Challenges/OpportunitiesFaceCustomBuildersinNewMexico

As I near the end of my term as President of NMHBA, I’d like to update you on the condition of NMHBA in three areas. The first is the Leadership Ladder. We have filled the position of Secretary Treasurer for 2014 with the appointment of Pat Bellestri-Martinez and she has already contributed positively during our Senior Officer meetings. Also, Steve Hale has agreed to run for the Secretary Treasurer position for 2015. So, for the first time in a few years, the Leadership Ladder is complete.

The second area is our financial health. As some of you may remember, we developed a 5-year Cash Flow Projection spreadsheet in 2013. That tool was essential in evaluating the ongoing depletion of cash reserves. We have updated the spreadsheet and are now utilizing it during our budget preparations to project five years out from the current budget year. The assumptions used in the projections have also been updated and are generally more conservative than those initially used. None the less, the projected outlook is considerably better than that in 2013. It now shows NMHBA reaching break even early in 2016 and thus halting the depletion of cash reserves.

The third area is membership. Through the first nine months of our fiscal year, our membership has grown at a rate of 3%. When evaluated year/year from July to July, the growth rate is about 3.5%. We are currently assuming a 3.5 % growth in membership for the 2014 fiscal year, as well as for 2015. At the recent NAHB Fall Board meeting it was announced that the national growth rate was about 3.6%. That rate is lower than NAHB had budgeted, and our current assumption of 3.5% is less than the 5% we had originally budgeted for 2015.

This slow growth in membership causes me great concern. When I was initially interviewed by the Nominating Committee in 2012, I expressed my concern about the future of our industry for small custom builders. Two and a half years later, New Mexico’s small custom builders still are not recovering from the recession. I think there are a lot of possible reasons for this, but lack of affordability is one of the most important.

Building science and sustainability are improving the way we build houses, but they also add cost to the product. The costs of material and labor are also rising and have risen dramatically in areas where recovery has taken hold. The use of building codes to accomplish public policy goals can also add to the cost.

The cost of being in business is going up. Compliance requirements with federal regulations have been steadily increasing and all indications are that they will escalate even more in the near future. Proposed regulation of silica will have a profound cost impact on the construction industry.

All of the above add cost at the same time that income inequality is increasing and wage growth has been essentially flat for 30 years. New job creation is generally considered to be at the lower end of the wage scale, so even falling unemployment does not mean a growing market that can afford new homes. It seems likely that these trends have been going on for quite some time, but the sub-prime lending and mortgage debacle allowed them to remain hidden until the crash. Demographic changes are also altering the market for new homes. Millennials are said to be delaying family formation and home purchases. They are also renting rather than buying in order to stay flexible for relocation purposes. Another demographic factor is that Generation X is considerably smaller than the Boomer generation and they reached prime home buying age during the recession. Even if the economy recovers, the number of potential buyers will not match that of the Boomers until Generation Y buyers hit the market.

There is a legitimate question here in New Mexico about whether we are seeing the typical lag in recovery that we are familiar with or whether the lack of recovery is due to some of the factors mentioned above. As a state, we are not competing favorably with our neighboring states and new jobs and businesses are in short supply. Many of our rural counties are seeing population loss and our larger cities may lack the infrastructure and amenities that demographers say are needed to support growth.

In short – be sure you are signed up to attend the next International Builders Show in January 2015. Last year about 250 people from New Mexico attended all or part of IBS in Las Vegas. After attending for the first time earlier this year, Mario Moreno of Pioneer Roofing & Specialties, Inc. (Las Cruces) said, “It was an excellent experience overall. Being able to talk to factory reps with so many manufacturers and products is a must for anyone in the building and remodeling trades.”

I am an unabashed fan of IBS. Everybody in the construction industry should go to the show every year. Yes – I really believe that! If you have never gone before just prepare yourself to be overwhelmed the first year. You will keep discovering new things around every corner and trying to sort it all out and prioritizing what to do and see is a challenge, to say the least. By your second show you will be getting the hang of it and by the third year you will feel like a pro and be getting more benefit than you ever imagined you could that first year. I pass this on because numerous members have recounted this progression from their first time at IBS to their eventual mastery of how to really “work” the show.

On a budget? I just got round trip airline tickets from Albuquerque to Las Vegas for $192, which these days is still a bargain! The “official” hotel for New Mexico HBA again this year is the newly named Westgate Las Vegas Hotel and Casino, otherwise known for years as the Las Vegas Hilton. OK, I admit it isn’t the swankiest place in town, but room rates are about $79-$119 nightly, and

by far the best part is the place is right next door to the convention center. You will be spending minimal time in your room anyway! It’s Las Vegas!!! If you do stay at the Westgate you can go out the sports book door and into the convention center back door in under ten minutes. Many of us dash back to the hotel for the lunch buffet – it’s that close. It’s also directly on the strip’s monorail line. I know many of you have your favorite place to stay in Las Vegas, and of course that’s OK too. It’s not about where you sleep – it’s about the show!

Counting this coming show, IBS will be held in Las Vegas for two more years, then move to Orlando again for the following two years. Las Vegas is certainly easier for us to get to, but Orlando is a great place to visit in January.

Don’t forget to look at the schedule early to plan your visit. It is available, along with a handy planner, at the IBS website. Once again there will be many excellent seminar opportunities throughout the show, which is why you will want to look at the schedule early and pick out the ones that will help you and your business. And don’t forget to look at the special intensive education classes happening prior to the show. These are usually fee based, but well worth it so if one appeals to you be sure to sign up. These seminars often count toward a professional designation.

Feds Squash Arizona Fall Protection Rules

Many of us have been following Arizona’s attempt to have their own more lenient residential fall protection rules rather than the federal “6 foot” rule promulgated by OSHA. The quick background on this issue is that for a number of years now federal OSHA has required construction fall protection equipment whenever a worker’s standing platform is over six feet above the lower surface. Residential construction advocates, such as National Association of Homebuilders and their state and local affiliates, protested loudly that these rules are impractical and even dangerous. For several years the feds gave residential construction a “pass” on this rule while the debate raged. During this time several states, at

The impact of a shrinking market, along with rising costs and lowered affordability, is likely to lead to further consolidation of the building industry, where fewer companies produce an ever higher percentage of new homes. High-volume builders may be the only companies able to meet the challenges of affordability. Small custom builders, by the very nature of what they build, must charge more for their homes than high volume production builders. So, if current trends don’t change, it seems likely that small builders will see a declining market. However, there also appears, at least anecdotally, to be a reduction in the number of young, new builders entering the market. As many older builders retire, the number of remaining builders may stay well balanced to demand in a declining market, but somewhere down the line we could see the end of the era of small custom builders.

Of course, there are other markets where small builders may thrive. Remodeling is one and a growing need for aging-in-place housing is another. Rising demand, especially with shrinking inventory, and rising wages could also reverse some of the trends noted. As building science and technology continue to improve housing amenities, dissatisfaction with older inventory will drive demand for new housing. A new study is being conducted in Portland, Oregon and early results are indicating that even adults under the age of 25 still prefer single family detached housing. These results, if confirmed, may signal a change to some of the demographic information we have been hearing for the last several years.

I believe that the key to the future shape of the housing industry will be affordability. We are facing great challenges, but within great challenges are great opportunities. Builders are expert at problem solving and overcoming challenges, so I remain hopeful for our shared future.

As mentioned above, I’m nearing the end of my term as President of NMHBA. It has been a real honor and privilege to serve you, the members, in that capacity. I also want to thank my fellow officers, the entire staff, and all committee chairs and members for all of their hard work this year. Without that work, your association would not function as successfully as it does and I urge you to get, or stay, involved.

the urging of their residential construction interests, took the position that they could create their own more lenient and more practical rules.

NMHBA attempted to get our state to adopt an alternate version of the fall protection rule right after Governor Martinez’s successful election, but met with repeated agency non-responsiveness and has thus far been unsuccessful. Arizona, with their famous business-friendly state government, took this effort the farthest, actually getting their legislature and governor to pass an alternate residential fall protection law. The federal government recently warned Arizona that they “will initiate proceedings to reject the (fall protection standard) and ‘reconsider’ Arizona’s status as a state-plan state unless Arizona submits a revised standard or is able to show that OSHA should not reject the (Arizona) standard.” In short Arizona is being told to adopt the 6’ rule or expect a federal take-over.

This news should trigger serious thoughts of state’s rights and the federal administration’s ability to force their version of rules down to you and me, and the realization that state government cannot protect us from federal administration rules (as contrasted to duly passed federal laws). In the meantime the message for New Mexico contractors is to look at your operations and figure out how you can comply. There isn’t much random enforcement of this rule, but if one of your workers sustains a fall-related injury or death, the consequences for your business can easily be catastrophic, and especially so if it is obvious you made no effort to comply. The fines can be astronomical. Stay tuned for the next big federal OSHA rule for the construction industry - airborne silica dust exposure limitations.

If you are interested in becoming a member of NMHBA’s Board of Directors for 2015, now is the time to act.

Being a Board member is a great way to become educated on what’s happening at the state level and meet other members who want to influence legislative and regulatory issues beyond their local jurisdiction. Important Change for Underground Electric Service for New Residential Customers of Public Service Company of New Mexico

The current PNM practice for new residential service is to install electric service cable direct buried in a 36” deep trench between PNM’s transformer or pedestal to the customer’s meter socket.

Effective January 1, 2015 new service will require a customer provided and installed empty three inch PVC duct buried 36” deep in a customer-provided trench connected to the meter riser pipe, and a PNM-provided three inch PVC stub out from the transformer or pedestal. PNM will inspect the duct installation and install the service cable in the duct. In both the current practice and the new practice, PNM connects the service wire at PNM’s source equipment and at the meter socket. This new practice will facilitate faster electric service installations, reduce future service cable fault repair costs, enable faster service restoration, and eliminate or reduce future disruptions to landscaping.

Developers:Effective September 8, 2014 PNM designs for all new

subdivision or line extension request will include the requirement for conduit elbows and stub outs installed with the transformer and/or pedestal installations. Additionally all secondary conductors will be required to be installed in conduit. (Diagrams are available at nmhba.org.)

Home Builders:Effective January 1, 2015 PNM will require new service customers to provide and install an empty three inch PVC duct buried 36” deep in a customer-provided trench connected to the meter riser pipe and to a PNM-provided three inch PVC stub out from the transformer or pedestal. Under this new practice home builders will coordinate with phone and cable companies for the installation of their services. PNM will no longer install these services.

If you have a home or remodeled project that’s worthy of notice, we want to help you show it off! Along with exterior and interior room shots, we’ll also accept photos of special features such as tile work, swimming pools, fireplaces, porches, etc.

Specifications:- Vertical shot 8x10 or proportional- Actual photo or on a CD (300 dpi, jpg or tif at final

size)- If the photo was professionally done, please obtain

permission from the photographer.
