THE King of the AbaThembu, BuyelekhayaDalindyebo, has written a letter to the Min-ister of Cooperative Governance and Tradi-tional Affairs, Pravin Gordhan, EasternCape Premier Pumullo Masualle, MECFikile Xasa, National Chairperson for theHouse of Traditional Leaders and EasternCape House of Traditional Leaders Chair-person, Ngangomhlaba Matanzima, re-questing information on the appointment or

coronation and recognition of SiyambongaMatanzima as King of Western Tembuland.

The royal house had confirmed this, stat-ing that the king has reacted on an invita-tion letter sent to him by Chief GwazinambaMatanzima. The invitation was extended toKing Buyelekhaya Dalindyebo, reigningking of the Thembunation, to attend the cor-onation of Siyambonga Matanzima, whichis scheduled to take place at Qamata, Cofim-vaba tomorrow, September 19.

In a letter, the King said the reason for hisshock, follows the recommendation by theNhlapho Commission that the AbaThembuhave one King, namely BuyelekhayaDalindyebo.It was made pertinently clear that kings

who were derecognised would be deemedkings until they had passed on and whereaf-ter, no person shall succeed them as king.In the letter the king also emphasized that

he wanted the appointment letter and certif-icate of recognition for SiyambongaMatanz-ima as a King of West Thembuland.He had also requested a copy of the recom-

mendationsmade by theHouse of Tradition-al Leaders, including theminutes of theRoy-

al family meeting.He also demanded all material and docu-

ments which had been placed before the ad-ministratorwho took thedecision toappointand recognize Matanzima as King.Dalindyebo stated that he demanded such

information to be furnishedwithin 5 days af-ter receipt of this letter, failing which, theking had threatened to approach the HighCourt in search of appropriate relief.King Dalindyebo is currently also in-

volved in a battle with some members call-ing themselvesmembers of the royal family,wanting to dethrone him.The matter was argued in court last week

and judgement is pending.

THE case of three men who were sup-posed to appear in the Mthatha HighCourt in connection with the killingof Elliotdale SAPS Station Command-er, Lieutenant Colonel Nomalizo Du-kumbana, was disrupted by the es-cape and shooting incident in whichrobbery suspects Sakhumzi Mvoko(30) and Yandisa Bila (32) died.

Siyamcela Ntshintshi (33) from Su-lenkama in Qumbu, Warrant OfficerPhumzile Ngqayimbana (41) fromBongweni locality in Mthatha andMbuyiseli Ngqayimbana (37) fromSangqu location were due to appear

for the start of their trial on Wednes-day, September 10.The three accused were arrested to-

gether with Constable Noxolo Matya(37) who pleaded guilty to the murderof Lieutenant Colonel Dukumbana .She was shot last year while she wasentering her place of residence.Warrant Officer Phumzile Ngqay-

imbana and Matya allegedly were ina relationship while working in thesame police station in Elliotdale.The escape and shooting happened

just when the accused were due to ap-pear in court. Police SpokespersonLieutenant Colonel Mzukisi Fatyelasaid Sakhumzi Mvoko (30) and Yandi-sa Bila (32) were on their way to the

entrance of the court when Bila hadasked to throw something in the dust-bin fromwhichhe retrieveda firearm.“Then Bila pointed the fire arm at the

warderwhowas escorting them.He thentookthewarder’s firearmandpassed it toMvoko. When the warder tried to runaway, they shot him,” said Fatyela.The warders started shooting and

both prisoners were shot dead. Fatye-la confirmed thatwhen the two left theBongweni Prison in Kokstad theywere searched.He said theywould recommend that

there must be more cameras in courtso every move in court could be seen.“We will investigate who placed the

firearm in the dustbin.”

MTHATHA High Court came to a standstilllastWednesdaymorning, September 10,whentwo prisoners, Sakhiwo Mvoko (30) andYandisa Bila (32), opened fire while trying toescape from custody.

The two were arriving in Mthatha Highcourt from the Kokstad maximum prison forthe hearing of one of 17 charges which includ-ed bank robbery, a cash-in-transit heist and

murder.SAPS Communications Officer, Mzukisi

Fatyela, said Bila retrieved a firearm from adustbin while he was pretending to be throw-ing away a take-away container.“Bila took the firearm and pointed it at the

escorting Correctional Services officer whileMvoko took the officer’s firearm,” said Fatye-la.He said the officer, after being disarmed,

ran for cover but they shot and injured him.Shooting ensued between the prisoners, the

SAPS and members of Correctional Services.The two prisoners were shot dead.Mvoko and his crew had been involved in

a spate of criminal activities in the Transkeiregion. This was not their first attempt to es-cape. The suspects had managed to escape onJanuary 2007 from the Ngqeleni Magistrate’scourt, but were later re-arrested on July 2007in KwaZulu Natal.In 2011 they had escaped again from the

Wellington prison inMthatha andwere re-ar-rested in Gauteng in the same year and takento the Bhongweni Maximum prison in Koks-tad, which is considered one of the most se-

cure prisons in the country.“They were kept in Kokstad because of

their escapehistoryandbecause theywere re-garded as most dangerous prisoners,” saidFatyela.He said Mvoko was shot and fatally injured

on the spotwhile Bila died a fewminutes afterthe crossfire.Fatyela said an investigation into the fire-

THE shooting which occurred at the Mt-hatha High Court last week, left the Ex-press reporter, Babalwa Ndlanya,shocked as she was inside the court wait-ing for another trial to start when the dra-ma started. She shares her experience:

“I went to Court to cover the case of theStation Commander of Elliotdale whowas murdered last year. Since the Courtis always full, I decided to get inside ear-ly, in order to get a seat.

“When I entered, the court was in ses-sion. I sat down. Within a second I sawpeople pushing each other while enter-ing . They said there was a shooting out-side. This was when I heard the secondgunshot. By this time people were run-ning around taking cover.

“Just imagine trying to run away in aplace with only one exit. It was very terri-ble, because while we were running, thegunshots sounded as if they were comingfrom the front and we had to run back in-to the court room.

“There was chaos as we were trying topush the door to get inside the courtroom, while people from the inside wererunning out. I made sure that I was run-ning behind the Advocates, because Iknew that at least they knew the HighCourt premises and that they would leadme to another exit. The gunshots sound-ed like a thunderstorm.

I decided to call my editor, Greg Nota,to inform him that I was in trouble, sinceI was not sure that we would be safe. Headvised me to calm down and take photoswhen everything was over. I also askedhim to phone my colleague, Ayanda Mil-lisa Madikizela, to come and see whatwas happening outside, since I was in-side. By the time she arrived, the prison-ers had already been shot dead.

“Luckily we managed to enter one ofthe offices where we had to hide while we

waited until everything went back to nor-mal.

“This was when I realized that whenworking as a journalist, there are timeswhen one works like a soldier or a policeofficial, since sometimes, one had to facedanger to get a story. It will take time toforget what happened that day.”

A POLICE Constable who pleaded guilty toplaying a major role in the killing of ElliotdaleStation Commander, Nomalizo Dukumbana,was found guilty of murder and conspiracy bythe Mthatha High Court and sentenced to lifeimprisonment and 18 years for the respectivecharges, last Tuesday.

Noxolo Matya, who confessed last week forplaying a part in the murder of the stationcommander, was sentenced to life imprison-ment for murder and 18 years imprisonmentfor conspiracy. The sentences will run con-currently. Matya was arrested with Siyamce-la Ntshitshi (33), her boyfriend PhumzileNgqayimbana (41) and Mbuyiseli Ngqayim-bana (37). All the the other accused are stillbehind bars and their case will resume on No-vember 10 for trial.

In her plea, Matya told the Court that shehad agreed to work together with her boy-friend (Phumzile Ngqayimbana) – who wasalso a Warrant Officer at the Elliotdale PoliceStation – to kill Dukumbana. She told thecourt that her boyfriend had told her that hedid not like taking instructions from Dukum-bana.

“On the day of the incident I played a majorrole by watching Dukumbana’s movements,because I was on duty. I saw her going backto the baracks (police cottages), then I in-formed the men who managed to shoot her,”said Matya.

When her lawyer, Mpendulo Stoyile, didhis submissions, he said the court must knowthat Matya is a first time offender and thatshe had shown remorse. She had worked withthe police, which resulted in the arrest of theother suspects.

“At least the court must consider those sub-missions and sentence her to 15 years impris-onment,” said Stoyile.

When handing down the sentence, Acting

Deputy Judge President Lusindiso Pakadesaid Phumzile was a Commander in the ReliefUnit in Elliotdale.

“On November 13, the Spar Supermaketmade a complaint that their shop had beenburgled, but that nothing had been done bythe police. This had resulted in Dukumbanaasking for information about the incident.Phumzile was working on the day of the inci-dent. The outcome led to Dukumbana inform-ing Phumzile that he had to work as a courtorderly. Phumzile did not like this and as a

result, he had told Matya that he was goingto kill Dukumbana,” said Pakade.

Pakade said the killing of a police official,whether on duty or not, was not acceptable.He said a junior is supposed to take instruc-tions from their senior, not to kill him or her.He said if the police official felt that hecouldn’t comply with the instructions, he orshe was free to resign.

“Even though you did not pull the trigger,you have played a major role in the murderof the deceased. In fact, the law says if a per-

son had killed a police officer, whether on du-ty or not, that person must be given a life sen-tence.” Before handing down the sentence,Pakade said, even though Matya had shownremorse, she did not say that she was no long-er in love with Phumzile. She had thought bypleading guilty and working with the policewould be to her benefit. Pakade said the Policemust fight crime not to kill one another.

Chairperson for the Women’s Network,Colonel Bongiwe Fikela, said they were hap-py with the sentence.

THE Amathole District Municipality is on amission to rebuild the Moral RegenerationMovement (MRM) in all its municipalitiesand last Thursday they were launching it inthe second municipality at the TRC Hall inDutywa.

At the event the MRM members, who willserve in the structure with the intention of

bringing back the dignity of Mbhashe resi-dents, were elected.

“We started in Mnquma Local Municipalityto restructure this MRM. Now we are in Mb-hashe Local Municipality. In fact, we want allthe Municipalities who fall under ADM to dothe same thing,” said the Chairperson of theMRM, Reverend Litha Nyathela.

He said their intention was to ensure thatthey visit schools in order to speak with thelearners about the things they should do in

order to have a bright future. They also wantto teach them about the consequences of neg-lecting their education which can help thembuild a better future.

Six different government departments, be-ing the Department of Education, Departmentof Health, Department of Home Affairs, SocialDevelopment, South African Police Servicesand South African Social Services Agency(SASSA), promised their support and showedappreciation about the MRM as they said it

would help a lot in building the society includ-ing children.

The Speaker for ADM, Councillor SamkeloJanda, said they realized that the MRM wasoperating differently which encouraged themto rebuild it.

“We will make sure that all seven munici-palities who are under ADM are involved inthis MRM because we have seen lot of thingshappening in our areas because of the loss ofdignity,” said Janda.

THE Congress of the People (COPE) is stillwaiting for the Speaker of Mbhashe Munici-pality, Councillor Mkhuseli Mcotshwa, toapologize about the threats that were madeby ANC Councillors in the Council Meetingheld on September 10.

COPE Councillor Nkosinathi Ndlodakasaid the carrying of fire-arms into a councilmeeting and other dangerous weapons wasnot accepted at all.

“This is utter disrespect for council rulesand a clear attempt to intimidate councillors.We want to know how these people were al-lowed into the council armed despite thepresence of the security in the municipality.We have no doubt that there was a pre-medi-tated plan to cause harm to some of us in themeeting. Remember we attended the meetingnot aware of what was on the agenda and hadno reason to suspect violence,” said Ndloda-ka in a letter addressed to the speaker.

He said they are demanding an apology andan assurance that that kind of behaviour willnot be allowed and will be reported to the po-lice. Failing which they will have no optionbut to organize their own security includingtaking such measures that will be necessaryfor their personal protection.

“We have weapons and we can use them ifthere is a need, but we respect the integrityof public institutions. We are councillors byright and are not in council by mercy of theANC and we deserve to be treated with re-spect. Note, that in the exercise of our rightsand as a preventative measure of the same oc-currence we are taking the matter to the po-lice for their investigations.”

According to the Council Standing rulesadopted by council on December 12, 2011, No37 on page 15 reads:

“The Carrying of weapons by a Councilloror any other attendee (with the exception ofduly authorized law enforcement agencies orpersonnel) at a meeting of council or any ofits committees is strictly forbidden. For the

purpose of this rule, any instrument intendedto inflict grievous bodily harm shall be con-sidered a weapon.

(1) The Councillor or any other attendeefound to be carrying a weapon at a meetingcontemplated in this rule shall be ordered bythe speaker to leave the meeting immediately.

(2) Any Councillor, who leaves a meetingcontemplated in this rule as a result of carry-ing a weapon, shall be considered to have ab-sented him or herself from the meeting with-out an apology.”Express contacted the Speaker of Council-

lor Mcotshwa to find out why the ANC coun-cillors were allowed in the council chamberswith weapons which was against the standingrules of the council and why they were notasked to leave the meeting. No comment couldbe obtained before time of going to print.

No comment could also be obtained from thespokesperson for the Department of Local Gov-ernment and Traditional Affairs, MamkeliNgam to find out what action will be taken byhis department to address the issue of Mbhashe.

THE news surrounding the death of the noto-rious Sakhi Mvoko and his friend Yandisa Bi-la while trying to escape in court last weekwas met with different views from the public.

Uyazi, death is another thing and for peopleto rejoice at one’s death is not really a nicething to hear, especially as a parent.

We just hope that fellow youth abazifakekwicrime can learn that crime does not paybut leads to imprisonment and death. We sendour condolences to the deceased families.

When you raise your child, you don’t thinkor hope that he or she will turn out to be crimi-nal and when he or she happens to turn to thatpath, I am sure your dreams and anticipa-tions for your child go down the drain and itis definitely not a good feeling.

Buckled up Teddy bear

Ukuhamba kukubona! Last week we visiteda high school in Ncambele and we met theteacher who was driving with her Teddy bearon the passenger’s seat. Eyona nto that caught

our eye was the size of the teddy bear whichwas like that of a human being and the teachermade sure that her passenger was buckled up.

When we asked the students about the ted-dy bear, they told us that yinto yakhe, everyday when she comes to work she has the teddybear next to her and is always buckled up.

They said even during lunch time, she eatsalone in her car with the teddy bear! Wow,talking about the love of artificial pets. Maybeshe is tired of the staffroom gossip or friendshad let her down and she decided to have afriend who doesn’t gossip nor talk nonsense.

What happened to the respect for theelders

Parents send their children to the Englishmedium school not for them to lose respectbut to learn and be able to face the challengesof life.

But what we saw in Ntabankulu with theVIP’s including journalists leaving before thefinish of the festival was very rude.

What is sad was that it was not at her home

where she did that.What happened? Tell us guys we are listen-

ing. As the other journalists were eating andremembered that their other colleagues camelate and they should be hungry as they calledthem to come and dine with them.

Wow that was when the trouble started thisgirl told them that they should go to the othertent where the community would be servedand when our other colleague was trying toexplain to her that those were journalists.

She started shouting and said, “I am doingyou a favour since I know you stop callingyour friends.”

This annoyed our colleagues since she wasshouting and even when they were also tryingto reason with her but that went down thedrain and the journalists did a noble thingand left without eating. We would like towarn you young girl, if you think since yourfather is a leader he was elected he is not achief so behave. Treat people the way youwould like to be treated. What is worse, youdid this in front of the journalists and radiopresenters yet they know your father.

Next time they need to be auditioned be-fore

The Pondo Cultural Festival in Ntabankuluwas successful but we think that next timewhen they hire sound and choose the Masterof Ceremonies (MC) they should first auditionthem to see what the sound is going to be likeand how the MC is going to handle the pro-gramme. These were the only two things thatspoiled the festival. The sound was very badand I won’t be surprised if they don’t pay forit. It was cutting off when the person was busytalking and when the group was performingon the stage. How can this guy who owns itcan travel all the way from Mthatha to Nta-bankulu with such a bad sound. And the MCmade people to make noise and lack concen-tration as he was not live. I won’t be surprisedif he is a teacher looking at the way he wasputting his finger to his mouth when he want-ed people to stop making noise as he was ina classroom.

He reminded us that advert which used toadvertise the generator ‘No Noise’.
