It is common practice for many gemstones to be treated by a variety of methods to enhance their appearance andthe international jewellery trade has generally accepted these methods. Although heat enhancement of colour isusually permanent, in some cases this could affect the durability of a gemstone. Oiled gemstones may need re-oilingafter a certain period. If no gemological report is published in the catalogue, prospective buyers should assume thatthe gemstones or pearls may have been enhanced by some method. Buyers should be away that Matthew BartonLtd’s saleroom estimates assume that gemstones or pearls may have been subjected to such treatments.

Estimates are published as a guide only and are subject to review. The actual hammer price of a lot may well behigher or lower than the range of figures given and there are no fixed “starting prices”.

A Buyer’s premium of 20% is applicable to all lots in this sale. Excepting lots sold under Temporary Import rules,which are marked with the symbol ‡ in the printed catalogue (see below), the Buyer’s Premium is subject to VAT atthe standard rate (currently 20%). Unless otherwise indicated lots are offered for sale under the auctioneer's marginscheme and VAT on the Buyer’s Premium is payable by all buyers.

Lots marked with the symbol ‡ have been imported from outside the European Union (EU) to be sold at auction underTemporary Import Rules. When released to buyers within the EU, including the UK, the buyer will become the importerand must pay VAT at the rate of 5% on the hammer price. 13A RARE COALPORT ORNITHOLOGICAL BLUEGROUND VASE AND COVER, CIRCA 1870of tripartite shield shape with domed cover, paintedby John Randall with three panels of birds of prey onbranches, divided by vertical pilasters enriched withdiamond pattern straps, the conforming tripartite footgilt with diaper and trellis decoration, gilt ampersandmark to cover44cm height, knob glued, hairline crack to cover andto rim(2)

John Randall (1810-1890) was one of the best knownCoalport artists and a great local celebrity. He wasapprenticed to his uncle Thomas Martin Randall andpainted at the Rockingham factory before joiningCoalport in 1835. His earlier work tended to featureexotic birds, but in the 1860s he began to paint morenaturalistic studies, often birds of prey in their naturalsurroundings. In addition to his work at Coalport, hewas a botanist, geologist, published local historianand journalist, starting a local newspaper, as well asserving as a postmaster and a borough councillor.

The figures and mottos appear to refer to the Convention ofAltranstädt held on the 1st September 1707. This agreement gavereligious freedom to Protestants in Silesia. For medalscommemorating this convention and bearing many of the samemottos, see Victoria and Albert Museum, collections nos. 1470-1882 and 1464-1882. For a similar cup (with cover) engraved withthe same mottos and figures, see Auktionshaus Dr Fischer,Heilbronn, 17th March 2006, lot 127.

Lots 17-44: part of the the Kaars Sijpesteijn Family Collection of Chinese blue and white porcelain.

The sellers are direct descendants of the Kaars Sijpesteijn family, who owned and managed various companies in andaround Krommenie (North Holland). The family business stretches back to the 17th century, when they started out as“rolreders“, a very early form of collective/ corporate entity, revolving around the sailcloth industry in the Zaan area ofHolland. At the time the Dutch sailcloth industry in Krommenie was not only very well known (the sailcloth was verywhite and extremely tough), but also had a major economic impact on the region. The family’s products were used in thesailmaking industry and they used them for their own ships as well as others, including prominently the Dutch East IndiaCompany. Many of the raw materials were brought in from the East and the family’s trading connections with the Orientwere strong for many years. It is hardly surprising the family amassed a large collection of Chinese blue and white wares;the collection remained together until after World War II, when it was split between family members.

101A FLEMISH LEAD ROUNDEL OF ‘THE DEMOLITION OF THECITADEL OF ANTWERP BY THE CITIZENS’, ATTRIBUTED TOJACQUES JONGHELINCK (1530-1606), ANTWERP, CIRCA 1580centred by the Citadel portico and showing in the background theremains of the fortifications being dismantled, with small maleand female figures clearing rubble behind a cohort of volunteersin the foreground, shovels to their shoulders, marching back tothe city led by a drummer and a smaller group to the lowerforeground armed with arquebuses, within a laurel leaf border18.5cm diameter

This roundel is one from a set of six depicting events surroundingthe ‘Spanish Fury’ of 1576. The ‘Tericos’, mercenaries in theservice of the Spanish authorities, had not been paid, followingSpain’s declaration of bankruptcy. Their consequent rampagethrough Antwerp in November saw three days of horror: themassacre of over 2500 citizens as the Tericos looted and burntcountless buildings, including the magnificent Town Hall. InAugust the following year a Netherlandish coalition overthrew theSpanish troops in the Citadel and it was subsequently demolishedby the citizenry, as shown in the present roundel.

Five of the subjects, including this scene, are derived fromengravings by the Wierix brothers after drawings by Martin de Vos(1532-1603). Four of the drawings can be found in the Ashmoleanat Oxford and one at the Metropolitan in New York. The fine detailand modelling of the figures on this series of circular plaquetteshas led to the attribution to Jacques Jonghelinck, the medalist andsculptor who was Master of the Mint at this period.

Prince William, Duke of Cumberland (1721-1765), was ayounger son of George II. Seen from today’s perspective, hisrole in the brutal suppression of the Jacobite Rebellionperhaps justly earned him the nickname ‘ButcherCumberland’, although at the time his prompt action instopping the war meant he was hugely popular with most ofthe Scottish population, as well as the rest of country, fordelivering them so swiftly from the Jacobite menace.Following an unsuccessful campaign during the Seven YearsWar and the humiliating Convention of Klosterzeven in 1757,he resigned from all his military and public offices. Hereturned to some greater favour under George III, but hishealth was deteriorating and he died at just 44 years old in1765.

This trio of busts, centred upon the ‘Iron Lady’ and flanked byReagan and Gorbachev, forms a group which is iconic of the1980s. It is one of only three sets made: one set was presented toMrs Thatcher in 1989.

The Polish-born sculptor Michal Golabek was born in Poznan in1949. Between 1970 and 1975 he studied at the Poznan Academyof Fine Arts where he received his diploma in Professor OlgrierdTruszynski’s atelier of sculpture. He has exhibited extensively andhis artistry has been acknowledged by a number of awards,including the Gold Medal, 5th Winter Salon in Warsaw (1989) andthe Bronze Medal, The Survey of Polish Sculpture of the Decade(1989). Among Golabek’s larger work is an imposing figureentitled ‘Jesus’ and an abstract wood and bronze piece entitled‘Windy everlasting.’ He now lives and works in Chicago.

This sale caused agreat deal of controversy in Israel; consequently a second trancheof Ben-Gurion property, consigned by the same descendant to thesame auction house, was sold anonymously. This tea kettle andteapot appeared in this later sale, Shorashim, Tel Aviv, 10thOctober 2011, lot 69 and although verbal assurances were givenas to the Ben-Gurion provenance, the problems following the firstsale meant documentation was not provided.

He married WinifredGrace, daughter of Edmund Hegan Kennard and his wife, Agnes(née Hegan), on 30th April 1898 at Christ Church, Mayfair, London.He died on 18th March 1950 at age 83. Sir Ralph, who waseducated at Wellington College, succeeded to the title upon thedeath of his father on 31st December 1888. A captain in the ScotsGuards and afterwards a captain in the Royal Guards ReserveRegiment, he was sometime Deputy Lieutenant of Suffolk before,in 1905, being appointed as High Sheriff of Suffolk.

The inscription reads: To Charles Brutton Esqr. by theSubscribers to the Fund for the reception of the RoyalAgricultural Society at Exeter in testimony of hisservices as their Honorary Secretary A.D. 1850.

The Royal Agricultural Society of England held theirtwelfth annual meeting and exhibition during July 1850at Exeter. Apparently the city celebrated the event withenthusiasm, erecting at least five decorative archesspanning the streets.

Charles Brutton (1791-1854) was a prominent Exeterlawyer, serving as the city’s mayor in 1846 andremembered as the owner at the time of the ExeterClock, shown at the 1851 Great Exhibition. The ExeterClock, finished in the 1730s, was said to have takenJacob Lovelace thirty years to build; measuring 10 feetby 5 feet, it was a Baroque extravaganza displaying apanoply of mechanics and automata.

Provenance: John Trotter (1757-1833) of Dyrham Park,Hertfordshire. Thence by direct family descent.

John Trotter amassed a considerable fortune as an armycontractor. “After the peace of 1783 he urged on thegovernment the absurdity and extravagance of sellingoff all the military stores, only to replace them by newpurchases on the occasion of any alarm, and offered towarehouse them in his own premises. This was agreedin 1787. On the outbreak of the French war the businessincreased enormously, and by 1807 he had established109 depots, containing supplies insured for 600,000. Thestorekeepers were all appointed and paid by him; therewas no government inspection, and apparently nogovernment audit. The agreement was that he was paidthe cost of the stores, plus a percentage to coverexpenses and profit. In the hands of an honest andcapable man the system worked efficiently, but it wasfelt to be improper to leave the country dependent onone man or to give one man such vast patronage. In1807 Sir James Pulteney, then secretary for war,established the office of storekeeper-general, givingTrotter the first nomination to the post and taking intoservice all his employees. In 1815 Trotter establishedthe Soho bazaar between Soho Square and OxfordStreet. On the other hand Marsh was agoldsmith of Cornhill so therefore much more likely to havebeen a retailer.

Premium and Buyer’s Expenses; “Reserve Price” (where applicable) is the minimum Hammer

Price at which the Seller has agreed to sell the lot.

The Buyer’s Premium, Buyer’s Expenses and Hammer Priceare subject to VAT, where applicable.

3. Examination of Lots (a) MBL’s knowledge of lots is partly dependent on information

provided by the Seller and MBL is unable to exercise exhaustivedue diligence on each lot. Each lot is available for examinationbefore sale. Bidders are responsible for carrying outexaminations and research before sale to satisfy themselvesover the condition of lots and accuracy of descriptions.

(b) All oral and/or written information provided to Bidders relatingto lots, including descriptions in the catalogue, conditionreports or elsewhere are statements of MBL’s opinion and notrepresentations of fact. Estimates may not be relied on as aprediction of the selling price or value of the lot and may berevised from time to time at MBL’s absolute discretion.

4. Exclusions and limitations of liability to Buyers (a) MBL shall refund the Purchase Price to the Buyer in

circumstances where it deems that the lot is a counterfeit,subject to the terms of MBL’s Authenticity Guarantee.

(b) Subject to Condition 4(a), neither MBL nor the Seller:- (i) is liable for any errors or omissions in any oral or written

information provided to Bidders by MBL, whether negligentor otherwise;

(ii) gives any guarantee or warranty to Bidders and any impliedwarranties and conditions are excluded (save in so far assuch obligations can not be excluded by English law), otherthan the express warranties given by the Seller to the Buyer(for which the Seller is solely responsible) under theConditions of Business for Sellers;

(iii) accepts responsibility to Bidders for acts or omissions(whether negligent or otherwise) by MBL in connectionwith the conduct of auctions or for any matter relating tothe sale of any lot.

(c) Without prejudice to Condition 4(b), any claim against MBLand/or the Seller by a Bidder is limited to the Purchase Price forthe relevant lot. Neither MBL nor the Seller shall be liable forany indirect or consequential losses.

(d) Nothing in Condition 4 shall exclude or limit the liability ofMBL or the Seller for death or personal injury caused by thenegligent acts or omissions of MBL or the Seller.

5. Bidding at Auction (a) MBL has absolute discretion to refuse admission to the auction.

Before sale, Bidders must complete a Registration Form andsupply such information and references as MBL requires.Bidders are personally liable for their bid and are jointly andseverally liable with their principal, if bidding as agent (in whichcase MBL’s prior and express consent must be obtained).

(b) MBL advises Bidders to attend the auction, but MBL willendeavour to execute absentee written bids provided thatthey are, in MBL’s opinion, received in sufficient time and inlegible form.

(c) When available, written and telephone bidding is offered as afree service at the Bidder’s risk and subject to MBL’s othercommitments; MBL is therefore not liable for failure to executesuch bids. Telephone bidding may be recorded.

6. Import, Export and Copyright Restrictions MBL and the Seller make no representations or warranties as to

whether any lot is subject to import, export or copyright restrictions.It is the Buyer’s sole responsibility to obtain any copyright clearanceor any necessary import, export or other licence required by law,including licenses required under the Convention on theInternational Trade in Endangered Species (CITES).

7. Conduct of the Auction (a) The auctioneer has discretion to refuse bids, withdraw or re-

offer lots for sale (including after the fall of the hammer) if (s)hebelieves that there may be an error or dispute, and may alsotake such other action as (s)he reasonably deems necessary.

(b) The auctioneer will commence and advance the bidding insuch increments as (s)he considers appropriate and is entitledto place bids on the Seller’s behalf up to the Reserve Price forthe lot, where applicable.

(c) Subject to Condition 7(a), the contract between the Buyer andthe Seller is concluded on the striking of the auctioneer’shammer.

(d) Any post-auction sale of lots shall incorporate theseConditions of Business.

8. Payment and Collection (a) Unless otherwise agreed in advance, payment of the Purchase

Price is due in pounds sterling immediately after the auction(the “Payment Date”).

(b) Title in a lot will not pass to the Buyer until MBL has receivedthe Purchase Price in cleared funds. MBL will generally notrelease a lot to a Buyer before payment. Earlier release shallnot affect passing of title or the Buyer’s obligation to pay thePurchase Price, as above.

(c) The refusal of any licence or permit required by law, asoutlined in Condition 6, shall not affect the Buyer’s obligationto pay for the lot, as per Condition 8(a).

(d) The buyer must arrange collection of lots within 10 workingdays of the auction. Purchased lots are at the Buyers risk fromthe earlier of (i) collection or (ii) 10 working days after theauction. Until risk passes, MBL will compensate the Buyer for any loss or damage to the lot up to a maximum of thePurchase Price actually paid by the Buyer. MBL’s assumption ofrisk is subjected to the exclusions detailed in Condition 5(d) ofthe Conditions of Business Sellers

(e) All packing and handling of lots is at the Buyer’s risk. MBL will not be liable for any acts or omissions of third partypackers or shippers.

9. Remedies for non-payment Without prejudice to any rights that the Seller may have, if the

Buyer without prior agreement fails to make payment for the lotwithin 5 working days of the auction, MBL may in its solediscretion exercise 1 or more of the following remedies:-

(a) store the lot at its premises or elsewhere at the Buyer’s solerisk and expense;

(b) Cancel the sale of the lot; (c) Set off any amounts owed to the Buyer by MBL against any

amounts owed to MBL by the Buyer for the lot; (d) Reject future bids from the Buyer; (e) Charge interest at 4% per annum above HSBC Bank Plc base

Rate from the Payment Date to the date that the Purchase Priceis received in cleared funds;

(f) Re-sell the lot by auction or privately, with estimates andreserves at MBL’s discretion, in which case the Buyer will beliable for any shortfall between the original Purchase Price andthe amount achieved on re-sale, including all costs incurred insuch re-sale;

(g) Exercise a lien over any Buyer’s Property in MBL’s possession,applying the sale proceeds to any amounts owed by the Buyerto MBL. MBL shall give the Buyer 14 days written notice beforeexercising such lien;

(h) Commence legal proceedings to recover the Purchase Price forthe lot, plus interest and legal costs;

(i) Disclose the Buyer’s details to the Seller to enable the Seller tocommence legal proceedings.

10. Failure to collect purchases (a) If the Buyer pays the Purchase Price but does not collect the lot

within 20 working days of the auction, the lot will be stored atthe buyer’s expense and risk at MBL’s premises or inindependent storage.

(b) If a lot is paid for but uncollected within 6 months of theauction, following 60 days written notice to the buyer, MBL willre-sell the lot by auction or privately, with estimates andreserves at MBL’s discretion. The sale proceeds, less all MBL’scosts, will be forfeited unless collected by the Buyer within 2years of the original auction.

11. Data Protection (a) MBL will use information supplied by bidders or otherwise

obtained lawfully by MBL for the provision of auction relatedservices, client administration, marketing and as otherwiserequired by law.

(b) By agreeing to these Conditions of Business, the Bidder agreesto the processing of their personal information and to thedisclosure of such information to third parties worldwide forthe purpose outlined in Condition 11(a) and to Sellers as perCondition 9(i)

12. Miscellaneous (a) All images of lots, catalogue descriptions and all other

materials produced by MBL are the copyright of MBL. (b) These Conditions of Business are not assignable by any Buyer

without MBL’s prior consent, but are binding on Bidders’successors, assignees and representatives.

(c) The materials listed in Condition 1(a) set out the entireagreement between the parties.

(d) If any part of these Conditions of Business be heldunenforceable, the remaining parts shall remain in full forceand effect.

(e) These Conditions of Business shall be interpreted inaccordance with English Law, under the exclusive jurisdictionof the English Courts, in favour of MBL.

Matthew Barton Ltd’s Authenticity Guarantee

If Matthew Barton Ltd sells an item of Property which is latershown to be a “counterfeit”, subject to the terms below MatthewBarton Ltd. will rescind the sale and return the Buyer the totalamount paid by the Buyer to Matthew Barton Ltd. for thatProperty, up to a maximum of the Purchase Price.

The guarantee lasts for one (1) year after the date of the relevantauction, is for the benefit of the Buyer only and is nontransferable.

“Counterfeit” means an item of Property that in Matthew Barton Ltd’sreasonable opinion is an imitation created with the intent to deceiveover the authorship, origin, date, age, period, culture or source, wherethe correct description of such matters is not included in the cataloguedescription for the Property.

Property shall not be considered Counterfeit solely because of anydamage and/or restoration and/or modification work (including, butnot limited to, recolouring, tooling or repatinating).

Please note that this guarantee does not apply if either:- (i) the catalogue description was in accordance with the generally

accepted opinions of scholars and experts at the date of thesale, or the catalogue description indicated that there was aconflict of such opinions;

(i) the only method of establishing at the date of the sale that theitem was a Counterfeit would have been by means of processesnot then generally available or accepted, unreasonablyexpensive or impractical; or likely to have caused damage to orloss in value to the Property (in Matthew Barton Ltd’sreasonable opinion); or

(i) there has been no material loss in value of the Property from itsvalue had it accorded with its catalogue description.

To claim under this guarantee the Buyer must:- (i) notify Matthew Barton Ltd in writing within one (1) month of

receiving any information that causes the Buyer to question theauthenticity or attribution of the Property, specifying the lotnumber, date of the auction at which it was purchased and thereasons why it is believed to be Counterfeit; and

(i) return the Property to Matthew Barton Ltd in the samecondition as at the date of sale and be able to transfer good titlein the Property, free from any third party claims arising after thedate of the sale.

Matthew Barton Ltd has discretion to waive any of the aboverequirements. Matthew Barton Ltd may require the Buyer to obtain atthe Buyer's cost the reports of two independent and recognisedexperts in the relevant field and acceptable to Matthew Barton LtdMatthew Barton Ltd shall not be bound by any reports produced bythe Buyer, and reserves the right to seek additional expert advice at itsown expense. In the event Matthew Barton Ltd decides to rescind thesale under this Guarantee, it may refund to the Buyer the reasonablecosts of up to two mutually approved independent expert reports,provided always that the costs of such reports have been approved inadvance and in writing by Matthew Barton Ltd.
