Regulation of the Minister of Trade (Permendag)
Number 39/M-DAG/PER/10/2010:
Deregulation Finished Goods Importation
Jakarta, October 7, 2010 - Ministry of Trade is committed
to continuously simplify import procedures without
forgetting the import duties in the management of
existing, on October 4, 2010 the Ministry of Commerce
issued Regulation of the Minister of Trade (Permendag)
Number 39/M-DAG/PER/10/2010 on the Import of finished
goods by the Manufacturer.
Trade Ministerial Regulation was issued in order to
create a more conducive business climate, in order to
create certainty and encourage investment acceleration.
Also refer to Regulation of the Minister of Trade Number
45/M-DAG/PER/0/2009 on Import identification Number
(API), which states that a manufacturer who has the API-M
is allowed to import goods for yourself and / or to the
production process, but is not allowed for trade in or
transfer to another party.
"This is one form of deregulation of trade sectors," said
Acting. Director General of Foreign Trade Deddy Saleh in
Jakarta, today (7/10). "Our commitment is clear, as long
as it is to encourage the creation of a more conducive
business climate, so the trade sector more dynamic," he
added.
Based on these things, then in Regulation No. 39/2010 of
the Minister of Trade are governed the following
provisions:
a. Manufacturers can import goods in accordance with
industrial permit or other similar business license
issued by the competent technical authorities, to
encourage the development of its business;
b. To be able to import finished goods, manufacturers get
a determination from the Director General of Foreign
Trade on behalf of the Minister of Trade, by
attaching:
1) Copy of Industrial Business License or other
similar business license issued by the Head of
BKPM or agencies / offices in the authorities; and
2) Copy of API-P
c. Manufacturers who import finished goods, are required
to submit reports on the realization of finished goods
in writing to the Director of Imports of each quarter
in the case of imports realized or not realized
through http://inatrade.depdag.go.id;
d. Director of Imports make an assessment of compliance
(post audit) to the producers who import finished
goods, based on:
- Truth reports of import
- Conformity of goods imported by industrial business
licenses or other similar business license issued
by the competent technical authorities, and
- Compliance with the provisions of regulations in
the field of import;
e. Against manufacturers who violate the provisions of
this rule shall be liable to revocation of the
determination to do imports of finished goods.
Although the Regulation of the Minister of Trade was
established on October 4, 2010, but only later will
become effective on January 1, 2011.
