January 15, 2018 REACH COMPLIANCE STATEMENT REACH (Registration, Evaluation, Authorization and Restriction of Chemicals) is a European Union Commission (EUC) Regulation on chemicals and their safe use. The REACH regulations became effective on June 1, 2007 and will be phased in until 2018. REACH establishes specific duties and obligations on a business in the European Union (EU) which manufactures or imports a substance or article that includes a “substance of very high concern” (SVHC) in concentrations of more than 0.1% w/w. A substance which is listed on the “Authorisation List” published by the European Chemicals Agency (ECHA) (Annex XIV of the REACH regulations) cannot be manufactured or imported in the EU after a fixed date unless the ECHA authorizes the use of the substance for a specific use or uses. As of January 15, 2018, there were 181 substances on the SVHC list and 43 substances on the Authorisation List. Further, the use of substances listed in Annex XVII of the REACH Regulations are banned in all articles or substances produced or imported in the EC except to the extent that the use complies with the specific restrictions contained in Annex XVII. Although not required to directly register any of its products with the ECHA, Boltaron Inc. (Boltaron) is committed to assisting its customers in their efforts to comply with REACH. To that end Boltaron has reviewed the formulations of the following products: 1050, 1050E, 1165, 1165C, 2019, 2020, 2150, 2450, 3355, 3420, 4004, 4008, 4010, 4050, 4065E, 4065MP, 4100, 4125, 4205, 4225, 4300, 4310, 4311, 4323, 4325, 4330, 4330M, 4332, 4332P, 4333, 4333W, 4335, 4350, 4353, 4550, 4800, 4800M, 6500, 6530, 6540, 6800, 6800E, 9200, 9200C, 9230, 9230C, 9250, 9250C, 9803, 9803E, 9803D, 9815, 9815D, 9815E, 9815M, 9815P, 9815SR, 9850, 9850E, 9916, 9916D So upon review of the formulations of these products and to Boltaron’s knowledge: (1) its products do not currently contain substances listed on the Candidate List of Substances of Very High Concern or the Authorisation List, both as published by the ECHA on its website on the date of this statement, in excess of the applicable legal thresholds; and (2) all substances contained in its products are currently in substantial compliance with the current conditions and restrictions of Annex XVII of the REACH regulations. Boltaron will endeavor to appropriately update or modify this REACH Compliance Statement should any changes occur in the composition of Boltaron’s products or the REACH regulations, including the addition of any substances to the SVHC Candidate List, the Authorisation List or Annex XVII of the REACH regulations.
