said Nikki Fales, marketing manager, Gulf Oil.

Gulf Oil is a refined products terminaling, storage and

logistics business, as well as a distributor of motor fuels

throughout the United States. It owns and operates a network of

17 terminals with more than 14 million barrels of refined prod-

uct storage capacity in the Northeastern U.S.

PRARA 2017 Scholarship Fund For the twenty third year, the Petroleum Retailers & Auto Repair Association is sponsoring two $500

College Scholarships to be awarded to a member’s son or daughter. The applicant must be the child of a current

member of PRARA and must be graduating from high school in 2017 or are already attending a college, trade

school, business school, etc. Applicant must be enrolled as a full time student. Postgraduate students are not

eligible. The student must begin classes within 13 months of the award date.

To be eligible, the member must submit the name, address, and telephone number of the child, along with

the name of the high school the applicant will graduate from or the name of the college, trade school, business

school, etc. already attending to the Association office. The application below must be mailed to the PRARA

office by July 1. (The postmark) No phone applications will be accepted.

Every applicant will be given a list of three-digit numbers. The child, who holds the three-digit number

corresponding to the Pennsylvania lottery on Monday, July 10 and Tuesday July 11, will be the winner. Who

ever won Monday’s lottery is not eligible to win Tuesday’s lottery. The applicant closest to the number on

Tuesday’s lottery will be the winner. The winners will be based on the 7:00 pm drawing for both nights.

Winners of previous scholarships are not eligible to participate. The PRARA Board of Directors will vote to

resolve any disputes.

The scholarship maximum is $500 each. The check will be made out to the student and the school of

his/her choice. Proof of registration must be provided before check is issued. The scholarship is not limited to

potential college students, but to anyone wanting to further their education, whether it is college, trade school,

business school, etc.

PUC Judge Hears Conflicting Views On Reversing Laurel Pipeline Flow

A Public Utility Commission administrative law judge Tuesday heard conflicting views

on the impact of reversing the flow of the Laurel Pipeline from Pittsburgh to Altoona allowing

petroleum products from midwest refineries to be sold in the midstate at the same time cutting

off access of Philadelphia refineries to Western Pennsylvania.

One of the key issues was the potential impact on the price of petroleum products to con-

sumers.

Testimony by Laurel Pipeline (Buckeye Partners LP) said consumer prices would be lower be-

cause midwest refineries produce product at a lower cost than Philadelphia refineries. Laurel

also said there has been a dramatic decline in the amount of product it shipped from Philadel-

phia to Pittsburgh from 90,000 barrels per day in 2014 to 30,000 barrels in 2017.

Gulf Operating and Altoona-based Sheetz, countered that Laurel’s proposal “would de-

stroy competition that keeps gas prices in check for the large Western Pennsylvania market.”

Pipeline laborers spoke in support of the project, which promises jobs through an esti-

mated $200 million in equipment upgrades, while Philadelphia-area refinery workers and busi-

ness groups urged the commission to oppose the project because any harm to the already chal-

lenged refineries along the Delaware River could lead to layoffs.

Many other stakeholders have weight in on this issue in prior comments to the PUC.

PA House, Senate Get Back To Work On Gaming, Liquor Reform, Merit Selection

The House and Senate return to Harrisburg this week, before their Memorial Day break, to po-

tentially tackle the issue of re-enacting the local share of casino tax and perhaps gaming expansion.

The House Gaming Oversight Committee Monday is scheduled to consider a series of bills on

gaming issues, including the local share of casino tax– House Bill 1342 (Santora-R-Delaware), assess-

ing a new one-time fee on casinos to help balance the state budget– House Bill 1281 (Quinn-R-Bucks)

and House Bill 965 (Masser-R-Columbia) that would mandate the repayment of the PA Race Horse

Development Fund.

Although not yet scheduled, Senate Republican could try again to have a Senate Community,

Economic and Recreational Development Committee meeting on House Bill 271 (Ortitay-R-

Allegheny) and amending it with their ideas on the local share of the casino tax and expanded gaming.

House Republicans are scheduled to take a final vote on House Bill 1213 (Kampf-R- Chester)

banning the process of spot property assessment appeals by school districts (sponsor summary) that is a

priority for PA Retailers.

In the Senate, companion legislation– Senate Bill 586 (Argall-R-Schuylkill) (sponsor summary)

– is scheduled to be considered Tuesday.

Liquor reform will be on the House agenda with Republicans set to consider final action on their

fifth liquor reform bill in the last three weeks– House Bill 1033 (Ellis-R-Butler) providing for Wine

and Spirits Enhanced Permits for malt and brewed beverage distributors (sponsor summary).

Merit selection of appellate court judges– House Bill 111 (Cutler-R-Lancaster) (sponsor sum-

mary) is also scheduled to be considered for a final vote in the House.

But, of course, legislative schedules can change.

HARRISBURG — Pennsylvania drivers, heating oil dealers, refinery workers and pipeline laborers weighed in Tuesday on a pro-

posal to partially reverse the flow of a cross-state gasoline and diesel pipeline that brings petroleum products from the East Coast to

southwestern Pennsylvania.

Laurel Pipe Line Co. is planning to reverse flow on the line near Altoona, 100 miles east of Pittsburgh, so Midwestern refin-

ers seeking an expanded market can ship more fuel to the middle of the state.

The move would end Western Pennsylvania’s pipeline access to Philadelphia-area refiners and make central Pennsylvania,

instead, the delivery point for pipeline flows from both directions.

An administrative law judge for the Pennsylvania Public Utility Commission heard competing testimony from mid-state fuel

consumers and dealers, who want the competitive benefits of a second supply source, and Western Pennsylvania consumers, who

said they fear they will be shut out of access to eastern gasoline supplies during months of the year when it has historically been

cheaper.

A resident from Peters Township said the pipeline reversal will lower Pittsburgh fuel prices so they are more in line with

those on the eastern side of the state.

Pipeline laborers spoke in support of the project, which promises jobs through an estimated $200 million in equipment up-

grades, while Philadelphia-area refinery workers and business groups urged the commission to oppose the project because any harm

to the already challenged refineries along the Delaware River could lead to layoffs.

A central debate focuses on the proposal’s effect on fuel prices.

David MacGregor, an attorney for Laurel, said the reversal will lower gasoline prices throughout the commonwealth.

“We’re bringing in cheaper supply from the Midwest,” he said. “Cheaper supply equals lower prices.”

Adeolu Bakare, an attorney for Gulf Operating and Altoona-based Sheetz, countered that Laurel’s proposal “would destroy

competition that keeps gas prices in check for the large Western Pennsylvania market.”

The afternoon and evening public hearings on Tuesday were an early step in a process that is expected to continue until at

least the fall, when evidentiary hearings are scheduled.

After Administrative Law Judge Eranda Vero issues a recommendation, the five-member commission will decide whether

to approve the project.
