Legendary Motown singer Marvin Gaye will be considered for a US postage stamp when the

Citizens Stamp Advisory Committee meets January 22 and 23 in Washington DC Los Angeles CA

commemorative U S postage stamp for the year 2006 when the 15-member Citizens Stamp Advisory

Committee meets January 22 and 23 in Washington DC

The deceased singer is being sponsored for the unique and special honor by the Motown Alumni

Association (MAA) Los Angeles chapter

We began the efforts to get a stamp for Marvin Gaye last June says Ron Brewington chapter

Executive Director Those efforts included a worldwide petition and letter writing campaign which

garnered thousands of signatures of support

The MAA chapter had hopes of getting a stamp for Gaye in April 2004 which would have been his 65th

birthday

But the US Postal Service and the Postmaster General on the recommendation of the Citizens Stamp

Advisory Committee selects stamp recipients far in advance of the issue date in order to provide time for

planning design production and distribution says Brewington They had already made their

selections for 2004 and 2005



This prompted the MAA chapter to extend their campaign soliciting support from politicians in Los

Angeles Washington DC and Detroit Michigan

The Los Angeles City Council on the recommendation of Councilman Bernard Parks gave a unanimous

passage of a resolution which was also endorsed by LA Mayor James Hahn says Brewington A

resolution introduced by Los Angeles County Supervisor Yvonne Brathwaite Burke before the LA

County Board of Supervisors was also unanimously passed

Support for the legendary singer also came from Calif State Assemblyman Mark Ridley-Thomas and

Calif State Senator Kevin Murray in whose respective districts Gaye lived before his death in 1984

The campaign also received unprecedented support from several hundred celebrities in a concurrent

Very few know that one of New York Citys pioneer rap artists Spyder D Duane Hughes of Queens NY

City was going to school in Ypsilanti Michigan on the campus of Eastern Michigan University in 1978

a bass player and Rueben Jones a drummer of a young group of musicians who formed Frosted

Neither of them knew that their collaboration together would combine the raw talent that would

fetching upwards of $300 on eBay

No one knew that at the time the group collaboration was the launching of the Motor City into the Hip-

Hop world

Today there is the brilliant lyricist known as Eminem and his proteacutegeacutersquos D-12 hailing from Motown And

theres the Hip-Hop influenced rock sound of Kid Rock

Its a safe bet to say that that all started with a collaboration of a New York City street ball player

frustrated that his basketball career was rapidly ending with knee problems and according to Billy a

group of young musicians who had grew up heavily influenced by the sounds of Motown in its heyday

Spyder reflected on the moment by saying It is one of the times in ones life where youre at a

crossroad and you get very creative because your back is up against the wall We went into the studio

with no rehearsal and no real game plan other than to vibe with each other and see what we come up

with I was home sick so I wrote about New York I hummed out the base line to Billy who took the

basics of it and funked it the way Motowners know how to do it I spliced in a sound effects recording of

a Delancey street vendor on the intro and bam Big Apple Rappin with the Motown flair was born

Spyder not quite twenty years old yet with Detroit born and raised Tito Lewis and his Moms financial

We got a lot of notoriety from that single right off the bat recalls Spyder A young Tom Silverman (who

Afrika Bambaata came to my crib on Jamaica Avenue in search of a new record deal with Newtroit as

he was unhappy with his deal with Winley Records To this day my mother and Bam always ask about

Jack Ashford one of the original members of the

Grammy Lifetime Achievement Recipient Motown Funk

Brothers visited Stillman College on behalf of the

Motown Alumni Association Inc and signed a

memorandum of understanding with Stillman The

memorandum entered the two parties into a joint

research initiative Dr Gregory McPherson director of

The Stillman Jazz Consortium and assistant director of

bands will serve as the project director



The proposed granting period is 36-months and shall

reflect an equitable value of $10 million relative to the

current market value of services provided by major

artists producers songwriters engineers and business

executives in the entertainment industry

most innovative and ground-breaking research initiatives

in African American historyrdquo said Wilson

Through this joint venture the development of a 28-song

double compact disc featuring Stillman students paired

with various legendary artists writers producers and

within the Motown Alumni Association Inc family

Another facet of this joint venture is the engagement in

research for the development of publication of an

anthology and textbooks depicting many of the facets of

the legacy of Motown and all of its areas of educational

value They include recording artists in classical jazz



gospel blues rock and roll rhythm and blues and music

of television and film In addition the history of these

same entities will be presented in a similar platform with

the development of a companion DVD documentary for

archival instructional and historical purposes

Additionally the inclusion of an in-kind contingency of a

recording contract equaling the par-value amount of

$250000 for select students who successfully complete

the program of study leading to a bachelorrsquos degree in

music is a part of this agreement Also if a student

exhibits exceptional talent and abilities special

consideration will be given to the student for the

awarding of the same type of recording agreement with a

major record label of whom the Motown Alumni

Former Republic Motown recording artist KJON has

joined the Motown Alumni Association and the MAA

has commited to join the marketing staff of KJON

We were following KJON before he became a big

star we are happy to join his team said Billy Wilson president of the Motown Alumni Association

The Detroit native is planning big things in his career and much of it is based in Detroit

He created Up and Up Records to help the children of

Detroit to have an outlet for their musican endeavour



Im giving back to my city he told the MAA KJon is

also the executive producer of a movie titled Dancing

on releasing the movie in 2014 We are hiring Detroit

celebrities to have a starring role in the movie and getting hollywood involved said KJON

Eminem Lawsuit May Raise

Pay for Older Artists

The most closely watched lawsuit in the music industry asks this question how much should a song on iTunes or another digital music service be worth to the performer

The artist at the center of the suit is Eminem but some of the biggest beneficiaries of the case may be thousands of older artists who have not released an album in decades

Four years ago the producers who discovered Eminem sued his record label the Universal Music Group over the



way royalties are computed for digital music which boils down to whether an individual song sold online should be considered a license or a sale The difference is far from academic because as with most artists Eminemrsquos contract stipulates that he gets 50 percent of the royalties for a license but only 12 percent for a sale

ldquoAs of now itrsquos worth $17 million or $20 million but on a future accounting basis five or 10 years from now it could easily be a $40 million to $50 million issuerdquo said Joel Martin the manager of FBT Productions in Detroit which first signed Eminem and continues to collect royalties on his music (Marshall Mathers himself who performs as Eminem was not a party to the suit although he stands to earn millions from it)

The suit reached its apparent end last week when the Supreme Court refused to hear an appeal letting stand a lower courtrsquos decision that digital music should be treated as a license Lawyers and music executives say that few younger artists are likely to be affected by the decision because since the early 2000s record companies have revised most of their contracts to include digital sales among an artistrsquos record royalties Eminemrsquos first contract was signed in 1995



Many older artists however whose contracts predate digital music and have not been renegotiated stand to profit significantly from the decision

ldquoThis is life-changingrdquo said Joyce Moore the wife of Sam Moore of Sam amp Dave the duo that had hits in the 1960s like ldquoSoul Manrdquo ldquoIf we were being paid a nickel a download as opposed to 35 cents mdash thatrsquos a huge amount of money for a guy that is on a fixed income or has to run up and down the road at 75 years oldrdquo

The lawsuit argued that record companiesrsquo arrangements with digital retailers resembled a license more than it did a sale of a CD or record because among other reasons the labels furnished the seller with a single master recording that it then duplicated for customers

ldquoUnlike physical sales where the record company manufactures each disc and has incremental costs when they license to iTunes all they do is turn over one masterrdquo said Richard S Busch a lawyer for FBT and Mr Martinrsquos company Em2M ldquoItrsquos only fair that the artist should receive 50 percent of the receiptsrdquo

A federal jury ruled in favor of Universal in 2009 but that decision was overturned on appeal last year The label



petitioned to the Supreme Court which declined to hear the case

Universal said the implications of the decision were limited

ldquoThe case has always been about one agreement with very unique languagerdquo the company said in a statement ldquoAs it has been made clear during this case the ruling has no bearing on any other recording agreement and does not create any legal precedentrdquo

Although current hits get more attention older music still represents a huge portion of overall music sales and over time durable hits can rack up significant sales Last year there were 6485 million downloads of ldquocatalogrdquo singles in the United States meaning songs more than 18 months old compared with 523 million for current tracks according to Nielsen SoundScan

Fred Wilhelms a lawyer in Nashville who specializes in collecting royalties for musicians said that sales of older music had provided the labels with steady income at low cost

ldquoThe labels make tens of millions of dollars a year from the deep catalog without paying a penny in promotion costsrdquo



said Mr Wilhelms who estimates that the Eminem ruling might apply to tens of thousands of artists ldquoAnybody who ended their recording career before 1978 and probably before 1992 is in the decisionrdquo he added

Royalty rates vary but today most acts get 10 to 15 percent of their musicrsquos net sales minus packaging and other deductions lawyers say In the 1970s and before the rates were often even lower But for decades licenses of music mdash to movies television or other third parties mdash gave artists a 50 percent share without the same deductions on the principle that a third party was bearing the relevant costs

Jason M Schultz an assistant professor of law at the University of California Berkeley who helped write a friend of the court brief on behalf of the Motown Alumni Association mdash a group that represents Motown acts but is not associated with the label mdash said that recording contracts made in the early days of digital music reflected the labelsrsquo failure to recognize that technologyrsquos potential

ldquoThe record companies would strike these deals with artists in a way that favored themrdquo Mr Schultz said ldquoBut when the digital revolution came around those contracts ended up favoring artists The record companies guessed wrongrdquo



Although sales of digital music around the world now represent 29 percent of record companiesrsquo revenue according to the International Federation of the Phonographic Industry the Eminem case and several others like it stem from the mid-2000s when the potential value of digital music was first becoming clear According to court papers the Eminem case had its origins in an audit of accounting records that FBT and the rapper conducted in 2005 two years after Apple opened the iTunes store

In separate cases the Allman Brothers have sued Universal and Sony BMG Music Entertainment over similar contractual issues The Sony case filed in 2006 was expanded to a class-action suit and earlier this month the parties informed the judge in the case that they had ldquoreached an agreement in principlerdquo (The Allman Brothers and Cheap Trick which joined the case both settled their claims) The Allmansrsquo suit against Universal filed in 2008 is still pending

For million-selling acts like Eminem and the Allman Brothers the stakes are high But plenty of other artists stand to gain from the decision as well



ldquoFor people who had a single hit who couldnrsquot afford to chase $100 in owed royaltiesrdquo Mr Wilhelms said ldquothey are now looking at a couple thousand Itrsquos worth a couple phone calls and an angry letter or twordquo
