History of the Program

• Implementation– 1979 statewide ballot issue “bottle bill” was defeated– Amended Substitute Bill 361 was passed in 1980 and signed by the

governor.– The Office of Litter Control was created within the Ohio Department of

Natural Resources under provisions of the Ohio Litter Control Law.– Office responsible to establish and implement programs that focused on:

• Litter containment and collection• Law enforcement• Litter prevention education• Recycling

– Funded by a two-tier addition to Ohio Corporate Franchise Tax• Replaced by a CAT (Commercial Activity Tax) in 2013

• Fifty percent (50%) cash match must be available and expended on those allowable costs directly associated with the approved project

• Eligibility: Private sector businesses and non-profit organizations who are located and registered to conduct business in Ohio. Businesses and non-profit organizations applying for funds must secure a public sponsor to serve as the grant applicant, which includes an agency of the state, as established by the Ohio Revised Code (i.e. municipality, county, township, village, state college or university and solid waste management district or authority)

• On hundred percent (100%) cash match

• Maximum grant period of 24 months

• The Market Development Grant program operates on a reimbursement basis for the businesses and non-profit organizations

Additional Resources & Funding Opportunities

• The Ohio Air Quality Development Authority (OAQDA) – is a non-regulatory agency created in 1970 – OAQDA qualifies projects for tax exemptions if the projects

contribute to better air quality. – OAQDA helps businesses qualify machinery and equipment

improvements projects for tax exemption. – The project does not have to be in response to a regulatory

mandate.

• OAQDA Financing– Grants

• Offers grants equal to 30% of equipment costs• Grants capped at $30,000• Once funded, grants are awarded to help cover

– Closing costs– Principle payments on equipment six (6) months after installation & operation

• Financing packages structured to fit needs of individual projects– Bonds

• Incentivized through conduit bonds issued by OAQDA– These bonds may be federally tax-exempt– Bonds are exempt from Ohio income, real property, sales, and use taxes for the

term of the financing

OAQDA Tax IncentivesOAQDA can provide 100% exemption for taxes:

• Real property tax– Any real property comprising an air quality project– Exempt from real estate and property taxes and assessments – Valid as long as bond or not issued by OAQDA is outstanding

• Sales and Use tax– All tangible personal property compromising an air quality project– Exempt from State and Local taxes – Exempt from tax levied on the transfer or sale of tangible personal property– State sales tax rate 5.0%– Sales tax rates vary by county – Counties authorized to levy additional, permissive sale taxes

• Interest Income on bonds and notes issued by OAQDA– Any income generated from the ownership of bonds and notesissued by the OAQDA, the transfer of bonds and notes, and anyprofit derived from the sale of bonds and notes is exempt from Ohio’s state income tax, and in some cases, federal income tax.

• Eligible Borrows are local government agencies and solid waste districts which:– Own or control an eligible Ohio solid waste facility– Authorized to incur debt and enter into legal contracts– Financially sound and have the ability to repay the loan– Currently in environmental compliance– Solid Waste Management Plan approved by Ohio EPA– Current on all taxes, loan payments, or other

indebtedness to the State of Ohio or any political subdivision

OWDA website.• Planning and Design Loan application requirements

– Pass legislation authorizing signing of the Cooperative Agreement– Complete any necessary assessment, tap-in and/or rate legislation– Prepare a projection schedule that shows user revenues, debt service obligations, and operation

and maintenance costs over the contract term of the years of loan repayment to OWDA– Copy of engineering agreement

• Construction Loan application requirements– Receive bids and tentatively approve contract awards– Certified Engineer's Estimate for project costs if application is being submitted prior to bid date.

Bid tabs are required to be submitted prior to project approval.– Detailed estimate for Equipment and Force Account if applicable– Plan approval by OEPA and obtained Permit to Install– Pass legislation authorizing signing of the Cooperative Agreement– Complete any necessary assessment, tap-in and/or rate legislation– Prepare a projection schedule that shows user revenues, debt service obligations, and operation
