Contract Details: Section 3 Goals
Overview:
Certain tasks in this project may be subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 1701), which requires to the greatest extent feasible:
Opportunities for training and employment be given to low- and very low-income individuals of the metropolitan area (Section 3 residents); and
Contracts for work in connection with the task be awarded to Section 3 businesses.
Section 3 goals:
30% of new hires will be Section 3 individuals
10% of the dollar value of construction contracts will be awarded to Section 3 businesses
3% of the dollar amount of non-construction contracts will be awarded to Section 3 businesses

Contract Details: Section 3 Qualifications
Section 3 Residents: Are public housing residents; or Reside in the five boroughs, and Have an individual or household income that does not exceed the local
income criteria of low- or very low-income (<80% of the average median income).
Section 3 Business Concerns:
Are 51% or more owned by low- and very low-income residents; or Employ full-time persons, at least 30% of whom are low- and very low-
income residents, or, within three years of the date of first employment with the firm become Section 3 residents; or
Provide evidence of commitment to sub-contract in excess of 25% of the dollar award of all sub-contracts to Section 3 business concerns.

Contract Details: Section 3 Contractor Requirements
Contractor Requirements: Contractors for Section 3 covered tasks must make every effort to meet Section 3 requirements.
Recommendations include:
• Targeted recruiting of Section 3 residents through local media, signage and outreach to community organizations
• Participation in a program which promotes contracting with Section 3 businesses and/or training or employment of Section 3 residents
Reporting: Contractors are required to report on their Section 3 efforts.
Criteria include:
• Within 60 days of the task order execution, submit a workforce needs plan and discuss strategy with NYC Department of Small Business Services
• Report on all new hires, and document new hires that are Section 3 residents and trainees that are Section 3 residents
• Report on total contracts awarded and total awarded to Section 3 businesses
• Document actions taken to comply with Section 3

M/WBE Participation Goal: 15-35% (as percentage of total contract value)
Firms must be certified as M/WBE by either City or State in order to count toward goal
Respondents must also submit a Narrative demonstrating how they will meet the M/WBE
Participation Goal. The Narrative should:
– Speak in detail to respondent’s commitment to ensuring proposed level of M/WBE participation
– Outline specific strategies to drive participation and methods for ensuring accountability
– Include any other info that demonstrates the likelihood that the proposed M/WBE Participation Goal will
be met or exceeded
List of State- or City-certified M/WBEs respondent plans to work with and a description of the
activities that would be subcontracted out to these firms
Narrative will be rated and factor into selection
– 15% of selection criteria corresponds to the quality of the M/WBE Narrative Form
Final M/WBE Goals will be incorporated into the Consultant Contract
– Selected Respondents will be required to meet the stated M/WBE goals or demonstrate good faith
efforts

– Refer to good faith efforts section in draft contract for more ideas
Make use of the Kick-Start Loan Program – Mobilization loans for M/W/DBE firms participating as either prime or subcontractor
– Amounts up to $250,000
– May be used to buy long lead equipment, material, and/or labor costs
