Nine months prior to the expiration of the 2 year statute of limitations, defendant filed an answer, which was verified by her counsel pursuant to Pa.R.C.P. 1024(c), attesting that she was the driver of the vehicle which rear-ended plaintiff. Almost three months after the statute of limitations expired, defendant filed a motion to amend her responsive pleading to aver that a non-party, rather than defendant, was the operator of the subject vehicle. The right to amend should be liberally granted unless the amendment would result in prejudice to the adverse party. Since plaintiff justifiably relied upon defendant’s judicial admission in her original answer, and plaintiff would clearly be prejudiced by the proffered amendment due to her inability to assert a viable claim against the non-party, plaintiff would clearly be prejudiced by the proposed amendment, and as a result, defendant’s motion to amend was denied.

Leslie L. Lewis, Esquire, Counsel for Defendant Summary of Opinion:

A dental supply company filed a motion for summary judgment in a debt collection action that it instituted against a dental practice group which purchased dental supplies on credit, but failed to timely pay in full for the products delivered. The debtor maintained a supply account, an installment contract account and a software license account with the creditor, and in opposing the summary judgment motion, the debtor contended that the creditor supply company arbitrarily applied the debtor’s payments to the foregoing accounts. Where a debtor owes more than one debt to a creditor, the debtor has the right to specify which payment is to be applied to which debt, but if the debtor fails to exercise that right, the creditor may apply the payment to one or more of the debts in any manner in which the creditor chooses. Since the checks submitted by the debtor during the relevant time period did not designate to which account they were to be applied, the creditor was entitled to apply those payments to the installment contract, which thereby resulted in a supply account default. Consequently, the debtor’s motion for summary judgment was granted with respect to the amount owed on the supply account..
