MINUTES OF MEETING OF MANAGERS OF BUFFALO CREEK WATERSHED DISTRICT

The Managers of Buffalo Creek Watershed District met on the 25th day of July, 2017 at

8:00 p.m. at its regular meeting place in Suite 103, Glencoe City Center, 1107 11th Street E., Glencoe, MN, for its regular monthly business meeting.

The following managers were present: Donald Belter Larry Phillips Matt Melberg Larry Kramer Corey Henke

Also attending the meeting was: John Kolb, Attorney Chuck Eberhard, Consultant Doug Krueger, McLeod Cnty. Comm’r. Ken Schiroo Lyle Grenke Leon Lidberg Al Robek

President Belter called the meeting to order and announced the first order of business was the consideration of minutes of the regular meeting of the Board of Managers held on June 27, 2017. A motion was made by Manager Kramer, and seconded by Manager Henke, to approve the minutes from the previous meeting. After discussion, and by unanimous vote, the Board of Managers approved the corrected minutes of the meeting held on June 27, 2017.

President Belter called upon Manager Phillips for the Treasurer’s report. Manager Phillips presented a written report which outlined income and expenses as follows: Beginning Balance: $77,739.74 Income: Interest Earned – June 2017 $9.26 Deposit from Renville County $109,166.57 Deposit from Renville County $1,452.31 Deposit from Sibley County $4,801.80 Deposit from McLeod County $96,962.55 Deposit from Kandiyohi County $4,348.29 Deposit from McLeod County – Bond, Marsh Creek Project

Upon motion of Manager Henke, which was seconded by Manager Kramer by unanimous

vote, the Board of Managers approved the Treasurer’s report.

President Belter next called for the bills that had been presented to the Board since the last meeting. Manager Phillips reported as follows:

Upon motion from Manager Melberg, seconded by Manager Kramer by unanimous vote,

the Board of Managers approved the above bills for payment.

President Belter called any new permits:

Eberhard presented proposed permit 2017-14. The permit is for the installation of a replacement culvert under 835th Avenue, Preston Lake Township on CD 133. Motion by Manager Melberg to consider, seconded by Manager Kramer, motion passed. After discussion and recommendation by Eberhard, motion by Manager Melberg to approve, seconded by Manager Kramer, passed.

President Belter next called for discussion old business:

Kolb explained the Judge’s decision in the JD 15 appeal, dismissing the appeal. Kolb recommended proceeding with final plans and specifications in order to advertise for bids by the

end of August. Eberhard presented an update from Chris Otterness on the plans and specifications.

The Managers discussed the status of Ditch 33 improvement construction. Manager Phillips presented a list of concerns from the contractor. Bolton & Menk has provided a letter to the contractor addressing payment retainage.

The Managers discussed the status of the Marsh Project. Eberhard presented an update from Chris Otterness. Eberhard reported that the pond construction will begin in the coming weeks.

The Managers discussed the status of the Glencoe East and Central Project. Houston Engineering has scheduled a meeting with the City of Glencoe to provide the Phase 1 report. The meeting is scheduled for August 7, 2017.

The Managers discussed the proposed Bank Stabilization work on Buffalo Creek.

Neal Lidberg Application, permit 2017-13. Application to install a 10” tile. Motion by Manager Phillips to remove from table, seconded by Manager Kramer, motion passed. Eberhard presented the permit and discussed the recommended conditions. Eberhard recommended approval with conditions. Motion by Manager Kramer to approve permit 2017-13, seconded by Manager Melberg, motion passed, Manager Henke voting no.

The Managers discussed the matter of trees in Buffalo Creek. Manager Phillips provided an update on removal of the trees.

The Managers submitted its election of Buffer Law enforcement. McLeod, Sibley and Renville Counties have also elected jurisdiction.

President Belter next called new business.

Manager Melberg raised the issue of the proposed revised rules. There will be a meeting at Dunn Brothers to discuss and make revisions.

Manager Phillips presented the financial report for approval. Motion by Manager Melberg, seconded by Manager Kramer, to authorize the President to sign and transmit the report, motion passed.

Ron Otto from the Sibley County Soil and Water Conservation District appeared and presented the SWCD identification of “other waters” under the buffer law. Kolb explained the buffer law requirements related to other waters.

The Managers addressed the proposed budget for 2018. Manager Phillips presented and explained the 2017 budget and current expenditures and made recommendations for budget items for 2018. Managers determined a preliminary budget amount to be derived from ad valorem tax as $194,500 for general fund (103D.905, subd. 3). For the Marsh Project (basic water management project) $210,000 (103D.905, subd. 9). Motion by Manager Phillips to set the

preliminary budget and advertise the budget hearing, seconded by Manager Henke, motion passed.

There being no further business to come before the Board, upon motion duly made, seconded and unanimously carried, the Board of Managers adjourned the meeting until the next regular meeting of the Board of Managers on Tuesday, August 22, 2017 at 8:00 p.m. at its regular meeting place in Suite 103, Glencoe City Center, 1107 11th Street E., Glencoe, MN.
