INFORMATION FOR BIDDERS

BIDS will be received by THE MAYOR AND CITY COUNCIL OF OCEAN CITY,

MARYLAND (herein called the TOWN), at the office of the City Manager, City Hall, 3rdStreet & Baltimore Avenue, Ocean City, Maryland during normal business hours until 11:00

a.m., Tuesday, April 10, 2012 and then opened and read aloud at the Work Session that day.

Each BID must be submitted in a sealed envelope, addressed to the Mayor and City Council of

the Town of Ocean City, Maryland. Each sealed envelope containing a BID must be plainly

marked on the outside as BID for: AIRPORT TERMINAL BUILDING - IMPROVEMENTS

and the envelope should bear on the outside the name of the BIDDER, his address, and the nameof the project for which the BID is submitted. If forwarded by mail, the sealed envelope

containing the BID must be enclosed in another envelope addressed to the Town of Ocean City,

City Managers Office, 301 Baltimore Avenue, P. O. Box 158, Ocean City, Maryland 21843.

PLEASE USE THE YELLOW BID TOTAL SHEET PROVIDED IN THE BID

PACKAGE.

All BIDS must be made on the required BID form. All blank spaces for BID prices must befilled in, in ink or typewritten, and the BID form must be fully completed and executed when

submitted. Only one copy of the BID form is required.

A Pre-Bid meeting will be held at the Airport Terminal Building, located at 12724 Airport

Road, Berlin, Maryland 21811, on March 30, 2012 at 10:00 A.M. All bidders are encouraged to

attend.

The TOWN may waive any informalities or minor defects or reject any and all BIDS. Any

BID may be withdrawn prior to the above scheduled time for the opening of BIDS or authorized

postponement thereof. Any BID received after the time and date specified shall not be

considered. No BIDDER may withdraw a BID within 60 days after the actual date of the openingthereof. Should there be reasons why the contract cannot be awarded within the specified period;

the time may be extended by the TOWN.

After BIDS have been submitted, the BIDDER shall not assert that there was a

misunderstanding concerning the quantities or the nature of the SCOPE OF WORK to be

performed.

The TOWN shall provide to BIDDERS prior to BIDDING, all information which is pertinent

to, and delineates and describes the scope of the BID.

The CONTRACT DOCUMENTS contain the provisions required for the construction of the

PROJECT. Information obtained from an officer, agent, or employee of the TOWN or any otherperson shall not affect the risks or obligations assumed by the CONTRACTOR or relieve him

from fulfilling any of the conditions of the contract.

Each BID must be accompanied by a BID BOND payable to the TOWN for five (5) percent ofthe total amount of the BID or a CERTIFIED CHECK payable to the TOWN for five (5) percent

of the total amount of the BID. As soon as the BID prices have been compared, the TOWN will

return the BONDS of all except the three (3) lowest responsible BIDDERS. When the agreement

is executed the bonds of the two (2) remaining unsuccessful BIDDERS will be returned.

The party to whom the contract is awarded will be required to execute an Agreement

within ten (10) calendar days from the date when NOTICE OF AWARD is mailed to the

BIDDER. The NOTICE OF AWARD shall be accompanied by the necessary Agreement.

In case of Failure of the BIDDER to execute the Agreement, the Town may at its Optionconsider the BIDDER in default.

The TOWN within ten (10) days of receipt of an acceptable Agreement signed by the

party to whom the Agreement was awarded, shall sign the Agreement and return to such

party an executed duplicate of the Agreement. Should the TOWN not execute theAgreement within such period, the BIDDER may, by WRITTEN NOTICE, withdraw his

signed Agreement. Such notice of withdrawal shall be effective upon receipt of the

notice by the TOWN.

The NOTICE TO PROCEED shall be issued simultaneously with the execution of the

Agreement by the TOWN. Should there be reasons why the NOTICE TO PROCEED

cannot be issued at such time, the time may be extended by mutual agreement betweenthe TOWN and BIDDER. If the NOTICE TO PROCEED has not been issued within the

ten (10) day period or within the period mutually agreed upon, the BIDDER may

terminate the Agreement without further liability on the part of either party.

The TOWN may make such investigations as it deems necessary to determine the

ability of the BIDDER to perform the WORK, and BIDDER shall furnish to the TOWNall such information and data for this purpose as the TOWN may request. The TOWN

reserves the right to reject any BID if the evidence submitted by, or investigation of,such BIDDER fails to satisfy the TOWN that such BIDDER is properly qualified to carry

out the obligations of the Agreement and to complete the WORK contemplated therein.

A conditional or qualified BID will not be accepted.

Award will be made to the lowest responsible BIDDER.

All applicable laws, ordinances, and the rules and regulations of all authorities havingjurisdiction over construction of the PROJECT shall apply to the contract throughout.

The Successful BIDDER is required to have or purchase the required State of Maryland,

Worcester County, Town of Ocean City, and any other licenses required to perform thiswork.

General Appearance Standards; G.O. 800 A-1 Page 2 of 10

I. Purpose:

One of the qualities that define a professional organization is the exemplary appearanceof its employees. Achieving and maintaining the highest standard of professionalism is aprimary objective of the Department.

The entire Department is often judged by the appearance of a single employee;therefore, the dress and grooming of all employees must establish and maintain thecredibility and professional standards of the Department.

The purpose of this policy is to establish guidelines pertaining to the grooming andappearance of employees such that employees project a neat and professional imageconsistent with the expectations of the public and of the Department.

II. Definitions:

A. Body Mutilation: Intentional and deliberate altering of any part of the human

body for non-medical reasons by branding, filing, cutting, scarring, piercing, orstretching of the skin. This does not include the standard piercing of the earlobe.Examples: A split or forked tongue, foreign objects inserted under the skin tocreate a design or pattern, gauging, intentional scarring, abnormal filing of teeth.

B. Business Attire: Business attire is considered civilian clothing.

For male employees business attire consists of a business suit, or sport coat,collared, cuffed, and button down dress shirt with necktie, dress pants, belt,socks and dress shoes. Pants shall extend to the ankle.

For female employees business attire consists of a business suit, or dress

slacks or skirt, blouse, and a business jacket and closed-toe dress shoes. Skirtsshall extend downward from the waist to the at least two inches above theknee. Slacks shall extend to the ankle.

C. Civilian Clothing: Any garment or article of clothing that is not issued tothe employee by the Department, or is not authorized for wear as part of auniform.

D. Employee (s): For purposes of this policy, employees are persons whoperform services for or on behalf of the Department and whose duties andassignments are directly controlled by the Department.

E. Gauging: The intentional non-medical expansion of a hole or piercing in theskin anywhere on the body, commonly seen on the ears, face, nose, or tongue.

F. Non-Sworn Employee (s): Any employee that is not a police officer

G. Sworn Employee (s): Employees who are police officers vested with lawenforcement authority

H. Uniform: Issued Departmental Class A, B, C, D or E uniforms or otherauthorized, and recognized uniform items as described in Department policy orapproved by the Department.

I. Tattoo : The intentional marking of the skin of the human body by insertingpigment below or on the skin for the purpose of creating a pattern, design, form,

figure, or any other similar art, whether permanent or temporary.

III. Policy:

All on-duty employees will maintain a neat and well-groomed appearance and willcomply with departmental standards for the wearing ofuniforms, other clothing, andgrooming as regulated by approved Departmental policy and practice.

IV. General Appearance

The following guidelines apply to all employees while on-duty, while wearing any uniformof the Department or while representing the Department in an official capacity, unlessotherwise exempted or clarified by this policy.

The Chief of Police reserves the right to determine appropriate attire for Departmentemployees and these guidelines are not meant to be all inclusive. Final judgmentconcerning questions aboutcompliance rests with the Department. In the event anemployee is uncertain about policy compliance, other attire should be worn until specificpermission is obtained.

A. Employees are required to appear neat, clean, and well-groomed at all times,except when authorized by the Department to appear otherwise;

1. Shirts that are designed to be tucked into pants shall be neatly tucked

2. Clothing shall be kept clean and pressed

3. Approved footwear will be worn

4. Text, pictures, emblems, or other markings on t-shirts worn underneath ofouter garments shall not be visible through the outer garment

5. Appropriate undergarments shall be worn at all times, in the mannerintended by the manufacturer, and shall not be intentionally visiblethrough or outside of an employees clothing.

B. Unacceptable Attire

Employees shall consider the following list as guidance and examples ofunacceptable attire;

1. Shorts, Capri pants, sweat pants, leggings, jeans or pants styled likejeans, any cut-off or un-hemmed slacks or skirts, bib overalls

2. Sweatshirts, tank tops, t-shirts, halters, tube tops, midriffs, other half-shirts

3. Sandals, flip-flops, or other causal beach type shoe, athletic shoesexcept as authorized for specialized assignments

4. See through material, leisure wear, sleepwear.

C. Employees shall bathe regularly to prevent odors from the body.

D. Hair

1. General

a. The length and bulk of the hair shall not interfere with the properwearing of any authorized uniform headgear. Hair in front will begroomed so that it does not fallbelow the band of properly wornheadgear.

b. Hair sculpturing is prohibited.

Examples: Mohawk style haircut, words or designs cut orshaved into the hair, the use of hair gels, mousses,waxes, or similar products to sculpt or shape thehair into non-traditional styles

c. Hair coloring, if used, must appear natural.

d. Ponytails, braids and plaited hair are prohibited.

e. Hair nets are prohibited.

f. Wigs or hairpieces shall not be worn on duty except to covernatural baldness or disfiguration. If worn under thesecircumstances, the wig or hairpiece will conform to all Departmenthair regulations.

2. Male Employees

a. Male employees shall wear their hair in a tapered or squaredlook on the back of the head.

b. Ribbons or ornamentation in the hair are prohibited

c. When combed, male hair shall not extend over the top of theear, the top of the shirt collar, or the eyebrows.

d. Sideburns shall be neatly trimmed and shall not extend belowthe middle of the ear, shall be of even width, and shall endwith a clean shaven horizontal line.

e. Mustaches are permitted but shall be well trimmed and shallnot exceed the corners of the mouth or over the upper lip.

f. Beards, goatees and all other facial hair are prohibited.Employees with a medical skin condition (ex; pseudofolliculitisbarbae) may request an exemption from the Chief of Police. In

such cases where an exemption is granted, the employee shallmaintain the facial hair in a well-trimmed and tightly groomedmanner.

3. Female Employees

a. When wearing a Departmental uniform, female employees shallwear their hair so that it does not extend over the bottom edge ofthe shirt collar.

b. When wearing civilian clothing, female employees shall wear theirhair in a combed and neatly styled manner

c. Ribbons or ornaments worn in the hair are prohibited except asprovided in d below.

d. Inconspicuous hair pins or conservative clips or bands that areworn for the sole purpose of holding the hair in place arepermitted. These objects shall be similar in color to the naturalhair or will be solid black or navy blue in color.

E. Colognes / Perfumes

Colognes, perfumes, body sprays, body lotions or like products may be used

sparingly such that the odors emanated from those products do not disturb otherpersons.

F. Wearing of Firearms

Unless exigent circumstances exist, on-duty sworn employees wearing civilianclothing shall wear and carry authorized firearms so that the firearms are properlyholstered and are concealed from public view. When off-duty, sworn employeesshall wear and carry firearms consistent with General Order 200 B-2.

G. Body Ornamentation

The wearing or display of body ornamentation is a form of personal expressionthat may not portray the desired image of the Department. A significant part ofthe Departments mission is accomplished by maintaining a neutral look for allemployees that creates public confidence, does not detract from a professionalappearance, is not distracting, distasteful or offensive to others, and does notcreate a safety concern.

The purpose of this section is to promote the uniformity of employee appearancefor the purpose of identification of employees to the public, to maintain neutrality

and the perception of neutrality amongst members of the public, to preventdiscrimination or the perception of discrimination by members of the public, andto foster discipline and encourage public confidence in members of theDepartment.

1. Jewelry

a. When wearing a Departmental uniform, the only permissiblevisible jewelry shall be;

i. Approved medical ID bracelets

ii. No more than two rings, worn on the fingers. Any ringworn will be of a conservative design, shall be metal tonein color and of the type which is designed for, and fits ononly one finger. The combination of an engagement ringand wedding ring shall be considered one ring.

iii. One watch of conservative design worn on the wrist.Watches shall be black, brown and/or metal toned in color.

iv. The wearing of all other visible jewelry, including but notlimited to jewelry worn in or on the ears, tongue, face, orother parts of the body, is prohibited; except as describedin b below.

b. When wearing civilian clothing, female employees may wear nomore than two stud-type or small hoop earrings in the lobe ofeach ear. Any earrings worn shall be metal-tone in color/finish.

2. Fingernails

a. Employees shall keep fingernails clean and trimmed to a lengththat allows the proper discharge of duties without injury to oneselfor others.

b. Fingernail polish is acceptable, so long as it is clear, natural, orbeige in appearance. Other nail ornamentation is prohibited.

3. Dental Ornamentation

Teeth, whether natural, capped or veneer, shall not be ornamentedwith designs, jewels, initials, or any similar adornment. The use ofgold, platinum, silver or other veneers or caps on the teeth forpurposes of ornamentation is prohibited.

4. Tattoos

a. Visible tattoos are prohibited

b. Offensive tattoos are prohibited anywhere on the body. Examplesof offensive tattoos include, but are not limited to those that;

1. Are gang related, or are representative of criminalorganizations in any manner,

2. Depict nudity or are sexually suggestive or explicit,

3. Include profane or vulgar words or phrases,

4. Advocate racial, ethnic, religious or sexual hatred ordiscrimination of any protected class, or

5. In any way undermine the Towns or Department's values

and mission.

The Department shall be the final authority in determining if atattoo is considered offensive.

c. Employees hired prior to April 4, 2012 will not be required to coverdocumented visible tattoo(s) received prior to said date providedthe tattoo is not offensive as described in b above.

d. Visible tattoos received before April 4, 2012 will be documentedby the employee's supervisor.

e. If an employee makes any changes to a documented visibletattoo after April 4, 2012, the tattoo will no longer be exemptedand shall be covered by uniform items or tattoo cover up garments

f. Tattoos on the scalp, face, ears, and neck are prohibited.

g. After April 4, 2012, employees are prohibited from receivingtattoos on any part of the body where the tattoo would violate thisPolicy.

5. Body Mutilation

Visible body mutilation on any part of the body is prohibited.

6. Cosmetics

Cosmetics are permitted and shall be used sparingly and shall appearnatural.

7. Eyewear

Eyewear may be worn, on the face, as intended by the manufacturer thatmeets the following standard;

a. Eyewear frames shall be black brown or metal tone in color/ finish.b. Mirrored lenses are prohibited

c. Eyewear will not be attached to chains, bands, or ribbons

d. Sunglasses shall not be worn indoors.

8. Other

The wearing or display of any other visible body ornamentation notspecifically named, including bracelets, ribbons, wristbands, earrings, andnecklaces is prohibited.

9. Applicant Screening Requirement

a. The Training and Recruiting Section shall be responsible forscreening all applicants for employment for compliance withSection IV, G, subsections 3, 4, and 5 of this policy as part of theapplicant process.

b. Applicants for employment who are not in compliance with thispolicy shall be disqualified from employment consideration unlessthey are able to be in compliance.

V. Exemptions and Limitations

The following employees are exempt from the standards set forth in Section IV of thispolicy as follows;

A. Employees assigned to or detailed to non-uniform special assignments that, for alegitimate law enforcement purpose, require an inconspicuous appearance, tothe extent that the employee will be able to be in compliance with this policywhen no longer in a position requiring an inconspicuous appearance.

Grooming and appearance standards for those employees will be establishedand approved by the appropriate Division Commander in accordance with theneeds and circumstances of the special duties to be performed by the employee.This exemption prohibits the wearing or display of anything that;

1. Is gang related, or are representative of criminal organizations in anymanner unless required by the special assignment,

2. Depicts nudity or is sexually suggestive or explicit,

3. Includes profane or vulgar words or phrases,

4. Advocates racial, ethnic, religious or sexual hatred or discrimination ofany protected class,

5. In any way undermine the City's or Department's values and mission, or

6. Creates a safety concern for the employee exempted, or others.

B. Employees detailed to Departmental functions, training or other assignments bySpecial Order where the Special Order directs a specific uniform or attire.

C. Employees who, because of a unique or unusual job assignment, have obtainedwritten from the Department to be exempted from a specific section(s) of thepolicy

VI. Courtroom Appearances

A. When an employee is summoned to appear in court in an official capacitypursuant to official Departmental business, the following guidelines shall apply;

1. Non-Sworn employees shall wear business attire or the issued Class Euniform of the day

2. Sworn Employees shall wear business attire or the issued ClassA,Class B or Class C uniform of the day except as provided in 3 below

3. Sworn Employees summoned to appear in the DISTRICT COURT maywear Class D Bike Patrol, Mounted Patrol, K-9 Patrol or Police OfficerTrainee Uniforms for the DISTRICT COURT appearance only when;

a. The employees District Court appearance is scheduled duringnormal duty hours, or

b. When the employees District Court appearance is scheduledcontiguous with the start or end of the employees duty hours

Example : Employee was assigned to Midnight Watch bikepatrol that ended at 0730 hours and is scheduledfor District Court at 0900 hours

4. Hats shall not be worn in the courtroomB. When an employee is summoned to appear in any court as a private citizen or for

private, personal activities unrelated to the employees official public duties as aDepartment employee, the following guidelines and restrictions shall apply;

1. Employees are prohibited from wearing Ocean City Police Departmentuniforms while appearing in court or entering the courthouse.

2. Employees shall comply with all firearms regulations as dictated by thespecific court in which the employee appears or enters.

3. Employees are prohibited from wearing or carrying firearms whenappearing as a criminal defendant in any court proceeding arising fromany private or personal activities.

VII. Training Attendance

When an employee is assigned by the Department or by the Town of Ocean City toattend training, and the special order assigning the employee to the training does notspecify the attire, the following guidelines shall apply;

A. Employees shall wear the ClassB, C or E uniform of the day as describedin Department policy, or;

B. In lieu of the uniform of the day, employees may wear;

1. Business attire, or;

2. Class D Training/Utility Uniform, or;

3. Attire that complies with the dress policies of the training facility where theemployee is attending training.

THIS MEMORANDUM OF UNDERSTANDING is being entered into by and betweenthe Mayor and City Council of Ocean City (hereinafter referred to as the Town) and

Tourism Advisory Board (hereinafter referred to as TAB) and is effective _______,

upon execution by both parties. This Memorandum of Understanding shall hereinafter

be referred to as MOU.

Purpose:

The purpose of this MOU is to illustrate the responsibilities of both parties with regard to

the destination marketing funds advised by TAB

Responsibilities:

The Tourism Advisory Board shall:

Identify, review and recommend events, promotional items and opportunities to

increase tourism.

o Recommendations shall be for future and/or existing events and/or

promotions that bring significant visitation to Ocean City, extended stays,

or provide an enhanced, value-added experience for visitors.

Have clear policies and procedures for collecting/soliciting, reviewing andrecommending expenditures to the Town Council. This includes the requirement

for each applicant to include a detailed budget and project narrative.

o All applicants fill out an application for funding which is reviewed by TAB

(see attached)

Ensure that all expenditures are approved by the Mayor and City Council.

Provide economic impact figures of events that have been supported by the

Town.

Attend work sessions to keep the Town abreast of the progress of various

approved events and/or projects.

The Town of Ocean City shall:

Provide annual funding annually in the amount of $300,000 to invest in new or

existing events, and/or marketing opportunities, and/or promotions that generate

visitation, extended stays and value added experiences for existing visitors. This

would be a 2 year commitment- reviewed every 2 years.

Allow dollars not used in one fiscal year to be rolled over to the next fiscal year.

Process all payments, once approved, through City accounts followingpurchasing requirements.

Ensure that all purchase orders will be obtained by the City and payments issued

directly to the vendors.

Ensure that all payments be processed in a timely manner.

Include events on website, consider during any PR/media tours and on any

collateral materials where appropriate.

Subsequent to the bid opening, the Architects and I met with the apparent low bidder to reviewtheir scope of work and explore additional cost reductions. We have been able to reduce the cost to$702,184. A number of modifications were made to achieve these savings, most notable was a changein the floor finish from a wood laminate to a vinyl system and changing the stair and rail materialfrom mahogany to red oak. The full Art League Project Budget now stands as follows:

Geotechnical investigation printing costs: $7,000Building Construction Cost $702,184Site work materials and subcontractor costs $40,000Elevator materials ( expect added cost reduction) $39,000Contingency $11,816

In 2004, the Ocean City Volunteer Fire Company (OCVFC) commissioned a

comprehensiveStrategic

Long

Range

Plan

in

an

effort

to

outline

the

strengths

and

weaknesses of the Department, and recommended improvements that should be

madetoprovide fireandrescueservices totheTownofOceanCityandsurrounding

service area. Prepared byDesignAtlantic and Standing StoneConsultants Inc., the

study,presentedtotheMayorandCouncilin2005,helpedlaythegroundworkforthe

eventual combinationofOCVFC,Fire/EMSDivision,andFireMarshal into theOcean

CityFireDepartment(OVFD)inMayof2008.

Included in the studywerenumerousoperational recommendations,manyofwhich

weresupported

by

astand

alone

Station

Site

Location

Study.

The

three

main

concerns

highlightedregardingOCFDfacilitieswere:

1. The current Headquarters (15th

Street) location does not optimize response

capabilitiesandistoosmallwithinadequateparking.

2. Theneedforanincreasedpresenceinthehighlybuiltupnorthernendoftown.

Improving service in thisarea is vital to the coverage size,highrisebuildings,

elderlypopulation,andrecurringtrafficcongestion.

3. Rapid growth inWestOceanCity. OceanCity firepersonnel find themselves

pulledfromtheislandmorefrequently.

The OCFD has not lost sight of the recognized goals for facilities improvements

outlinedinthisstudy. Toaddressthethirditem,Station5at10124KeyserPointRoad

wasdedicated in2011,completewithadditionalapparatusbays, liveInquarters,and

supportfacilities,successfullyimprovingresponsetotheWestOceanCityarea.

Incontinuing

to

address

these

concerns,

the

OCFD

is

respectfully

requesting

to

continuewiththenecessaryimprovementstothestations,asfollows:

HeadquartersFacility(Station#1),1409PhiladelphiaAvenue Roof and faade are beyond the life expectancy for repair. Both need to be

replacedandbroughtuptocurrentstormresistivestandards. Thisbuildingisa

placeofrefugeduringstormsandneedstobeupdated.

Amodestexpansionneedstobeaddedtothefacilitytoaccommodatephysical

fitnessand

administrative

needs

of

the

Fire

Department.

Themodestexpansionwouldalsoincludeanextensionoftheambulancebayon

thenorthwestcornerofthebuildingtoaccommodatecurrentandfuture

growthofthemedicaltransportunits.

Theexpansionandcontinuedrenovationoftheheadquartersfacility
