Highlights of the year
1. Strong representation before various authorities and meetings with the Commissioner of Sales Tax for Clarification and Amendments to the MVAT Act, 2002 and Various issues in the administration of the Act.
2. Expanding the Scope of Law & Representation Committee by making three separate Committees of Law & Representative for VAT, Service Tax & LBT.
3. Lecture Meeting held on the topic of ‘Cyber Crimes’ under the Arvind Thakkar Memorial lecture series.
4. Ten Study Circle meetings including one Mega Study Circle Meeting held on 5th February, 2014 topic on “Determination of Value under Rule 58 for of Builders & Developers and their Assessment under MVAT Act, 2002”and “Special Comments on SPL filed in Supreme Court by BAI & MCHI” led by Adv., Vinayak Patkar & Adv., Ratan Samal at Mazgaon Library on important subjects.
5. Effective use of Sales Tax Review for communication with the Sales Tax Department and business community. Two special issues of STR on topics relating to Builders & Developers and Compilation of References to Bombay High Court under MVAT/CST Act.
6. Emailing and Publication of monthly STPAM News Bulletin for Members containing Circulars, Short Notes on Tribunal Judgment, Important Judgments on Allied Laws and other information regarding programme organised by the Association, Renewal of Membership etc.
7. Mega Guidance Cell on New “E” CST Module at Mazgaon Library.
8. Successful workshop on MVAT, CST and Service Tax jointly organised with AIFTP, CTC, BCAS, MCTC and WIRC.
9. 38th Residential Refresher Course at Hotel Royal Orchid, Jaipur with 173 participants. The concept of Mentors in each group for group discussion was introduced in this RRC.
10. Full day seminar on LBT at Thane along with Thane Branch of WIRC, Tax Practitioners’ Association, Thane and the Thane Municipal Corporation.
11. 13th International Study Tour at Hong Kong, Macau and Shenzen with 40 participants as conducted, organised and operated by Club 7 Holidays Ltd.

We have pleasure in presenting the 63rd Annual Report of the activities of the Association during the period 2013-14 along with the Audited Statement of Account and Balance Sheet as on 31-3-2014.
1. Election for the year 2013-14
At the 62nd Annual General Meeting held on 26th July, 2013, Shri K. M. Shah, member of the Election Committee informed the members present that exact number of valid nominations had been received for the various posts. Accordingly no election was required for the year 2013-14. He announced the names of the Office Bearers and Managing Committee Members who were elected unopposed. The baton of the Presidentship was entrusted to the dedicated and enthusiastic member of the Association, CA Pankaj Parekh from Thane.
2. Election Committee
Elections are an important aspect of democratic functioning of any organisation. Under Article 17(1) of the Constitution of our Association, an Election Committee was formed to conduct elections for the post of Office Bearers and the members of the Managing Committee for the year 2014-15. The Committee was headed by our senior member, Shri K.M. Shah as a Chief Election Officer.
3. Managing Committee
At the first meeting of the Managing Committee Adv. Vinyak Patkar, Mr. Dhaval Talati and CA Mahesh Madkholkar were unanimously co-opted as the members of the Managing Committee for the year 2013-14. With their wealth of experience in the functioning of the Association, they guided the members of the Managing Committee and the Office Bearers in the day-to-day issues arising before them.
The members of the Managing Committee for the year 2013-14 comprising of young, enthusiastic and dynamic members performed their functions with great zeal throughout the year. Till the date of this report, 12 meetings of the Managing Committee were held. The details of attendance are given in Annexure “C”.

4. Law & Representation Committee – VAT
This Committee represents the Association in making valuable representations and suggestions on legal and administrative issues to the Sales Tax Department as well as to the Government. Besides representations, meetings, discussions with the Sales Tax Department are held and are followed-up on the issues, which results in better and simplified administration of the law, thus achieving an important objective of the Association. The L&R (VAT) Committee for the year, under the Chairmanship of the President, Shri Pankaj Parekh, was headed by the Convenor, Shri Ashit Shah. During the year, the Committee made numerous representations and organised various Study Circle meetings in order to update the members with the latest development on MVAT & Allied Laws. The details of the activities during the year are summarised below.
During the year 2013–14, the Committee had represented on many matters concerning legal and administrative issues faced by the members of our association and the dealers. Besides representing the matters before the appropriate forums, study circle meetings were organised to educate the members of the association on the indirect taxes as well as on smart apps for tax professionals and cyber crime. Video Streaming of Study Circle Meetings has been introduced during the year and the recording of Study Circle Meetings are also placed on the website of the association, resulting in extension of benefits to all the members of the Association.

(B) Representations before Hon’ble Member of Parliament During the years 2012-13 and 2013-14, many dealers had become liable to
pay Tax, Interest and Penalties on account of disallowance of input tax credit u/s 48(5) of the MVAT Act by the Sales Tax Department. This had created lot of financial as well as mental harassment and threat of prosecution to the business community. Hence, the committee had represented this matter before Hon’ble Member of Parliament Mrs. Supriya Sule and requested

Madam to appoint high level committee to protect the interest of honest taxpayers and stay the recovery and prosecution proceedings.
(C) Study Circle Meetings
The L&R(VAT) committee had arranged the following study circle meetings addressed by renowned personality in the profession. Inaugural Study Circle meeting was held on Wednesday, 14th August 2013 on the topic “Recent High Court Judgments” by Adv. P. C. and Representation Committee, at the Service Cell meetings held by the Sales Tax Department. Various important issues were raised from time to time in the meetings.
5. Law & Representation Committee – Service Tax
From this year, under inspiration and guidance from President Shri. Pankaj Parekh three separate Law & Representation Committees were formed for Sales Tax, Service Tax & Local Body Tax.
Day by day the scope of practice in Indirect Tax is widening and eventually the situation has arisen that one who is expert in sales tax must understand service tax as well. Therefore, keeping in view the said necessity and the main object of the Association to educate the public in general and the members in particular, the Association has made a sincere attempt by forming this committee to educate the members on service tax law.
The Convenor of this Committee Shri. Dinesh Tambde under the Chairmanship of President Shri Pankaj Parekh designed the “1st Specialised Course on Service Tax” consisting of 15 exclusive sessions on the various topics of service tax. This course was designed in such a manner that it started with the session on constitutional provisions with respect to levy of service tax and introduction to various statutes, Rules and other enactments and thereafter, every subsequent session went to the root of every part of levy of service tax. Under the scenario of increasing need for the educational programme on Service tax, it was not to the surprise of Association that the number of enrollments received for the said course reached to 169. The specialised course was organised jointly with the Malad Chamber of Tax Consultants and was inaugurated by CA Sunil Gabhawalla. A Short Publication on the subject of ‘Guide to Reverse and Partial Reverse Charge Mechanism under Service Tax’ Compiled by CA Ashit Shah was also published during the year.

6. Law & Representation Committee – Local Body Tax
A new Law & Representation Committee Committee for LBT was formed this year. It was headed by Smt.Nikita Badheka as Chairperson and Shri. Pradeep Kshatriya as L&R Convener - LBT.
During the year the Committee addressed the problems of Local Tax Practitioners’ Associations from various Districts in the State of Maharashtra. As the levy of local body tax has commenced in many Municipal Corporations since last financial year and as the levy was a new one and was collected by the local Municipal Corporations, the Committee guided the local associations as well as the Tax Practitioners in the said areas on difference of opinion with the Corporation Officers. A Full day seminar on LBT was organised at Thane along with Thane Branch of WIRC, Tax Practitioners’ Association-Thane and the Thane Municipal Corporation. A short publication on the subject of ‘Local Body Tax Provisions at a Glance’ Compiled by Adv. Pradeep Kshatriya was also published during the year.
7. Journal Committee
Our prestigious publication Sales Tax Review, a monthly journal and mouth piece of members was published uninterruptedly, every month under the able Editorship of Shri Pravin R. Shah and Associate Editor Shri Chirag S. Parekh alongwith the guidance and support of the Editorial Board comprising of Shri Ashvin A. Acharya, Shri. S.S. Gaitonde, Shri P.V. Surte, Shri Vinayak Patkar, Shri P. C. Joshi, Shri R. S. Pathak, Shri C.B. Thakar, Shri D. H. Joshi and Smt. Nikita Badheka.
From 01-04-2014 Smt. Sujata Rangnekar was appointed as the Chief Editor & Shri Vikram Mehta as Associate Editor of the Sales Tax Review for F.Y. 2014-15.
The journal comprising columns, articles, gist of case laws, gist of DDQ’s, recent amendments, etc. continues to be a constant companion of practitioners. The Journal Committee was headed by Shri Vinayak Patkar as the Chairman and Shri Sunil Khushalani as the Convenor. The Committee rendered valuable assistance in the publication of the Sales Tax Review.

During the year, in addition to the regular articles and columns on the topics of VAT, CST, Service Tax and LBT, two special issues, on emerging and burning topics were published on the important topics of Builders & Developers and Compilation of References to Bombay High Court under MVAT/CST Acts which contained more than 1800 pages in total 12 Issues. This shows the eagerness for dissemination of knowledge and eagerness to learn amongst the members of the Association.
We place on record our grateful thanks to the Editors, Associate Editors, the Editorial Board and all the column writers and contributors of articles for their valuable efforts in sharing their knowledge and experience throughout the year. Regular cartoons on various current topics on second cover page of the Review contributed by CA Anil P Kelkar and drawn by CA Rajshree K Dave have become a popular feature.
8. Library Committee
Providing the members with latest publications and material on the subject of tax laws is an important objective of the Association. The libraries situated at Mazgaon and Bandra Sales Tax Offices cater to this important requirement.
The committee under the Chairmanship of the Vice President Sachin Gandhi was headed by Convenor, Dattatray V Phad. The said committee purchased various books, New Projector, Computer and Printer at Mazgaon Library, and arranged various meetings with PRO, Commissioner of Sales Tax and Principal Secretary of Finance Department for obtaining the permission for renovation of library.
The Association is regularly receiving letters from the Deputy Commissioner of Sales Tax (PRO) regarding surrender of area in excess of 825 sq. feet, occupied by STPAM at Room No. 104, 1st Floor, Vikrikar Bhavan, Mazgaon and STT Bar Association at 7th Floor, Vikrikar Bhavan, Mazgaon. The members of Library Committee, office bearers of STPAM and STT Bar Association along with senior members of our Association are regularly following up the matter and have represented the matter before the Commissioner of Sales Tax and the Principal Secretary Finance Department, Maharashtra State.

9. Books & Bulletin Committee
The endeavour of the Association is to make available books at discounted rates to the members at the counter of both the libraries. The Convenor of this Committee Shri Dinesh Tambde under the Chairmanship of Hon. Treasurer Shri Vijay Sachiv ensured that books are available to the members at the best discounts and new books were also included in the stock of our library for reading & reference purpose.
10. Coaching Class Committee
28th batch of coaching classes were organised under the able Chairmanship of our Hon. Jt. Secretary Mr. Pranav Kapadia and Convenor Mr. Pravin V. Shinde at our Association’s library. 78 participants who were new entrants in the practice of taxation & students who were pursuing professional courses had enrolled for the coaching classes. This batch of coaching classes was inaugurated by our Past President CA Sujata Rangnekar on 9th October, 2013 and total 33 lectures were conducted during the 19 days duration of the course. Mock tribunal was also organised by the committee wherein the students of the coaching class alongwith other members of the Association actively participated as Appellants and Defendants. Senior Member of Association were judges at the Mock Tribunal. Hon’ble Shri A. D. Babrekar, President of Maharashtra Sales Tax Tribunal alongwith other members of the Tribunal had graced the occasion.
11. Computer and Website Management
This committee was headed by CA Ashit Shah as Chairman and Adv Amol Mane as Convenor. The website is an important and efficient tool to disseminate information amongst the members all over Maharashtra. This year our website www.stpam.org has reached new heights. Several new concepts and facilities have been introduced such as Full text of Acts, Rules, Notifications and Circulars

issued under MVAT Act, CST Act, Service Tax Law, Entry of Goods into Local Areas Act, Entry of Vehicles into Local Area Act, Sugarcane Tax Act, Luxury Tax Act and Profession Tax Act.
A new feature which has been introduced this year was of video streaming of study circle meetings held at STPAM and lectures at RRC. Majority of the members including outstation Members have taken the benefit of the same.
The website is regularly updated. The MSTT Judgments have been uploaded on the Website from April, 2000 to March, 2014 and the DDQ’s have been uploaded from April, 2005 to March, 2014, with search facility and index.
12. Accounting and Office Administration Committee
The Committee was headed by Hon. Joint Secretary, Shri Pranav Kapadia as Chairman and Shri Pradip Kapadia and Shri Aalok Mehta as Joint Convenors. The day-to-day issues of Office Administration have been attended by the committee members regularly along with proper guidance given to office staff as when required which in turns results into smooth functioning of work of our office.
The duties of the existing staff have been shuffled and reorganised so as to increase work efficiency among the staff. The rotations of duty of staffs were also carried out during the year. Two new staff members have also been appointed. The Committee was regularly taking report from STPAM staff containing details of work completed and works pending. Implementation of surprise checks and various check lists have increased efficiency of the office staff. We place on record our appreciation to the members of this committee as well as to our office staff who were instrumental in smooth functioning of the activities of the Association and Service provided to the Members.

13. DDQ Compilation Committee
This Committee undertakes the task of publishing gist of DDQ orders in the Sales Tax Review and preparing and publishing the compilation of orders on calendar year basis. The Committee headed by the Honble Jt. Secretary Dr. Shashank Dhond as Chairman and Shri Ishaan V. Patkar as the Convenor, have taken great efforts in preparing the gist of DDQs and published in Sales Tax Review throughout the financial year for the benefits of the members of the Association.
14. Mega Guidance Cell Committee
One Mega Guidance Cell meeting was held under the Chairmanship of Hon Treasurer Shri Vijay Sachiv and Jt. Convenors Shri Dattatray V. Phad and Shri Sunil Khushlani. Queries raised by the participant members were answered by the panel members in detail and expressed their views and experience in the subject matter. The Mega Guidance Cell meeting was inaugurated by Shri Haresh Gangurde, Joint Commissioner of Sales Tax on 24th December, 2013

15. Intensive Study Course Committee
In this study course participants meet on the first and third Saturday of every month to discuss intricate issues under the Sales Tax, Service Tax and Allied Laws such as Profession Tax, LBT etc. Group leaders generate the discussion on the given subject and senior in the profession monitor the discussion and guide the participants. These interactive meetings were arranged in our Library at Mazgaon.
Under the Chairmanship of Joint Secretary Shri Pranav Kapadia and Convenor Shri Aalok Mehta, the Intensive Study course was inaugurated on 5th October, 2013 at the worthy hands of our President, Shri Pankaj Parekh and eminent faculty and Monitor of the first session Shri Dhaval Talati.
The total enrolment for the Intensive Study Course was 106, which has created record of maximum number of participants in Intensive Study Course of the Association.
We are very much thankful to all the monitors and group leaders for providing their insights on various provisions under VAT, Service Tax and Profession Tax. We are also thankful to the participants for their enthusiasm and zeal for intense study and interactive meetings.
16. Non–Residential Refresher Course Committee
The Association had organised 17th Non–Residential Refresher Course at Navin Thakkar Auditorium, Vile Parle on 15th November, 2013 and 16th November, 2013 under the Chairmanship of Shri Chirag Parekh and Convenor Mr. Raj P. Shah.
The 17th NRRC was inaugurated by the Hon’ble President of The Maharashtra Sales Tax Tribunal Shri A. D. Babrekar.
The NRRC had total 5 Technical Sessions and it benefited all delegates. It was a grand success.

17. Picnic Committee
A Picnic was arranged at Shangrila Resort and Waterpark, Bhiwandi on 1st September and 2nd September, 2013. The Committee was headed by Shri Tushar Joshi as the Chairman and Convenor Shri Raj P. Shah. It was a relaxing moment in the hectic days of the year with a luxurious stay and sumptuous food at the resort.
18. Publication Committee
The Publication committee under the Chairmanship of our Vice President Shri Sachin Gandhi and Convenors Shri Vivekanand Rao and Shri Aalok Mehta have released short publications on “Guide to Reverse and Partial Reverse Charge Mechanism under Service Tax” compiled by CA Ashit Shah & “Local Body Tax – Provisions at a Glance” compiled by Adv. Pradeep Kshatriya. The short publications will provide quality reference material at reasonable price to the members.

19. Referencer Committee
The STPAM Referencer on Sales Tax and Allied Laws has become a must for all concerned practicing in Sales Tax and Allied Laws. In this year also the Referencer Committee was divided into two parts.
Part A – Table Referencer, Pocket Referencer and Telephone Index, headed by the Vice-President Shri Sachin Gandhi as the Chairman and Shri Vivekanand Rao, as the Convenor.
Part B – of the Referencer consists gist of important provisions under MVAT Laws, CST Laws and Allied Laws; Judgments and Circulars, headed again by the Vice-President Shri Sachin Gandhi as the Chairman and Shri Dharmen Shah as the Convenor.
This year the referencer was published and distributed well within time.
20. 38th Residential Refresher Course Committee
Residential Refresher Course is always an eagerly awaited programme of the Association because it provides an atmosphere of learning in relaxed environment. This Committee was headed by President Shri Pankaj Parekh as Chairman along with Convenor Shri Pradip Kapadia. The 38th Residential Refresher Course was held from 8th February to 12th February, 2014 at Hotel Royal Orchid, Jaipur. The R.R.C. was inaugurated by Hon’ble Justice Shri J. K. Rankaji of Rajasthan High Court.
The participants appreciated the excellent presentation of papers by the paper writers, detailed group discussions and Chairmen’s important remarks. The paper writers painstakingly highlighted the legal provisions, technical interpretation and the issues arising there from the papers evinced keen interest and lively discussion amongst the participants. The Chairmen of the technical sessions provided the participants with their in-depth analysis of the provisions, issues and guided the participants on the subjects. The concept of Mentors in each group for group discussion was also introduced in this RRC. The participants also enjoyed visiting the Pink City and various places of interest and the lovely weather.
21. Workshop on MVAT & Allied Laws Committee
The Workshop on MVAT, Service Tax and Allied Laws was held between 18th January, 2014 and 3rd May, 2014. The Workshop was jointly Organised by 6 Professional Associations viz AIFTP, BCAS, CTC, MCTC, STPAM and WIRC of ICAI. This year one more association viz. WIRC of ICAI has participated in the Joint Workshop. There were record number of 223 participants enrolled for the Joint Workshop. It comprised of 10 Technical sessions with 17 eminent speakers. Out of the above, 5 technical sessions were on MVAT and CST, 3 technical sessions were on Service Tax and 2 technical sessions were ‘Jugalbandi’ sessions covering selected topics involving taxability of both MVAT and Service Tax.
This Committee was headed by Chairman and Hon. Treasurer Shri Vijay Sachiv and Shri Dharmen Shah and Shri Aalok Mehta as Joint Convenors.

22. Short Notes on Tribunal Judgments Committee
This Committee undertakes the task of publishing short notes on the important recent decisions of the Maharashtra Sales Tax Tribunal. The Committee under the Chairmanship of Smt. Rupa Gami along with Convenors Shri Ishaan Patkar and Shri Dinesh Tambde took great efforts to see that the maximum number of judgments are timely reported in the STPAM New Bulletin every month. We are thankful to S/Shri D. M. Gala, Amol Shirode and Hemant Patki who contributed their efforts in preparing the short notes on Tribunal Judgments in the News Bulletin.
23. Finance & Accounts Committee
The Committee under the Chairmanship of Shri CA U. M. Loonawat, Co-ordinator Shri Mayur R. Parekh and S/Shri Vijay M. Sachiv, Treasurer along with President Pankaj Parekh, Vice President Sachin Gandhi, Jt. Secretaries Shashank Dhond & Pranav Kapadia, V. R. Ghelani, K. M. Shah, R. S. Pathak, Suresh Sanghavi, Pravin Shah, Janak Vaghani, Pradip Kapadia, met at periodical intervals to review finance and accounts of the Association. The audited annual accounts for the year ended 31-3-2014 are printed along with this Annual Report. The Committee thanks Chairman Shri U. M. The object of the Association is to spread activities and knowledge to each and every place in the State of Maharashtra.
This Committee was headed by President Shri Pankaj Parekh as Chairman and Shri Pradeep Kshatriya and Shri Taufik Mullani as Convenors.
During this year, the object of the Association was accomplished in real sense with the inspiration of the President Shri Pankaj Parekh.

25. Contributory Judgments Compilation Committee
This Committee was headed by Hon. Joint Secretary Shri Shashank Dhond as the Chairman and Shri Amol Shirode as the Convenor. The printing of Contributory Judgments and the CJ scheme is discontinued from April 2012 onwards. Now, the Judgments from April 2000 to March 2014 are made available on the STPAM website for the benefit of all the members.
26. STPAM News Bulletin
Under the Chairmanship of Shri Vijay Sachiv and Convenor Shri Amol Shirode, the Association has regularly published News Bulletins during the year. The News Bulletin is being sent through email from June, 2013 onwards and also uploaded on STPAM website. Few copies of the News Bulletin are also kept at Mazgaon Library and counter.
The STPAM News Bulletin contains details of the programmes of the Association during the month, Sales Tax Updates, Services Tax Updates, Short Notes on the recent decisions of the Maharashtra Sales Tax Tribunal etc. This year Shri Kishor Lulla, Past President had written series of articles on the subject of LBT in the News Bullettin.

The committee was headed by Adv. Deepak Bapat as the Chairman and Dr. Shashank Dhond as Convenor. No meetings were held by this committee during the year.

The main object on this committee is to increase the membership and to renew the membership of the existing members and strengthen the association. The committee was headed by Hon. Jt. Secretary, Dr. Shashank Dhond and Convenor Shri Pravin Shinde. The efforts of the convenor brought in many new members to the association and also renew the maximum members.

32. Foundation Day & Diwali Get-together 17th November being the Foundation Day of STPAM, was celebrated along with
Diwali Get-together on 15th November, 2013 at Navinbhai Thakkar Auditorium, Vile Parle. On this day Musical evening was organized with a masterly speech delivered by Sister Deepaben of Brahmakumari. Members present were very much influenced by the said speech and also enjoyed the evening and the sumptuous dinner.
33. Awards Awards recognise and promote talent and create a competitive environment,
which encourages all to put in their best efforts. Our Association has also instituted various awards in order to promote healthy competition amongst members. Statement of Significant Accounting Policies:
1 Method of Accounting :
Accounts are maintained on accrual basis.
2 Fixed Assets and Depreciation :
Fixed assets are stated at cost. Depreciation is provided on fixed assets on written down value method as prescribed under the Income tax Rules.
3 Investments :
Investments are stated at cost of acquisition.
4 Inventories :
Own Publication issued during the year are valued at cost . Obsolete stock of Compliation of MVAT Rule C.D.,Compilation of Gazette & Notification C.D.,Circular & DDQ CD-2011, DDQ CD-2012,37th RRC Paper (Hyderabad), Recent Amendments – 2013, Recent Amendments–2012 and RRC Kit are written off and valued at token value ` 1/-each.
5 Admission Fees, Donor Membership Fees, Patron Membership Fees and Life Membership Fees :
All these fees are capitalised and transferred to respective Fees a/c.
6 Previous year figures have been regrouped/ recast wherever necessary.
