Will the Minister for Law and Justice be pleased to state:

(a) whether the Government and Law and Justice Commissionof Pakistan have taken notice that several persons who wereconvicted on different offences were exonerated by the highercourts after several years/decades;

(b) if the answer to part (a) above is in the affirmative,whether there is any proposal under consideration of theGovernment to investigate such convictions from lower courtsin order to identify lacunas at the part of executive andjudiciary to hold responsibles in such cases; and

(c) whether the Government is formulating outlines for bringingabout Judicial reforms for speedy, effective and time bounddelivery of justice alongwith transparency in judicial system

for litigants in order to ensure accountability at every stage;if so, the details thereof?

Minister for Law and Justice (Chudhary Mahmood Bashir Virk):(a) & (b) Ministry of Law and Justice performs Federal Government functionswith regard to Supreme Court, Supreme Judicial Council and High Courtsunder Rules of Business, 1973. None of its functions allows to take notice ofthe persons convicted on different offences and exonerated by the High Courtsafter several years/decades. Moreover, in view of the independence of theJudiciary no such data of these persons is available with Ministry of Law andJustice. However, the matter is being taken up with Ministry of Interior toexamine the situation and if required, to formulate any proposals to investigatesuch convictions from lower courts and exoneration from the higher courts asthe Ministry deal with Prosecution of cases.

(c) Dispensation of justice in the country is one of the top prioritiesof the present Government. The Prime Minister had constituted a Law ReformsCommittee for consideration, inter-alia, of the law reforms for provisions ofexpeditious and inexpensive justice to people. After extensive deliberationsby the Law Reforms Committee, Bills are finalized to help in reducing the timeinvolved in litigation, help to reduce burden on courts and streamline theprocedures for effective administration of justice. So far the following laws inthis regard have been made by the Parliament:–

(a) The Cost of Litigation Act, 2017 (XVII of 2017). Purpose is todiscourage frivolous litigation and unnecessary adjournments.Both Civil and Criminal cases have been covered. It would helpin curtailment of delays and speedy disposal of cases.

(b) The Explosive Substances (Amendment) Act, 2017 (XVI of2017). The procedure for trial and sanction of trial has beensimplified.

(c) The Alternate Dispute Resolution Act, 2017 (XX of 2017). ADRboth in civil and criminal (compoundable offences). The act willhelp in reducing the burden on Courts, reducing backlog andspeedy disposal of cases.

(d) The Land Acquisition (Amendment) Act, 2017 (XXIII of 2017).

(e) The Illegal Dispossession (Amendment) Act, 2017 (XXVIII of2017). Land grabbing is quite common and in some casesorganized groups are involved.

(f) The Criminal Law (Amendment) (Offences in the Name or on Pretextof Honor) Act, 2016 (XLIII of 2016).

(g) The Criminal Law (Amendment) (Offences relating to Rape) Act,2016 (XLIV of 2016).

(h) The Benami Transactions (Prohibition) Act, 2017.

(i) The Witness Protection, Security and Benefit Act, 2017 (Act No.XXI of 2017) providing for protection, security and benefits ofwitnesses to avoid delay in trial of offences due to security threats;

(j) The Constitution (Twenty-third Amendment) Act, 2017 (Act No.XII of 2017) relating to speedy trial of offences of terrorism, etc;

(k) The Pakistan Army (Amendment) Act, 2017 (Act No. XI of 2017)relating to speedy trial of offences of terrorism, etc;

(l) The Islamabad Subordinate Judiciary Service Tribunal Act, 2016(Act No. V of 2016) to speed up deciding cases of subordinatejudiciary through a special tribunal, for avoiding delay in such casesby the service tribunal;

(m) The Criminal Laws (Amendment) Act, 2016 (Act No. VI of 2016)providing for designation of separate Electricity Utilities Court fortrial of offences relating to electricity;

(n) The Gas (Theft Control and Recovery) Act, 2016 (Act No. XI of2016) providing for Gas Utility Courts for expeditious disposal ofcases;

(o) The Offences in Respect of Banks (Special Courts) (Amendment)Act, 2016. (Act No. XXII of 2016) providing for opportunity toprefer appeal against an order passed by Special Court (Offences inBanks); and.

The following Bills are pending legislation in the Parliament.

i. Evening Courts Bill, 2017

ii. The Juvenile Justice System Bill, 2017

A comprehensive review of the Pakistan Penal Code and CriminalProcedure Code was also undertaken by the Law Reforms Committee. Therecommendations have been sent to Interior Division for consultation withstakeholders and processing the legislation under the Government Rules of •Business, 1973.

A Bill “The Civilian Victims of Terrorism (Relief and Rehabilitation)Bill, 2017 providing for compensation to Civilian Victim of terrorism (to theextent of ICT) has also been prepared by the Law and Justice Division andhas been forwarded to the concerned Division for further processing.

The Code of Civil Procedure (Amendment) Bill, 2017 prepared bythe Law and Justice Division and approved by the Law Reforms Committee isalso in the pipeline.

32. *Mr. Junaid Akbar:

Will the Minister for Communications be pleased to state:

(a) whether there is any proposal under consideration of theGovernment to plant trees at both sides of Highways andMotorways in the country;

(b) if so, when it will be implemented; if not, the reasons thereof?

Minister for Communications (Hafiz Abdul Kareem): (a) It ispertinent to mention that as per NHA approved Policy plantation has beendeclared the integral part of road construction activates.

- A proposal for plantation of 122,877 plants (Approximately)including maintenance for two years has been processed onfollowing locations:-

(a) 3 Sections D.I. Khan Mughal Kot N-50.

(b) Median of Nowshera-Chitral Road

- Approximately 206,525 Nos. trees to be planted in Punjab onfollowing locations.

(a) N-55 from Kashmore to Dera Ghazi Khan.

(b) N-5 from Lahore to Rawalpindi.

- 70,350 plants will be planted in Sindh Region on the locationmentioned below

(a) Moro - Sakrand N-5.

(b) District Ghotki from Km 525 to 608 of N-5.

- Motorway M-4 (Pindi BhattianMultan section) the tree plantationschemes for five years in the ROW are under procurementprocess. Approximately 110,000 plants will be planted as perBOQ in spring plantation season 2018.

(b) Approximately after 06 months work will be commenced.

33. *Shaikh Rohale Asghar:

Will the Minister for Communications be pleased to state:

(a) whether it is a fact that metal speed breakers fixed onHighways of the country are dangerous for vehicles andtraffic accidents are occurring daily on said Highways dueto bursting of vehicles tyres;

(b) if so; the steps being taken by the Government in this regard?

Minister for Communications (Hafiz Abdul Kareem): (a) No. Thisis not a fact that metal speed breakers fixed on Highways of the country aredangerous for vehicles and traffic accidents are occurring daily on saidHighways due to bursting of vehicle tyres. The matter of fact is that the metalspeed breaker, termed technically as Cateyes are highway safety instrument.A road is designed in such a way that it is safe to commute on and its operations

are smooth and secure. For this purpose many road safety devices are usedfor road users for the sole purpose of highway safety. These devices includebut not limited to paint, sign boards (information/guide, regulatory & warningsigns), lane marking, reflectors, speed calming devices etc. In night, road usersare especially facilitated by reflective devices on roads including reflectors onkerb side and cat eyes in the pavement. These cat eyes are approved HighwaySafety item by all the major highway agencies all over the world. Its standardsare approved by American Society for Testing and Materials (ASTM) andworldwide recognition is imperative. Cat eyes are primarily installed for;

Guidance of drivers to warn them to be in their lanes

Speed calming purposes, where drivers notice the upcoming cateyes from some distance, so that they reduce their speed in timelymanner

Excellent guide for road users during fogy season as it delineatesthe road edge

Then, there are raised type studs which are used to regulate thetraffic, when priority of traffic has to be established for turningtraffic and oncoming traffic is discouraged to change the lane onsuch turning space. These raised studs are not installed on highspeed lanes. These raised type studs are used for regulationpurposes on National Highways only

In conclusion, These devices help saving many lives and therefore thisapprehension that these are dangerous for vehicles is unfounded and againstthe scientific evidence.

(b) These devices i.e. cateyes are good for highway safety purposeand these are used all over the world since 1930’s without any reported accidentdue to these. So there is no action is warranted from Government side.

(a) the names of international conventions regarding theprotection of rights of children signed/ratified by Pakistan sofar alongwith the details thereof; and

Minister for Human Rights (Mr. Mumtaz Ahmed Tarar): (a) TheGovernment of Pakistan has ratified various international conventions forprotection of the rights of the child. The detail is as under:

United Nations Convention on the Rights of the Child (UNCRC)ratified in 1990.

SAARC Convention on Preventing, Combating Trafficking inWomen and Children for Prostitution, 2002

SAARC Convention on Regional Arrangements for the Promotionof Child Welfare in South Asia.

(b) The aforesaid international conventions have been incorporatedin the following national and provincial legislation:

Minister for Communications (Hafiz Abdul Kareem): (a) Thedetail of trauma centers on motorways and highways are as under:—

(b) Yes, these trauma centers are insufficient and there is a dire needto establish Medical and Trauma Centers alongwith side the Highways toprovide prompt medical facilities to the distressed road users.

40. *Malik Muhammad Amir Dogar:

Will the Minister for Science and Technology be pleased to state:

(a) whether it is a fact that number of laboratories for checkingthe sample of clean drinking water have been established inthe country by the Pakistan Council of Research in WaterResources; if so, the total number thereof;

(b) the other facilities available in said laboratories at present;

(c) the performance made by said laboratories during the tenureof the present Government; and

(d) whether it is also a fact that salaries have not been paid toemployees working in said laboratories for the last two years;if so, the reasons thereof?

Minister for Science and Technology (Rana Tanveer Hussain):(a) Yes. Pakistan Council of Research in Water Resources (PCRWR) haveestablished 24 water quality laboratories in the country including Gilgit Baltistanand AJK (list at Annexure-I).

(b) Out of 24 laboratories the National Water Quality LaboratoryIslamabad have analytical facilities for Physico-Chemical, Waste Water, TraceMetals, Microbiological parameters and Organic analysis of Persistent OrganicPollutants (POPS) in water and waste water and Six Regional Laboratories,(Lahore, Bahawalpur, Peshawar, Quetta, Karachi and TandoJam) haveanalytical facilities for Physico-Chemical analysis, Wastewater, Trace Metalsand Microbiological parameters in water and Wastewater whereas EighteenDistrict Laboratories have analytical facilities for Physico-Chemical.Wastewater, Microbiological parameters in water and waste water(Annexure-II ).

(c) Total number of water quality samples analyzed in the laboratoriesof PCRWR during the tenure, of the present Government are 80686. Serviceswere provided to clients from PHEDs, WASA, Local Govt. Industries, NG0s,ING0s, general public and research students from universities(Annexure-III).

(d) Regular Employees working in these laboratories are being paidsalaries regularly.

41. *Mr. Muhammad Muzammil Qureshi:

Will the Minister for Energy be pleased to state:

(a) whether there is any mechanism to obtain funds from theGovernment for alignment of electricity lines/wires; if so, thedetails thereof;

(b) whether there is also any mechanism to use funds by theGovernment itself for alignment of electricity lines and wires;if so, the details thereof; and

(c) the reasons not to reserve funds for the alignment of electricitywires/lines by the Government itself particularly to align thoseelectricity wires/lines which have been installed contrary toElectricity Act, 1910?

Minister for Power Division (Sardar Awais Ahmad Khan Leghari):(a) At present there is no mechanism to obtain funds from the Government foralignment of electricity lines. Whenever any Government department such asNHA, C & W, City Governments requires re-alignment of electricity lines orremoval of line due to new schemes, then an estimate is prepared according torequirement of the Government department/ sponsor and demand notice forthe work is served to that sponsor/ Government department. On receipt ofrequisite funds, the work is carried accordingly executed.

(b) There is no mechanism to use funds by the Government itself foralignment of electricity lines/wires.

(c) All out efforts are carefully made to lay electricity lines inaccordance with Electricity Act, 1910, so no funds are reserved for re-alignment.

(a) the total number of male and female children who becamevictim of abuse in the country during the period from 01-01-2013 to 23-01-2018;

(b) the total number of accused persons arrested during the saidperiod; and

(c) the total number of persons to whom punishments havebeen awarded during the said period?

Minister for Human Rights (Mr. Mumtaz Ahmad Tarar): (a) Inthe wake of 18th Constitutional Amendment, the subject of minors/ childrenhas been transferred to the Provinces. Accordingly, the Provincial HomeDepartments were requested to furnish the requisite information, but theirresponse is still awaited. These devices includebut not limited to paint, sign boards (information/guide, regulatory & warningsigns), lane marking, reflectors, speed calming devices etc. In night, road usersare especially facilitated by reflective devices on roads including reflectors onkerb side and cat eyes in the pavement. These cat eyes are approved HighwaySafety item by all the major highway agencies all over the world. Its standardsare approved by American Society for Testing and Materials (ASTM) andworldwide recognition is imperative. Cat eyes are primarily installed for;

Guidance of drivers to warn them to be in their lanes

Speed calming purposes, where drivers notice the upcoming cateyes from some distance, so that they reduce their speed in timelymanner

Excellent guide for road users during fogy season as it delineatesthe road edges

In conclusion, These devices help saving many lives and therefore thisapprehension that these are dangerous for vehicles is unfounded and againstthe scientific evidence.

(b) These devices i.e. cateyes are good for highway safety purposeand these are used all over the world since 1930’s without any reported accidentdue to these. So there is no action is warranted from Government side.

Minister for Power Division (Sardar Awais Ahmad Khan Leghari):(a) Prime reasons of pilferage of electricity in the country include feeble law &order situation and attacks on employees/ offices of DISCOs, lack of supportfrom law enforcing agencies in providing security to staff and lodging FIRsagainst culprits, pitiable socio economic condition of people residing in farflung rural areas mostly under jurisdiction of SEPCO, HESCO, QESCO,PESCO & MEPCO etc.,

Apart from this bare LT lines in villages/ narrow streets provides easyaccess for hooking up (Kundas), similarly, the high tariff rate and inclusion ofvarious taxes in electricity bill escalates electricity price from reach of commonman are also some basic reasons of pilferage of electricity.

(c) No, it is not a fact that all employees of DISCOs are involved inpilferage of electricity. Minister of State for Petroleum Division (Mr. Jam Kamal Khan):(a) SNGPL has reported that the cost of project (6 inch dia X 2.3 KM MSpipeline) to overcome the low pressure problem of Gujjar Garhi is Rs. 14.1Million approximately. Later on as per request of the union council membersand honorable MNA of NA 327, the pipeline was rerouted and its length wasextended to 2.4 Kms, which was also approved in Aug.-16.

(b) Laying of above pipeline has been completed and shall becommissioned during the current month i.e. Feb.-2018 and low pressureproblem shall be resolved.

(c) No job number is pending regarding addressing of low pressureissue of Gujjar Garhi. However 13 Nos. development job Nos. of 88.98KMs of various dia pipeline with a cost of Rs.177.538 Million for NA-327have been processed. 5 Job Nos. have been approved while remaining 8 JobNos. are in process.

(d) Regional Manager (Mardan) has expedited the process of layingof the said operational phase (6 inch X 2.4 Kms) for addressing the lowpressure issue of the area. Any delay in the project cannot be attributed to himas NOCs were pending with various departments. Similarly, rerouting ofpipeline and budget constraints were the reasons for the delay.

(a) whether it is a fact that  there is security threat to the employeesof the Pakistan Aeronautical Complex, Kamra due to non-availability of residential accommodation for them; and

Minister for Defence Production (Rana Tanveer Hussain): (a)The security threat to the installations and personnel of GovernmentOrganizations exists in the prevailing security environment. PakistanAeronautical Complex (PAC) Karma is not an exception. However, employeesare not under threat due to non-availability of residential accommodation butbeing employees of PAC.

(b) Generally speaking, shortage of accommodation not only existsin PAC Kamra but also in other defence establishments including Army, Navy& PAF etc.

(c) Notwithstanding above, PAC Kamra (and other establishmentsas well) do plan every year construction of additional residentialaccommodation, some steps being taken by PAC Kamra are:-

(i) 115 Flats / Houses are under construction for BPS-17 and above.

(ii) 372 Qtrs. are under construction for BPS-16 and below inFY-2016-17 & 2017-18.

(iii) The construction of accommodation is planned on yearly basisaccording to DP-1 of various projects/ subject to availability offunds.

Minister for Power Division (Sardar Awais Ahmad Khan Leghari):It is a fact that the gas-based power stations contributed economical energyduring the period from 1-1-2012 to 31-12-2016.

It is not a fact that their units were put on standby mode due to whichthe energy was procured by CPPA-G from oil based expensive power stations,as all the dispatch instruction to power plants are given strictly in accordancewith Economic Merit Order (EMO) and no discrimination is made in this regard.

The Allocation/ Diversion of Gas/RLNG does not fall under the scopeof NPCC/NTDC. Oil-Based Power Plants, being costly are dispatched asper merit in order to meet system demand due to non-availability of gas forsome gas based power stations.

54. *Ms. Shamas Un Nisa:

Will the Minister for Defence be pleased to state the year-wisedetails of Pakistanis injured/killed during the last five years tilldate due to unprovoked firing of Indian forces at Line of Control/working boundaries?

Minister for Defence (Eng. Khurram Dastgir Khan): a. A total of66 x civilians embraced shahadat and 228 x civilians suffered injuries due toCease Fire Violations (CFVs) committed by Indian troops since 1 Jan. 2013.

b. A total of 1394 x Ceasefire Violations along Line of Control havebeen committed by Indian Army since 1 January, 2017.

c. Indian Army is carrying out continuous deliberate targeting ofcivilians along Line of Control (LoC). Pakistan Army is responding in a befittingmanner and is taking all necessary safeguards to protect the life and propertyof our citizens.

Minister of State for Petroleum Division (Mr. Jam Kamal Khan):(a) Per liter rate at which petroleum products (Petrol, Diesel, Kerosene oiland Light Diesel Oil (LDO) are purchased and sold, effective from 1st February2018 attached at Annex-I.

(b) Government does not earn profit on petroleum products, butimposes taxes to meet country’s budgetary revenue requirements as per detailsattached at Annex-I. The taxes are revised upward/ downward keeping inview to maintain the prices in the country at affordable limit of generalconsumers as well as to meet country’s budgetary targets.

Further, oil prices in Pakistan are at reasonable limit comparing to ourneighboring countries as per details attached at Annex-II.

(c) The company further reported that the streets of said area have beenproperly back filled after digging. However, completion of PCC patchwork/reinstatement of some sections are required. Apparently some slackness has beennoticed on the part of the contractor and explanation letter to this effect has beenissued and necessary action shall also be taken as per policy of the Company.

(d) Rehabilitation work is almost complete and reinstatement work ofsaid streets shall be completed within a week.

(a) whether it is a fact that the pressure per square inch for Nowsherahas dropped by 50% causing extreme public inconvenience;

Minister of State for Petroleum Division (Mr. Jam Kamal Khan):(a) SNGPL is a gas distribution Company, supplying gas to more than 5.78 millionconsumers of domestic, commercial & industrial categories. Gas is supplied to theconsumers on their door step through an integrated distribution network. Allcategories of consumers are fed through same distribution network.

Lines are laid for all categories of consumers not for domestic only.However, adequate pressures and volume of gas is made available in network sothat requirement of all categories is met to their entire satisfaction.

To overcome the overloading of the said transformer, an ELR proposalwas approved but due to right of way problem the work could not be excecuted.

(b) The said 100-KVA over loaded transformer has already beenaugmented with 200-KVA transformer on 14-12-2017. Therefore, the issue standsresolved \and no action is required.

(c) Appropriate voltage is now being supplied in the said area.

(a) whether it is a fact that a Security Vehicle (Toyota Hilux) of SkyExchange Private Company Limited carrying foreign currenciesamounting to PK Rs. 33,000000/- was looted on 08-01-2018 at06:45 PM on M-I (Motorway) near old Toll Plaza, Islamabad;

(b) whether cameras installed on said Toll Plazas were functionalon said date; if so, whether any footage has been captured;

(c) if the answer to part (a) and (b) above are in the affirmative,whether any action has been taken against responsibles; if so,the details; if not, the reasons thereof?

(b) No, it is not a fact that 200 KV transformer has not been installed inthe said area so far. In a fact a 200 KVA transformer already exists in the saidarea and apart from the said 200 KVA transformer, no proposal for installation ofadditional 200 KVA transformer was/is under consideration.

(c) Previously a proposal was prepared for installation of additional 100KVA transformer in addition to the existing 200. KVA transformer which wasturned down due to not being technically feasible.

Will the Minister for Energy be pleased to state whether it is a factthat the un-scheduled loadshedding of electricity is being made invillage Shahother, UC Garlat, Teshil Balakot, District Mansehra sincelong; if so, the reasons thereof?

 

Minister for Power Division (Sardar Awais Ahmed Khan Leghari):(a) No, it is not a fact that unscheduled load management is being carried out at11-KV Gharri Habibullah Feeder supplying power to village Shahoter, TehsilBalakot.

It is apprised that according to Aggregate Technical and Commercial(AT&C) Loss, there is “NO” load management on the said feeder. However,some times the power supply may disrupt due to fault in the system.

Will the Minister for Communications be pleased to state the lengthof section of Burhan to Havelian Motorway which has been completedso far?

 

Minister for Communications (Hafiz Abdul Kareem): First twopackages alongwith a portion of package-III of Hassanabdal Havelian Motorwayhave been completed and operationalized for traffic on 27th December, 2017.
