INFORMATION FOR BIDDERS

BIDS will be received by THE MAYOR AND CITY COUNCIL OF OCEAN

CITY, MARYLAND (herein called the TOWN), at the office of the City Manager, 301North Baltimore Avenue,, Ocean City, Maryland during normal business hours until11:00 a.m., Tuesday, May 15, 2012, and then opened and read aloud at the CouncilWork Session.

Each BID must be submitted in a sealed envelope, addressed to Mr. Richard W.Meehan, City Manager. Each sealed envelope containing a BID must be plainly markedon the outside as BID for: Golf Car Lease and the envelope should bear on the outsidethe name of the BIDDER, his address, and the name of the project for which the BID issubmitted. If forwarded by mail, the sealed envelope containing the BID must beenclosed in another envelope addressed to 301 North Baltimore Aveune, Ocean City,

Maryland 21842.

All BIDS must be made on the required BID form. All blank spaces for BIDprices must be completed in ink or typewritten, and the BID form must be fullycompleted and executed when submitted. Only one copy of the BID form is required.

The TOWN may waive any informalities or minor defects or reject any and allBIDS. Any BID may be withdrawn prior to the above scheduled time for the opening ofBIDS or authorized postponement thereof. Any BID received after the time and datespecified shall not be considered. No BIDDER may withdraw a BID within 60 days afterthe actual date of the opening thereof. Should there be reasons why the contract cannotbe awarded within the specified period, the time may be extended by the TOWN.

After BIDS have been submitted, the BIDDER shall not assert that there was amisunderstanding concerning the quantities or the nature of the SCOPE OF WORK to beperformed.

The TOWN shall provide to BIDDERS prior to BIDDING, all information that ispertinent to, and delineates and describes the scope of the BID.

The CONTRACT DOCUMENTS contain the provisions required for thecompletion of the work. Information obtained from an officer, agent, or employee of theTOWN or any other person shall not affect the risks or obligations assumed by theCONTRACTOR or relieve him from fulfilling any of the conditions of the contract.

The NOTICE TO PROCEED shall be issued within ten (10) days of the executionof the Agreement by the TOWN. Should there be reasons why the notice to proceedcannot be issued within such period, the time may be extended by mutual agreementbetween the TOWN and CONTRACTOR. If the NOTICE TO PROCEED has not beenissued within the ten (10) day period or within the period mutually agreed upon, the

CONTRACTOR may terminate the Agreement without further liability on the part ofeither party.

The TOWN may make such investigations as it deems necessary to determine theability of the BIDDER to perform the WORK and the BIDDER shall furnish to the

TOWN all such information and date for this purpose as the TOWN may request.

The TOWN reserves the right to reject any BID if the evidence submitted by, orinvestigation of, such BIDDER fails to satisfy the TOWN that such BIDDER is properlyqualified to carry out the obligations of the Agreement and to complete the WORKcontemplated therein.

A conditional or qualified BID will not be accepted.

All applicable laws, ordinances, and the rules and regulations of all authoritieshaving jurisdiction over the service shall apply to the contract throughout.

Each BIDDER is responsible for reading and being thoroughly familiar with the scope ofthe work requested. The failure or omission of any BIDDER to do any of the foregoingshall in no way relieve any BIDDER from any obligation in respect to his BID.

REQUEST FOR PROPOSALGOLF CAR FLEET

For Eagles Landing Golf CourseScope of Service & Specifications

1. IntentThe Town of Ocean City, Department of Recreation and Parks is requestingproposals from manufacturers, and/or distributors of electric powered golfcars.

2. Scope of WorkThe successful vendor will supply a leased fleet of 80 electric powered golf

cars.

3. Specifications and ProvisionsThe following specifications and provisions shall apply to the golf car fleet.

3.01 There shall be 80 electric powered golf cars provided for a leaseperiod of 48 months.

3.02 The lease shall commence on August 15, 2012 and run throughAugust 14, 2016.

3.03 The car battery shall be a minimum of 48 volts.3.04 The cars shall have a battery fill system.3.05 The cars shall have a canopy top.3.06 The cars shall have a split windshield.3.07 The cars shall be equipped with a message holder, rear rain cover,

sweater basket and two (2) sand/seed bottles.3.08 The cars shall include pin stripping, number decals and the club logo

and name.3.09 The cars shall have hub caps or wheel covers.3.10 The color of the cars shall be hunter green or dark green. The vendor

shall provide a color chart.3.11 The proposal price shall include the delivery cost and installation of

all accessories.3.12 The entire fleet shall be delivered and operational by August 4, 2012.3.13 The bidder shall supply a copy of the warranty included with the

proposal.

3.14 The existing Eagles Landing GPS units shall be installed on the golfcars by the selected vendors. Manufacturers warranties shall not bevoided or adjusted by properly installed GPS units.

4. Qualifications

4.01 Vendors may provide a statement with the submission of theirproposal indicating their ability and expertise in designing andmanufacturing electric golf cars. Vendors may also provide a catalogdepicting the golf car and its specifications.

5. Terms and Conditions

5.01 The Town reserves the right to request clarification of information

submitted and to request additional information from one or morevendors.

5.02 The vendor shall submit all supporting documentation and productliterature at the time of submission of the proposal.

5.30 Vendor agrees to ship product so that the Town receives all the carsby August 14, 2012.

6. Evaluation

6.01 The Director of Recreation and Parks and the Head Golf Professionalshall evaluate all proposals and recommend the vendor to be selectedby the Mayor and Council.

6.02 In awarding the contract, the Mayor and Council may take intoconsideration the quality, value, durability, aesthetics, style, size ofvehicle, materials, appropriateness and the compatibility of theequipment for the site; the experience, ability, responsibility,reputation, previous work and financial standing of the vendor; theperiod of time within which equipment is delivered; and the necessity

of prompt delivery of items described herein. The inability of anyvendor to meet the requirements mentioned above may be cause forrejection of this proposal.

Larry Noccolino

Larry Noccolino, 58, was born in Washington, D.C. and raised in District Heights, MD.He attended Mt. Calvary Grade School and Bishop McNamara High School. He later

attended Prince Georges C.C. and American University, majoring in Political Science andCriminal Justice. Larry worked for the Marlborough Country Club from 1980-1990; ClubOperations and Property Management in 1990-1993; and most recently, he worked for

the Valley Forge Convention Center as their General Manager from 1993 until May 1 st of

this year.

Larry has been a long term, part-time resident in Ocean City, now residing in NorthOcean City, adjacent to North Side Park. He is married to Patricia and has three children,

Anthony, Erica and Alexis. He also has two grandchildren, Zoe and Dominic.

Your Honor and Ocean City Council members,

According to the people working at City Hall, they are telling all of our Blaire Isle Condominium owners that rent their unitthat the Mayor and City Council passed an ordinance that all Rental Stickers MUST be placed on the front door of therental unit or face a fine if not AFFI XED TO the DOOR.

We take pride in the appearance of our building and do not want anything stuck on the front of our fiberglass doors, thesticker not only takes away from the appearance of our building, it also interferes when the doors need painting. Wehave always required our owners to place the sticker on the kitchen window glass panel which is three feet one inch fromeither the left or the right side of the entrance door. The Association paints all doors at the same time and by placing thesticker on the glass window and not on the fiberglass door, the sticker is always visible and it would not interfere with ourpaint schedule.

If in fact, you have an ordinance that says it must be on the door, we request that the ordinance be modified to read thatthe sticker must be visible from the entrance door or be within so many feet of the entrance door. If the ordinance is not

modified, we request an exception be issued to allow us to place the sticker on the glass window next to the door.Attached is a picture of proximity of sticker and entrance door at Blaire Isle

MEMORANDUM

TO: Richard Meehan, Interim City Manager

FROM: Joseph J. Theobald, Emergency Services Director

SUBJECT: Fee proposal for disclosure of telephone and radio records

DATE: May 7, 2012

During our FY2013 budget presentation before the Mayor & Council, I informed you thatone of the goals this year for the Communications Division is to develop a policy regarding

the disclosure of telephone and radio records when requested under the Maryland PublicInformation Act, and an appropriate fee schedule for the production of such records.Pursuant to Maryland law, the records maintained by a Public Safety CommunicationsCenter are public records and subject to disclosure in certain instances; therefore, it isnecessary for the Emergency Services Department to establish policies and procedures forthe disclosure of telephone and radio records. I am proposing the following policy toaddress this matter:

1. General public requests for telephone and/or radio records shall be in accordancewith the Maryland Public Information Act (MPIA) and must be submitted in writing

to the Director of the Ocean City Department of Emergency Services. The request

must specify the date, address, approximate time and any other pertinent

information regarding the incident for which information is requested. A minimum

of ten (10) days processing will be allowed for research of the records, and

notification to the requester that the Department is the custodian of the requested

records. A maximum of thirty (30) days processing will be allowed for reproduction

of the records or to provide reasons, under the MPIA, that the request is denied.

2. A service fee of forty dollars ($40.00) will be charged for each incident, for theproduction of any records, including taped records, leaving the custody of the

department. Payment must accompany the initial request and will be requiredbefore any research and or production of records leaving the custody of the

department.

3. An affidavit (Certification Document) will accompany the records/tape indicatingthat the record/tape is a true and correct copy; that the record/tape was made in the

regular course of business; that the record/tape was made simultaneously with

receipt of the call; and that it is the practice of the Public Safety Communications

Center to make such recordings and documents.

4. Emergency Medical Services calls, documents or tapes containing medicalinformation WILL NOT be released without a written court order (a subpoena will

not be considered a court order) or a written and signed authorization from the

injured party.

5. Police assistance calls, documents or tapes may not be disclosed to any individualsother than the investigating law enforcement agency and/or the appropriate States

Attorney, pending review to determine whether or not disclosure would be

inappropriate.

6. The release of tapes and/or information to the media will follow all the policies setforth in paragraphs 1 through 3 above. Once these requirements have been met, the

following will occur:

o The request will be reviewed by the City Solicitor.o The City Solicitor will confer with the appropriate States Attorney or

investigating officer to determine if any release will interfere with any on-

going investigation.

o The City Solicitor will advise the Emergency Services Director as to thedisposition of the record/tape disclosure.

7. No one will be permitted to enter the Public Safety Communications Center toobtain a record.

8. These rules may be waived or adjusted by the Emergency Services Director for goodcause shown.

9. Requests from Ocean City Police Department or Ocean City Fire Departmentpersonnel shall be processed according to internal policy and procedures.

It is requested that this matter be placed on the agenda for an upcoming Work Session
