2. Rules of the meeting Cllr Yvonne Woodhead and Eddie Moorcroft welcomed everyone to today’s meeting and details of people who could not come to the meeting were recorded under Item 1. Richard Taylor presented the Ground Rules. Eddie Moorcroft thanked Richard.

3. Notes from the last meeting (19th March 2015) Eddie Moorcroft asked people to look at the Minutes of the last meeting held on 19th March 2015 and said he would go through them page-by-page. Eddie Moorcroft asked people to speak up if he was going too quickly and if they had any questions or changes. Eddie went through the minutes and there were no changes made; they were agreed as a correct record.

4. What we said we would do Update from Bassetlaw on Liaison Nurse Eddie Moorcroft said that the Liaison Nurse, Michelle Neal, was returning to work on 1st June. Number of Hoists in Kings Mill Hospital Eddie Moorcroft said that Claire Henley has provided a list of hoists at Kings Mill Hospital and it can be found with people’s papers. Changing Place Toilet at Kings Mill Adrian Hartley confirmed that the new Changing Places toilet is now open and up and running. Eddie Moorcroft said this action is now complete and asked for it to be removed from the Action Log. Lesley Booth asked for a record to be made of thanks to Adrian Hartley for all the hard work undertaken in following this action through.

Jan Harding asked if a Changing Places toilet can be looked at for Retford. Caroline Baria asked where in Retford would this be located and Jan Harding said that she does not know but it needs to be public (somewhere in the town centre?) Jan Harding said that a Changing Places toilet is something that both adults and children’s services need to work together on providing. Caroline Baria said that the Board can contact Bassetlaw District Council to make enquiries. But there needs to be more information before we do. We need to know things like what the demand is and who are the people who will benefit from this facility. Jan Harding said that the use of this facility may well apply to people within the area currently in Supported Living. Jan Harding said that Worksop have a Changing Places toilet located in the library.

Newark Leisure Centre, including Changing Places Toilet Eddie Moorcroft confirmed that an invite will be sent to Helen Ellison to come back to the Board to present an update at the meeting scheduled to take place on 30th July 2015. Budget Consultation Eddie Moorcroft said that at the last meeting members asked if there could be an update on what decisions were made after the consultation. Eddie Moorcroft said that some information has been included within the papers for today and that Cath Cameron-Jones will talk about this subject later in the meeting. Transport in Bassetlaw Caroline Baria agreed at the last meeting to contact the people responsible for Transport to find out more details about what is happening in Bassetlaw and feedback at today’s meeting.

Caroline Baria said that people know a consultation had taken place during 2014 about service reductions. Caroline said that a budget reduction of 30% had been proposed to local bus services. Caroline said that in Bassetlaw there had been in the region of a £490,000 reduction. Caroline Baria said that a report had gone to the Transport & Highways Committee on 21st May 2014, which had taken into account what people had said. Caroline said that whilst there had been a reduction in spending on transport, Bassetlaw has received more funding than other areas. Money is being spent in Bassetlaw on supporting main commercial bus networks. Caroline Baria said that it was decided that it was better to remove support for evening and Sunday services to keep priority services during the working week. This was to get people to work (employment), health appointments and to the shops. Jan Harding said that evenings are the problem as people cannot afford the £28 taxi fares and it is people without transport that are being affected. Caroline Baria said that she acknowledged this point.

Bronwen Downing questioned whether we have to accept that there are no buses running after 6.00 pm and asked if the Board can bring pressure on this. Caroline Baria said that the Board can write to the Transport/Highways Department expressing concerns. Caroline Baria added that she would be surprised if the decision will be changed as money is being spent on essential bus services. Bronwen Downing asked if funding is going in from the Council to support transport. Caroline Baria talked about a previous 6.1 million pound budget being spent on transport and this was reduced down to a 4.2 million on 21st May 2014. Jan Harding said that if someone is rushed to hospital, family members and friends may not be able to afford the travel expense of a taxi if a bus service is not available.

John Parrot said in other areas of Nottinghamshire buses were still operating at 2:00 am in the morning. John Parrott said that it surely is only fair if able to happen across all areas of the County. Cllr Yvonne Woodhead and Caroline Baria talked about the Council not being able to fund all bus services and that it is doing its best to target services that would not run at all if it did not make a contribution. Eddie Moorcroft said that we are being told disabled people need to get out, but we cannot do this if affordable and accessible transport is not in place. Cllr Yvonne Woodhead talked about buses being tried for a month and no one getting on them and that the buses are then running for nothing which is very expensive. Cllr Yvonne Woodhead said that unless we can get enough people to use the buses, services cannot afford to run. It was mentioned that we need to think about other ways of offering transport. Jan Harding and Cllr Yvonne Woodhead talked about people being aware of services and that we need to publicise them.

Neil Pike said that would it be better idea to give people extra money within their care package to cover a transport cost; for people living in rural areas. Caroline Baria said that the amount of money that each person receives is based on their level of need and that transport is thought about at the time the budget is set. Lesley Booth said that could people possibly get together and look at getting at a mini-bus. Lesley said that this could take a long time to achieve but it would also raise the issue of needing a service. Cllr Yvonne Woodhead said that the Board would support this. Eddie Moorcroft thanked Caroline for giving details.

5. The Board Theme: Keeping People Safe Eddie Moorcroft invited Claire Bearder to talk to people about Keeping People Safe. Claire Bearder said that it was really good to be here today and thanked everyone for inviting her to today’s meeting. Claire Bearder said that she is the Group Manager for Safeguarding Adults and the lead person for Keeping People Safe and that she wanted to talk to you about Safeguarding Procedures and the Care Act. Claire said that she hoped that you had read her report and talked through her slide presentation covering:

• What is Safeguarding? • What the Care Act says • What about support for people? • 6 important ideas about Safeguarding

Eddie Moorcroft asked if the word ‘Proportionality’ could be changed (the title of the 3rd important idea). Claire Bearder said that she was open to any suggestions. Following a discussion it was agreed for the word to be changed to ‘Right Level of Response.’ Claire continued through her slide presentation covering:

• What will this mean? • Who we must support • Some of the terms we use in safeguarding have

changed Eddie Moorcroft asked why an assessment or investigation is now called a ‘Section 42 Enquiry.’ Claire said that the reason for the wording change is possibly that within Children’s services it is called a ‘Section 47 Enquiry’. Claire Bearder said that she cannot change this name as it is the Government that decided what to call it

Claire continued through her slide presentation covering:

• The other kinds of abuse that have now been included and what they are.

• How will the changes affect the way we work? Eddie Moorcroft asked if permission was needed to gather information and record it on the Council’s computer system (Framework i). Claire Bearder said ‘yes’ in the new procedure it say we should seek consent. Claire finished her presentation and asked if there were any questions. Service User Forum Questions Mark Taylor asked the following... It is a good thing that Safeguarding is more person -centre.

If I was being abused and I didn’t want anything to happen, would it be dropped? It is really good that Safeguarding is more person-centred. Claire said that we would work with you to find out about any issues and what you are concerned about. Claire said that we have to do this because other people may be at risk and action may need to be taken. Christopher Belcher said that he was once bullied by a teacher but was not convinced that any action was taken at that time. Claire Bearder said that if someone is bullying one person, they could actually be bullying lots of people. Lesley Booth raised concern that if an organisation employs a person who is then found to be abusing people, that person can then go on to work somewhere else if no action taken. They should be sacked at that time and not able to find work supporting other vulnerable people.

Claire Bearder said that she agreed with this. Eddie Moorcroft said that if no action is taken, the staff member could move on to work for another organisation or a different area of work within the same organisation and continue to be a bully. Claire Bearder said that there is a disclosure and barring system (police checks) and there are two Safeguardings in place. Claire Bearder said that the Care Act says we have to employ a DLASM (Designated Local Authority Safeguarding Manager). A lady called Becky has been employed by the Council in this position and that her main focus is on ‘how do we support employer’s to do the right things.’ Claire Bearder said that we know that changes will not happen overnight, but work is taking place. Eddie Moorcroft said that if you have a Direct Payment you would not know about all the checks and if a person’s details are on the list.

Lesley Booth said that we do look at the disclosure and barring system. Adrian Hartley mentioned Winterbourne View and being concerned that we are saying that there will be fewer investigations and, therefore, will staff just let some things go. Claire Bearder said that we have checks and monitoring in place and we monitor number of referrals to safeguarding. Adrian Hartley said that there are a vast number of people in Care Homes – these people are at risk and they are not being safeguarded. Caroline Baria said that we know this is important and a review is being done; we are in the process of doing something about this. Jan Harding raised concern about volunteers who work a few hours a week are being advised that they are not included in disclosure and barring, as it is not necessary.

Claire Bearder said that the conservative Government had felt we needed to bring back checking. But it needs to at acceptable and sensible levels. Whilst checks are useful they do not remove the need for good recruitment and supervision. Christopher Belcher asked if we can make a law to cover this. Claire Bearder said that there is a law and that if a person commits a criminal offence, the law will deal with them and they should be sacked. Claire said that we need enough evidence and that if we have enough evidence, people’s details will be put on the list. Claire said it can be difficult to get evidence because we are not always able to prove it, for example, if it is one person’s word against another. If the evidence is physical, then it can be easier to prove.

Keith Lancaster raised a number of points:- 1. Self-neglect – a strange name to use. 2. Adults at risk – if a person is living with their parents,

couldn’t it actually be a parent at risk. It is not always the adult service user that is at risk.

3. Under the new law – mental capacity – It is alright for

parents or family representative to be the responsible person. But sometimes it is possible for a parent or family member to behave towards the person they care for in a way that would be totally unacceptable for a member of staff to do. So what is abuse and what is normal behaviour? This can put people asking any questions in a very difficult position.

Caroline Baria answered the points:- 1. We did say that a different term might be better but it

is now the law that says we use self-neglect – we will put the right things in place with the right level of support.

2. Vulnerability of carers – there are carers support

services and carers assessments are carried out to look at the support people need. We would expect various staff to support people and to put in good plans to manage challenging behaviour.

3. Right that we have a balance in service – no abuse

should be tolerated in services where we are paid to care. If families are in a mess it is about going in, offering support and putting behaviour management in place.

Eddie Moorcroft thanked Claire for presenting this item and for input from colleagues. Meeting adjourned for a short Tea/Coffee break.

6. Future Board Meetings Eddie Moorcroft invited Konrad Bakalarczyk to talk about future Board meetings. Konrad Bakalarczyk said that this part of the meeting was for people to think about who to invite and what you would like to see on agendas.

Konrad Bakalarczyk asked you to take 5 to 10 minutes to talk about this and to write down ideas on the pieces of paper provided on each table. Konrad Bakalarczyk said that the pieces of paper will be collected, ideas and thoughts looked at and details will be circulated to you. Konrad Bakalarczyk asked for Mandy Snowden to ensure details of this item were recorded on the Action Log. Konrad Bakalarczyk said that Darren Stapleton from the i-Works Team at Nottinghamshire County Council will be coming to the next meeting to talk about current projects and Newark Leisure Centre will be updating on building works. Darren Stapleton asked you to contact him with any questions or items you would like to raise about employment.

7. Smile Stop Hate Crime – Safe Places Eddie Moorcroft invited Karen Aspley to present this item. Karen Aspley introduced herself and said that she wanted to talk to you about what the Smile Stop Hate Crime Group have been doing during the last year. Karen Aspley said that a report had gone out with the papers and hoped that everyone had a chance to read it. Karen Aspley talked through her slide presentation, covering:

• Details of the former Director of Public Prosecution and the current Director of Public Prosecution

• Learning Disability Hate & Mate Crime Training

• Learning Disability Hate Crime Awareness Sessions with Young People

• Campaigning

• Working with Volunteers

• Safe Places Karen Aspley said that she has some packs to give out today and for people to speak to her if they would like one re: Safe Places Scheme. Karen Aspley said that she is more than happy to go in and speak to people bout training. Christopher Belcher asked what do you do if someone shouts at you. Karen Aspley said that you need to tell people and keep telling people until something is done. Karen Aspley said that it is fine to keep on telling people, as many times as you need to.

Eddie Moorcroft and Karen Aspley discussed the Safe Places Scheme in the County and Eddie asked if it was going out to the whole of the County and not just the City Centre. Karen said that it is being rolled out and there are 75 places in the County and City who have signed up. Karen said that we started work in the Mansfield, Sutton in Ashfield, Worksop and Gedling areas so at the moment they are the main areas. Karen said that in the next 6 months we will start working in the Newark and Bassetlaw areas. Eddie Moorcroft asked if we took packs ourselves can we take them to places like Bingham where we go and see if any of the shops in Bingham will help. Karen Aspley said that it is very important / to get a group of volunteers together and to look at how we are going to do this.

Richard Taylor said the following... We think this project is really good and gets the message to lots of people. 1. How long will it take to get the Safe Places

across the County? Karen Aspley said that this is as fast as our legs can carry us around the County. Karen added that we send lots of emails and talk to lots of groups and that Newark is our last area to concentrate on.

2. When will you know about funding? Karen Aspley said that we have funding until March next year that will help us to carry out our work.

Eddie Moorcroft asked if there were any further questions. Ruth Williamson asked if there will be a list on the intranet that people can access that gives details of Safe Places and if it a logo for the scheme will be displayed in shop windows. Karen Aspley said that, yes, logos are available and will be on display in windows and that a listing will be on their website. Karen added that we will have printed lists available as well. Cllr Sheila Place asked if the scheme extends into other Counties, e.g. Doncaster. Karen Aspley said that there are similar schemes in Sheffield and Doncaster, certainly in South Yorkshire. Karen Aspley said that there is currently no joined up scheme for the whole of the UK. Question asked if the logo/sign was similar; Karen said that it was more or less the same. Bronwen Downing asked if there is any record of who has used the scheme.

Karen Aspley said that log sheets are kept (electronically), but we do not ask for details of names or addresses. Eddie Moorcroft said what if someone is going into a Safe Place every week for help and support. Karen Aspley said that we have people giving us this information and we will talk to people if they are accessing schemes regularly. Gary Watt asked if a Safe Place could include a family home – Neighbourhood Watch mentioned. Karen Aspley said that she had never been asked this before and will need to check with the Safeguarding team, but thought we probably could not do this. Jan Harding asked if a telephone number can be given if you need help and advice in a situation of what to do. Karen Aspley said that this is really for emergency support and to encourage people to contact the named emergency person or to call 999.

Cllr Yvonne Woodhead said that if a home number is given, you can leave yourself open to abuse from someone who is not disabled or in need of help and sked whether people would actually want to put themselves in that position. Karen Aspley said that this is outside of the project and not within scheme at the moment. Karen encouraged people to contact her if they wanted any more details or had any further questions. Eddie Moorcroft thanked Karen for presenting this item.

8. Budget Consultation Cath Cameron-Jones introduced herself and said that she was here today to talk to you about the results from the Budget Consultation.

Cath said that people had found it difficult to find the information on the Council website. Cath said that there is an easy-read version of details now available on-line, along with the Budget Consultation document. It was agreed that a copy of the easy read version ‘Budget Consultation Summary’ would be circulated with today’s meeting minutes. Cath talked through this document. Carers Questions Lesley Booth asked if any thought had been given to paying Council staff less to save money (those high er on the payscale). Lesley mentioned the Police forc e having a 10% cut to their wages. Caroline Baria said that Nottinghamshire County Council employees have not had an increase for the last 3 years (other than the lowest paid workers who have been paid more).

Caroline Baria said that after long talks with the Union, it has been agreed for a 1% increase in wages from April 2015. Julie Hartley mentioned Pre-Paid Cards and that the contact number is a premium rate telephone number. Cath Cameron-Jones said that she will take this comment back to colleagues. Keith Lancaster talked about paying the minimum living wage. He asked if this is being thought abou t when a decision is made on the amount of money being given to Providers? Caroline Baria said that when we have a contract with Providers (tendering for services) checks are made to see if they are paying the minimum wage and we look at how money is spent. Caroline said that we cannot tell providers how much to pay the people they employ. We are looking at how we can support independent voluntary providers to pay staff above the minimum living wage.

Jan Harding mentioned B03 – Short Term Prevention Services regarding people with a mild learning disability or Asperger’s. This is being seen as no longer being as important in the future. Jan asked how are carers going to cope in the futur e and how are families going to be affected. Caroline Baria talked about the Care Act and new duties for the Council. Caroline said that the Local Authority has responsibilities to carry out assessments, look at people who are eligible for Social Care Services and to look at on-going services with Health Providers and Clinical Commissioning Groups. Bronwen Downing asked if Independent Living Fund money from the Government is being ring-fenced (kept for use for people with learning disabilities). Caroline said ‘yes,’ it is in Nottinghamshire. Caroline said that all Local Authorities have to report back to Government on how money is spent.

Bronwen Downing asked what happens if the Council fails to report back. Caroline Baria said that the Council cannot fail and talked about a quarterly form that is sent out for the Council to complete and return. Caroline Baria mentioned 100% response going back to Government and that it is in our best interest to report back. Caroline Baria said that the extra money has only been for a one year period, 2015/2016.

9. Open Forum Eddie Moorcroft invited you to ask any questions of the Board. Paul Johnson talked about the death of Lee Irving – Northumbria Police – being treated as hate crime – and asked if we can send a letter from the Board offering our condolences to the family. Jan Harding gave details of a Rural Isolation Conference at which ‘Access to Transport’ will be discussed. The conference is taking place on 24th June 2015 at the Civic Centre, Off Long Lane, Carlton-in-Lindrick. Item on access to transport starting at 1.45 pm. Lesley Booth - The review of the capacity of Nottinghamshire County Council day services – what is involved in this review and who is doing it? Jane McKay said that the review was about how big a building is, the number of people attending each day, the levels of need for each person and the number of people in sessions. Jane McKay said that all this information is brought together to see how we are doing; Jane said that this has been done before and there are a number of people involved. Jane McKay talked about the review bringing together different systems and this mainly being carried out by Business Support and the Transformation Team.

Jane McKay gave an example; where there may only be 10 service users, if they have very complex needs there might actually be 30 people in the building who are supporting these 10 people. Jane said that we have to look at the affect support has on services Keith Lancaster mentioned that they had their first inspection which was very thorough and fair we are now making sure we do the things we have been to do. Lesley Booth - Is anyone finding out what people wh o no longer use day services do during the day? Has this led to isolation and is there an impact on car ers? Caroline Baria said that when a person is not going to a service it is because they are not eligible to have a service. Caroline Baria said that if a person’s needs change we will make sure they can have an assessment.

Caroline Baria talked about more support for carers and the Council promoting appropriate support. Adrian Hartley talked about people stopping using t he day service when they became a shared service. Caroline Baria said that if people are eligible to receive a service we will help them find an alternative. But there may be some people who choose not to use our day services. Lesley Booth - Has the Council reviewed the outcomes of previous budget cuts to service users, for example, whether or not activities are availabl e in day services? Caroline Baria said that we have previously had a lot of discussion about activities and we recognise that there has been a reduction in the number activities. However, there is whole range of different activities still on offer to people. Caroline said that we review needs individually.

Lesley Booth - The Care Act is clear on the legal responsibilities on Local Authorities where a care provider fails and is not well managed to ensure th at the needs of people continue to be met, however it is funded. Caroline Baria said that in terms of duties around checking good quality services, quality is monitored and good strong processes are still in place. We have not reduced responsibilities and will ensure good quality services are provided. Lesley Booth - Who is there to support and help carers and families when they have taken on responsibility for Direct Payments? Following the reduction in staff levels, does Nottinghamshire County Council still have the capacity to meet requirement? Caroline Baria said that we are reviewing what we need from a good Direct Payment support service. Caroline said that we have less frontline staff and we are still looking at what staff we have and what staff we need. Caroline said that we are getting more staff in some areas where we feel it is needed.

Bronwen Downing said that she would like to thank the Board today for what has been a very informative session Pippa Gascoigne, Choice Support, mentioned details of a Living Well Workshop which is taking place on 8th July 2015 at Trent Vineyard, Easter Park, Lenton Lane, Nottingham. Pippa said that booking forms are on tables for people to take away. Cllr Yvonne Woodhead, Caroline Baria and Eddie Moorcroft thanked people for attending today and closed the Board meeting at this point.
