14IntroduCtIonTheICCistheinternationalfederationresponsiblefortheglobalgovernanceofthesportofcricketandtheCodeofConductforMatch OfficialsandMatch Official Support Personnel(the“Code of Conduct”)isadoptedandimplementedaspartoftheICC’scontinuingeffortstomaintainthepublicimage,popularityandintegrityofcricketbyproviding:(a)aneffectivemeanstodeteranyMatch OfficialorMatch Official Support Personnelfromconductingthemselvesimproperlyonandoffthe‘field-of-play’orinamannerthatiscontrarytothe‘spiritofcricket’;and(b)arobustdisciplinaryprocedurepursuanttowhichallmattersofimproperconductcanbedealtwithfairly,withcertaintyandinanexpeditiousmanner.

Unlessotherwiseindicated,referencestoarticlesandappendicesaretoarticlesandappendicesoftheCodeofConduct.WordsinitalicisedtextintheCodeofConductaredefinedtermsandtheirdefinitionsaresetoutinappendix1.

artICle 1 - sCope and applICatIon

1.1 allMatch OfficialsandMatch Official Support PersonnelareautomaticallyboundbyandrequiredtocomplywithalloftheprovisionsoftheCodeofConduct.accordingly,bytheirappointmenttoofficiateinanInternational Match,suchMatch OfficialsandMatch Official Support Personnelshallbedeemedtohaveagreed:

1.1.1 thatitistheirpersonalresponsibilitytofamiliarisethemselveswithalloftherequirementsoftheCodeofConduct,includingwhatconductconstitutesanoffenceundertheCodeofConduct;

1.1.2 tosubmittotheexclusivejurisdictionofanyJudicial CommissionerorAppeal PanelconvenedundertheCodeofConducttohearanddeterminechargesbrought(andanyappealsinrelationthereto)pursuanttotheCodeofConduct;

1.1.3 nottobringanyproceedingsinanycourtorotherforumthatareinconsistentwiththeforegoingsubmissiontothejurisdictionoftheJudicial CommissionerorAppeal Panel;

1.1.4 tobeboundbyandcomplywiththePCT Code;and

1.1.5 tobeboundbyandcomplywiththeICC Anti-Corruption Code for Participants.

1.2 allMatch OfficialsandMatch Official Support PersonnelshallcontinuetobeboundbyandrequiredtocomplywiththeCodeofConductuntilhe/shehasnotofficiatedinanInternational Matchforaperiodofthree(3)monthsandtheICCshallcontinuetohavejurisdictionoverhim/herundertheCodeofConductthereafterinrespectofmatterstakingplacepriortothatpoint.

1.3 ItisacknowledgedthatcertainMatch OfficialsandMatch Official Support PersonnelmayalsobesubjecttootherrulesoftheICCandNational Cricket Federationsthatgoverndisciplineand/orconduct(including,withoutlimitation,thePCT CodeandtheICC’santi-CorruptionCodeforParticipantsandanydomesticequivalentcodes,breachesofwhichshallbedealtwithundertherelevantdisciplinaryprovisionsofsuchcodes,notunderthisCodeofConduct),andthatthesameconductofsuchMatch OfficialsandMatch Official Support PersonnelmayimplicatenotonlytheCodeofConductbutalsosuchotherrulesthatmayapply.fortheavoidanceofanydoubt,Match OfficialsandMatch Official Support Personnelacknowledgeandagreethat:(a)theCodeofConductisnotintendedtolimittheresponsibilitiesofanyMatch OfficialorMatch Official Support Personnelundersuchotherrules;and(b)nothinginsuchotherrulesshallbecapableofremoving,supersedingoramendinginanywaythejurisdictionoftheJudicial CommissionerorAppeal PaneltodeterminemattersproperlyarisingpursuanttotheCodeofConduct.

1.4 fortheavoidanceofdoubt,theCodeofConductshallnotreplaceorinanywayaltertheICC’sabilitytopursuedisciplinaryactionagainstMatch OfficialsorMatch Official Support PersonnelunderthetermsofanyemploymentorconsultancycontractwithsuchMatch OfficialorMatch Official Support Personneland/orpursuanttoanyoftheICC’semploymentpoliciesinforcefromtimetotime,including,withoutlimitation,theICCdisciplinaryPolicyandtheICCGrievancePolicy.WhereconductprohibitedunderthisCodeofConductalsoamountstoabreachofthetermsofaMatch OfficialorMatch Official Support Personnel’semploymentorconsultancyarrangementwiththeICC,theICCshallbeentitled,atitsabsolutediscretion,toelectonlytopursuedisciplinaryactionunderthetermsoftheMatch OfficialorMatch Official Support Personnel’semploymentorconsultancycontractandthereisnorequirementontheICCtoalsoinstituteactionunderthisCodeofConduct.

artICle 2 - Code of ConduCt offenCes

Theconductdescribedinarticles2.1–2.4below,ifcommittedbyaMatch OfficialorMatch Official Support Personnelatanytime,whetherduringorinrelationtoanInternational Matchorotherwise,shallamounttoanoffencebysuchMatch OfficialorMatch Official Support PersonnelundertheCodeofConduct.

COMMENT: Where considered helpful, guidance notes have been provided in text boxes beneath the description of a particular offence. Such notes are intended only to provide guidance as to the nature and examples of certain conduct that might be prohibited by a particular Article and should not be read as an exhaustive or limiting list of conduct prohibited by such Article.

For the purposes of the Code of Conduct, the phrase “during an International Match” should be interpreted broadly to cover all conduct which takes place at the ground on the day of an International Match, and not just conduct which takes place on the field of play. It will therefore include conduct which takes place off the field of play, for example in the changing rooms or during any of the intervals in the match.

2.1 Level 1 Offences:

2.1.1 Conductthatiscontrarytothespiritofthegame.

NOTE: Article 2.1.1 is intended to cover all types of conduct of a minor nature that is contrary to the spirit of the game and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct. The spirit of the game may be defined by reference to the Preamble to the Laws of Cricket and involves respect for, amongst others, (a) the role of the umpires and (b) the game and its traditional values.

2.1.2 Conductthatbringsthegameintodisrepute.

NOTE: Article 2.1.2 is intended to cover all types of conduct of a minor nature that bring the game into disrepute and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct.

By way of example, Article 2.1.2 may (depending upon the seriousness and context of the breach) prohibit the following: (a) public acts of misconduct; and (b) unruly public behavior.

14 2.1.3 Publiccriticismof,orinappropriatecomment(includingviaany

socialmediaplatformsuchas,withoutlimitation,facebook,Twitter,YouTube,Google+,PinterestandLinkedIn):

2.1.3.1 inrelationtoanincidentoccurringinanInternational MatchoranyPlayer,Player Support Personnel,Match Official,Match Official Support PersonnelorateamparticipatinginanInternational Match,whetherornottheMatch OfficialorMatch Official Support PersonnelisinvolvedintheparticularInternational Matchandirrespectiveofwhensuchcriticismorinappropriatecommentismade;or

2.1.3.2 whichmaybeconsidereddetrimentaltothegameofcricketingeneral.

NOTE: When assessing the seriousness of the breach, the context within which the criticism and/or comment has been made must be taken into account.

2.1.4 Usinglanguageoragesturethatisobscene,offensiveorinsultingtoaPlayer,Player Support Personnel,otherMatch OfficialorMatch Official Support Personneloranyotherthirdperson(includingaspectator)duringanInternational Match.

NOTE: Article 2.1.4 includes (a) audibly swearing; and (b) obscene gestures whether or not directed at another person.

When assessing the seriousness of the breach, the context of the particular situation and whether the words or gesture are likely to: (a) be regarded as obscene; (b) give offence; or (c) insult another person, must be taken into account.

This offence is not intended to cover any use of language or gestures that are likely to offend another person on the basis of their race, religion, culture, colour, descent, national or ethnic origin. Such conduct is prohibited under the ICC Anti-Racism Code for Participants and must be dealt with in accordance with the procedures set out therein.

2.1.5 abuseofanycricketequipmentorclothing,groundequipmentorfixturesandfittingsduringanInternational Match.

2.1.6 failingtoobserveandcomplyatanytimewiththeprovisionsoftheICC’s Match Officials Dress Code,theICC’s Clothing and Equipment Regulationsand/oranyotheradditionaldresscodesinforceforspecificICC EventsduringanInternational Matchassuchmaybeinforcefromtimetotimeinforce.

2.2 Level 2 Offences

2.2.1 Conductthatiscontrarytothespiritofthegame.

NOTE: Article 2.2.1 is intended to cover all types of conduct of a serious nature that is contrary to the spirit of the game and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct. The spirit of the game may be defined by reference to the Preamble to the Laws of Cricket and involves respect for, amongst others, (a) the role of the umpires and (b) the game and its traditional values.

2.2.3 Seriouspubliccriticismof,orinappropriatecomment(includingviaanysocialmediaplatformsuchas,withoutlimitation,facebook,Twitter,YouTube,Google+,PinterestandLinkedIn):

2.2.3.1 inrelationtoanincidentoccurringinanInternational MatchoranyPlayer,Player Support Personnel,Match Official,Match Official Support PersonnelorateamparticipatinginanInternational Match,whetherornottheMatch OfficialorMatch Official Support PersonnelisinvolvedintheparticularInternational Matchandirrespectiveofwhensuchcriticismorinappropriatecommentismade;or

2.2.3.2 whichmaybeconsidereddetrimentaltothegameofcricketingeneral.

NOTE: When assessing the seriousness of the breach, the context within which the criticism and/or comment has been made must be taken into account.

2.2.4 Usinglanguageorgesture(s)thatisseriouslyobscene,seriouslyoffensiveorofaseriouslyinsultingnaturetoaPlayer,Player Support Personnel,otherMatch OfficialorMatch Official Support Personneloranyotherthirdperson(includingaspectator)duringanInternational Match.

NOTE: When assessing the seriousness of the breach, the Judicial Commissioner or Appeal Panel shall be required to take into account the context of the particular situation and whether the words or gesture are likely to: (a) be regarded as seriously obscene; or (b) give serious offence; or (c) seriously insult another person.

This offence is not intended to cover any use of language or gestures that are likely to offend another person on the basis of their race, religion, gender, colour, descent, national or ethnic origin. Such conduct is prohibited under the ICC Anti-Racism Code for Participants.

2.2.5 InappropriateanddeliberatephysicalcontactwithaPlayer,Player Support Personnel,otherMatch Official,Match Official Support Personneloranyotherperson(includingaspectator)inthecourseofplayduringanInternational Match.

NOTE: Cricket is a non-contact sport and, as such, inappropriate physical contact will not be tolerated.

2.2.6 InappropriatedistractionorobstructiononthefieldofplayduringanInternational Match.

2.2.7 disclosingorcommentinguponanyallegedbreachofthisCodeofConductortheICC Code of Conduct for Players and Player Support Personneloranyhearing,reportordecisionarisingfromsuchabreachunlesssuchdisclosureisrequiredundertheprovisionsofthisCodeofConductortheICC Code of Conduct for Players and Player Support Personnel.

14 2.3 Level 3 Offences

2.3.1 Conductthatiscontrarytothespiritofthegame.

NOTE: Article 2.3.1 is intended to cover all types of conduct of a very serious nature that is contrary to the spirit of the game and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct.

See guidance note to Article 2.1.1 for examples of conduct that may (depending upon the seriousness and context of the breach) be prohibited under Article 2.3.1.

2.3.2 Conductthatbringsthegameintodisrepute.

NOTE: Article 2.3.2 is intended to cover all types of conduct of a very serious nature that bring the game into disrepute and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct.

2.3.3 ThreatofassaultonaPlayer,Player Support Personnel,otherMatch Official,Match Official Support Personneloranyotherperson(includingaspectator)duringanInternational Match.

2.4 Level 4 Offences

2.4.1 Conductthatiscontrarytothespiritofthegame.

NOTE: Article 2.4.1 is intended to cover all types of conduct of an overwhelmingly serious nature that is contrary to the spirit of the game and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct.

See guidance note to Article 2.1.1 for examples of conduct which may (depending upon the seriousness and context of the breach) be prohibited under Article 2.4.1.

2.4.2 Conductthatbringsthegameintodisrepute.

NOTE: Article 2.4.2 is intended to cover all types of conduct of an overwhelmingly serious nature that bring the game into disrepute and which is not specifically and adequately covered by the specific offences set out elsewhere in this Code of Conduct.

See guidance note to Article 2.1.2 for examples of conduct that may (depending upon the seriousness and context of the breach) be prohibited under Article 2.4.2.

2.4.3 PhysicalassaultofaPlayer,Player Support Personnel,otherMatch Official,Match Official Support Personneloranyotherperson(includingaspectator)duringanInternational Match.

2.4.4 UsingorinanywaybeingconcernedintheuseordistributionofillegaldrugsoranysubstancesprohibitedundertheICC Anti-Doping Code(including,fortheavoidanceofdoubt,recreationaldrugs)whetherIn-Competitionorout-of-Competition(asthosetermsaredefinedtherein).

artICle 3 - reportInG an alleGed offenCe under the Code of ConduCt

3.1 anyoneofthefollowingindividualscanreportanallegedoffenceundertheCodeofConductbylodgingareportinthemannerdescribedinarticle3.2,below(a“Report”):

3.1.1 wheretheallegedoffencewascommittedbyanUmpireorMatch Official Support PersonnelduringanInternational Match,theMatch RefereethatwasappointedtoofficiateintheInternational Matchduringwhichtheallegedoffencewascommitted;

3.1.2 wheretheallegedoffencewascommittedbyaMatch RefereeduringanInternational Match,anyUmpireappointedtoofficiateintheInternational Matchduringwhichtheallegedoffencewascommitted;or

3.1.3 theCEo(onhis/herownaccountoronbehalfofhis/herplayersorplayersupportpersonnel)ofeitherofthetwoNational Cricket FederationswhoserepresentativeteamsparticipatedintheInternational Matchduring,orinrelationtowhich,theallegedoffencewascommitted;or

3.1.4 theICC’s Chief Executive Officer.

3.2 allReportsmustbesubmittedinwritingtotheICC’sGeneralManager-Cricket(orsuchotherICCstaffmemberasmaybesodesignatedbytheICC’sChiefExecutive)assoonasreasonablypracticable,andinanyeventnolaterthanfive(5)daysafter:(a)thecommissionoftheallegedoffence;or(b)theallegedoffencewasbroughttotheattentionofthepersonlodgingtheReport.TheReportmustbesignedanddatedbythepersonlodgingtheReport,andacopymustbeprovidedtotheICC’s General Counsel.

3.3 ThereisnostandardformthataReportmusttake.However,itmustcontainatleastthefollowinginformation:

3.3.1 thenameoftheMatch OfficialorMatch Official Support Personnelallegedtohavecommittedtheoffence;

3.3.2 detailsoftheInternational Matchduring,orinrelationto,whichtheoffencewasallegedtohavebeencommitted(ifapplicable);

3.3.3 detailsoftheoffenceallegedtohavebeencommitted,includingthedate,timeandlocationthereof,thespecificoffence(byreferencetotherelevantsub-articleinarticle2),adescriptionoftheincidentandalistofanyindividualswhomayhavewitnessedit;and

3.3.4 theidentityofthepersonmakingtheReport.

3.4 WhereitisallegedthataMatch OfficialorMatch Official Support PersonnelhascommittedmorethanoneoffenceundertheCodeofConductduring,orinrelationto,anInternational Match(whetherarisingoutofthesamesetoffactsorotherwise),thenaseparateReportshouldbefiledinaccordancewiththisarticle3foreachoftheoffencesthatareallegedtohavebeencommitted.

14 artICle 4 - InVestIGatIons and notICe of CharGe

4.1 followingreceiptofaReport,theICC’s General Manager – Cricket(inconsultationwiththeICC’s General Counsel)mustpromptlyconductareviewtodeterminewhethertheMatch OfficialorMatch Official Support PersonnelnamedintheReporthasacasetoanswer.aspartofthisreviewprocess,theICC’s General Manager – CricketmayconductinvestigationsintotheactivitiesofsuchMatch OfficialorMatch Official Support PersonnelincludingissuingwrittendemandstotheMatch OfficialorMatch Official Support Personnelconcerned,oranyotherperson,requiringhim/hertofurnishhim/herwithanyinformationthatisreasonablyrelatedtotheallegedoffence.

4.2 TheICC’s General Manager – Cricket(inconsultationwiththeICC’s General Counsel)mayalsoinitiateaninvestigationonhis/herownbehalfwherehe/shereasonablysuspectsthataMatch OfficialorMatch Official Support PersonnelhascommittedanoffenceundertheCodeofConduct.

4.3 Where,followinghis/herreview,theICC’s General Manager – CricketdeterminesthattheReportdoesnotrevealacasetoanswer,thentheICC’sGeneralManager-CricketshallnotifythepersonwhofiledtheReportofthefact,andthemattershallnotproceedanyfurther.

4.4 Where,followinghis/herreview,theICC’sGeneralManager-Cricketdeterminesthatthereisacasetoanswerunderarticle2,thentheMatch OfficialorMatch Official Support Personnelshallbesentwrittennoticeofthefollowing,copiedtotheICC’s General CounselandtheMatch Official orMatch Official Support Personnel’srelevantNational Cricket Federation(the“Notice of Charge”):

4.4.1 thattheMatch OfficialorMatch Official Support Personnelhasacasetoanswerunderarticle2;

4.4.2 thespecificoffence(s)thattheMatch OfficialorMatch Official Support Personnelisallegedtohavecommitted;

4.4.3 detailsoftheallegedactsand/oromissionsrelieduponinsupportofthecharge;

4.4.4 therangeofsanctionsapplicableundertheCodeofConductifitisestablishedthattheMatch OfficialorMatch Official Support Personnelhascommittedtheoffence(s)charged(whichshallbewithintherangespecifiedinarticle7.1);

4.4.5 (whereapplicable)themattersrelatingtoProvisional Suspensionspecifiedinarticle4.5;and

4.4.6 themattersrelatedtorespondingtoaNotice of Chargespecifiedinarticle4.6.

4.5 Provisional Suspension

4.5.1 WheretheICC’sGeneralManager-CricketdecidestochargeaMatch OfficialorMatch Official Support PersonnelwithanoffenceundertheCodeofConduct,he/she(inconsultationwiththeICC’s General Counsel)shallhavethediscretion,incircumstanceswherehe/sheconsidersthattheintegrityofthesportcouldotherwisebeseriouslyundermined,toProvisionallySuspendtheMatch OfficialorMatch Official Support PersonnelpendingtheJudicial Commissioner’sdeterminationofwhetherhe/shehascommittedanoffence.anydecisiontoProvisionallySuspendtheMatch OfficialorMatch Official Support PersonnelwillbecommunicatedtotheMatch OfficialorMatch Official Support Personnelinwriting,

withacopysenttotheMatch OfficialorMatch Official Support Personnel’srelevantNational Cricket FederationandtheICC’s Senior Manager - Umpires and Referees.

4.5.2 Whereafullhearingunderarticle5hasnotbeenconvenedwithinone(1)monthoftheimpositionofaProvisional Suspension,theMatch OfficialorMatch Official Support PersonnelshallbeentitledtoapplytotheChairmanoftheICC Code of Conduct Commission(sittingalone)tolifttheimpositionoftheProvisional Suspension.ItshallbetheburdenoftheICC’sGeneralManager-CrickettoestablishthatthereremainsariskthattheintegrityofthesportcouldbeseriouslyunderminediftheProvisional Suspensionwaslifted.TheChairmanoftheICC Code of Conduct Commissionshallhavediscretiontodeterminesuchapplicationasheconsidersappropriate(includingwhethertoconveneahearingor,alternatively,todeterminethematter(oranypartthereof)bywayofwrittensubmissionsalone),providedthattheMatch OfficialorMatch Official Support Personnelisaffordedafairandreasonableopportunitytopresentevidence,addresstheChairmanandpresenthis/hercase.

4.5.3 noMatch OfficialorMatch Official Support PersonnelwhoisthesubjectofanyProvisional Suspensionmay,duringtheperiodofanyProvisional Suspension,officiateorotherwiseparticipateorbeinvolvedinanycapacityinanyInternational MatchoranyotherkindofMatch,function,eventoractivitythatisauthorised,organised,sanctioned,recognisedorsupportedinanywaybytheICC,aNational Cricket FederationoranymemberofaNational Cricket Federation.National Cricket Federationsshalltakeallreasonablestepswithintheirpowerstogiveeffecttothisarticle4.5.3wheretheyhavethejurisdictiontodoso.

4.6 Responding to a Notice of Charge

4.6.1 TheMatch OfficialorMatch Official Support PersonnelmustrespondtotheNotice of ChargeinwritingtotheICC’s General Manager – Cricketwithinfour(4)days(96hours)ofreceiptoftheNotice of Charge(orbysuchextendeddeadlineastheICC’s General Manager – Cricketagrees)statingwhetherhe/sheacceptsordisputesthecharge(s)againsthim/herand/orthesanctionproposed,andonwhatbasis(insummary),and,wherehe/shedisputesthechargeand/orthesanctionproposed,requestingahearingbeforeaJudicial Commissionertohavethechargeand(ifappropriate)anysanction(s)determined.

4.6.2 Unlessexceptionalcircumstancesexist,iftheMatch OfficialorMatch Official Support Personnelfailstofilesuchwrittenresponsebythatdeadlinethenhe/shewillbedeemedtohavewaivedhis/herentitlementtohaveahearingon,ormakewrittensubmissionsand/oradduceevidenceinrelationto,thechargebeforeaJudicial CommissionerandtheJudicial CommissionershallbeentitledtoconsiderthematterwithoutaffordinganyopportunitytotheMatch OfficialorMatch Official Support Personneltomakewrittensubmissionsand/oradduceevidence.

4.6.3 WheretheMatch OfficialorMatch Official Support Personneldoesrequestahearinginaccordancewitharticle4.6.1,themattershallproceedtoahearinginaccordancewitharticle5.

5.1 WhereaMatch OfficialorMatch Official Support PersonnelischargedwithcommittinganoffenceundertheCodeofConduct,andtheMatch OfficialorMatch Official Support Personneldeniestheallegation,and/ordisputesthesanctionstobeimposedforsuchoffence,thenthemattershallbereferredtoaJudicial Commissionerforadjudicationinaccordancewiththeproceduresetdownineitherarticle5.3or5.4(asappropriate)andarticle5.5.

5.2 assoonasreasonablypossible,butinanyeventnolaterthanseven(7)daysafter(i)receiptoftheMatch OfficialorMatch Official Support Personnel’sresponsetotheNotice of Charge,or(ii)wherenoresponseisreceivedandunlessexceptionalcircumstancesexist,theexpiryoftheperiodsetoutinarticle4.6.1above,theICC’s General CounselshallappointonememberfromtheICC’sCodeofConductCommissiontositastheJudicial Commissionertohearthecasesittingalone.Theappointedmembershallbeindependentoftheparties,havehadnopriorinvolvementwiththecaseandshallnot,whererelevantandunlessotherwiseagreedbetweentheparties,befromacountrywhosenationalteamparticipatedintheInternational Match(ifany)during,orinrelationtowhich,theallegedoffencewascommitted,orbefromthesamecountryastheMatch OfficialorMatch Official Support Personnelwhoisthesubjectofthecharge.

5.3 Level 1 Offences and Level 2 Offences

5.3.1 SubjecttothediscretionoftheJudicial CommissionertoorderotherwiseforgoodcauseshownbytheMatch OfficialorMatch Official Support Personnel,thehearingwilltakeplaceassoonaspossible(and,unlessexceptionalcircumstancesexistorwherethepartiesagreeotherwise,atthelatestwithinfourteen(14)daysofreceiptbytheMatch OfficialorMatch Official Support PersonneloftheNotice of Charge).

5.3.2 Theprovisionsofarticle5.5belowshallapply.

5.4 Level 3 Offences and Level 4 Offences

5.4.1 TheJudicial CommissionershallconveneapreliminaryhearingwiththeindividuallodgingtheReport(theComplainant)andhis/herlegalrepresentatives,togetherwiththeMatch OfficialorMatch Official Support Personnelandhis/herlegalrepresentatives(ifany).ThepreliminaryhearingshouldtakeplaceassoonaspossiblebytelephoneconferencecallunlesstheJudicial Commissionerdeterminesotherwise.Thenon-participation,withoutcompellingjustification,oftheMatch OfficialorMatch Official Support Personnelorhis/herrepresentativeatthepreliminaryhearing,afterpropernoticeofthepreliminaryhearinghasbeenprovided,shallnotpreventtheJudicial Commissionerfromproceedingwiththepreliminaryhearing,whetherornotanywrittensubmissionsaremadeonbehalfoftheMatch OfficialorMatch Official Support Personnel.WheretheinitialReportwaslodgedbysomeoneotherthantheindividualdescribedinarticle3.1.4,theICCwillbenotifiedandinvitedtoparticipateinanysuchpreliminaryhearingconvenedbytheJudicial Commissionerthroughitsrepresentative.

5.4.2 ThepurposeofthepreliminaryhearingshallbetoallowtheJudicial Commissionertoaddressanypreliminaryissuesthatneedtoberesolvedpriortothehearingdate.Inparticular(butwithoutlimitation),theJudicial Commissionershall:

5.4.2.1 determinethedate(s)uponwhichthefullhearingshallbeheld.Saveinexceptionalcircumstancesorwherethepartiesotherwiseagree,thefullhearingshouldtakeplacenolongerthantwenty-eight(28)daysafterthereceiptbytheMatch OfficialorMatch Official Support PersonneloftheNotice of Charge.

5.4.2.2 establishdatesreasonablyinadvanceofthedateofthefullhearingbywhich:

a) theComplainantshallsubmitanopeningbriefwithargumentonallissuesthattheComplainantwishestoraiseatthehearingandalistofthewitnessesthattheComplainantintendstocallatthehearing(andasummaryofthesubjectareasofthewitness’santicipatedtestimony),andenclosingcopiesoftheexhibitsthattheComplainantintendstointroduceatthehearing;

5.5.3 ThehearingbeforetheJudicial CommissionershallbeinEnglish,andcertifiedEnglishtranslationsshallbesubmittedofanynon-EnglishdocumentsputbeforetheJudicial Commissioner.Thecostofthetranslationshallbebornebythepartyofferingthedocument(s).IfrequiredbytheJudicial Commissioner(athis/herdiscretion),theICCshallmakearrangementstohavethehearingrecordedortranscribed.IfrequestedbytheMatch OfficialorMatch Official Support Personnel,theICCshallalsoarrangeforaninterpretertoattendthehearing.SuchcostsoftranscriptionandinterpretationshallbepaidbytheICC.

5.5.4 WherevideoevidenceoftheallegedoffenceisavailableatthehearingbeforetheJudicial Commissioner,thenitmayberelieduponbyanyparty,providedthatallotherpartiesshallhavetherighttomakesuchrepresentationsinrelationtoitthattheymayseefit.

5.5.5 Unlessexceptionalcircumstancesapply,eachofthefollowingindividualsmustattendanyhearingbeforetheJudicial Commissioner:(a)theMatch OfficialorMatch Official Support Personnelwhohasbeenchargedwiththeallegedoffence;(b)thepersonwholodgedtheReport(or,inthecaseoftheICC’s Chief Executive Officer,his/herrepresentative/nominee);and(c)arepresentativeoftheICC’sLegaldepartment.Whereanysuchindividualhasacompellingjustificationforhis/hernon-attendanceinpersonatthehearing,thentheyshallbegiventheopportunitytoparticipateinthehearingbeforetheJudicial Commissionerbytelephoneorvideoconference(ifavailable).

5.5.7 Thenon-attendanceoftheMatch OfficialorMatch Official Support Personnelorhis/herrepresentativeatthehearing,afterpropernoticeofthehearinghasbeenprovided,shallnotpreventtheJudicial Commissionerfromproceedingwiththehearinginhis/herabsence,whetherornotanywrittensubmissionsaremadeonhis/herbehalf.

5.5.8 attheendofahearing,wheretheJudicial Commissionerconsidersthatfurtherevidenceisnecessaryorfurthertimeisrequiredtoconsidertheevidencethathasbeenpresented,he/sheshalladjournthehearingforanappropriateperiodoftimeandmakesuchdirectionsasmaybenecessary.

b) wheretheJudicial CommissionerdeterminesthataCodeofConductoffencehasbeencommitted,theMatch OfficialorMatch Official Support Personnelmayrequestashortadjournment(ofnomorethanthirty(30)minutes)toprepareanysubmissionsthathe/shemightwishtomakeinrelationtotheappropriatesanctionthatoughttobeapplied;and

c) assoonaspossibleaftertheconclusionofthehearing(and,inanyevent,nolaterthanforty-eight(48)hoursthereafter),theJudicial Commissionerwillannouncehis/herdecisioninwriting,withreasons,settingout:(a)thefindingastowhetheraCodeofConductoffencehadbeencommitted;(b)whatsanctions,ifany,aretobeimposed(includinganyfineand/orperiodofsuspension);(c)thedatethatanyperiodofsuspensionshallcomeintoforceandeffect;and(d)anyrightsofappealthatmayexistpursuanttoarticle8.

5.9 WhereaMatch OfficialorMatch Official Support PersonnelisallegedtohavecommittedmorethanonebreachoftheCodeofConductduring,orinrelationtothesameInternational Match,thenalloftheallegedoffencesmaybedealtwithatthesamehearing.

5.11 WhereaJudicial Commissioneris,orbecomesunwillingorunabletohearacase(forexample,wherehe/shefindshim/herselfinapositionofconflict),thentheICC’s General CounselshallhavethediscretiontoappointanothermemberoftheICC’sCodeofConductCommission(whoshallhavehadnopriorinvolvementwiththecaseandshallnot,whererelevantandunlessotherwiseagreedbetweentheparties,befromacountrywhosenationalteamparticipatedintheInternational Matchduring,orinrelationtowhich,theallegedoffencewascommitted,orbefromthesamecountryastheMatch OfficialorMatch Official Support Personnel)asareplacementtotheJudicial Commissionerandalloftheremainingprocedurewillapplyaccordingly.

5.12 TheICCwillissueapublicannouncementregardinganydecisionoftheJudicial CommissionermadeundertheCodeofConduct,assoonasisreasonablypracticableafterthedecisionhasbeencommunicatedtotheparties.ThepublicannouncementofthedecisionmayincludedetailsoftheoffencescommittedundertheCodeofConductandofthesanctionsimposed,ifany.Untilsuchtimeasapublicannouncementispublished,allpartiesandparticipantsintheproceedingsshalltreatsuchproceedingsasstrictlyconfidential.fortheavoidanceofdoubt,nothinginthisarticleshallpreventanyparty(oranyrelevantNational Cricket Federation)publiclyconfirmingthedateofthehearing,theoffencethatisallegedtohavebeencommittedand/orthenameoftheMatch OfficialorMatch Official Support Personnelcharged.

artICle 6 - standard of proof and eVIdenCe

6.1 Unlessotherwisedescribedherein,thestandardofproofinallcasesbroughtundertheCodeofConductshallbewhethertheJudicial Commissioneriscomfortablysatisfiedthattheallegedoffencehasbeencommitted,bearinginmindtheseriousnessoftheallegationthatismade.Thisstandardofproofinallcasesshallbedetermineonaslidingscalefrom,ataminimum,amerebalanceofprobability(fortheleastseriousoffences)uptoproofbeyondreasonabledoubt(forthemostseriousoffences).

6.2 TheJudicial Commissionershallnotbeboundbyjudicialrulesgoverningtheadmissibilityofevidence.Instead,factsrelatingtoanoffencecommittedundertheCodeofConductmaybeestablishedbyanyreliablemeans,includingadmissions.

6.3 TheJudicial CommissionermaydrawaninferenceadversetotheMatch OfficialorMatch Official Support PersonnelwhoisassertedtohavecommittedanoffenceundertheCodeofConductbasedonhis/herrefusal,withoutcompellingjustification,afterarequestmadeinareasonabletimeinadvanceofthehearing,toappearatthehearing(eitherinpersonortelephonicallyasdirectedbytheJudicial Commissioner)and/ortoansweranyrelevantquestions.

7.2.3 thenatureoftheactiononthepartoftheMatch OfficialorMatch Official Support PersonnelgivingrisetothebreachoftheCodeofConduct;

7.2.4 anypreviousoffencescommittedbytheMatch OfficialorMatch Official Support PersonnelundertheCodeofConduct;

7.2.5 anyothercircumstancesofthecasewhichmayseemtotheJudicial Commissionerrelevanttotheimpositionofasanction.

7.3.3 whereaMatch OfficialorMatch Official Support PersonnelisfoundguiltyofcommittingtwoCodeofConductoffencesinrelationtothesameincidentorsetofcircumstancesarisingduringanInternational Matchandissanctionedseparately,thenanysanctionsimposedshouldrunconcurrently(andnotcumulatively);

7.3.4 ifaJudicial CommissionerimposesasuspensiononaMatch OfficialorMatch Official Support Personnel,thatMatch OfficialorMatch Official Support Personnelshallnotbepermitted,duringtheperiodofsuchsuspension,toofficiateorotherwiseparticipateorbeinvolvedinanycapacityinanyInternational MatchoranyotherkindofMatch,function,eventoractivitythatisauthorized,

organized,sanctioned,recognizedorsupportedinanywaybytheICC,aNational Cricket Federation,oranymemberofaNational Cricket Federation.further,anypaymentsowedtosuchMatch OfficialorMatch Official Support Personnelunderanycontractorconsultancyagreementhe/shehasenteredintowiththeICCoranyNational Cricket Federationduringtheperiodofthesuspensionshallbewithheldforthedurationoftheperiodofthesuspension,includingpaymentsdueundertheMatch OfficialorMatch Official Support Personnel’sretainerwiththeICC(ifany);and

7.3.5 whereafineand/orcostsawardisimposedagainstaMatch OfficialorMatch Official Support Personnel,thensuchfineand/orcostsawardmustbepaidwithinonemonthofthedateonwhichtheMatch OfficialorMatch Official Support PersonnelisnotifiedoftheJudicial Commissioner’sdecision.WhereaMatch OfficialorMatch Official Support Personnelfailstopaysuchfinewithintherelevantperiod,heshallnotbeeligibleforappointmentasaMatch OfficialorMatch Official Support PersonnelbytheICCoranyNational Cricket Federationuntilsuchtimeasthefinehasbeenpaidinfull.

artICle 8 - appeals

8.1 decisionsmadeundertheCodeofConductbyaJudicial Commissionermaybechallengedsolelybyappealassetoutinthisarticle8.SuchdecisionshallremainineffectwhileunderappealunlessanyproperlyconvenedAppeal Panelordersotherwise.

8.2 Theonlypartieswhomayappealadecisionshallbe:(a)theMatch OfficialorMatch Official Support Personnelfoundguiltyoftheoffence;and(b)theICC’s Chief Executive Officer.

8.3 anynoticetoappealunderthisarticlemustbelodgedwiththeICC’s General Counselwithinseven(7)daysofreceiptofthewrittendecisionoftheJudicial Commissioner.Thereafter,thefollowingwillapply:

8.3.1 Withinforty-eight(48)hoursofreceiptofanoticetoappeal:(a)theICC’s General CounselwillappointthreemembersoftheICC’sCodeofConductCommissioneachofwhommust(unlessotherwiseagreedbetweentheparties)befromacountryotherthanthoseparticipatingintherelevantInternational MatchandnotbefromthesamecountryastheMatch OfficialorMatch Official Support PersonneltositastheAppeal Paneltoheartheappeal;and(b)theJudicial CommissionerwillprovideawrittenstatementtotheICC’s General Counselsettingouranyrelevantfacts(tobecopiedtotheMatch OfficialorMatch Official Support Personnel).

8.3.2 Theprovisionsofarticles5.5,6and7,applicabletoproceedingsbeforetheJudicial Commissioner,shallapplymutatismutandis(iewithchangesdeemedtohavebeenmadeasrequiredtoreflectthedifferentcontext)toappealhearingsbeforetheAppeal Panel.

8.3.3 TheAppeal Panelshallhearanddetermineallissuesarisingfromanymatterwhichisappealedtoitpursuanttothisarticleonadenovobasis,ieitshallhearthematteroveragain,fromthebeginning,withoutbeingboundinanywaybythedecisionbeingappealed.fortheavoidanceofdoubt,theAppeal Panelshallhavethepowertoincreaseordecrease,amendorotherwisesubstituteanewdecisionontheappropriateness(orotherwise)ofthesanctionimposedatfirstinstance,providedthatanynewsanctionmustbewithinthepermittedrangeofsanctionssetoutinarticle7.1.

expeditiously.Savewhereallpartiesagreeorfairnessrequiresotherwise,theappealhearingshallbecommencednolaterthanthirty(30)daysaftertheappointmentoftheAppeal Panel.

8.3.5 TheAppeal Panelshallhavethepowertoordersomeorallofthecostsoftheappealproceedings(includingthecostsofholdingthehearing,anyinterpretationcosts,thelegaland/ortravel/accommodationcostsoftheAppeal Paneland/oranyotherrelevantparties)tobepaidbytheappealingpartyifitconsidersthatsuchpartyhasacted,spuriously,frivolouslyorotherwiseinbadfaith.

8.3.6 anydecisionmadebytheAppeal Panelunderthisarticle8,shallbethefull,finalandcompletedispositionofthematterandwillbebindingonallparties.

8.4 No appeal in relation to an accepted sanction

8.4.1 fortheavoidanceofdoubt,whereaMatch OfficialorMatch Official Support PersonneladmitstheoffencechargedandaccedestotheproposedsanctionspecifiedintheNotice of Chargeinaccordancewitharticle4.6.1orentersintoanAgreed Sanctionpursuanttoarticle5.6,theMatch OfficialorMatch Official Support Personnelwaiveshis/herrighttoanyappealagainsttheimpositionofsuchasanction.

artICle 9 - reCoGnItIon of deCIsIons

9.1 anyhearingresultsorotherfinaladjudicationsundertheCodeofConductshallberecognisedandrespectedbytheICCanditsNational Cricket Federationsautomaticallyuponreceiptofnoticeofthesame,withouttheneedforanyfurtherformality.EachoftheICCanditsNational Cricket Federationsshalltakeallstepslegallyavailabletoittoenforceandgiveeffecttosuchdecisions.

artICle 10 - aMendMent and InterpretatIon of the Code of ConduCt

10.1 TheCodeofConductmaybeamendedfromtimetotimebytheICC,withsuchamendmentscomingintoeffectonthedatespecifiedbytheICC.

10.2 TheheadingsusedforthevariousarticlesoftheCodeofConductareforthepurposeofguidanceonlyandshallnotbedeemedtobepartofthesubstanceoftheCodeofConductortoinformoraffectinanywaythelanguageoftheprovisionstowhichtheyrefer.

10.3 TheCodeofConductshallcomeintofullforceandeffecton1november2016(the“effective Date”).ItshallnotapplyretrospectivelytomatterspendingbeforetheEffective Date;provided,however,thatanycasependingpriortotheEffective Date,orbroughtaftertheEffective DatebutbasedonanoffencethatisallegedtohaveoccurredbeforetheEffective Date,shallbegovernedbythepredecessorversionoftheCodeofConductinforceatthetimeoftheallegedoffence,subjecttoanyapplicationoftheprincipleoflexmitiorbythehearingpaneldeterminingthecase.

10.4 IfanyarticleorprovisionofthisCodeofConductisheldinvalid,unenforceableorillegalforanyreason,theCodeofConductshallremainotherwiseinfullforceapartfromsucharticleorprovisionwhichshallbedeemeddeletedinsofarasitisinvalid,unenforceableorillegal.

10.5 TheCodeofConductisgovernedbyandshallbeconstruedinaccordancewithEnglishlaw.Strictlywithoutprejudicetothearbitrationprovisionsofarticles5and8oftheCodeofConduct,disputesrelatingtotheCodeofConductshallbesubjecttotheexclusivejurisdictionoftheEnglishcourts.
