GENERAL Global Best Practice is the overarching brand that umbrellas multiple AXELOS best practice products, including ITIL, PRINCE2, MSP, P3O and others. The internationally renowned portfolio is adopted as best practice through high quality training, publications, software tools and consultancy for portfolio, programme, project, risk, value and service management disciplines. The Global Best Practice products were created on behalf of Her Majesty's Government (HMG) in the United Kingdom. From 2000 to 2010 OGC was custodian of the intellectual property and since 2010 the Cabinet Office has owned and created further intellectual property assets. On 1 July 2013 ‘AXELOS’ was announced as the name for the Joint Venture company that the Cabinet Office has formed to deliver and commercialize the UK Government's portfolio of Best Practice accreditation and publishing services, including the ITIL and PPM product sets. AXELOS now owns the intellectual property of the whole Global Best Practice portfolio and will build on the current business activities and developing products in new areas. This document provides general advice on the use of AXELOS copyright text/diagrams and trade marks and should be used in conjunction with the terms and conditions of the Licence Agreement. AXELOS and the UK Government have invested in the development and protection of the trade marks and copyright and AXELOS reserves all rights of ownership. AXELOS limits the use of its material (trade marks and copyright) to persons and organizations who have received permission to use its material either by way of a Waiver Licence, a Copyright Licence, a Trade Mark Licence or a Trade Mark and Copyright Licence. In order to obtain permission to use the trade marks and/or copyright material, or if you wish to use the trade marks and/or copyright material in any way other than as detailed in the Licence Agreement then please contact the Licensing team at [email protected]. These Guidelines do not constitute legal advice and any organization or person using these guidelines should seek their own legal advice. Please note that laws relating to Intellectual Property may vary from country to country. CRITERIA Definition of terms Copyright – refers to text, diagrams and tables that form part of the content of the official Global Best Practice portfolio material that is available for re-use in accordance with the terms of your IP Licence. Product – refers to a product which has passed a product review and is specified within the Licence Agreement. Symbol – refers to the “™” or “®” symbol. Trade marks – refer to logos and word marks. If a trade mark features a “™” symbol, the trade mark contains unregistered rights. If a trade mark features the “®” symbol, the trade mark is registered. It is important that the correct trade mark status is accorded to each trade mark. Word marks – refers to trade marks in normal font for example the product names: PRINCE2®, MSP®, P3O®, M_o_R®, ITIL®, P3M3®, MoP® and MoV®. Criteria AXELOS encourages the creation of new and innovative products and services which extend the range of products available and allows the material to be accessed by a wider range of people in a greater range of both geographic and industry sectors. Prior to submitting your product for review, you should ensure that your product complies with the criteria set out below. You may use as much AXELOS copyright material as you need within your product, but the re-use of the complete or substantial content of one of our products will only be permitted where the applicant adds value to the original. This may be done by: creating a product that, when compared to an official AXELOS product or service, is

transformed, distinctive, exhibits its own personality, and is clearly differentiated from AXELOS products. You should therefore ensure that your product or service does not simply change the delivery mechanism or typographical arrangements as this will be deemed insufficient to meet this requirement; and

by satisfying one or more of the following conditions: it brings together information from a variety of sources in order to add a new

perspective, purpose or dimension. it includes new material to the AXELOS source material: You should ensure that your

new material is completely original and is not simply a rewording of the AXELOS material;

adding commentary, analysis, indexing, search facilities or text retrieval software in ways which extend its usefulness as a reference tool;

presenting the material in completely different ways so that it enhances the customers’ understanding of the AXELOS guidance;

translating the material into languages other than English.

In assessing whether your application adds value to the portfolio of AXELOS products we confirm it meets the above points, and also consider: the amount of new material compared to the amount of AXELOS source material in the product; whether, when compared to an AXELOS product or service, the product is distinctive and

clearly differentiated from the AXELOS product or service; whether it extends the range of products available by providing a product or service with a

different purpose to the portfolio of AXELOS products; and whether it enhances customers’ understanding of AXELOS products. Adding to the Brand Value Please provide evidence that your product adds value to the AXELOS brand(s) and complements the existing range of official products available. Where possible, please show that your product: is timely, topical and current; is suitable for the target audience (in terms of content structure, length, presentation of key

messages); is not simply a summary of an existing AXELOS publication; has content that is aligned with the relevant, current published guidance and does not conflict

with or contradict that guidance; and is a fair representation of the method and faithfully embodies the spirit of the brand.

For Trade Mark and combined Trade Mark and Copyright Re-use As well as meeting the criteria outlined above, when using the trade marks you should: use the correct trade mark symbols; use the correct trade mark acknowledgement statements; and adhere to the IP Guidelines.

For products using the trade marks or a combination of trade marks and copyright material you should ensure your product meets the following quality criteria. For all formats you should ensure the product: has a professional look and feel to the material; is easily readable and understood, and is written in clear understandable English (or translated

language); and has a good clear layout, being logical and providing sections/chapters in a good sequence; has been well edited; where applicable, uses terms consistently in accordance with the relevant methodology; and where applicable, has a glossary or explanation of technical terms.

For paper-based formats the following criteria also applies. The product should be: comprised of a good quality of paper; and use a good quality of print.

For software and web-based products the following criteria also applies. The product should be: of sound and reliable technical and operating quality to provide a smooth and reliable function,

e.g. it does not crash or freeze for long periods of time; easy to understand and use; compatible with the current popular operating systems; able to facilitate the application of the principles found in the original material from which the

documentation.

TRANSLATIONS AND FOREIGN LANGUAGE PRODUCTS You may translate your product into any internationally recognised language provided you ensure that: if your product, and any related marketing material, is in a language other than English we may

request that you either (a) provide us with an English translation which satisfies the translation criteria set out in the Product Review Criteria; or (b) we will obtain an English translation (for which you may be required to cover the costs;

each translation of a product must be submitted for review and a licence obtained for each translation. The translation of the product should be undertaken by a competent translator;

if we request details of the translator used these should be provided promptly; the product is translated into the language faithfully and accurately in a manner which remains

true to the style, nature and essential characteristics of the product; where abbreviations or alterations from the previous text of the product are made these are

clearly explained. Previous Quality Reviews We can accept previous quality reviews conducted on the product as part of our review process which may reduce the time taken in the review process. If you would like to include any previous reviews we will need the following information: the review itself. The review must have been conducted by an independent person or

organisation and you must provide us with details of the reviewer, including (i) their subject matter qualifications; (ii) their experience, (iii) how they have applied the Product Review Criteria, (iv) contact details, (v) any other relevant details that we may reasonably require;

our review assessment report form must be completed and returned to us. The review criteria can be provided to you upon request; and

the review should cover all of the review criteria elements. Where a review does not satisfactorily cover all the elements we may still accept the review as a partial review of the product.

We reserve the right to carry out our own review of your product. All licences are non-exclusive and non-transferable.
