TheParties
ThepartiesconcernedwithaLetterofCreditaredescribedbelow:
Applicant:ThepartythatorganizesfortheLetterofCredittobeissued,usuallythebuyer(importer)inacommercialtransactionortheborrowerinafinancialtransaction.
Beneficiary:ThepartynamedintheLetterofCreditinwhosefavortheLetterofCreditisissued,itisgenerallytheseller(exporter)inacommercialtransactionorthecreditorinafinancialtransaction.
IssuingBank:TheApplicantsbankthatissuesitsundertakingtotheBeneficiaryintheformofaLetterofCredit.
AdvisingBank:Thebank,usuallyintheBeneficiaryscountry,whichinformstheBeneficiarythatanotherbankhasissuedaLetterofCreditintheirfavor.
LetterofCreditTermsandConditions
Thefollowingtermsandconditionsarebasictomostlettersofcredit:
DraftLettersofCreditusuallynecessitatethattheBeneficiarydrawadraftontheIssuingBank.Theperiodoftimefromthedateonwhicheitherthecomplyingdocumentsarepresentedorthedraftisdrawn,tothedateonwhichpaymentispayableisthetenorofthedraft.Ifthedraftispayableuponpresentation,thedraftwillbedrawnpayableatsight.

UnlesstheLetterofCreditotherwisestates,theUCPrequiresthatmarinebillsofladingshowthatthegoodsareonboard.ThismeansthattheBeneficiarymusteitherprovideanonboardbillofladingorhavethecarriersonboardnotationputonthebilloflading.
LatestDateforPresentationUnlessthecreditstipulatesotherwise,theUCPrequiresthatdocumentsbepresentedwithin21daysofthedateofshipmentoratanothersuchperiodstatedintheLetterofCredit.ForMarineBillsofLading,theonboarddateisseenastheshipmentdate.
CommercialLettersofCreditareoftenissuedwithalatestshippingdatethatismorethan21dayspriortotheLetterofCreditexpirationdate.ThisisduetothefactthatthemostcommonamendmenttoacommercialLetterofCreditistoextendtheshippingdate.Theadditionalperiodpermitstheshippingdatetobeadjustedwithouttheexpirationdatebeingextended.Theadditionaltimeisnotacureperiodfordocumentsunderdiscrepancy.
