Principles of Morality Reasoning

Consequentialist – locates morality in theconsequences of an act

Categorical – locates morality in certain duties and rights

THE ELEMENTS OF A CRIMINAL OFFENCE

“Actus non facit reum nisi mens sit rea”The act will not make a person guilty unless the mind is also guilty

Criminal Formula (by definition)• Actus Reus- criminal act occurred- “wrongful deed”

• Mens Rea- criminal intention (but not necessarily intent)- “guilty mind”

• In court it is the Crown (represents society) that must prove, beyond a reasonable doubt that the accused did the act as well as had some type of criminal intention

• There are 9 types of criminal intention- let’s see them!
