GENERAL INFORMATION Absences

Please call 394-5450 as soon as you know your child will be absent. This will help the school personnel determine if a child is out of school without parental knowledge. If you have not called the school, please send a

note with the returning child explaining the reason for the absence. Absences can only be excused for the

following reasons: sickness, doctor or dentist appointments, court appearance, and death in the immediate family.

Absence notes are to be turned in to the attendance office prior to class on the day the student returns to school. Students will not be admitted to class without absence verification from the office. Students, who

are more than 30-minutes late without an excused absence note, are considered truant.

Abusive Language

Students are EXPECTED to show respect for ALL persons. They are expected to communicate without using

hurtful or inappropriate words or gestures. Racial remarks directed at any member of our diverse student population will not be tolerated on campus. The use of profane or indecent language is not permitted, whether it

be it verbal or in writing.

Accelerated Reader AR is a reading program designed to increase reading skills and motivation to read. In August all students will

take a reading placement test to determine their ZPD (Zone of proximal development) range for the program.

This range determines the level of books students will have to choose from for their reading development. Typically, AR is a part of the language arts curriculum and is part of the classroom grade. To encourage students

to achieve their AR goals, LMS established a “Voracious Reader” award for the student with the highest number

of AR points for the entire year.

Activity Bell

Loitering on campus after school is not permitted due to the absence of adult supervision. Students are expected

to vacate the campus no later than 2:45 p.m. or after the activity bell has sounded. Only students participating in school supervised activities such as Homework Club, Academic Pentathlon, Performing Arts, Athletics and

School Clubs may remain on campus if they are engaged in a supervised extra-curricular activity.

Agendas

Each student will be provided an LMS agenda during the first week of school. Students should take their agenda

to class each day so that they may write in assignments and other important information. Students needing to

purchase an agenda may do so for $5.00.

Awards (End of the Year) For the end of the year assembly the 8th grade graduates will have an Awards Night Ceremony and the 6th - 7th

grades will have an end of the year assembly. Awards will be given in the areas of academics, attendance and citizenship. Parents are invited and encouraged to attend these special events.

Bicycles/Skateboards Students may ride bicycles to school. State law requires that individuals under the age of 18 wear helmets when

riding a bicycle. Bicycles must be locked in the designated bicycle parking area. The designated bike area is off limits during school hours. Bicycles may NOT be ridden on campus. Students who violate these bicycle rules

and the helmet law may lose the privilege of riding a bike to school. City of Livingston ordinance requires that all

bicycles be licensed within the city limits. Students will be allowed to use their skateboards as a means of

transportation to and from school. However students will NOT be allowed to use their skateboards on school grounds. Your skateboard must be secured in a classroom with the teacher’s permission prior to your arrival.

Students will not be allowed to carry skateboards in their possession at any time throughout the school day.

Students who violate the skateboard rules on campus will lose the skateboard privilege after the second offense.

Books Students are responsible for care of textbooks and library books. Textbooks are to be covered. Students will be charged for lost or damaged books. In addition to the end of the year consequences, students may not

participate in dances, team sports, or other school activities if they have any outstanding library

obligations. There will be a monthly textbook cover check that will take place in your homeroom on the

second Thursday of each month. Please be prepared!

Buses All pupils are expected to follow instructions regarding bus conduct. Bus riding is a privilege and may be

revoked temporarily or permanently if students do not abide by safety regulations.

Cafeteria The school provides breakfast and hot nutritious meals for students who wish to participate in the school lunch

program. There will be no charge for student meals. Students who abuse cafeteria privileges will not be allowed

to eat in the cafeteria. Students are expected to act responsibly in the cafeteria. It is the responsibility of the

student to clean up after him/herself. Failure to do so will result in the student receiving a consequence for defiance. Campus Supervisors

To assist in the supervision of the campus and to increase the overall safety of the school during school hours

there will two campus supervisors on site. Please feel free to approach them whenever necessary along with your teachers and the instructional aides. Campus Visitations

We believe that it is important for parents/guardians and community members to take an active interest in the

issues affecting district schools and students. We encourage interested parents/guardians and community members

to visit the schools and participate in the educational program. At the same time, a school’s most fundamental duty is to protect the safety and welfare of its students and staff.

To ensure the safety of students and staff and minimize interruption of the instructional program, the school district has established procedures which facilitate visits during regular school days. Visits during school hours

should be arranged with the principal or designee. When a visit involves a conference with a teacher or the

principal, an appointment should be scheduled during non-instructional time, when possible.

A visitor is a person entering school premises for a purpose other than leaving or collecting children at the beginning or end of the school day. Any person who is not a student or staff member shall register immediately

upon entering any school building or grounds when school is in session.

Registration Procedures

1. Visitors are required to report directly to the school office upon entering school grounds: (Penal Code 627.3)

a. Each visitor shall enter his or her name, the purpose of his or her visit, and the time of entrance into the

visitor’s logbook. b. Visitors will be issued an identification badge (dated) that must be worn and visible during the visit.

2. Permission to proceed to a classroom or any area of the school must be cleared by office personnel.

3. Should the intended visit interfere with the planned instructional program, the principal/designee will so

advise the visitor and suggest another time for the visit.

a. Requests to observe a classroom, the visitor must make arrangements with the teacher and state the purpose of observation. This should be made at least two days in advance of the intended visit.

b. Visitors must verbalize their intended destination to school office personnel. Office personnel will then

contact the classroom teacher or supervisor on duty.

4. Visitors will wait in the front office until permission is given to proceed to the classroom.

5. Visitors will report back to the main office, sign-out, return identification badge, and proceed directly off school grounds.

Cell Phones Cell phones are allowed at school; however they are a distraction of the learning environment and must remain off

between the hours of 7:30 AM and 2:30 PM. If a student’s cell phone is on and creating a distraction it will be

confiscated by the teacher sent to the office where it will be the responsibility of the parent to retrieve the phone. Should a student be found with their cell phone on again it will be confiscated and sent to the office where it will

be held for a week and only returned to the parent. Should a third offence occur the student will loose their cell

phone privileges for the remainder of the trimester. The Staff of Livingston Middle School for is not responsible for lost, broken, damaged, or stolen cell phones.

Change of Address or Phone Number Please notify the attendance office at 394-5450 or send a note to the attendance office if there is a change of

address or telephone number. Also be sure to notify the attendance office if there is a change in the family

household or guardianship in order to keep our records updated. To change guardianship, complete The Parent

Affidavit of Responsibility Form available in the office. Constitution Test The School Board requires that all 8th grade students pass a test on the National Government and the Constitution

prior to graduation. The Constitution test will be given in History 8 class during eighth grade. Counseling Services: The School Counseling Program at the middle school level of education addresses the

personal, social, emotional and academic needs of all students in grades 6-8. The role of the middle school

counselor is to counsel, consult and collaborate with students, parents, staff and administration. All subjects discussed are kept confidential unless the student requests or consents to the inclusion of another interested person

or as required by mandating reporting laws.

All seventh graders and his/her parent(s) will be invited to an individual counseling conference with a school

counselor during the Fall. The purpose of the conference is to explain the academic progress needed to

satisfactorily complete middle school and begin planning for high school and post-secondary education and/or employment. Parents are strongly encouraged to attend this conference.

Dances Dances are held from 2:45: to 4:45 p.m. for grades 6 through 8. One night dance will be held for 8th graders after

graduation. Eligibility rules apply. Parents are encouraged to attend the dances. Parents are asked to please pick

up children as soon as the dance ends.

Deliveries Because we are working hard to increase the amount of learning time in classes, we will not be able to make

deliveries to students in classes. Please do not send flowers, balloons or other gifts to the school.

Discipline At the end of this handbook we specify our school rules and consequences. Please read and discuss these rules with your children.

DRESS Standards (Please note “college” attire is now acceptable) School staff and students are to dress in a manner that is age appropriate and acceptable. Since styles are

constantly changing, it is impossible to list all of the appropriate and inappropriate forms of clothing. Standards

include but are not limited to the following:

1. No professional sports team clothing will be worn, including hats, shirts, or jackets. 2. Attire identified with gangs, such as bandannas, gloves, jackets, work fatigues, knit caps and over-display of

known gang colors, must not be worn.

3. No clothing or hats advertising alcohol, drugs, tobacco or clothing with crude, profane or sexually explicit language may be worn.

4. Pants must fit at the waist, no sagging or bagging.

5. Low necklines, low backs, bare midriffs and inappropriate tank tops may not be worn. All undergarments must

be covered. 6. Hats, caps and other non-religious head coverings shall not be worn indoors.

7. Shoes must be appropriate for school activities. 8. School clothing must be clean and in good repair.

9. Belts must be worn inside belt loops at all times. Belt ends may not hang.

10. Skirts and shorts must be at least mid-thigh in length. 11. Clothing must fit appropriately and may only be one or two sizes too large (to accommodate growth).

Students who dress inappropriately will need to change before reporting to class.

Early Release Parents wishing to take a child out of school before the end of the school day must sign the child out in the

attendance office. Parents wishing to have their child walk home early must send a written notice to the attendance office. Emergency Contacts

Make sure you have on file at the school emergency names, current addresses and telephone numbers, in case

your child becomes ill or has an accident. An Emergency Update form must be signed by the parents or legal

guardian and returned to the attendance office immediately upon registering a new student. Update forms will be mailed home prior to school starting.

Field Trips Field trips are a wonderful educational opportunity. Any student who has received more than three detentions

and/or was suspended during a four-week period preceding a field trip may be ineligible to participate. The homeroom teacher will make the decision on field trip participation.

Foggy Day Schedule In the event of a foggy day schedule, classes will begin on time (8:00 a.m.); however, busses will be delayed an

(1) hour. The information will be broadcast at 7:00 a.m. and throughout the morning, on radio stations KMJ

Fresno 580; KNTO Livingston 95.9 and KYOS Merced 1480 on your radio dials.

Graduation Requirements These requirements shall apply to students in 7

th and 8

th grade.

CLASS CREDITS: In order to participate in graduation activities and earn a diploma from Livingston Middle School, students must earn a total of 31 credits in 7

th and 8

th grade.

1. For each of the six trimesters offered, students shall have the opportunity to earn a total of 6 credits per trimester. Each class shall be worth one credit. Successful completion shall be defined as earning at

least a D- on a traditional A-F grading scale.

2. Students must earn 5 of 6 credits during the last trimester of their eighth grade year. 3. A student may earn up to 2 credits by attending summer school in order to remediate up to two classes

in which no credit was earned.

4. Students may earn 1 credit by attending an after or before school program in order to remediate a class in which no credit was earned.

DEMONSTRATE A HIGH DEGREE OF CITIZENSHIP: Students must demonstrate good citizenship as evidenced by being in either the green, yellow, or orange level

of the discipline scale outlined below.

1. Green Level: The student has no behavioral issues. This is defined as 5 or less detentions.

2. Yellow Level: The student has 6 – 15 detentions, or one Saturday School, or one in-house suspension, or one home suspension.

3. Orange Level: The student has 16-29 detentions, or 2-4 Saturday Schools, or 2-4 in-school suspensions,

or 2-4 home suspensions. 4. Red Level: The student has more than 30 detentions, or more than four Saturday Schools, or more than

four in-school suspensions, or more than four home suspensions. Any student who is recommended for

expulsion will be placed at the red level. At this level, the student will not be eligible to participate in

graduation.

5. Students may earn their way back to a lower level of concern by 30 days of no behavior incidents. This means no more than 5 detentions, no Saturday School, no in-school suspension, and no home suspensions.

For each 30-day period of good behavior the student will earn back one level. Note: Students at this level

in the last trimester must meet with a panel of one teacher, one administrator, and the school counselor, to develop an individualized plan.

6. Students who are attending school under a suspended expulsion may earn their way back to the orange

level and graduate by fulfilling their behavioral contract as stipulated in the expulsion agreement. 7. Students with special circumstances, or students who move into the district during the last trimester,

will meet with the review panel consisting of the principal, the counselor and a teacher to determine

their discipline status.

COMMUNITY SERVICE:

10 hours of Community Service shall be completed by the first school day in May of the student’s eighth

grade year. Students trying for a silver cord – 50 hours are due by the first school day of May.

CONSTITUTION TEST:

Students must pass the Constitution test. (A maximum of four opportunities to pass will be provided.)

GRADUATION CEREMONY REQUIREMENTS:

Participation in the graduation ceremony is a privilege which is extended to those students who have

demonstrated good behavior and academic effort. All requirements above must be met prior to graduation in order for a student to participate in the graduation ceremony.

DIPLOMA REQUIREMENTS To receive a diploma, students must meet all listed graduation requirements prior to the start of their freshman

school year in the fall.

Gum, Candy and Sunflower Seeds Gum is not allowed at school. If a student is found chewing gum they will be asked to remove it. Should the

student be found with gum a second time during the same period they will be sent to the office for defiance of the valid authority of the teacher. Candy is allowed at school at the discretion of the individual teacher. Any candy or

other treat given in an individual classroom must be consumed in that class and before leaving the room.

Health Education and Family Life Instruction

Livingston Middle School provides instruction in health and family life in accordance with Education Code

provisions. All curriculums follow State Department of Education Guidelines. We use professional judgment to provide age appropriate instruction and materials. You are invited to discuss curriculum, methods of instruction

and use of instructional materials with us at any time. Please contact the Principal if you wish an appointment.

Permission slips are required.

Student Accidental Insurance for Participation in Sports

Under state law, school districts are required to ensure that all members of school athletic teams have accidental

injury insurance that covers medical and hospital expenses. The District does not provide medical and hospital services for students injured while participating in athletic activities, however the district does provide optional

coverage for students at a reasonable price through a private insurance carrier. Some students may also qualify to

enroll in no-cost or low-cost local, state, or federally sponsored health insurance programs. Information about these programs may be obtained by calling

1-800-880-5305. (Ed. Code, §§ 32221.5, 49471)

Head Lice

The district’s head lice policy encourages early detection and treatment in a manner that minimizes disruption to the educational program and reduces student absences. School staff shall report all suspected cases of head lice to the

school nurse as soon as possible. The school nurse or designee shall examine the student and other students who are

siblings of the affected student.

If a student is found with active head lice, he/she shall be excluded from attendance. The parent/guardian of the

affected student shall be given information about the recommended treatment for head lice and encouraged to begin

treatment of the student immediately and to check all members of the family. The student shall be allowed to return to school the next day and shall be checked by the nurse or designee before returning to class and allowed to remain

in school if no active head lice are detected. Once he/she is determined to be free of lice, the student shall be

rechecked weekly for up to six weeks. Three school days of excused absence will be allowed for the communicable condition to be resolved. Staff will maintain the privacy of students identified as having head lice.

Homework/Makeup Work Homework is an important learning tool when it is used to reinforce or expand concepts previously taught in the

classroom. It also helps to conserve class time for learning activities, which benefit most from teacher interaction.

The following guidelines are used for assigning homework at Livingston Middle School:

1. Students will be assigned an average of one to one and a half hoursof homework per day, five days per week.

2. Teachers will have the flexibility of deciding whether or not they should assign homework on any

given day. 3. The consequences for failing to turn in completed work when due are as follows:

a. First day - warning

b. Second day - teacher conference; parent notified

c. Third day - detention 4. Homework assistance will be available three days per week (T-W-Th) except during minimum days

from 2:35 - 3:05.

Makeup Work

No student may have his/her grade reduced or lose academic credit for any excused absence when missed assignments

and tests are satisfactorily completed within a reasonable period of time.

The teacher of any class from which a student is suspended may require the student to complete any assignments and

tests missed during the suspension. (Education Code 48913)

Students who miss schoolwork because of an excused absence shall be given the opportunity to complete all

assignments and tests that can be reasonably provided. As determined by the teacher, the assignments and tests shall

be reasonably equivalent to, but not necessarily identical to, the assignments and tests missed during the absence. Students shall receive full credit for work satisfactorily completed within a reasonable period of time. (Education

Code 48205)

Students who miss schoolwork because of unexcused absences shall be given the opportunity to make up missed work

within a reasonable amount of time and as can be reasonably provided by the teacher. Students in 6th – 8

th grades may

earn a minimum of 80 percent credit for assignments missed due to an unexcused absence. Teachers shall assign such

makeup work as necessary to ensure academic progress, not as a punitive measure.

Library Hours The library will be open to students from 7:20 a.m. to 3:00 p.m. Monday through Thursday.

Lockers Lockers are available to all students and are to be kept locked when unattended. Students are not to share their

combination with other students. The LUSD will not be responsible for lost or stolen property from the lockers.

P. E. lockers will also be available to 7th

and 8th grade students along with a master lock that students will be

responsible for. All lockers are the property of LUSD and are subject to inspection at all times. Permission slips must be returned to the office before a locker will be issued.

Lost and Found We have a lost and found box in the office. Unclaimed items are donated to a charitable organization.

Lunch Time Our district maintains a closed campus policy. If you wish your child to go home for lunch, send a note to the

attendance office stating that you wish him/her at home for lunch.

Once students arrive at school, they are not permitted to leave campus.

Medication If your child is on medication of any kind, please notify the school nurse. The school CANNOT administer

medication of ANY TYPE without written instructions from the child’s physician and also a written request from

the parent. Forms for this are available in the office.

Office Hours Our office hours are from 7:15 a.m. to 4:15 p.m. If you have any questions, please feel free to contact the school

at any time. Our phone number is 394-5450.

Parent Concerns/Complaints Occasionally a parent has a concern about something that is happening at school. We encourage parents to keep

good communication channels open with the school. We need your input. The established procedure to be followed is: 1. Conference with your child’s teacher.

2. If necessary, contact the school principal, counselor, or associate principal.

3. If you cannot resolve it, speak with the District Superintendent. 4. Lastly, ask to be put on the agenda of the next board meeting to discuss your concern/

complaint.

Parent Conferences In the fall and again in the spring, Parent-Teacher Conferences are scheduled. Parents are requested to come to

school at a pre-arranged time to talk with their child’s teacher about his or her academic and social growth. We

strongly feel that the Parent-Teacher Conference is the most meaningful method of communication and reporting

between school and home. During the conference there can be a mutual exchange of pertinent information about each individual child, which may be very important to his/her progress in school.

Parent Involvement We encourage you to make time in your busy life for your children’s school. It has been shown over and over

again that children whose parents are actively involved in school do better in school. There are many ways for you to become involved and help your child and the school. For example:

1. Help in the classroom.

2. Help in special events such as sports events, band concerts, and field trips.

3. Assist in our special projects. Some of the traditional ones are sports events, and graduation. 4. Attend Parent Conferences, Open House and Back to School Night.

5. Join the school’s Site Council, which meets on a monthly basis. Contact the school for more information.

6. Join the school’s ELAC, which meets four times per year. Contact the school for information. 7. Monitor your children’s watching television and homework completion habits.

8. Most importantly, be in contact with your child's teacher.

P.E. Clothes Students are required to dress out for P.E. in grades 7 and 8. The required uniform consists of a logo T-Shirt, black or green shorts and tennis shoes.

Radios/Electronic Devices

The use of personal radios, tape players, pagers, CD players, compact discs, electronic games and other electronic devices are not allowed at school. (Hearing aides, Visual Assistants and other medically necessary devices are excluded). Should a student be found with such a device it will be confiscated and sent to the office where it will be only returned to the parent. Use of such devices on a field trip is at the discretion of the individual teacher. The Staff of Livingston Middle School for is not responsible for lost, broken, damaged, or stolen electronic devices.

Reporting To Parents/Grading Policy

Report cards are issued Three times during the school year. The end of the three grading periods are: 1. October 27

1. November 1 2. February 28 3. June 4 Progress reports will be sent to parents/guardians in the middle of each grading period. Report cards will be

issued a week after the grading period ends.

In both the fall and spring a week is set aside for parent conferences. We urge you to attend. Not only will the

school have information for you but also we need your view of your child’s progress. (September 24 - 28 first

conference week and March 10 - 14 second conference week).

Grades are determined as follows: A = Outstanding

B = Above average

C = Average D = Below average

F = Failing : The parents of students who are failing or in danger of failing must be notified of the grade status

of the student prior to the issue of the F grade. I = Incomplete: Incomplete work must be made up within 3 weeks of the issue of the Incomplete mark.

Incompletes that are not made up by the due date automatically become F’s.

NM = No mark : Grade issued to students who are enrolled 15 days or less unless transfer grades are

available.

School Hours School hours for students are from 8:05 a.m. to 2:30 p.m. Supervision of students is not provided in the morning

until 7:20. DO NOT send your children to school until after that time. Following are scheduled minimum days

with a 1:30 release time: September 30 - October 4 December 13 April -17

November 22 Mar. 10-14 June 4

Sixth Grade Outdoor Education This is a weeklong outdoor education experience we are proud to offer to students. It is an added responsibility

taking students to the mountain setting and thus, students must earn the privilege to attend outdoor education. Students who are defiant, behave inappropriately, and do not comply with school expectations may be ineligible

to attend outdoor education.

Special Programs The school provides several special programs to enrich and meet the special needs of students. They are briefly described below.

1. TITLE 1 PROGRAM - Its purpose is to improve learning basic skills and assist the school to broaden and enrich the program. It provides for teacher aides or reading clinicians so that children in need can

receive greater special help from the teachers.

Special materials are purchased that are designed to accelerate learning. Reading specialists provide

intensive remediation for pupils. Through a yearly planning and evaluation process that includes advice

from parents (School Site Council and ELAC), the school works to constantly improve its program for

students. 2. SPECIAL EDUCATION PROGRAM - The parents and the school work together in partnership to

provide a free, individually appropriate education for the student. We have a team of specially trained

staff members known as the Child Study Team. During the course of the school year, your child may be referred to the Child Study Team if he/she is observed to be having learning, behavior, attendance or other

difficulties that may require some form of assistance in the regular classroom.

The Child Study Team may carry out informal assessment activities (e.g. observing your child in the

classroom assessing reading, math or other academic skills, screening for speech, vision or hearing problems, etc.) to assist in making appropriate recommendations. The teacher will keep you informed

regarding any unusual problems your child is having at school as well as any extra steps taken to provide assistance. No assessment for determining Special Education eligibility will be conducted without your

written consent.

3. MIGRANT EDUCATION PROGRAM - Some of our families move frequently because of agricultural employment. The Migrant Education Program provides special services for students from such families so

that the moves disrupt school and learning as little as possible.

4. AVID (Advancement Via Individual Determination) – This program is designed to prepare students in the average range for advanced coursework. Success in advanced classes will help students be ready

for college. AVID is an elective program offered to student in 7th and 8

th grades. Interviews and

recommendations for the program normally take place in the spring of 6th grade. LMS has earned the

distinction of being an AVID National Demonstration School since 1998. 5. DLA (Dual Language Academy) - LMS offers a dual language program in 6

th, 7

th and 8

th grades. The

goal of the program is to develop reading and writing skills in both Spanish and English.

Sports Program We maintain an inter-scholastic sports program for boys and girls in the 6th, 7th and 8th grades. The purpose of the program is to encourage the development of healthy bodies, sportsmanship and experience in teamwork.

Participation criteria is enforced. A sports program is offered students as an extra curricular activity after school.

Grades for participation are checked on a regular basis. Any “F” will exclude a student from playing.

Student Council

The Livingston Middle School Student Council is an elected representative body of students. The Council meets

weekly. Its officers, (President, Vice President, Secretary, and Treasurer) are elected in a school-wide election.

Additional representatives are elected in each homeroom to represent their class. The purpose of the Council is to act as the student voice and to sponsor activities of a beneficial nature for the student body. All representatives

and officers must maintain a “C” average with no grade lower than a “D”, in order to participate. All Student

Council members and their parent/guardian will sign a contract agreement stating the requirements and obligations for holding a student council position.

Telephone Use The school phone is a business phone and is to be used by school personnel only. Only in cases deemed as an

emergency by the school office may students use the school phone. Homework left at home, permission to

participate in special activities, permission to visit a friend, etc., are NOT considered emergencies. Please have your children make appropriate arrangements before leaving for school.

Transfer If you move or plan on being away from a school for a long period of time, please notify the attendance office as

early as possible. The necessary paperwork requires time to process, and will be made available for the next school that your child will be attending.

Walkers In Parking Lot

When walking to and from school, students are to walk around the parking lots. Do not cut between cars.

Student Conduct

We believe all students have the right to be educated in a positive learning environment free from disruptions.

Students shall be expected to exhibit appropriate conduct that does not infringe upon the rights of others or interfere with the school program while on school grounds, while going to or coming from school, while at school

activities, and while on district transportation. In accordance with Education Code and district policies, the staff

has developed standards of conduct. Prohibited student conduct includes, but is not limited to:

1. Conduct that endangers students, staff, or others

2. Conduct that disrupts the orderly classroom or school environment

3. Harassment or bullying of students or staff, including, but not limited to, cyber bullying, intimidation, hazing or initiation activity, extortion, or any other verbal, written, or physical conduct that causes or threatens to

cause violence, bodily harm, or substantial disruption, in accordance with the section below titled

"Bullying/Cyber bullying". 4. Damage to or theft of property belonging to students, staff, or the district

5. Possession or use of a laser pointer, unless used for a valid instructional or other school- related purpose with

prior approval from the principal or designee. (Penal Code 417.27) 6. Use of profane, vulgar, or abusive language

7. Plagiarism or dishonesty on school work or tests

8. Inappropriate attire

9. Tardiness or unexcused absence from school 10. Failure to remain on school premises in accordance with school rules.

Incentives for Good Behavior/Positive Rewards A. ONGOING REINFORCEMENT AND ACKNOWLEDGMENT: Administration and staff will acknowledge

and reinforce students for special efforts and achievement. This may include verbal praise and/or phone

calls, certificates, letters of commendation, etc.

B. SCHOOL-WIDE ASSEMBLIES: Assemblies will be held to recognize special achievements, citizenship,

scholarship, sports achievements, etc. Parents are invited and encouraged to attend.

C. SPORTS AND DANCES: Students will be eligible to participate as follows:

GRADE Requirements/Sports

All students participating in school-sponsored extracurricular activities must maintain a 2.0 grade point average

with no F grade. The grade point average used to determine eligibility shall be based on grades earned at each

three-week eligibility block.

Code of Conduct: Students participating in extra-curricular activities are expected to obey the following Code of

Conduct rules. a. Regular attendance at practice is required of all students except in case of illness or if excused by the

sponsor. A participant must attend school for a majority of the school day in order to be eligible to

participate in any scheduled activity. Medical appointments or extenuating circumstances with approval by the Administration are the only exception to this rule.

b. On trips, a student directly represents the school. Thus it is expected that all students will dress and

conduct themselves in an acceptable manner. Members of an activity must go and return in school-

provided transportation, the only exception being if a parent or legal guardian requests in writing to transport their child.

c. Students are responsible for all equipment issued to them. Equipment must be returned at the end of the

season or the student will be charged for replacement costs. Students are not eligible eo compete or practice unless all obligations are paid.

Additional Requirements for Sports Participation: 1. More than 3 detentions or one in-house suspension will render a student ineligible for the subsequent

three-week eligibility block.

2. Students who are removed from class with an official period suspension (vs. isolation) are ineligible for 7 calendar days beginning the day after the incident.

3. A student who becomes ineligible during the last three week eligibility block will be ineligible for the

remainder of the season. 4. Any official home suspension, for any part of the school day, will exclude the student from competition

for the duration of the season effective immediately.

Cafeteria Rules and Consequences

A. RULES

1. Be cooperative and patient with peers and all staff members. 2. Keep hands, feet and objects to yourself.

3. Clean up your area and return your tray to the work area.

4. No swearing, verbal harassment, or name-calling.

5. Defiance, fighting, and throwing food are NOT tolerated. (Refer to “Severe Clause” under consequences.)

6. No hats will be worn in the cafeteria.

Student Discipline We believe that high expectations for student behavior, use of effective school and classroom management

strategies, and parent involvement can minimize the need for discipline. School staff shall use preventative

measures, age-appropriate strategies and positive conflict resolution techniques whenever possible to correct student behavior to keep students in school and participating in the instructional program. Disciplinary strategies

may include, but are not limited to:

1. Discussion or conference between school staff and the student and his/her parents/guardians. 2. Referral of the student to the school counselor or other school support service personnel for case

management and counseling.

3. Convening of a study, guidance, resource panel, or other intervention-related team to assess the behavior and

develop and implement an individual plan to address the behavior in partnership with the student and his/her parents/guardians.

4. When applicable, referral for a comprehensive psychosocial or psychoeducational assessment, including for

purposes of creating an individualized education program or a Section 504 plan. 5. Enrollment in a program for teaching prosocial behavior or anger management.

6. Participation in a restorative justice program.

7. A positive behavior support approach with tiered interventions that occur during the school day on campus 8. After-school programs that address specific behavioral issues or expose students to positive activities and

behaviors, including, but not limited to, those operated in collaboration with local parent and community

groups.

Suspension and Expulsion

Maintaining an environment, which promotes learning and protects the health, safety, and welfare of all students, may require the suspension or expulsion of a student from regular classroom instruction. District policies and

school site rules shall clearly identify district behavior standards and the disciplinary procedures for addressing

violations of those standards, including suspension and/or expulsion.

Students facing suspension or expulsion shall be provided with fair and equitable treatment by affording them their due process rights under the law. The administration and staff shall comply with procedures for notices,

hearings and appeals as specified in law and administrative regulation.

Except for single acts of a grave nature or offenses for which suspension or expulsion is required by law,

suspension or expulsion shall be used only when other means of correction have failed to bring about proper

conduct or the student's presence causes a continuing danger to himself/herself or others.

The grounds for suspension and expulsion and the procedures for considering, recommending and/or implementing suspension and expulsion shall be specified in the district’s administrative regulation.

Notification to Law Enforcement Authorities

In accordance to Education Code 48902, the principal or designee shall notify appropriate city or county law

enforcement authorities of any student acts which may violate law.

Removal from Class by a Teacher and Parental Attendance A teacher may remove any student from his/her class for the remainder of the day and the following day for

committing an obscene act, engaged in habitual profanity or vulgarity, disrupted school activities or otherwise

defied valid staff authority, or any other act listed in the district’s administrative regulation. When removing a

student from his/her class, the teacher shall report this action to the principal or designee and send the student to the principal or designee for appropriate action.

The teacher of the classroom may require the student’s parent/guardian to attend a portion of a school day in

his/her child's classroom. When a teacher makes this request, the principal shall notify the parent/guardian that the

parent/guardian's attendance is requested pursuant to law (Education Code 48900.1). The parent/guardian’s attendance may be on either the date the student is scheduled to return to class or within one week thereafter and

may request the parent/guardian to meet with the principal after the visit and before leaving school

Bullying/Cyber Bullying

The School Board desires to prevent bullying by establishing a positive, collaborative school climate and clear rules for student conduct.

Cyber bullying includes the transmission of communications, posting of harassing messages, direct threats, or

other harmful texts, sounds, or images on the Internet, social networking sites, or other digital technologies using

a telephone, computer, or any wireless communication device. Cyber bullying also includes breaking into another

person's electronic account and assuming that person's identity in order to damage that person's reputation.

Bullying is defined as hurtful or aggressive acts that are carried out repeatedly over time that are unprovoked. These acts involve a real or perceived imbalance of power, with the more powerful individual or group attacking

or intimidating those who are considered less powerful and who may have difficulty defending or protecting

themselves. The perpetrators usually feel empowered and receive enjoyment when demonstrating hurtful or aggressive behavior and the victim(s) have a sense of being oppressed by the perpetrator(s). Bullying may be

physical (hitting, kicking, spitting, pushing), verbal (taunting, malicious teasing, name calling, threatening), or

psychological (spreading rumors via verbal, written, and electronic communication, manipulating social

relationships, or promoting social exclusion, extortion, or intimidation).

Students shall be encouraged to save and print any messages sent to them that they feel constitute cyber bullying and to notify a teacher, the principal, or other employee so that the matter may be investigated.

Students may submit a verbal or written complaint of conduct they consider to be bullying to a teacher or

administrator. Complaints of bullying shall be investigated and resolved in accordance with site-level grievance

procedures.

Any student who engages in cyber bullying on school premises, or off campus in a manner that causes or is likely to cause a substantial disruption of a school activity or school attendance, shall be subject to discipline in

accordance with district policies and regulations. If the student is using a social networking site or service that has

terms of use that prohibit posting of harmful material, the Superintendent or designee also may file a complaint

with the Internet site or service to have the material removed.

Classroom & Playground Rules and Consequences A. RULES

1. Be prepared, cooperative and courteous.

2. Follow directions the first time given. 3. Keep hands, feet, and objects to yourself.

4. Do not disturb others.

5. Turn in completed work when due.

6. Fighting and defiance are not tolerated. (refer to “Severe Clause” under consequences) 7. No gum.

8. Do not destroy school or personal property.

B. CONSEQUENCES (On a weekly basis in 7th & 8th and on a daily basis in 6

th grade).

1. Name on board - Verbal warning

2. Check by name – one check away from detention. 3. Two checks by name – detention

4. Three checks by name - detention/parent notified.

5. Severe Clause - refer to office. Possible consequences include: Responsibility Center or out-of school

suspension, Saturday School, isolation in the student cubicle and parent notification and conference.

C. BUS RULES

1. Bus riders shall listen and obey the Bus Driver’s instructions for safety. 2. Bus riders shall walk onto the bus and be seated as quickly as possible.

3. Bus riders shall stay seated while in the bus.

4. Bus riders shall place backpacks on floor in from of them. 5. Bus riders may talk quietly only with the person seated next to them. Riders may not talk to other riders

behind them or across the bus from them. Bus riders shall be silent when instructed to by the Bus Driver.

Bus riders must be silent at all railroad crossings. 6. Bus riders shall not place any items in the aisle of the bus. It must be kept clear for a safe pathway into

and out of the bus.

7. Bus riders shall not throw anything inside of the bus.

8. Bus riders shall not put their hands, arms, or any other part of their body outside the bus window. 9. Bus riders shall not eat or drink while on the bus.

10. Bus riders shall not litter the bus.

11. Bus riders shall not bring any type of combustible item, ignition source, or weapon on the bus. Any violation of this rule will be grounds for immediate suspension for a minimum of two (2) weeks from the

bus.

12. Bus riders shall not touch another rider in any way that may be inappropriate.

13. Bus riders may not touch or operate any bus controls without Bus Drivers authorization, except during an emergency as instructed.

14. Bus riders shall give proper identification when requested by the Bus Driver. Violations of the above rules are dealt with in various ways.

A. CONSEQUENCES 1ST VIOLATION: Verbal Warning by Driver.

2nd VIOLATION: Student assigned designated seat

3rd VIOLATION: Driver issues first Citation* - Student meets with Principal. Parents are notified. 4th VIOLATION: Driver issues second Citation* - Parents are notified and 1 – 5 day suspension

from bus services.

5th VIOLATION: Driver issues a Citation* - 3 or more citations will result in long-term bus service

suspension and/or school suspension. Immediate suspension from school and or bus service suspension for threatened or actual bodily harm.

Citations are written by bus drivers but issued to students by the school administrator.

B. BUS SAFETY RULES

In accordance with the amended section 39831.5 of the California Education code, the Livingston Union

School District is providing the following information and rules regarding school bus safety. 1. Students shall listen and wait for instructions from the bus driver when crossing the street to and from the

bus. Students shall NOT cross the street behind the bus. Students shall inform the bus driver if they need to cross the street.

2. Students shall stand quietly and orderly while waiting for the school bus. Students shall respect the

property of others while walking to and from the designated bus stop. Students should walk only on

sidewalks, and/or public right of way, and not on lawns or properties not belonging to them. 3. Students shall be at the designated bus stop five (5) minutes before the scheduled arrival of the school bus.

4. Students shall walk directly from home to the designated bus stop in the morning and directly home from

the designated bus stop in the afternoon. Students should not stop at friend’s homes, nor stop at stores to or from the designated bus stop. Parents should discuss the most direct walking route they wish their

child to take to and from the designated bus stop.

5. Students shall only be allowed to disembark the bus at their designated bus stop by the school and

transportation department. Parents wishing to have their child dropped off at a different stop than usual shall call the students’ school of attendance and/or send a note to inform the school office of the change.

Notes from the parents must be approved and signed by the school office. Notes from the parent to the

bus driver will not be accepted.

6. Students shall respect other persons. They shall not harass or harm another person. 7. Animals shall not be allowed on the bus. The only exception to this is an approved guide dog, signal dog,

or hearing dog that assists a handicapped person. Students that arrive at the bus stop with animals, except

as noted, will not be allowed to board the bus. 8. Skateboards shall not be allowed on the bus.

BEHAVIOR EXPECTATIONS AND CONSEQUENCES

The number of violations occurring in one school year determines the consequences.

C. Playground/Equipment 1. Equipment is to be used for its intended purpose (basketballs and volleyballs are not to be kicked.)

2. Restrooms are to be kept clean and used properly. They are not to be used as a social hall, loitered in, or considered part of the playground. All restroom doors are to remain open during school hours. The

design of the restrooms provides students with privacy at all times.

D. General Procedures 1. Students are not to be on the playground until 7:20 a.m. 2. Once a student is on the school grounds, he/she is NOT to leave.

3. Except in an emergency, (health/accident), students are to have a pass from a teacher to come to the

office. Student will be required to access the attendance office or attendance office window only.

4. Students are to have a phone pass before using the phone. 5. Students who are out of class are to have a pass from a teacher.

8. Bikes and skateboards are NOT to be ridden on the sidewalks at any time!

Consequences Defined

Detention:

Detention is assigned to the student by school officials as an intermediary step to correct misbehavior. Detention will be offered in the Responsibility Center Monday through Friday during lunch time and on

Tuesday mornings. Upon receiving a detention it is the student’s responsibility to report to the office to signup

for his/her scheduled detention. Failure to do so upon a school officials request will result in a Saturday School. Upon receiving a detention with a scheduled date and time from the office. The student will have two school days

to return his/her signed detention slip to the assigning teacher. If a student does not provide the assigning teacher with a detention slip signed by the parent or guardian it will result in the following consequences:

1st Offense – Parent notification by assigning teacher.

2nd

Offense – One additional detention 3

rd Offense – Referral to the office for a Saturday School

As a reminder the detention list will be posted on the morning of the scheduled detention date on the Science Prep

window (next to G-8). Missing lunchtime detention is not an option.

Severe Clause: (Referral System): 1. Teacher sends students to office with Discipline Referral form. 2. Student will be detained in-house until Principal/Vice Principal can interview the student.

3. Possible consequences:

- Teacher class suspension for remainder of period and the next day

- Parent/Teacher/Student/Administrator conference - Student assigned to the Responsibility Center

- Suspension from school

- Expulsion from school 4. Teacher to be informed of follow up on referral form.

Suspension 1. Student shall not report to school during the period of suspension, unless coming to the office on official

business by prior arrangement with a school administrator. Student is expected to be under the

supervision of a parent during school hours when serving suspension days at home (7:00 a.m. - 4:30 p.m.)

2. Student is not to attend any school event at any school campus during suspension. 3. The responsibility of obtaining and doing class work lies with the student. The teacher may require the

student to complete any assignments and tests missed during the suspension.

School Vandalism Consequences

48900.6. As part of or instead of disciplinary action prescribed by this article, the principal of a school, the principal's designee, the superintendent of schools, or the governing board may require a pupil to perform

community service on school grounds or, with written permission of the parent or guardian of the pupil, off

school grounds, during the pupil's non school hours. For the purposes of this section, "community service"

may include, but is not limited to, work performed in the community or on school grounds in the areas of outdoor beautification, community or campus betterment, and teacher, peer, or youth assistance programs.

This section does not apply if a pupil has been suspended, pending expulsion, pursuant to Section 48915.

However, this section applies if the recommended expulsion is not implemented or is, itself, suspended by stipulation or other administrative action.

Responsibility Center

The Responsibility Center is a self-contained classroom with strict guidelines and procedures. Students may

be assigned the Responsibility Center for one or two periods or one or more days depending on the specific circumstances. Students who are assigned to the R.C. will be isolated from the general school population

including recess and lunch. Students will be expected to complete all homework and class assignments and all

work assigned by the R.C. teacher. Students who fail to comply with all of the R.C. rules and regulations will

be assigned additional days to the R.C. or home suspension. Further non-compliance may result in recommendation for an alternative placement. A full day assignment to the Responsibility Center is equal to a

one day of suspension. Students who spend a minimum of three hours but don’t complete a full day in the

R.C. will be credited with a half-day suspension. Every half hour spent in the R.C. short of a half-day is equal to one detention on the student’s discipline record.

Isolation Cubicle

Students who are assigned to the office cubicle by an administrator will earn a detention for every half hour spent in the cubicle on his/her discipline record up to a maximum of 2.5 hours and will be used accordingly

with all school functions where eligibility is a factor.

Ineligibility List: Students who owe for library or uniform fines and/or have behavior problems will be placed on an ineligibility

list. While on the list, students may not participate in extra curricular activities. The ineligibility list will be

revised every three weeks.

Student use of Technology Resources

The district intends that technological resources provided by the district be used in a safe, responsible, and proper manner in support of the instructional program and for the advancement of student learning. The district

shall ensure that all district computers with Internet access have a technology protection measure that blocks or

filters Internet access to visual depictions that are obscene, child pornography, or harmful to minors and that the

operation of such measures is enforced.

Before a student is authorized to use the district's technological resources, the student and his/her

parent/guardian shall annually sign and return the Acceptable Use Agreement specifying user obligations and responsibilities. In that agreement, the student and his/her parent/guardian shall agree not to hold the district or

any district staff responsible for the failure of any technology protection measures, violations of copyright

restrictions, or user mistakes or negligence. They shall also agree to indemnify and hold harmless the district and district personnel for any damages or costs incurred.

The district also reserves the right to monitor use of the district's systems for improper use without advance notice or consent.
