About MNLU-Aurangabad Maharashtra National Law University Aurangabad (MNLU-A) came into existence on March 16, 2017. It is an independent and autonomous institution created under the Maharashtra National Law University Act, 2014. The State of Maharashtra realizing the importance of quality legal education and need of well-trained law graduates to the Bar, Bench and various professions took a very bold decision by creating the third National Law University in the state, after Mumbai and Nagpur. The commencement of the university has fulfilled the need and aspirations of the people of Marathwada region for an institution of national importance in Aurangabad. MNLU-Aurangabad aims at disseminating learning as well as imparting knowledge of law and legal processes for the cause of national welfare and development.

Context of Seminar

The Bhopal Gas Tragedy (1984) was a catastrophe that had no parallel in the world’s industrial history. In the early morning hours of December 3, 1984, a rolling wind carried a poisonous grey cloud from the Union Carbide Plant in Bhopal, Madhya Pradesh (India). Forty tons of toxic gas Methyl-Iso-Cyanate, (MIC), was accidentally released from Union Carbide’s Bhopal plant, which leaked and spread throughout the city. The result was a nightmare that still has no end. An estimated 10,000 or more people died. About 5,00,000 more people suffered agonizing injuries with disastrous effects of the massive poisoning. The US based multinational company, Union Carbide Corporation (UCC) , which owned the plant through subsidiary . The company, did little to help deal with human tragedy. This seminar aims at having a scholarly discussion and research on the legal aspect of the disaster from various perspectives.

CALL FOR PAPERS

Well researched original research papers, case comments and articles are invited from academicians, research scholars and students. Only 1 co-author is permitted. Research papers shall be subject to the approval of the Editorial Board and depending on the quality of papers, selected papers will be published in the form of a Book with ISBN No.

GUIDELINES FOR SUBMISSION

• Submission must include- 1) Abstract, 2) Cover page, 3) Full Paper, 4) Application Form, and 5) Demand Draft

• Word limit for Abstract is 300 words. • Word limit for Full paper is 3000-6000 words. • Abstract and Full paper must be typed in Times New Roman Font and the font size

must be 12 on a A4 size paper with 1.5” line spacing. Footnote should follow uniform style of citation. Citation should be according to Standard Indian Legal Citation (SILC).

• Abstract along with the Cover Page and the paper must be submitted to the Convenor of the seminar at: [email protected]

• The subject of e-mail for Submission must be “National Seminar: Submission of Abstract & Cover Page” for Abstract submission, and for full paper submission “National Seminar: Submission of Full Paper”

Theme- I: Mass Torts & Bhopal Gas Tragedy-National and International Perspective

The Bhopal Gas Tragedy is one of the worst forms of disaster that has happened ever in the history of India. It has posed many questions so far as the legal system is concerned. This theme is taken into consideration so as to have a scholarly discussion and research on the legal aspect of such incidences from the perspective of both national and international legal systems.

Theme-II: Corporate Liability, Accountability and Corporate Social Responsibility The Bhopal Gas Tragedy is the result of callous approach and the negligence of a Company, having its plant located in the middle of the Bhopal city. The Companies and Factories, especially the hazardous industries, make profit out of their business, which is in most of the case at the cost of the environment and the society in general. Fixation of liability of such enterprises is the main concern for the legal fraternity. The present theme aims at having scholarly discussion and research on liability of such enterprises in event of incidents like Bhopal Gas Tragedy.

Theme-III: Mass Torts, Bhopal Gas Tragedy and the Accountability of State The approach and the response of State have found to be indifferent in dealing with the legal battle as well as the aftermath of the Bhopal Gas Tragedy. People are still suffering due to the said incident and many of them did not get the justice. The theme will focus on the accountability of the State in such type of incidents.

Theme-IV: Mass Torts, Bhopal Gas Tragedy and the Dispensation of Justice The approach and the response of State has found to be indifferent in dealing with the legal battle as well as the aftermath of the Bhopal Gas Tragedy. People are still suffering due to the said incident and many of them did not get the justice. The theme will focus on the accountability of the State in such type of incidents.

Theme-V: Bhopal Gas Tragedy and the Human Rights Perspective Restoration of life as a result of mass torts like Bhopal Gas Tragedy is something beyond the reach of humanity. The best which the legal system can do, is to restore the personal loss and the injury incurred by the victims in such incidents. Justice to victim of such incidences is something, which should be the priority of the states. The theme has been visualized to discuss the concept of justice to the victims in such cases, from the perspective of Human Rights norms.

Theme-VI: Mass Torts, Bhopal Gas Tragedy and the Public Health Public Health has always been considered as the essential service and the duty of the State. After the Bhopal Gas Tragedy, many people lost their life and many have suffered with various types of ailments and disabilities. Several studies, & medical research has been done, but none of the reports could concretely suggest anything which could prevent those ailments and disabilities. Timely medical assistance and treatment could have averted many deaths and loss of human beings. The theme aims at to discuss the role and involvement of State in ensuring the quality medical assistance and facilities, to the victims of such incidences.

Tourist attractions

Bibi ka Maqbara

Aurangabad is a historic city in Maharashtra state of India. The city is a tourist hub, surrounded by many historical sites such as the Ajanta and Ellora Caves, which are UNESCO World Heritage Sites, as well as Bibi Ka Maqbara and Panchakki. The administrative headquartes of the Aurangabad Division or Marathwada region, Aurangabad, is said to be a City of Gates and the strong presence of these can be felt as one drives through the city. In 2010, Maharashtra Tourism Minister declared Aurangabad to be the tourism capital of Maharashtra. It is also one of the fastest growing cities in the world.

Ajanta Caves

The Ajanta Caves in Maharashtra, India are 31 rock-cut cave monuments which date from the 2nd century BC. The caves include paintings and sculptures considered to be masterpieces of both Buddhist religious art (which depict the Jataka tales) as well as frescos which are reminiscent of the Sigiriya paintings in Sri Lanka. Ellora Caves : Ellora is an archaeological site, 30 km (19 mi) built by the Rashtrakuta rulers. Well known for its monumental caves, Ellora is a World Heritage Site.
