THE NATIONAL HISPANIC LEADERSHIP AGENDA

The National Hispanic Leadership Agenda (NHLA) was founded in 1991 as a non-partisan coalition of major Hispanic national organizations, as well as distin-guished Hispanic leaders from across the nation. The NHLA represents all major

ethnic groups in the Hispanic community: Mexican Americans, Puerto Ricans, CubanAmericans, and Americans whose countries of origin are in the Caribbean and Centraland/or South America. Governing the NHLA is a 37-member board comprised of thechief executive officers of 31 national Hispanic organizations, along with elected officials,corporate executives, and other prominent Hispanic professionals. NHLA’s mission callsfor a spirit of unity among Latinos nationwide to provide the Hispanic community withgreater visibility and a clearer, stronger voice in our country’s affairs. NHLA seeks a con-sensus among Hispanic leaders to help frame policy and promote public awareness of themajor issues facing Latinos nationally.

FOREWORD

As Chair of the National Hispanic Leadership Agenda (NHLA), I am proud to pre-sent the NHLA Congressional Scorecard. This report identifies key votes of con-cern to NHLA member organizations, and documents how Senators and

Representatives acted on them in the latest session of the 106th Congress.

The Scorecard is a consensus document reflecting the views of the major Hispanic organi-zations and leaders throughout the nation. It provides key information to Latino leaders, thepress, the Hispanic population at-large, and Members of Congress themselves about issues ofconcern to the Hispanic American community. It serves as an accountability tool for citizens touse in evaluating their elected officials, and helps to empower Hispanic advocacy organizations,including NHLA members, as they engage policy makers.

The Scorecard covers a broad range of issues, capturing the interests of our extremelydiverse community. It is a fair document. The only votes included are those in which everyRepresentative and Senator received a formal communication from one or more NHLA mem-bers identifying their position on the issue. We believe that this is a powerful document, onethat has an impact in shaping public policy in our nation’s capital.

As powerful as the Scorecard is, it is equally important to acknowledge its limitations in pre-senting information about the totality of the contributions of any particular member ofCongress. Many Senators and Representatives contribute to the Latino community in waysother than voting - by sponsoring and cosponsoring important bills and working on their behalf,through services to their constituents, and in many other ways. Conversely, some Members havedone much to thwart the interests of Hispanic Americans without ever casting a vote on thefloor, by opposing proposals in Committee or undermining opportunities for important billsand amendments to even receive floor consideration. In this regard, we are deeply concernedthat due to the partisan atmosphere in Congress, many of NHLA’s policy priorities have not beenconsidered on the House or Senate floor.

Therefore, in addition to using the Scorecard, we encourage you to consider other sourcesof information in making a judgment on any particular Senator’s or Representative’s performanceon Hispanic issues. These include recognition awards to members of Congress by Latino orga-nizations, Action Alerts and similar materials produced by NHLA members.

As a non-partisan coalition of public policy and civil rights organizations, NHLA advocatesfor policies that address socioeconomic concerns and protect the rights of all Latinos. We believethat the NHLA Scorecard is the single best resource for anyone interested in monitoring the per-formance of Congress on Latino concerns. And, taken together with its predecessors, it providesthe most comprehensive record of how Congress votes on issues that are important to HispanicAmericans.

METHODOLOGY

In February of 2000 the Board of Directors of the National Hispanic LeadershipAgenda (NHLA) authorized the publication of its 2000 Hispanic Legislative Scorecardcovering the second session of the 106th Congress, soon after it adjourned. A

Scorecard Committee was appointed to identify and recommend to the Board votes forinclusion in the document (see front cover for a listing of Committee members).

The fundamental purpose of the Scorecard is to ensure that Latino leaders, organiza-tions, and voters are fully informed about the performance of federal legislators on issuesof importance to the Hispanic community. In addition, we seek to ensure that U.S.Representatives and U.S. Senators are fully aware that their key votes on issues of partic-ular significance to Hispanic Americans will be scrutinized and published.

Pursuant to discussions of the NHLA Board, the Committee used three basic criteriato select key votes: ■ Importance of the vote to the Hispanic community, measured both substantively

and symbolically,

■ Prior notice to members of Congress regarding the position of NHLA member orga-nizations, as evidenced by a formal communication by at least one NHLA memberorganization to the Congress,

■ Substantial consensus, although not necessarily unanimity, among NHLA memberorganizations regarding the “pro-NHLA” position.

During the Committee’s deliberations, an informal “issue diversity” criterion alsoemerged. In other words, the Committee sought some degree of balance in the votesselected so that the Scorecard would not be unduly weighted toward any single issue, e.g.,immigration or education. Committee decisions were arrived at by consensus.Member organizations identified potential votes, which were then discussed, sometimesat length. Only those votes reflecting a consensus of the Committee were recommend-ed to the Board for inclusion.

On October 30, 2000, after consideration and some revisions of the Committee’s rec-ommendations, the Executive Committee of the NHLA Board of Directors selected thevotes included herein for inclusion in the Scorecard.

IMMIGRATION & CIVIL RIGHTS

1. Commerce - Justice - State Appropriations, H.R. 4690 - Sponsored by RepresentativeHarold Rogers (R-KY), the bill did not include increases for key NHLA priorities,including naturalization and service activities of the INS, improved enforcement ofcivil rights laws, or investigation of law enforcement abuse in the Department ofJustice, and the Legal Services Corporation. Bill passed 214 - 195, 1 Present (Roll no.326), June 26, 2000. (NHLA Position: No)

2. Hate Crimes - Representative John Conyers (D-MI) sponsored a motion to instructHouse conferees to the Defense Authorization bill to accede to the Senate-passedprovisions containing the Hate Crimes Prevention Act, a key priority of many NHLAmembers(see Senate vote #7). Motion passed 232-192 (Roll no. 471), September13, 2000. (NHLA Position: Yes)

3. Vieques, Restrictions on Economic Assistance, H.R. 3908 - Representative TillieFowler’s (R-FL) amendment (H. Amdt. 626) would place restrictions on $40 millionof economic assistance intended for Vieques, Puerto Rico. According to NHLAmembers, this amendment would break the agreement made between the President,the Governor of Puerto Rico, and the Secretary of Defense regarding future use of theVieques training range. It would require the resumption of live fire training inVieques and the removal of civil disobedience protestors from the range before eco-nomic assistance is allocated to the municipality of Vieques. Amendment failed 183-232 (Roll no. 88), March 29, 2000. (NHLA Position: No)

4. Vieques, Transfer to Puerto Rico, H.R. 4205 - Representative Ike Skelton’s (D-MO)amendment to the Department of Defense Authorization bill would allow the Navyto transfer the western part of Vieques back to Puerto Rico in accordance with thePresident’s negotiated position with the government of Puerto Rico and the

Department of Defense. The agreement is not contingent upon the resumption oflive-fire training on the island. Amendment passed 218-201 (Roll no. 202), May 18,2000. (NHLA Position: Yes)

5. District of Columbia/Commerce - Justice - State Appropriations, Conference ReportH.R. 4942 - Sponsored by Representative Ernest J. Istook (R-OK), the bill failed toinclude provisions of the Latino and Immigrant Fairness Act (LIFA, see Senate vote#8 for more detail). NHLA members conditioned their support for the bill on inclu-sion of the LIFA legislation (S. 2912). Conference Report passed 206-198, 29 notvoting (Roll no. 562), October 26, 2000. (NHLA Position: No)

EDUCATION AND ECONOMIC OPPORTUNITY6. New Markets/American Community Renewal Act, H.R. 4923 - This compromise leg-

islation resulted from the merger of President Clinton’s “New Markets” proposal and“The American Community Renewal Act,” sponsored by several key members of theCongressional leadership. The bill provides a series of tax incentives and other pro-visions designed to encourage and target increased private investments in disadvan-taged inner city and rural areas. Bill passed 394 - 27 (Roll no. 430), July 25, 2000.(NHLA Position: Yes)

7. Phone Surcharge, H.R. 3916 - Repeals a tax surcharge on telephone bills firstimposed during the Spanish American War. The “telephone tax” is regressive in thatit disproportionately affects lower-income consumers. Bill passed 420-2 (Roll no.233), May 25, 2000. (NHLA Position: Yes)

8. Funding for Education (Labor-HHS Appropriations) - Although the bill includedmany laudable provisions, including increased funding for Hispanic ServingInstitutions of Higher Education (HSIs), it failed to include full funding for numer-ous NHLA priorities, including the Hispanic Education Action Plan (HEAP), MigrantEducation, School Construction, Class Size Initiative, English language courses forcommunity-based organizations, and increased labor law enforcement on behalf oflow-wage workers and many others. Bill passed 217-214 (Roll no. 273), June 14,2000. (NHLA Position: No)

9. Funding for Low-Income Housing (HUD-VA Appropriations) - Sponsored by Rep.James Walsh (R-NY), the bill cuts and level-funds several major housing and com-munity development programs in the Department of Housing and UrbanDevelopment (HUD) that serve low-income families. In addition, according toNHLA members, the bill failed to provide increased funding for fair housing pro-grams to enforce anti-discrimination laws, or for housing counseling programs toassist low-income, first-time homebuyers to navigate the mortgage process. Billpassed 256-169 (Roll no. 309), June 25, 2000. (NHLA Position: No)

10. Minimum Wage Increase - Amendment sponsored by Representative James Traficant(D-OH) would increase the minimum wage by $1 over a two-year period. Thisincrease, according to NHLA members, is needed to help assure that low-wageworkers, who are disproportionately Latino, benefit equitably from the nation’sbooming economy. Amendment passed 246 - 179 (Roll no. 43), March 9, 2000.(NHLA Position: Yes)

SENATE

EDUCATION AND ECONOMIC OPPORTUNITY1. Compensatory and Bilingual Education Programs - Senator Joseph Lieberman’s (D-

CT) amendment (S. Amdt. 3127) to S. 2, the “Educational Opportunities Act,”would reauthorize elementary and secondary education programs, including bilin-gual education. This legislation would eliminate targeted allocation of funds for fed-eral programs designed to help disadvantaged students and replace it with blockgrants. In addition, according to NHLA members, this amendment would severelyweaken the effectiveness of the bilingual education program by eliminating targetingof funds to the best programs serving the most disadvantaged students.Amendment failed 13-84 (Roll no. 95), May 9, 2000. (NHLA Position: No)

2. Social Promotion - Senator Dianne Feinstein’s (D-CA) amendment (S. Amdt. 2876)to S. 1134, the “Affordable Education Act of 2000,” would require states receivingfunding under the Elementary and Secondary Education Act to adopt a policy end-ing the practice of “social promotion.” According to NHLA members this legislationwould likely increase the Hispanic grade retention rate, which would consequentlyincrease the Hispanic dropout rate. Amendment failed 30-68 (Roll no. 31), March 2,2000. (NHLA Position: No)

3. Teacher Quality Amendment - Senator Edward M. Kennedy’s (D-MA) amendment (S.Amdt. 2872) to S. 1134, the “Affordable Education Act of 2000,” would establishprograms to enable states and local educational agencies to place a qualified teacherin every classroom. This amendment would likely help Hispanic students who aremore likely than non-Hispanic Whites to be taught by an unqualified teacher,according to NHLA members. Amendment failed 39-60 (Roll no. 25), March 2,2000. (NHLA position: Yes)

4. Class Size Reduction Amendment - Senator Patty Murray’s (D-WA) amendment (S.Amdt. 3122) to the “Educational Opportunities Act” would provide for class sizereduction programs. According to NHLA members, this amendment would likelyhelp Hispanic students who mostly attend high-poverty, overcrowded schools.Amendment failed 44-53 (Roll no. 93), May 4, 2000. (NHLA position: Yes)

5. Minimum Wage Increase - Senator Edward Kennedy’s (D-MA) amendment toexpress the Sense of the Senate that the federal minimum wage rate should beincreased by $1.00 over one year. His increase, according to NHLA members, isneeded to help assure that low-wage workers, who are disproportionately Latino,benefit more equitably from the nation’s booming economy. Amendment passedafter being amended by Senator Don Nickles (R-OK) with language expressing theSense of the Senate that any minimum wage increase should not be passed withouta $100 billion tax cut. While NHLA members did not take a position on the tax cuts,they supported an increase in the minimum wage. Amendment passed 51-48 (Rollno. 76), April 7, 2000. (NHLA Position: Yes).

CIVIL RIGHTS & IMMIGRATION6. Federal Circuit Appointment of Judge Paez - Motion to confirm the appointment of

Judge Richard Paez to the Ninth Circuit Court of Appeals. Judge Paez, a sitting U.S.District Court Judge, received the highest possible rating from the American BarAssociation and yet had to wait for over four years to be confirmed. Judge Paez hadto wait the longest time ever to be confirmed. Motion passed 59-39 (Roll no. 40),March 9, 2000. (NHLA Position: Yes)

7. The Hate Crimes Prevention Act, S. 622- Senator Edward Kennedy’s (D-MA) amend-ment to the Defense Authorization Act would enhance federal enforcement of hatecrimes laws. The bill would expand federal jurisdiction over hate crimes based onrace, ethnicity, and national origin, and also would provide authority to investigateand prosecute crimes based on a victim’s disability, gender, or sexual orientation.Amendment passed 57-42 (Roll no. 136), June 20, 2000. (NHLA Position: Yes)

8. Latino and Immigrant Fairness Act (LIFA) - Motion to suspend the rules and passLIFA as an amendment to the H1-B bill. Also known as the “H1-B plus” agenda, thelegislation would update the registry date to allow, among other things, hundreds ofthousands of eligible persons who were illegally denied an opportunity to apply forlegalization under the 1986 immigration law to apply for legal status. In addition,the bill would provide parity for certain Central American groups with others legal-ized under the Nicaraguan Adjustment and Central American Relief Act (NACARA).Motion failed 43-55 (Roll no. 257), September 27, 2000.
