The Winner of the Grand Prize may select a guest of their choice to participate in the Grand Prize (the “Grand Prize Guest”). The Grand Prize Guest must be of legal drinking age in his/her country, state, province or territory of residence to participate in the Grand Prize.

For the avoidance of doubt, all costs in addition to those expressly stated above including, but not limited to, travel to and from the airport of departure and return, travel insurance, excess baggage charges, laundry, bar, food, beverage, telecoms charges and other personal and sundry expenses or charges are not included in the Grand Prize and must be paid in full by the Winner of the Grand Prize and/or the Grand Prize Guest.

Each of the Winner of the Grand Prize and the Grand Prize Guest must hold a valid passport with at least six months’ validity remaining as at the date on which the Grand Prize is won. Any visa, travel, immigration or vaccination requirements which the Winner of the Grand Prize and the Grand Prize Guest are required to meet to travel and participate in the Grand Prize will be the sole responsibility of such individuals. Specific travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Trip must be taken by December 31, 2018.

General. The Sponsor retains the right, in its absolute discretion, to substitute a Prize or any part thereof with a Prize or part, as the case may be, of equal or greater value. The Prizes are not transferable. The Prizes must be accepted as awarded and there is no substitution other than as set out above.

The Sponsor and the Promotion Entities do not warrant that access to or use of the web service website service will be uninterrupted. Sponsor and the Promotion Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Provider, Web Services sites, or other connections, availability or accessibility problems arising in connection with or over the course of the Contest; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or table transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any prize or in any prize notification documents; or (d) for any errors of any kind in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or (f) damage to a user’s system occasioned by participation in the Contest or downloading nay information necessary to participate in the Contest.

4. AWARDING OF PRIZE

Prize Random Draw: One (1) eligible entrants will be selected by random draw at approximately 10:00:00am Eastern Time at 20440 Simcoe St., Seagrave, Ontario, on August 20th, 2018. (“Draw Date”) from all eligible entries received during the Contest Period. The odds of winning a Prize depend on the number of eligible entries received during the Contest Period.

Entries automated by script, macro, programming, robotic or any other automated means are prohibited. These entries submitted by individuals or organizations will be disqualified. Selected entrant will be notified of his/her selection by email within 7 days of the Draw Date and will have 10 business days to claim their Prize.

Before being declared a Winner, the selected entrant must first: a) correctly answer, unaided, a time-limited mathematical skill testing question to be administered by telephone at a prearranged mutually convenient time or email; and b) sign a standard declaration and release form confirming compliance with these Rules, acceptance of the Prize as awarded and releasing the Sponsor, its advertising and promotion agencies, the provincial liquor agencies, boards and commissions and liquor licensees and their respective shareholders, directors, officers, employees, contractors and agents, among others, from any and all liability of any kind in connection with the Contest, the entrant’s participation therein and/or the awarding and use of a Prize or any portion thereof, within ten (10) business days of being contacted. The Grand Prize

Guest will also be required to sign a declaration and release form within the time period specified by the Sponsor.

If a Prize is not claimed by a selected entrant within 10 business days of receipt of the above noted email, or if the selected entrant fails to correctly answer the mathematical skill testing question, or if the selected entrant fails to return the above noted declaration and release form and any other documents required by the Sponsor within the time specified by the Sponsor, the draw of such entrant shall be deemed void and he/she will forfeit any and all right to a Prize. An alternate eligible entrant will then, at the Sponsor’s discretion, be selected and this process will be repeated, at the Sponsor’s discretion, until the earlier of such time as a winner is confirmed. Winners are not allowed to transfer the right to take up a Prize to anyone else without the prior written consent of the Sponsor.

5. GENERAL RULES

(a) By entering the Contest, each entrant agrees to abide by these rules and regulations (the “Rules”) and all decisions of the Sponsor and its agents which are final and binding on all entrants, without right of appeal, with respect to all matters relating to the Contest, including without limitation, eligibility and/or disqualification of entries. All entries become the exclusive property of the Sponsor.

(b) None of the Contest Entities accepts any responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of any website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from entering or attempting to enter the Contest.

(c) By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees to release, discharge, indemnify and hold harmless the Contest Entities from and against any and all claims, causes of action, demands, loss, injury, damage or liability whatsoever which may arise or occur in connection with or as a result of (a) the entrant’s participation in the Contest; and (b) the awarding and use of a Prize or any portion thereof.

(d) Entries are subject to verification and will be declared invalid if they are illegible, mechanically or robotically programmed or reproduced, mutilated, forged, falsified, altered or tampered with in any way.

(e) By entering the Contest, each entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including but not limited to print, broadcast or the Internet.

(f) The provincial liquor agencies are not connected with the Contest in any manner whatsoever and are not liable in any way whatsoever in regard to any matter which relates to the Contest.

(g) The Sponsor reserves the right, at its sole discretion and without notice, to disqualify any entry, and to modify, terminate, or suspend the Contest for any reason including if a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupts or impairs the administration, security, fairness, or proper play of the Contest, and, if the Contest is modified, terminated, or suspended, select a Winner from those eligible entries received prior to the event requiring such modification, termination, or suspension.

(h) The Contest is subject to all applicable federal, provincial, and municipal laws.

(i) By entering the Contest, entrants agree to abide by these Rules and decisions of the Sponsor which are final.

(j) The Contest, these Rules and any other matters relating to the Contest shall be governed and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute will be subject to the exclusive jurisdiction of the courts of the province of Ontario. If any term within these Rules is deemed to be illegal, invalid or otherwise unenforceable by a court of law for any reason, the affected term shall be deleted from these Rules and the remaining terms shall continue in full force and effect.

(k) Other than as provided in these Rules, unless an entrant otherwise consents, all personally identifying information submitted by the entrant in order to enter the Contest will be used only for the purpose of conducting the Contest, including contacting the entrant in connection herewith.
