Water A�airs Minister Nomvula Mokonyane recently revealed that the drought currently a�ects 173 of the 1 628 water supply schemes na-tionally, serving approximately 2.7 million households.She also revealed the scale of the effect of the drought and the state of water security in the country. “An estimated 6 500 stand-alone rural communities are currently experiencing water shortages. These are mostly situated in KwaZulu-Natal, Mpuma-langa, Limpopo and North West provinces,” said Mokonyane.

She said this number could increase to over 11 000 rural communities as the dry period extended and local water resources got depleted.

Mokonyane added that in badly affected areas such as the northern parts of KwaZulu-Natal, southern parts of Mpumalanga, and parts of Limpopo, North West and the Northern Cape, about 50% of local water storage is problematic and could become critical if not managed carefully.

According to a recent article, a Water Research Commission (WRC) study had indicated that South Africa lost 1.58 billion kilolitres of water a year, or just under 132m k/l a month.

This was enough water to fill a third of the Gariep Dam, the largest in South Africa.

The water loss reportedly cost South Africa around R7.2bn a year.

It is reported that 37% of our clean drinkable water is lost through leaking pipes, dripping taps and infrastructure failures and some analysts say the more realistic figure here is about 50% losses.

A study released by the Department of Water and Sanitation in conjunction with the Water Research Commission estimates that 1.58-billion cubic metres of supplied water is unaccounted

for each year. About 36.8% of SA’s water is nonrevenue water — which represents the level of water loss from urban supply schemes due to nonpayment of accounts (unbilled metered and unbilled unmetered), illegal offtake and loss and leakage from infrastructure.

Research data from 132 (of 237 municipalities), representing 75% of the total volume of municipal water supply, show that the current level of non-revenue water is estimated at 36.7%, of which 25.4% is considered to be losses through physical leakages .

Gauteng spends between R50m and R100m a year on infra-structure maintenance, but “this is not enough to cover

one-third of the cost required for maintenance, let alone refurbishments”.

In Etekwini, 237 million litres a day are lost due to illegal water connections, vandalism, and

leaks that are not reported on time.

Government has earmarked R350 million to address

the disaster.The government is spending about

350 million rand ($25 million) on measures to reduce the effects of the drought, such as drilling bore-holes, upgrading infrastructure, capturing more rainwater and build-ing desalination plants, facilities that make sea water potable. It will spend

a further 95 million rand on water tanks and other steps to alleviate the drought.

According to a recent government report, R300 billion needs to be spent over the short term to avoid a full scale water crisis.

It is predicted that South Africa’s water demand will out-strip its supply by 2030The 2030 Water Resources Group, of which the Water Affairs department is a member, has calculated that, by 2030, the demand for water will exceed supply by 17%.

The national theme during a recent water week was, ‘What if this were the last drop’. That is a sobering thought for anyone who has suddenly found a dry tap due to a pipe burst, and it is a daily reality for millions of people throughout South Africa. It could become a daily reality for us all.

To Trust or not to Trust??Many people consider setting up a trust without realising and appreciating the full consequences that goes with a trust.

A trust is a legally binding relationship which is created by the founder who places assets under the control of trustees for the benefit of the beneficiaries. This either happens during the founder’s lifetime (inter vivos trust) or at the death of the founder (testamentary trust). In order to shed light on inter vivos trusts we shall briefly look at some of the advantages and disadvantages of such trusts.

Advantages of a trustEfficient successionDue to the fact that a trust never dies, but is rather terminated at the instance of trustees or as directed by the trust deed, beneficiaries will be able to continue enjoying the asset if one beneficiary were to pass away, more so the founder. This also curbs the need to transfer property and assets to other beneficiary whenever one of them passes away. This, in turn, spares costs pertaining to transfers and administration of estates.

Protection against creditorsAs the trust’s assets are not owned by the beneficiaries, trustees or the founder, creditors do not have a claim on the assets. This is most important for people who have exposure to potential liability. Companies and individuals are able to transfer assets into trusts, and such assets shall be protected

against being attached, for example, by creditors issuing claims against beneficiaries or founders.

Reducing estate dutyInter vivos trusts can be used to minimise estate duty. No estate duty should be payable on assets owned by the trust as a trust does not die. Estate duty is currently taxed at 20%. This estate duty saving can be substantially large especially for high net worth individuals who are worth millions of Rands. In comparison,

DisadvantagesLoss of controlThe founder of the trust needs to be aware that the assets in the trust do not belong to him/her anymore. The assets belong to the trust for the benefit of the beneficiaries. The founder is totally devolved from ownership of the assets as soon as the assets are registered in the name of the trust. Should there not be separation of ownership of assets or loss of control of such assets, the trust may be seen as an alter ego of the founder which could result in the assets being included in creditors’ claims as well as having estate duty consequences. This can also be construed as a mechanism for tax evasion where the founder may be held criminally liable.

Duties of trusteesTrustees can be held personally liable for losses suffered by the trust if it can proven that they did not act with care,

diligence and skill required by the Trust Property Control Act. Trustees may be proven negligent not only if they invested in risky investments, but also if they invested capital too conservatively causing the capital not to grow sufficiently. Trustees also need to be aware that they can still be held liable if only one trustee has signing power on behalf of the trust and he/she makes a poor decision that finds all the trustees liable for his negligence.

TaxThe earnings from the assets in the trust are taxed at 40% and interest exemptions do not apply to trusts. Also, the consideration for capital gains tax for a trust is much higher than that of an individual. This is only calculated upon the assets being transferred to the beneficiary in their personal capacity.

As can be seen above, a trust may not be for everyone depending on the reasons for establishing one and on the circumstances that necessitate the establishment of a trust. For this reason, it would be beneficial to also consult with a certified financial planner, in conjunction with your attorney.
