The First Bench comprising Chief Justice M. Y. Eqbal and Justice A. Arumughaswamy made the observation while passing further orders on writ petitions relating to the drown- ing of Ranjan (9), a Std. 4 stu- dent, in the swimming pool of Padma Seshadri Bala Bhavan Senior Secondary School in K. K. Nagar. When the matter came up, a counter was filed spelling out the CMDA stand that the school swimming pool had not “Swimming pool in school built illegally,” says High Court been shown in the approved site plan while making the con- struction and that the school management had made a de- viation in respect of the school building and applied for regu- larization, which was rejected in March 2010. The Bench said that as the construction of the swimming pool itself was illegal, any ac- tivity carried on in the pool was equally unauthorized. The school’s counsel, P. S. Raman, said 5 years after the school building was con- structed, a separate plan was submitted for approval of the pool. It was rejected. The school had gone on appeal, which was pending. In view of the submission, the Bench directed that the swimming pool should remain closed. In the event that the counsel’s submission was found incorrect, it would order the demolition of the pool con- structed without any approved plan. As the investigation was not yet complete, the court said it was adjourning the matter by 4 weeks. The Bench reiterated the police’s statement that after completion of the investigation, considering the material and gravity of the offences, it was always open to the police to alter or add more sections un- der the IPC if other offences were made out. (One of the petitions had sought prosecu- tion of the school Dean and Director for non-cognizable of- fenses punishable under Sec- tion 304(ii) instead of the bail- able offenses invoked against them). The CBSE counsel submit- ted that there was no rule or guideline that affiliation of a school will not be given unless it made provision for training of swimming as a subject or extra-curricular activity for students of Stds. 1 to 4. Chennai Corporation zonemanagers have been asked tosketch a new route map for itsconservancy workers.

The map will mark out theexact stretch of road or blocksthat a sweeper or a garbagecollector is supposed to clean.It means the jobs will not bedecided upon in a haphazardmanner so that inefficientworkers can be pulled up.

It is one of the measuresthat D. Karthikeyan (Corpo-ration Commissioner) hasimplemented to address com-plaints from residents acrossthe city on garbage pile-up.

It had been decided earlierthat a conservancy workerwould be given a particularstretch of 500 meters whichthe worker is expected to sweepor along which collect garbagedoor-to-door in a tricycle cart.“The working model is alreadyin place. But, since problemspersist, we have asked engi-neers to rework the wardmaps,” Karthikeyan said.

The SMS system to monitordaily garbage collection, abrainchild of former Commis-sioner P. W. C. Davidar, hasalso been revived.

Zonal Com-missioners and engineers havebeen asked to recruit moreworkers to tide over staff short-age, which has been one of thereasons for poor conservancyoperations in north and cen-tral Chennai. “We have decidedto recruit 2,000 more persons.Locals will be recruited so thatthey will not find it tough toreport to work,” said the offi-cial.

The civic body has also de-cided to buy 2,000 new gar-bage bins and 500 new tricyclecarts for zones across the city.

City residents ready to pay for parking

A recent study by a privateconsultant on parking woes inthe city has found that 90% of thepeople are ready to pay for park-ing provided they are given abetter place to park their ve-hicles with a nominal charge.However, 5-10% of them wantthe Corporation or the Govern-ment authorities to provide freeparking space with adequatesecurity in congested areas, dis-closed Chennai Corporation of-ficials now exploring solutionsto the parking problem in thecity.

The Corporation has beenducking the issue for the past 9

years and the multi-storey park-ing facilities proposed by it atBroadway bus terminus,Greams Road and T. Nagar hangin balance.

“The city corporation has failedto come up with a policy to regu-late parking lots and traffic con-gestion and the issue was peri-odically raised during the previ-ous Council tenure, but nothingmateri-alised,” lamented SaidaiP. Ravi (former opposition floorleader of the Council). The Cor-poration has acquired severalacres of OSR lands from privatefirms and commercial com-plexes. These lands can be

utilised to construct under-ground parking lots, leaving thebasement for greenery, and thiswould ease congestion in thecity. Even the present AIADMK-led Council lacks clarity in ad-dressing the issue.

However, a senior Corpora-tion official said that steps arebeing taken to sort out the park-ing problem.

Areas around the proposedthree Metro Rail corridors areset to witness a big change onthe infrastructure develop-ment front.

Taking the cue from DelhiMetro, the Chennai Metropoli-tan Development Authority(CMDA) has decided to developthe areas up to half a km. lo-cated on both sides of the MetroRail corridor.

The project, named as ‘tran-sit oriented development’, willpave way for all-round devel-opment of those in the vicinityfor which CMDA will launch astudy soon.

And the good news for resi-dents in these areas is that theTamilnadu Government iscontemplating to increase thefloor space index (FSI) for build-ings and pave the way for ver-tical growth along thosestretches.

“On implementation, the lo-calities along the stretches ofMetro Rail corridors might wit-ness reclassification of ‘landuse zones’, as it will enable moredevelopmental activities,”sources in CMDA said.

Chennai Corporation Coun-cil passed a resolution on Aug.24 approving a Rs. 25-croreproject to build a multi-levelparking facility on BashyamRoad next to Panagal Park.

The facility will be equippedwith state-of-the-art facilitiessuch as closed-circuit televi-sion (CCTV) and electronic tick-eting counters. However, theproposed parking fee for 4-wheelers at Rs. 30 an hour ishigher than that even in somepopular malls.

“The fee recommended wasRs. 40 for cars and Rs. 10 for 2-wheelers. Mayor Saidai S.Duraisamy felt it would be tooexpensive and, after a lot ofdebate, we brought it down toRs. 30 for cars and Rs. 10 for 2-wheelers,” said D. Karthikeyan(Corporation Commissioner).

The charges in Express Av-enue mall are Rs. 25 per hourfor 4-wheelers on weekends andpublic holidays. However, it isfelt that the occasional shop-per will not mind as long as he/she gets a comfortable park-ing spot in the congested area.

The facility will consist of sixor seven levels and will be ableto hold around 510 4-wheelers

Multi-level parking lot near Panagal Park okayed

The eastern side of Panagal Park now being used as a paid parking lotand 918 2-wheelers. “A realestate agency did a thoroughfeasibility study in the area,including the soil and rock for-mation, and proposed buildingthree levels above ground andthree or four underground,” saidKarthikeyan.
