MASS RAPID TRANSIT CORPORATION SDN BHD (902884-V) (“MRT CORP”) was set up by the Government of Malaysia to be the developer and asset owner of the Klang Valley Mass Rapid Transit (“KVMRT”) Project. The company is wholly owned by the Minister of Finance Incorporated.

The KVMRT Project involves the construction of a rail-based public transport network in the Klang Valley. The MRT SUNGAI BULOH-SERDANG-PUTRAJAYA LINE (“SSP Line”) is the second MRT line to be developed after the construction of the MRT Sungai Buloh-Kajang Line (“SBK Line”) began in 2011.

For the development of the SSP Line, MMC GAMUDA KVMRT (PDP SSP) SDN BHD (1117100-V) has been appointed as the Project Delivery Partner (“PDP”).

MRT Corp. wishes to invite prospective Tenderers to participate in the tender for the works package stated in the table below.

All Tenderers are required to register on Thursday, 30 November 2017 at the above venue between 9.00 am and 9.30 am. A maximum of three (3) representatives from each Tenderer will be allowed.

The representatives from the Tenderer shall be key qualified personnel with sound knowledge on tenders and contracts for the said work and are duly authorised by the company and shall include one of the following:1. Managing Director or;2. Executive Director or;3. Chief Executive Officer

Representatives of the Tenderer are required to produce a valid ‘ORIGINAL’ and ‘CERTIFIED TRUE COPY’ (certified by the Company’s Secretary or the Government Grade A Servant) certificates as per the TENDER REQUIREMENTS upon registration for the Tender Briefing.

Tender documents can be purchased from 30 November 2017 (after the tender briefing) to 14 December 2017 at the office of:

NOTE:1. Experienced Contractors that can meet the mandatory criteria and registered with the relevant bodies with the specified registration details as

per the above table which are still valid and allowed at the point of tender are invited to participate in this tender.2. Tenderers are required to attend a MANDATORY tender briefing at the date, time and place stated above.3. Tenderers are allowed to form a JV or Consortium with local company or locally incorporated or registered foreign owned company or international

company, PROVIDED THAT at least one (1) of the member must have a valid certificate of Perakuan Pendaftaran Kontraktor (PPK) and Sijil Perolehan Kerja Kerajaan (SPKK) from CIDB Grade G7 Category ME and Sijil Taraf Bumiputera (STB) from Bahagian Pembangunan Kontraktor & Usahawan (BPKU) formerly known as Pusat Khidmat Kontraktor (PKK) during the tender. However, a JV or Consortium shall not consist more than two (2) companies.

4. The locally incorporated or registered foreign owned company must comply with requirement of the Companies Commission of Malaysia (CCM) and CIDB (for Works).

5. Tenderers are restricted to submit only one (1) tender either in the form of single entity or JV or Consortium. Tenderers shall select ONLY one (1) Manufacturer or Supplier from the Particular Specification of Tender Documents. However, Manufacturers or Suppliers are not restricted from taking part in more than one (1) Tender submission.

6. Tenderers are not allowed to change the JV Partner or Consortium after the submission of Tender Document.7. A JV or Consortium submission shall be accompanied with a JV or Consortium Agreement and in the JV or Consortium agreement must state

the Lead Partner, equity participation of all the members of the JV or Consortium and shall include a clause stating that all members are jointly and severally liable for the JV or Consortium.

8. Tender Documents will be displayed and made available for purchase from the date, time and location stated above. Tenderers can view the Table Tender Document (TTD) prior to purchase.

9. Tender Documents shall only be sold to Tenderers who attended the Tender Briefing. MRT Corp. WILL NOT entertain any request for the purchase of Tender Documents before or after the date and time stated above.

10. Tender Documents will only be sold to a “bona fide” representative of the Tenderers. For this purpose, a Letter of Authorisation to purchase the Tender Documents MUST be produced by Tenderers’ representative together with valid ‘ORIGINAL’ and ‘CERTIFIED TRUE COPY’ (certified by the Company Secretary or the Government Grade A Servant) from CIDB of PPK and SPKK to confirm the Tenderer’s qualification.

11. All Tenderers must observe and comply with statutory requirements, rules and regulations, including any modifications to it or re-enactment that is enforced by the Government of Malaysia.

12. In line with the instruction by the Mahkamah Persekutuan Malaysia [Ruj.(44) dlm JK/MP/53/WP(140/97), 23 June 2005] Tenderers are reminded that certificates which are certified true copies by the Commissioner for Oaths shall NOT be accepted.

13. By issuing this Notice of Tender, MRT Corp. is not bound in any way and does not have to accept the lowest or any tender.

14. MRT Corp. reserves the right to accept or reject any tender from any Tenderers without assigning any reason and further without thereby incurring any liability of whatsoever nature to the affected Tenderers or any obligation to inform the affected Tenderers of the grounds for such decision.

Payment for the purchase of Tender Documents can only be made via Bank Draft or Banker’s Cheque with the amount stated in the above table and made payable to Mass Rapid Transit Corporation Sdn Bhd and non-refundable.

Completed Tender Documents shall be submitted in a sealed envelope, clearly marked with the Title of Tender and Tender Number at the top center of the envelope, and placed in the Tender Box at MRT Corp.’s Procurement Department, not later than 12.00 noon, Tuesday, 30 January 2018. All late submission will be disqualified.

In addition to the above Tender requirements, Tenderer MUST also fullfil the Mandatory Criteria as below:

MANDATORY CRITERIA

i. LED Manufacturer / Supplier / Company engaged or proposed by the Tenderer has successfully completed product sale value in the last five (5) years with yearly product average sale value exceeding Ringgit Malaysia: One Million (RM1 Million) per year.

ii. Tenderer (at least one company in the JV / Consortium) has successfully completed at least one project greater than Ringgit Malaysia: Five Million (RM5 Million).

iii. Tenderer or Lead Partner in the JV or Consortium shall have the technical capability to satisfy the mandatory compliance specified in the Schedule of Technical Data.

iv. The Lead Partner must be a Bumiputera entity and the equity in the JV or Consortium shall not be less than 51%.
