The last dinnerThis may sound crazy—in fact, I’m fairly certain it will sound crazy—but I sometimes find myself thinking about what I would choose for my last meal if I were on death row. This typically happens after I see a television show or a movie that involves a prisoner. (I told you it was crazy.) There is so much to consider.

I would ask for two or three last meals. You know when the end is coming, why not make it “the last week of meals?” Of course my husband would have to prepare all of the dinners since the prison can’t cook all that food properly. Or what if you do choose just one—let’s say you choose eggplant Parmesan; but when it comes, the eggplant is underdone, the sauce is bland and the cheese is sub-par. I doubt they let you send it back. Or what if you order a rare steak and it is served well-done? What then? What happens? Yes, these are the thoughts that plague my mind.

But I think the fact that prisoners get to choose a last meal illustrates the importance we all place on food. Okay. I may place a wee bit more importance than most do. But still, it is worth noting. As far as I know, they don’t let you choose a special outfit to wear to your execution. They don’t show you your favorite movie or let you watch your favorite sports team. But, they do let you choose your last meal. You have to wonder why.

Food is pretty important to most people—and I am not just talking about nourishment. Food connects us to our religions, our ethnic groups, our families and our friends. It serves as a bridge to our past and our futures. Who doesn’t look forward to a great meal?

I have a pastry board and a rolling pin that belonged to my grandmother who was as talented a cook as there ever was. She made rugelach on that board and taught my mother

how to make it. And my mother taught me. Whenever I break out the board and the rolling pin, I think of my grandmother. She passed away when I was just 7 years old, but when I make those rugelach, I know she is somewhere smiling down on me.

Food is part of who we are, our memories of the past and surely part of our futures. But that last meal? Some days I think I know what I will choose and then it changes.

Tonight for example, as I ate some take-out eggplant Parmesan, I thought to myself—“yeah, eggplant parm, one of my all-time favorites.  I hope they would serve it to me with a side of spaghetti and some garlic bread. And I would love to start off with an antipasto—with plenty of Genoa salami on there. And for dessert…chocolate pudding. But only if they get it from Hominy Grill in Charleston, South Carolina. Or lamb chops with a side of potato pancakes. I’ve also considered a fresh Maine lobster with plenty of drawn butter. And bread. There would have to be a warm, crusty loaf of French bread with plenty of room-temperature butter to go with it. Oh, and some pâté—and while I’m going high-end, maybe some caviar with an ice cold glass of Veuve Cliquot. And not-for-nothing, but some killer macaroni and cheese might be great too. 

I think I’ll keep evaluating my options so I’m truly prepared. But I am certain of one choice. I would end with a big bowl of chocolate ice cream with hot fudge and whipped cream—or maybe Häagen-Daz coffee ice cream. Oh I give up.

LifesaversPOMPANO BEACH SUMMER JUNIOR LIFEGUARD PROGRAM The Ocean Rescue Division of Pompano Beach Fire Rescue offers a Junior Lifeguard Program each year in June and July for boys and girls age 9-17.

Children gain self-confidence, improve their physical condition all while learning about water safety, first aid, beach ecology and surf rescue techniques. While being introduced to safe marine and aquatic recreational opportunities, the kids gain respect for the environment, for themselves, their parents and their peers.

REQUIREMENTS: All Junior Lifeguard applicants must pass a swimming proficiency test that includes:

• Swim 150 yards (six lengths) non-stop with a time limit of five minutes. • Tread water for at least three minutes. • Swim five yards underwater. No exceptions.**Swim tryouts are held each year on specified dates. For more information

I was born and raised in South Florida and have been fishing my entire life. I live and breathe being on the water. Social media has allowed me to share with the world my love and passion for fishing. Pelagic Gear noticed my Instagram page and they thought I was the perfect fit to represent the brand and the lifestyle of being a “Pelagic Girl”. They contacted me and I quickly became a brand ambassador for their woman’s apparel, Pelagic Girl. 

My fiancé John Dalton and a friend of ours, Nic Bechtel, were dying to get out on the water for a couple of weeks since the conditions had been extremely rough for a while. The seas were three to four feet that day (November 21). We made a plan to troll for tuna, wahoo, and mahi so we were fishing with naked ballyhoo, which is what the sailfish was caught on. We left out of Hillsboro Inlet and made our way north towards Boca. We stayed inshore from 80 to 120 ft depth and because of the conditions we were trolling at about four knots. There were only a couple of other boats around from

what we could see and they all seemed to be flying kites because of the high winds that morning. We were right around the Deerfield Beach pier when our line started to ring. As I began to reel, the last thing I was thinking was that it was a Sailfish. It has been about a year since the last time I caught one so it just escaped my mind completely. It jumped out of the water a few times with the sail flying high and what a great surprise it was. We also thought it was a little ironic that the other boats nearby that were fishing with kites and live bait, were all intrigued by our catch. The fight only lasted about 10 minutes. Nic and John were ready with gloves on and helped me by pulling it onto the gunnel for a quick picture. We didn’t weigh him, but our guess was around 50 to 60 pounds, 10 feet long. (This was also my first Sailfish brought on board since past ones had always seemed to break off right next to the boat.) We were so elated that we decided to go back in since we felt pretty accomplished in just a short hour.

As an artist, I am always searching for something different.  My mother and I would travel the art show circuit and watch people buy expensive sculptures and paintings.  Though I sold a lot of drawings and paintings, I felt like it had all been done before.  As time passed, sword fishing became hugely popular and I experimented with painting scenes on swordfish bills.  This is what I had been looking for as an artist for years.  I now had something different that no other artists were doing.  The painted swordfish bill would became my little niche as customers would drop off their swordfish bills to be painted with scenes of boats and swordfish jumping under moonlit skies.  I would often paint scenes that I myself have experienced and fished through; scenes that I knew swordfishers would appreciate. However, I was so busy painting other people’s swords, I noticed I never had one in the store to display when people visited to discuss their painting.  I decided to paint a swordfish bill that would sit in my studio as a display piece for the new customers to see and be inspired by.  I wrote a weight on the bill in gold ink stating 439lbs. The biggest fish I had caught at night in the past 14 years, up until this point was only 350 pounds, but the bill was so big that this weight seemed fitting.  After all, it was only used as a display.  The sword has hung on my office wall and has sat there for 18 years.

We started catching big swords about eight years ago. I never really cared to fish at night—not like I had back in the day for a constant 10 years. That is, until the night of September 9, 2012. Until this night I had not fished in the dark for over eight years.  We would fish the Miami Swordfish Tournament aboard the boat “Stake Out” out of Lighthouse Point.  That night I fought the toughest fish of my life and was standing up battling in a harness for nearly six hours.  When it was all said and done, we boated the Florida 50lb tackle state record and won the tournament.  A week after the tournament, a customer entered my office to discuss a sword bill painting.  As I began to fill out his paperwork he said, “Wow I can’t believe you painted that sword from the tournament so quickly.”  I wasn’t quite sure where he was going with this, so I turned in my chair to look at the bill hanging on my wall.  The weight on the sword bill I had painted as a sample 18 years earlier read 439 pounds which matched the weight exactly of the fish I had landed in the tournament.

DIRECTIONSPreheat the oven to 400°F and line a baking sheet with tinfoil.In a small bowl mix together 3 tablespoons of olive oil, garlic, rosemary, salt and pepper. Rub the mixture all over the beef tenderloin.

In a large fry pan over medium-high heat, warm 1 tablespoon of olive oil. Sear the tenderloin on all sides until browned, about 3 minutes per side. Reserve liquids, and transfer the tenderloin to the baking sheet. Place into the oven and roast for 28-30 minutes for medium-rare.

Remove from the oven and transfer the meat to a cutting board. Cover with tinfoil and allow it to rest for 20 minutes.

Just before serving, slice the meat into 1/4 inch thick slices and arrange on a platter. Pour the red wine reduction over top and serve.

TENDERLOIN INGREDIENTS1 center-cut beef tenderloin, about 3 pounds, trimmed and tied 4 tablespoons olive oil 3 garlic cloves, minced 1 sprig fresh rosemary, minced sea salt and pepper to taste

RED WINE REDUCTION INGREDIENTS2 cups chicken stock 1 cup dry red wine 1/3 cup shallots, finely chopped 1 thyme sprig 1 rosemary sprig, minced 3 tablespoons butter sea salt and pepper to taste1 teaspoon flour, for thickening (optional)

Rosemary-rubbed beef tenderloin with red wine Reduction

RED WINE REDUCTIONIn a medium saucepan over medium heat, combine juices and brown bits from the fry pan with chicken stock. Bring to a simmer. Stir in red wine, shallots, thyme and rosemary. Cook until reduced to about ¾ cup, around 10 minutes. Stir in butter until melted. Season with salt and pepper. Bring to a simmer, then remove from heat.

Strain mixture over a bowl and discard solids. Keep reduction warm until ready to serve.

Optional: if you like a thick reduction, add a pinch of flour, up to 1 teaspoon to thicken the consistency.

It’s a new year and time for new eyes on our gardens. It’s also the time of year that I’m thankful to have planted Florida natives as the backbone of my garden.

When temperatures suddenly fall as they will this month, and people begin to panic, I just sit back with full confidence that nature has it under control. Here’s a good tip to remember: Plant tissues will die at 32 degrees, not at 33, or 35, and certainly, not 40 degrees.

And even if it does hit the actual freezing point, the freezing temperatures have to be sustained for a certain period of time, depending

on the plant, to actually cause irreparable damage.

Most plants, even some tropical ones, will simply die to the ground. The root, which wasn’t frozen (that’s 32 degrees) will cause the plant to sprout when temperatures warm.

In order for most Florida plants to perish, the ground would actually have to freeze for a certain number of hours. This just doesn’t happen in South Florida, thankfully.

So, try to remember that many plants actually thrive with this extra cool blast. It is often necessary to trigger blooming. This is especially true in the case of some orchids. If you bring them

in now, you may actually forfeit the bloom. Unless a freeze is imminent, leave your orchids

alone. Don’t start moving them and overprotecting them. Just make sure they are properly hydrated and out of direct winds. If you have some that are blooming, you can bring those in to enjoy and to preserve the blossoms, which may wither a bit, but this will not kill the plant.

If you have some low-chill peaches, plums, nectarines or apples planted, this is just what the doctor ordered. Many fruits will not blossom and set fruit unless they receive a predetermined number of hours around 40 degrees.

So, fellow Floridians, it’s time to take a chill pill; change is inevitable, and often beneficial.

Sporting events can be very exciting. Most people enjoy participating in and watching sports. It can be more exciting when it involves our children. We sit on the sidelines and think about the great things to come from our little angels. Participating in sports can be a great experience for kids, and should be. There are some things we as parents should keep in mind.

What do we want our children to learn from participating in sports?  We want our children to learn the sport they are playing; the rules, skills and proper form. However, they have the opportunity to learn so much more. What they learn in sports carries over into life. They are learning how to take direction from a coach, use constructive criticism, work with peers, how to be patient, how to cope with disappointment, being a good winner and a good loser (sportsmanship), learning to push themselves physically and what it means to make and keep a commitment.

I think most conscientious parents do a great job of supporting their child’s education and their teachers. These are the same things we need to do as parents of an athlete. Parents need to model appropriate behavior on the sidelines just like they do elsewhere.  Supporting the referees, even when you’d like to throw out a few expletives or send the ref to the optometrist. This can be a tough one. This helps our kids understand the roles of the people involved. Fans cheer for their team and enjoy watching the sporting event. Referees make sure the sport is played according to the rules and do their best to make the right calls. Coaches- instruct the players, decide who plays what position and who goes in and out of the game. Players- take instruction and play the sport to the best of their ability, show up to all practices and games.

Exposing your child to a variety of sports and choosing the best one for him or her is important. The goal is to develop your child physically and develop their self-esteem. Competition is also about your child learning to compete against her or himself. This is done by setting personal goals for which to strive. Their team may have lost but your child may have set a personal record. Have a healthy attitude toward the competition. Opponents are

your child’s best teachers. Olympic or professional athletes look for fierce competitors to push them to new personal levels. The opposing team should never be viewed as “bad” or people you need to “crush”. Whatever attitude you take trickles down to your kids. If you congratulate the opposing player for a skillful move, your children will too.

Who is playing the sport? Sports should be fun for kids. When they stop having fun we need to talk to them to determine why. Many kids are playing a particular sport because that was mom or dad’s sport and they are trying to please a parent. As parents we need to ask ourselves if we are living vicariously through our children and attempting to accomplish our goals through them. Your children will be far more successful playing a sport for themselves. Bruce E. Brown and Rob Miller of Proactive Coaching have been coaching athletics have surveyed college athletes over 30 years and asked them what their parents said to them that made them feel great and increased their joy. The most frequent response was “I love watching you play.”

Well, it’s January, and with the new year, it’s time for that official, and universal, “fresh start” for everyone. And so, I’m inspired to write something meaningful about new beginning—Yes, I’d like to write something insightful and positive which sums up the purpose of life; something which everyone reads and says; “That’s profound. I couldn’t have said it better myself.”

And then I fall short. Do you ever have an idea rolling around upstairs, one on the tip of your tongue that could have the potential to be great, if only you could find the words? Well, I must admit, when I want to write something “deeply meaningful,” I’m usually at a loss for words. And this is how I was feeling when I typed in “new beginning” and “inspiration” on my lap top…And with just a few clicks; I found myself in a euphonious world of beautiful quotes. And so…. Drones, also known as unmanned aerial vehicles or UAVs, have become ubiquitous. You can buy one at Target, Macy’s or Sicilian Oven, which offers the flying pizza UAV. Whole Foods even has an organic drone, made of quinoa stuck together with honey. It’s very light and quite tasty. Just don’t fly it when birds are present.

Personal drones now come with high-resolution cameras, which should take the “Peeping-Tom” industry to a whole new level. They can see a blemish on a caraway seed from 5,000 feet. This will be a boon to the Paparazzi. They no longer will have to risk being punched in the nose by Alec Baldwin.

My concern is not with the Paparazzi. I’m worried about a nosy neighbor who will use the device to steal my secret recipe for smoked panda barbecue sauce.

These flying objects are similar to the ones the military uses, but a lot smaller. No, you can’t use it to take out the guy who wakes the neighborhood starting his two-stroke Boston Whaler at 5 in the morning. The ones sold locally don’t carry guns or bombs. You must go to the high-end super-drone stores if you want Hellfire missiles as an extra cost option. Be warned, these are pricey and probably violate some busybody ordinance enacted by humorless local officials.

I plan to buy a camera-equipped drone to further my study of anatomy. I have an attractive neighbor who likes to sunbathe nude in her backyard, in full view from my property. Well, almost full view. I need only a five-foot ladder to see over the ficus hedge.

There is, however, a danger to this. I could burst my fantasy bubble by obtaining detailed pictures of a woman whom I have admired from afar. I would be chagrined to learn that her body is covered with little round circles from where people have been touching her with ten-foot poles.

Amazon recently announced it was considering using drones to deliver packages.  Their first test market included 100 people, 67 of whom ordered inexpensive items, then stole the drones. Total merchandise ordered was $982. The loss of 67 drones

costing $8,000 each was $536,000. This was slightly better than the loss ratio of the U.S. Post Office.

Convicts are petitioning various correctional institutions for the right to use drones, via their organization—the American Association of Recidivist Prisoners (AARP). They argue that if they are permitted access to drones to fly in contraband, this will relieve friends, family and the occasional prison guard of that responsibility, thus reducing crime. Seems like a valid argument.

Southwest Airlines is contemplating using drones to fly passengers, making flight crews obsolete. This will create one more hassle for passengers. You will have to bring your own peanuts.

Various government agencies are flirting with the idea of creating drone-free zones. If a UAV wanders into one of these areas, citizens should be permitted to use them for target practice.

If you plan to buy a drone, make sure you get one that has been endorsed by the Voyeurs Association of America and certified by JD Power and Associates.

Just keep it away from me, as I’m ready for you. I have purchased a Daisy “John Wayne Commemorative” surface-to-air BB-gun.

I am not afraid to use it if you violate my air space.

Pets are part of your family.  Whether you have a dog, cat, bird or any other combination of animals living with you, it is important to consider the legal issue of providing for your pet when you pass away.  I recommend that you make specific provisions for your pet in your lat will and testament and/or your revocable living trust.

You may have a certain person in mind to take care of your pet after you die.  You should speak to that person before naming him or her in your will or trust.  You should also consider having an alternate if that person dies before you.  If there is no individual person whom you trust, you can name an organization or specific facility that specializes in caring for pets after their owners die.  You can ask your veterinarian for recommendations.

The next consideration is how much money you will be designating to take care of your pet’s needs for the rest of your pet’s life.  If you are naming an individual, the amount of money will be up to you, based on your own assets and your pet’s life expectancy and special needs.  You can leave the full amount to the individual as a specific bequest.  The individual will pay for the pet’s needs from those funds and have use of the full bequest without restrictions. You can also set up a trust naming a different person as trustee of the funds with discretion to give the pet caregiver funds as needed and with a provision as to who will inherit any remaining money after your pet passes away.

INCLUDE YOUR PET IN YOUR WILL OR TRUST

In the case of an institution or facility as the caregiver, you will need to determine the fees for that facility so that you can provide sufficient funds during your pet’s lifetime.

You should specifically name any current pets in your will or trust and also designate any future pets to be covered under this estate plan.

Pompano Beach’s arts scene explodes

There is a new vibrancy in Pompano Beach these days. Arts and culture venues are buzzing with activities from concerts to exhibitions, classes to artist meet-n-greets.  Residents and visitors alike are lining up for new experiences, while artists and performers are making their way to Pompano Beach, the next creative haven.

Pompano Beach’s leadership have embraced the artistic spirit by redeveloping and/or building new venues throughout the city. The establishment of new cultural hubs and the reimagining of others have led to an exciting synergy that hums throughout the city.

Music fills the starry skies over The Pompano Beach Amphitheatre, which has been branded The Amp, by Creative City Collaborative (CCC), which was engaged by the City to program and manage the 3,000 seat outdoor venue. Revived after having been dormant for nearly seven years, the entertainment center is now booked with a wide variety of concerts. On any given month, concert goers enjoy a diverse array of performers from the King of Romance, Engelbert Humperdinck to heavy metal favorites Queensryche.

The concept of providing concerts for everyone has proven

extremely popular, and now the CCC is opening a box office/business office space in the busy Pompano Citi Centre.  However, this space will not be your ordinary ticket stop. That just wouldn’t be fitting for a company that has creative in its moniker. Instead, it will be a carefully curated space featuring art work from local, regional and nationally respected artists.

Byron Swart who is the artistic director/curator for the CCC, which manages venues in both Palm Beach and Broward Counties, will be curating these exhibits and will be conducting ArtPop shows in some of the available storefronts at the plaza.

“These pop up galleries will introduce major artists to Pompano Beach as we craft the programming for the upcoming cultural arts center in the city, which is currently under construction,” said Swart.

“The cultural center will become an icon that amplifies the vibrancy of the region’s creative community and enriches the lives of those who reside, work and visit here,” explained Alyona Ushe, President and CEO of the CCC. “The only venue in the area devoted to showcasing the best of South Florida, the Centser will be a collaborative, cross -disciplinary arts venue founded

on the belief that art is directly connected to the individuals who produce it, the communities that arise because of it, and to everyday life.”

The cultural center, which is anticipated to open in late 2016, will expose audiences to visual arts, dance, theatre, and musical performances by accomplished and emerging innovators who are pushing the boundaries of art-marking and redefining the cultural landscape.

For Swart, who is highly respected in the South Florida art scene, the plethora of talent that he views on a daily basis is truly inspiring.

“There are so many artists that truly captivate me,” he said. “And I look forward to coordinating exhibits to showcase their brilliance.”

Currently Swart is enamored with the Latin American Art Pavilion, which engages some of Cuba’s hottest contemporary emerging artists as well as those from Latin America and the Caribbean. Some of these artists will be showcasing soon in Pompano Beach including Vicente Diez, Lemay Oliva Cabo, Aimee Perez and Luis Valles to name a few.  

The Latin American Art Pavilion (LAAP) offers ongoing professional support to mid-career Latin American artists, orienting them with regard to the right steps to create a potential niche for sales to selected groups of collectors, and to insert themselves into the global art market.  The LAAP was founded by María Nápoles, a Miami entrepreneur who has devoted herself to the arts.

“In December I curated the exhibit at Art Basel

that LAAP showcased at the Red Dot Fair,” explained Swart. “The artists are stylish emotive forces that I am thrilled to introduce to new audiences here during the coming months.”

Luis Berros sold out at the recent Art Basel event and Swart understands his appeal. “He knows firsthand the power of art without limits. Today he has become engrossed by the under lying narrative of his work, which is to accelerate fine art and street art along the same plane and document the collision.”

Eduardo Mendieta has always been interested in graffiti and the fine arts. “Mendieta’s artwork has evolved from mere canvas and paper to epic murals for the Super Bowl, and in West Palm Beach and Miami.  I have some interesting ideas to harness his talent for Pompano Beach!”

Another pick of Swart’s is Luis Valle. “Luis believes that spirituality has been lost in the mix of commercialism and fashion in art,” he said. “So he strives to bring the essence of the soul to his artwork. He believes humans are inherently spiritual beings who are here to realize the same goal. Which is the self-realization of his or herself.”

“Luis is also very active in working with students and schools,” continues Swart. “This essential educational element is something I will be incorporating into all the venues.”

 For Swart and Ushe, Pompano Beach’s artistic future is dazzling. “It’s an exhilarating time in Pompano Beach and we are thrilled to play a part in the cultural renaissance of the community,” said Ushe.

that arts was integral to the reinvention of Pompano Beach. The Community Redevelopment Agency (CRA) which was tasked with redeveloping the city, spearheaded the initiative to preserve two historic but dilapidated buildings in the central part of town.  The former eye-sores are now two of the most stylish buildings in the community that offer an array of artistic opportunities.

BACABailey Contemporary Arts was a former hotel that now houses monthly exhibits, artist meet-

n-greets, paint-n-sip classes and other events. It also features artist studios where local artists create, share and explore their craft, providing a home base and form of community inspiration.

 Sarah Miller Benichou, the venue’s director, spent many years in Paris and then became the Education Programmer for Art After Dark at the Norton Museum, a weekly event that brought 17,000 people to the museum.  Each month she selects exhibits to engage the nascent art lover and aficionado alike.

is opening a door and we want people to feel the messages of what we are showing them, but also challenge perceptions of process and expression. And since we are incubating artists in our loft, it is important to honor the different maturation stages of an artist and allow artists a space to feel comfortable to reveal themselves. Many artists who show here are doing so for the first time, so it’s important that the exhibition itself be part of the learning experience.”

January’s show at Bailey is called Chance: REDUX and it is all about the art of chance.  The exhibit will feature The Crit Club, a group of seven diverse professional artists, located in and around FATVillage in Ft. Lauderdale. Leah Brown, Christian Feneck, Virginia Fifield, Bonney Goldstein, Henning Haupt, Donna Haynes, and Peter Symons initially united to provide each other with ongoing no-holds-barred criticism. Although they wished to collaborate on an exhibition, they found that discovering a conceptual binding to fix the show was proving difficult. Therefore as their first curator charged with organizing their maiden show (and

now this traveling exhibit), Meg Kaplan-Noach’s role was to probe, ponder, and propose a justifying logic to fuse their artworks together.

   The artworks have been organized in the Bailey Contemporary Arts gallery through methods of chance. Drawing artworks one-by-one from seven brown paper bags– one for each artist’s three works–each grouping was thus arranged according to chance. Bailey’s gallery was also divided into

seven consecutive areas each with a corresponding number (also put into a separate brown bag). Then, one at a time, the seven artists’ names were picked out of a bag, each picked simultaneously with a corresponding gallery position. Thus, this group of work was situated in that spot. None of which were to be reconsidered for any reasons.

 It is hoped that the brown paper bag drawings for the Bailey’s exhibition will also uncover the elusive visual manifestations of chance. For it is in the unusual

choices and pairings where chance is most obviously revealed, and can be experienced. It is

the gallery’s hope that seeing these artworks under these conditions will permit the viewers, artists, and the curator to fully experience how chance makes meanings that may not have previously existed through the use of more conventional curatorial methods of judgment.

Ali Cultural Arts CenterThe other historic building that has been reimagined is the Ali Cultural Arts Center. The venue features local artists in their community gallery and showcases historic exhibitions that highlight the black history of the Northwest Community. The Ali also offers an array of classes including several styles of dance and features an outdoor stage that showcases concerts and events.

“We are focused on inspiring the community,” said Drew Tucker, The Ali’s Director. “December’s Brown Ballerina event brought in the film’s creators plus dancers and artists to celebrate the growing diversity of dance in the country.”

The Ali’s Sunday Gospel events attract the city’s vibrant worship community and have featured major names in the genre, including the Miami Mass Choir.

But Ali is not just about important cultural movements, sometimes it is just about having a good time! The January 12 Ghost-Note event is an all percussion, bass and electronics event that will be a fun, funky celebration of rhythm and soul.

The beats that fill the city’s venues and the colors that brighten the community are true examples of how art brings people together. Art creates conversation and awareness. And art can elevate an idea to reality.

Some ideas appear at first to be too-good-to-be-true or too complicated

to be successful. PACE (Property Assessed Clean

Energy) project funding could be described this way.

The PACE program allows property owners to finance 100 percent of

qualifying clean energy projects and can be cash-flow positive.

Consider that Scientific American magazine named PACE as one of the

top 20 “world-changing” ideas—truly important ideas sometimes take time

and effort to understand.

PACE started in 2008 and is now available in over 30 states. The City of Pompano Beach voted to support the program in 2015. “We see the financial as well as the convenient advantages of PACE for our residents and therefore wanted to make sure it was immediately available to our community,” said Pompano Beach Mayor, Lamar Fisher.

“PACE is one of those special programs that helps everyone and we were excited to approve it,” said city commissioner Rex Hardin.

This commercial and residential building capital improvement financing program (PACE) has been a boon for 58,000 property owners ( over 1,000 just in Florida) during the last few years.  Over $1.3 billion in building improvements have been financed using PACE.

PACE, which began in California, was approved unanimously by the Florida Legislature in 2010.  But, for it to be available for a building owner, both Pompano Beach and its taxing authority, Broward County, needed to sign up.  Roughly 75 percent of Florida cities are still setting up their PACE programs.  The

City of Pompano Beach and the Broward County property appraiser were proactive and approved PACE earlier in 2015.  

PACE is not for new marble floors or luxurious swimming pools. Essentially, municipal, state and federal government entities are helping spur investment in long-term improvements that reduce energy consumption, water consumption or harden buildings and homes against hurricane damage. These types of improvements are often expensive and difficult to justify financially.

What exactly is PACE?PACE is a financing mechanism that works like a traditional loan but the repayment is through a special tax assessment on the property. If the property is sold, the annual tax assessment is then paid by the new owner. To simplify, the loan becomes a tax on the property for a specified number of years.

That is the basic description of the program. The reasons why the concept is so powerful are more complex; but, the benefits are clear:• Business and home owners can install

improvements sooner and on a larger scale if needed.

• Business and home owners can install now with an accepted method for future owners to pay for their part of the improvements.

• Cities can encourage these improvements to spur economic activity, reduce carbon output and reduce energy usage, clean water and storm damage costs.

PACE financing provides the commercial lender with better security than with a traditional loan. Instead of the traditional process of the lender lending you money to pay the contractor; the lender’s money passes through the tax collector’s office before going to the contractor.  The tax collector places a special assessment on the building.  By this happening (the note has become a tax), the lender is in a much better position than if the property owner were to give a corporate or

Modification of the loanGiven that the note has become a tax and the lender has improved security, the following can happen:

• 100 PERCENT FINANCING Instead of having to pay a 20-30 percent down payment, owners can now finance 100 percent of their projects if they desire.

• NO CORPORATE OR PERSONAL GUARANTEE Now that the lender is securatized by the tax collector, there is no need for a corporate or personal guarantee.

• TERM LENGTH CAN BE EXTENDED Instead of a typical three to five year loan, the term can match the life of the improvement (i.e. 20 years for a roof ).  By extending the term, the annual cost is reduced (i.e. $100,000 over five years is

• REPAYMENT OBLIGATION CAN TRANSFER WITH SALE On a traditional loan, the owner is responsible for paying the loan, even if they sell the building.  With PACE financing, the tax is attached to the building and goes with the building if it is sold.  The current property owner only pays for the portion they used during their ownership. 

In other words, owners are able to improve their properties with no money down; no corporate or personal guarantee; have the improvements pay for themselves through energy cost savings; then pass the remaining obligation to the next owner when the property is sold.  In effect, turning a capital improvement project from a cash “outflow” into a cash “inflow” while dramatically improving the value of the property and the return on investment.

immediately and spread the cost over time. When the property is sold, the PACE loan may transfer to the next owner who is responsible for repaying the loan. The ability to transfer the loan to the new owner allows for both the payment and the value of the retrofit to be transferred from one owner to the next.”

“We are a non-profit, have limited cash, and also have limited borrowing capability.  We looked into the PACE funding help us with impact windows and energy savings improvements.  The goal is to finance these improvements over a long period; thus saving our cash,” said Jacqueline Reed, CEO of Oasis of Hope CDC, a community development program in Pompano Beach that provides apartment building housing for low to moderate income families and individuals.

According to David Goodman, Managing Director of PACE Corporate Advisors, “PACE is a game-changer for all building owners.  To be able to improve your building without draining your cash reserves is huge.  Regardless if you are a condo owner, a single-family home owner, small commercial building owner/occupier, or a large real estate portfolio manager, the impact on your return-on-investment is dramatic when you can add value to your building without investing your cash.  Each of the additional benefits of the program—such as no personal credit review, no personal or corporate guarantee, no impact on debt equity ratios, positive tax impact, positive balance sheet impact, long payment term to lower the annual payment burden, transfer of payments to buyer at sale…and use of energy savings, tax savings and energy credits, to pay for the improvements—is, on its own, justification to use the service.  But, when you add them all together, there is nothing else even close to being as beneficial.”

Who is eligible for PACE?Any building liable for non ad valorem taxes.  This includes all commercial buildings, single family homes, condos, apartment complexes, churches, hospitals, et cetera.

What is the underwriting criteria?Given that the note (tax) is tied to the building, the application process is far easier than a traditional loan.  It typically takes 24 – 72 hours, as there is no credit component.  The building must be current on its property taxes and mortgage payments for three years and the owner not be in bankruptcy for seven years.  The building’s debt cannot exceed its “just value,” and the cost of the improvements cannot exceed the lesser of 20 percent of just value or the equity the owner has in the building.  The owner’s personal credit score has no impact on funding eligibility.  Also, a donation-based organization (i.e. church, charity, non-profit) with a weak balance sheet and limited cash can qualify if it meets the above requirements, as the cash, credit and balance sheet are not part of the review process.

DefaultFinancial hardships happen. PACE loans are more secure to the lenders because the “tax man gets his money first” as the saying goes. Since the PACE loan converts to a tax, the tax assessor must be paid first in any bankruptcy or liquidation proceedings.

are additional community benefits: PACE spurs economic activity and drives job growth. The acceleration of previously delayed capital improvement projects on local buildings increases the tax base and the overall beauty of the city. 

Additionally, solar energy, which has long been difficult to finance, is easy to finance with PACE.  Solar is a renewable resource that doesn’t add to global warming. 

Florida’s PACE funding also includes building hardening to protect against hurricanes. Stronger buildings and homes reduce insurance losses which can reduce insurance costs for everyone.

The future is brightThere is nothing magical about PACE funding. Taking out a loan to improve any building is still a loan that must be repaid and the resources must be there for that to make sense. 

Some PACE projects may be easy to justify such as a new roof: it must be done and it would likely be financed over several years and the expense makes sense for any new owner of the structure to pay their share of that improvement.

A complete retrofit of all lights in a large building, may also make financial sense as the savings on electricity will pay for the upgrade in just a few years and give the owner positive cash-flow on the loan for years to come.

Others projects will certainly need the help of tax advisors, PACE funding consultants and competent contractors to ensure financial and technical viability.

Lighting retrofits are one of the most popular PACE funding projects. LED lights are far superior to conventional ones with savings of up to 80 percent on energy costs and 15 to 25 year life spans. Businesses with hundreds or thousands of bulbs can achieve quick return on their investments in new lighting with 100 percent funding for the retrofit.
