Misuse of residential buildings not falling inmixed land use area/street

Under the provision of section of 347 of DMC ACT 1957 (as amended), changeor allow the change of the use of any land or building is not permitted. Instructionshave been issued in past from time to time for taking action against such a misuse.

The Hon’ble High Court of Delhi vide orders dated 10.12.04 in WP (C)1089/03has given the following directions:

1. Henceforth, no new commercial use of residential building is allowed in any building,which does not fall in an area or a street declared as falling under mixed land use.

2. It would be the duty of the SHO to bring the said violation to the notice of MCDas well as DDA.

3. It shall be the duty of Junior Engineer to forthwith bring the said violation to thenotice of the Executive Engineers (Building) who will bring it to the notice of DyCommissioner, who would ensure that the information is brought to the notice ofthe court by filling appropriate application in WP(C) 1089/03.

In order to implement the directions of the court the following action shallbe taken by the Zonal Staff:-

1. A survey shall be conducted immediately to identify the properties where suchmisuse is already in existence and action shall continue to be taken against suchproperties as per the instructions already in vogue.

2. For any new violation henceforth apart from taking usual action, the matter is tobe reported by J.Es to their Executive Engineer (Bldg.) of the Zone, who willbring it to the notice of Dy. Commissioner.

3. The Deputy Commissioner incharge of the zone will get prepared a monthlyReport prepared of all new violations noticed individual property wise along withnecessary details including the name and address of the violator and the actiontaken by MCD and the same shall be brought to the notice of the court by filingappropriate application in WP(C) 1089/03 by first week of the next month.

The above instruction should be followed meticulously. For any laxity, individualwill not only face disciplinary action but may also invite action by the Hon’blecourt.

Registration & VerificationsFor convenience of the employers, servant verification will be got done through beatconstables. He will go to the employer's residences, request them to fill the forms andreturn the forms to the Divisions Officers at the police station after beat patrolling duty isover. Adequate attention must paid by the Division's Officer/ SHO's to this importantmatter.

The division officer and the beat patrolling constable will be required to jointly do thisjob from time to time. They will take with them sufficient number forms(Appendix ' A' ) go the houses of the employers and get the forms filled in triplicate forall private / domestic servants/casual workers employed in tent houses, Halwai shops,casual labourers, plumbers, electricians and also the chowkidars employed by theResident/Market Welfare Associations. One copy of their photographs be retained inPolice Station and their forms shall be entered in the servant verification register andshall be sent to the Police Station concerned, in duplicate, for verification in the form ofstranger Roll. Concerned SHO will check their antecedents from CRO, whether theyare involved in any cases in Delhi or otherwise.

2. They should always register their residential & personal details in the Police station which is closeto their house.

3. Senior citizens should feed all the telephone numbers of the local Police station in their telephoneor mobile or should write down in their telephone diary.

4. Should also feed the telephone numbers of near by 24 hours open medical shop , hospital & also thecontact numbers of family doctor .

5. Senior Citizen who live all alone should maintain a dairy or note pad for people who visit them . Theelderly person without fail should record the details of the person who has visited him or her in theday along with their time details.

6. They should not keep huge sum of cash & jewelry in their home.

7. Should develop friendly relation with the neighbors & especially with their young children

8. They should install iron grills in window for safety.

9. In the night before sleeping , they should on a bulb or a light in the passage common to bedroom &living room & also in toilet.

10 Should keep telephone or mobile just close to their bed in the room where they sleep in night.

11. If possible should install a alarm which is connected in neighbor's home , so in case of emergencythe elderly person can inform neighbor for help with the alarm.

12. If the elderly person is Diabetic or Asthma patient or Heart patient than he or she should keep thenecessary medicine some where close to the bed on which he or she sleeps.

13. Do not keep servants without somebody's recommendations & should always submit the servant'sphoto copy of identity in the local Police station & in the society where the senior member lives.

14. In case of plumber or gas repairer etc comes to the house . The senior citizen should call either aneighbor or a relative to his or her house when the service provider is doing the work in the house.

15. The senior citizen should keep the approximate payment of the service provider ready before theservice provider comes , so that the elderly person does not have to open his or her cupboard formoney in the presence of the service provider. In case the payment is not kept in advance , the elderlyperson should ask the service provider to wait outside the house .

16. They should never show or make other people realize that they are old , weak & dependent onothers for help.

Benefits, Concessions and Schemes for SeniorCitizens in India

(1) Court cases involving senior citizensThe Chief Justice of India has advised Chief Justices of all High Courts to accord priorityto cases involving older persons and ensure their expeditious disposal. [vide letter ofGovernment of India, Ministry of Social Justice & Empowerment (SD Section), New Delhi,F. No. 20-76/99-SD dated 03.11.1999]

(2) RTI Act (Right to Information Act)Second appeals filed by senior citizens and differently abled persons under the Right toInformation Act (RTI) are taken on a high priority basis, according to a directive of theCentral Information Commission (CIC).

(3) Health Care(a) There is provision for separate queues for senior citizens at hospitals and health carecentres when they visit for any health related concerns or clinical examinations.(b) The Delhi Government runs special clinics for Senior Citizens in most of its hospitals inDelhi.

(4) Finance & Taxation(a) You are advised to refer to the Indian Income Tax Department for the current slabs ofIncome Tax including rebate admissible to senior citizens. As per recent finance budget2008-09 (presented on 29th February, 2008) the threshold income when you start payingtax stands at Rs. 2.25 lakh per annum for senior citizens. In this case the qualifying age asspecified by Income Tax Department is 65 years.(b) The benefit of Section 80C of the Income Tax Act, 1961 has been extended to theinvestments made under 5-Year Post Office Time Deposits Account and Senior CitizensSavings Scheme, with effect from 01.04.2007.

(5) Banking(a) Government also gives a higher rate of interest to senior citizens on certain Savingsschemes which it runs through its large network of Post Offices (Senior Citizens SavingsScheme) and Public sector Banks. For further details you are advised to contact yournearest Bank or local Post Office.(b) Some banks like State Bank of India charge only 50% of the applicable prescribedcharges in respect of following services:i) Issue of duplicate passbook/statement of accountii) Issue of cheque books,iii) Noting of standing instructions,iv) Stop payment instructions,v) Charges of non maintenance of minimum balance,vi) Issue of balance certificate,

(6) Telecommunications(a) Department of Telecommunications has made special provisions for senior citizens whoapply for a new telephone connection. The department has earmarked separate prioritycategory for senior citizens wherein they can apply for registration.(b) In case of any complaint or fault with the telephone a senior citizen’s complaint is redressedon a priority basis.(c) MTNL (Delhi) gives 25% discount in rentals (Tariff Plan-250 only) and installation toSenior Citizens who are 65 years or above in age. (7) Travel by Indian Railways(a) Travel by Indian Railways is 30% cheaper for all Senior Citizens who are 60 years in ageor above, while women aged 60 years or above are entitled to 50% concession in fare.Indian Railways provides this fare concession to elderlies in all its trains including Shatabdi,Rajdhani and Jan Shatabdi trains. Kindly note that while travelling all Senior Citizens need tocarry proof of their Date of Birth / Age with a Photo ID Card.(b) There are separate Counters / Queues for Senior Citizens at all Railway Stations forpurchase, booking or cancellation of tickets.(c) Special arrangements are available for those who find it difficult to walk or move on theirown. Wheel Chairs are available at all major junctions, District Headquarters and otherimportant Railway stations for the convenience of Senior citizens and also for those who arein need.(d) Indian Railways have recently introduced specially designed coaches which have provisionsfor hand rails and specially designed toilets for handicapped persons. These coaches alsohave space for wheel chairs.

(8) Travel by Airlines(a) Senior Citizens are entitled to 50% discount on Economy Class fares on all flights ofIndian Airlines subject to certain conditions.(b) Air India gives 45% discount in economy class on domestic sectors to senior citizens(women aged 63+ and men aged 65+).(c) Other Airlines operating in India also offer discounts to senior citizens. It is advisable tocheck with them before you plan your travel.

(9) Travel by Roadways (state transport)(a) State Road Transport Undertakings have made provision for senior citizens for reservationof 2 seats in the front row of all buses.(b) Some state governments also give concessions (in fare) to senior citizens, while somealso have specially modelled buses for the elderlies.

HEALTH TIPS

1. To avoid diseases like hepatitis and Typhoid, eat 5 basil leaves everyday.2. For tooth ache, keep a clove on the affected area.3. Have a mixture of gingelly oil and egg, for 3 days, for menstrual disorders.4. You will get a great relief from menstrual pain , if you have a gooseberry daily.5. Vegetarians Live LongerThe battle has long been waged, and will certainly continue in spite of this study. Arehumans designed/evolved to eat everything and at risk of malnutrition as vegetarians?Or is vegetarianism the healthy and ethical choice? The most impressive data arisesfrom a study of 1904 vegetarians over 21 years by the German Cancer ResearchCenter (Deutsche Krebsforschungszentrum). The study's shocking results: vegetarianmen reduced their risk of early death by 50%! Women vegetarians benefit from a30% reduction in mortality.

Long-term Study of VegetariansThe participants of the the German Cancer Research Center study included 60 vegans(no animal products consumed), 1165 vegetarians (eating eggs, milk but no meat)with the remainder described as "moderate" vegetarians who occasionally ate fish ormeat. The health of these study participants was compared with the average Germanpopulation. Living longer seems not to be exclusively related to eating meat, though,as the results for moderate vegetarians was not statistically different from those forvegan or strict vegetarian diets.

To the argument that it is not vegetarianism but a general interest in a healthier lifestylewhich leads to such notable results, scientists reply with evidence that the majority ofvegetarians do not cite health reasons for their lifestyle, but make their choice basedon ethical commitment, environmental concerns or simply personal taste.
