e. Terms of Payment:95o/o of payment shall be allowed on proof of receipt of material as recorded in

Provisional Consignee receipt certificate and submission of Security Deposit as certified byDG:DD. The balance 5olo will be payable after final acceptance of the entire stores by theconsignee as recorded in his final receipt certificate.

f. Transit lnsurance:The purchaser will not pay separately for transit insurance and the supplier will be

responsible for arrival of the entire stores contracted for in good condition at destination.The consignee will, as soon as possible but not later than 30 days of receipt of stores, notifythe contractor of any loss/damage to the stores that may have occurred during transit.

g. Town duty, Octroi & TerminalTax:(i) Government materials issued to contractor free of cost for fabrication purpose

are exdmpted from payment of Municipal and other local taxes under article205 ol the Const(ution. \

(ii) ln respect of the stores which are to be supplied to Government Departmentcompl,iance with acceptance of tender / rate contracts placed by the DirectorateGeneral intended for Government are exempted form payment of Octroi /Terminal / Town Duty under Municipal Act / Bye/Laws formed there under.

(iii) Octroi exemption certificate where necessary, will be issued to contractors bythe consignee of the stores concerned on application for presentation to theM un icipal Authorities.

(iv) In either case, should any Municipality insist on payment of such taxes or duty,the same should be paid by the contractor to avoid delay in the supplies andpossible demurrage charge. The receipt obtained for such payment shoulddone be forwarded to purchase officer concerned without delay together with acopy of relevant act or bye-laws/notifications of the municipality or the localbody concerned to enable him to take the matter with municipality for refund ifadmissible under the said acts or rule of the municipality concerned.

h. Warranty & Guarantee:Unless some special Warranty/Guarantee clause has been stipulated elsewhere in theinvitation to tender or any of its Annexures, the following warranty shall form part of thecontract placed on successful tenderer: -

Except as otherwise provided in the invitation to the Tender, the contractor/seller herebydeclares that the good, stores/articles sold/supplied to the purchaser under this contract shallbe of the best quality and workmanship and new in all respect and shall be strictly inaccordance with the specification and particulars contained/mentioned in contract. Thecontractor / seller hereby guarantees that the said goods/stores/articles would continue toconform to the description and quality aforesaid for a period of 24 months from the date ofsupply of the said goods/stores/ articles to the purchaser notwithstanding the fact that thepurchaser (lnspector) may have inspected and/or approved the said goods/stores/articles ifduring the aforesaid period of 24 months the said goods/storeVarticles be discovered not toconform to the description and quality aforesaid or not giving satisfactory performance orhave deteriorated and the decision of the purchaser in that behalf shall be final and bindingon the Contractor /Seller and the purchaser shall be entitled to call upon the contractor/sellerto rectify the goods/stores/articles or such portion thereof as is found to be defective bythe purchaser within a reasonable period, or such specified period as may be allowed bythe purchaser in his discretion on an application made thereof by the contractor/ Seller, andin such an event, the above mentioned warranty period shall apply to thegoods/stores/articles rectified from the date of rectification thereof, otherwise thecontractor/seller shall pay to the purchaser such compensation as may arise by reasons ofthe breach of the warranty herein contained.

(i) Guarantee that they will supply spare parts, if and when required on agreed price. Theagreed basis could be including but without any limitation and agreedliscount on thepublished catalogue or an agreed percentage of profit on the landed cost.

(ii) Warranty to the effect that before going out of production for the spare parts they will giveadequate advance notice to the purchaser of the equipment so that tne lbtter mayundertake the balance of the lifetime requirements.

(iii) Warranty to the effect that they will make available the blueprints of the drawings of thespare s if any when required in connection with the main equipment.

(iv) lt is a condition of the contact that the contactor shall be responsible for free after-sales-service for minimum period of 24 months from the date of acceptance of the equipment by

, the consignee. \\ \i. Correctness and completeness.of stores: The stores will be completed in every respect with

mountings fittings, fixtur"es and standard accessories which are normally supplied even thoughnot specifically mentioned in the specifications. The contractor shall not be eligible for paymentin respect of such mountings fittings, fixtures and standard accessories, which are needed forsafe operation of the equipment. The contractor shall be responsible for the completeness of theequipment and for efficient working of the same at site.

j. The period for making risk purchase shall be nine months instead of six months as provided insub para clause 14 (7)(ii i) of the General Conditions for the contract DGS&D€S(R).

k. Repeat Order: Purchaser reserves the right to place order upto 50o/o of the original quantity ofany item(s) on the same terms and conditions stipulated in the original acceptance of tenderduring the validity of this tender or within six months of the original A/T whichever is later will beobligatory on the part of the supplier to execute repeat order(s) also.

l. Tolerance: The purchaser reserves the right to place an additional order to the extent of 21o/oof the ordered quantity on the same price, terms and conditions during the currency of thecontract.

m. Failure and termination: Liquidated damages to the extent of 1l2o/o (half percent) of thecontract price of the whole unit per week for such delay or part thereof subject to maximum of5o/o of the contract price of the whole unit will be deducted from the contract in the event offailure to deliver the stores within the contractual delivery period.

n. Please return acknowledgement of contract duly signed immediately.
