NOTICES OF MOTION 1. That this House notes:

That, according to Parliamentary Library research: 1. In the United States and other countries the ownership of mineral resources is granted to

those who own the land. 2. In Australia, landholders generally have no right to the ownership of mineral resources

that are located either on or under their land as they belong to the state. 3. Consequently, as there is no right of ownership of the mineral wealth, compensation to

the landholder is not based on the value of the minerals that are located there.

4. The value of any compensation to the landholder is based on the loss suffered by the landholder in the running of their business activity.

And calls on the Premier to establish a bipartisan parliamentary committee commissioned to identify the legal changes required in Queenlsand to provide mineral rights to landowners, thereby guaranteeing landowners and farmers a legal right to a gtreater share of the state’s mineral wealth. 2. That this House notes that: 1. Sharia or Islamic law is routinely used all over the world in Muslim countries and countries

with Muslim communities. 2. Sharia or Islamic law permits in some instances, the state to militate and/or impose the

death penalty on people found to be guilty of certain crimes, including stealing and adultery.

And calls on this Government to preemptively ban the use of Islamic law or Sharia law in Queensland. Notice given: Member for Burnett (Mr Messenger) Date: 25 May 2011 Status: To be debated.

3. That this House notes that: 1. This Premier and Opposition leader have failed to move a motion for a minute’s silence

as a mark of respect and to acknowledge the death of Commando Sergeant Brett Wood MG, who was killed this week leading his unit in Afghanistan.

2. Sergeant Wood was the 24th Australian soldier killed in Afghanistan. 3. On only one of the occasions since 2001 has this House observed silence for a soldier

killed serving in Afghanistan (David Pearce). 4. This House has in the past also observed a minute’s silence for an executed drug

trafficker. And calls on the government, supported by the opposition, on the first sitting day immediately following the death of any members of the Australian military on active overseas service, to move, as a mark of respect, a motion for a minute’s silence. 4. That this House notes that: 1. In reply to Question on Notice 531, the Education Minister refuses to disclose the number

of students on a yearly basis found by teachers to be in possession of and/or using illicit and illegal substances on school premises.

2. The Education Minister also refuses to disclose the number of students reported to police on a yearly basis for the possession and/or use of illicit and illegal substances on school premises.

3. There is an ever present and growing drug problem in our State Schools. 4. Parents have a right to send their children to a drug and weapons free educational

environment. 5. This government has a duty of care to take all lawful steps necessary to ensure a safe,

drug and weapons free educational environment. 6. The use of drug detection dogs by appropriately trained people are lawful in Queensland.

And calls on the Education Minister to allow State Schools Parents and Citizens committees in co-operation with principals, the right to authorise random searches of their schools using appropriately trained personnel and drug and weapon detection dogs. 5. That this House notes that: According to a Parliamentary Library study: 1. Public notification is required of the application of initial mineral exploration in all State

jurisdictions (except Queensland). 2. In Queensland notification is only required where the permit application is being

processed in accordance with native title procedures. 3. Only Queensland and New South Wales have no provision for objections to the grant of

the application for an initial mineral exploration. And calls on the Government and opposition to commit to amending Queensland mining laws: to 1. Require public notification of all initial mineral exploration. 2. Enable our land owners and farmers to formally object to the grant of initial application for

mineral exploration. Thereby ensuring that our farmers and land owners have the same property rights and legal protection from mining companies as other Australian farmers and land owners. Notice given: Member for Burnett (Mr Messenger) Date: 15 June 2011 Status: To be debated.

6. That this House notes that according to the Australian Productivity Commission’s draft report into a national disability insurance scheme (NDIS): 1. In Australia there are 747,400 people aged under 65 (2008 figures) with disability

classified as severe or profound, while in Queensland there are 151,500 people with severe or profound level of disability.

2. In Queensland only 15 per cent of the population who should receive some form of disability support actually do receive it.

3. People with disabilities and their families spend their lives filling in forms “proving” their permanent disability has not miraculously disappeared, to go on a wait list for expensive, essential products like wheelchairs, personal care, communications equipment and personal support services.

4. The Productivity Commission will estimate the annual cost in its draft report, reported to be around $10.5b per year. The current, ineffective system costs around $6.5b per year.

5. A National Disability Insurance Scheme as a Medicare-type scheme, would provide a secure and consistent pool of funds for disability services and support.

And calls on the Premier and Opposition Leader to support the introduction of a national disability insurance scheme, in order to allow Queenslanders with a disability to finally get the kind of support they need, to reach their full potential and participate more fully in the economy and the community. 1006 MRS PRATT ASKED THE MINISTER FOR ENVIRONMENT AND RESOURCE MANAGEMENT (MS JONES)— With reference to Queensland’s strategic cropping land (SCL)— Will the Minister (a) outline where ground truthing of SCL designated land has been undertaken, (b) advise (i) the justification for the narrow margins imposed (taking into consideration that all crops require varying acidity/alkalinity and varying degrees of flat/slope, for example, bananas/wheat) (ii) the appeal process for landholders to be included as SCL and (iii) who bears the cost of ground truthing areas currently not designated as SCL?

1009 MS BATES ASKED THE MINISTER FOR GOVERNMENT SERVICES, BUILDING INDUSTRY AND INFORMATION AND COMMUNICATION TECHNOLOGY (MR FINN)— Will the Minister explain how the hospital rostering and payroll service is currently operating, given that the software has not yet been repaired, including how many hospital payroll staff have been employed to date to manually compensate for the inadequacies of the failed system, and advise if these costs have been included in the total cost announced to fix the system?

1012 MS NELSON-CARR ASKED THE MINISTER FOR AGRICULTURE, FOOD AND REGIONAL ECONOMIES (MR MULHERIN)— How are Department of Employment, Economic Development and Innovation scientists assisting growers to identify and manage plant viruses spread by thrips?

1013 MR HORAN ASKED THE MINISTER FOR COMMUNITY SERVICES AND HOUSING AND MINISTER FOR WOMEN (MS STRUTHERS)— As residents at the Bridge Street Resort in Toowoomba have made an official complaint to the Office of Fair Trading (OFT) regarding the parking of a bus in close proximity to their residence and OFT officers have identified this as a breach of section 86 and/or section 96 of the Manufactured Homes (Residential Parks) Act— Will the Minister ensure the legislation is enforced in relation to this breach?

meet the demand of public transport patronage in this area?

1015 MR RICKUSS ASKED THE MINISTER FOR TRANSPORT AND MULTICULTURAL AFFAIRS (MS PALASZCZUK)— Will the Minister advise on the implementation status of each recommendation of the parliamentary Travelsafe Committee’s Report No. 47, June 2007: Report on the inquiry into Q-RIDE?

1016 DR ROBINSON ASKED THE MINISTER FOR MAIN ROADS, FISHERIES AND MARINE INFRASTRUCTURE (MR WALLACE)— With reference to variable message sign (VMS) units in use on Queensland roads— Will the Minister list the (a) installation costs, (b) repair/maintenance costs and (c) reported malfunctions of VMS units in 2008-09, 2009-10 and 2010-11 to date (each year reported separately)?

1017 MR DICKSON ASKED THE MINISTER FOR ENERGY AND WATER UTILITIES (MR ROBERTSON)— Will the Minister advise if the government is considering re-locating a number of South East Queensland water entities to a single premises in the Ipswich area and if so, are the proposed premises flood prone?

1018 MR ELMES ASKED THE MINISTER FOR TRANSPORT AND MULTICULTURAL AFFAIRS (MS PALASZCZUK)— As data obtained from the Queensland Building Services Authority quotes the cost to build a typical 200 square metre four bedroom, single storey, brick veneer house would be between $250,000 to $350,000, which means a house with medium to high quality finishes and fittings would cost between $1,250 and $1,800 a square metre to build— Will the Minister advise the average cost to build a typical bus stop shelter and bus pull-in zone and provide a breakdown of how this cost is calculated, from design through to completion?

1019 MR GIBSON ASKED THE MINISTER FOR EDUCATION AND INDUSTRIAL RELATIONS (MR C R DICK)— With reference to the ongoing growth within the Gympie Electorate and the recent announcement of year 7 moving to high school— What reviews have been undertaken by the department to determine what the need will be for new primary, secondary or special schools in the future for the electorate (reported by area and school type) and what major facility upgrades will be required to existing primary, secondary or special schools in the future (reported by area and school type)?
