Read the entire policy carefully todetermine rights, duties, and what is and isnot insured. Various provisions in thispolicy restrict coverage.

Words and phrases that appear in bold-faced type have special meaning. Refer tothe Definitions.

Insuring Agreement

With your payment of the premium, weagree to provide only the Coverages,Amounts of Insurance and Limits ofLiability you have selected as shown onthe Declarations Page. This is subject to allpolicy terms and conditions. This policy,which includes the Declarations Page andendorsements, if any, is the entireagreement between you and us regardingthe insurance coverages expressed in itand supersedes all previous agreementsregarding those coverages, either oral orwritten.

We, us and our mean the insurancecompany named on the Declarations Page.

You, your and yours mean the personnamed on the Declarations Page and thatperson’s family member.

For purposes of SECTION II — YourLiability Coverages, you also means:

1. Any person or organization legallyresponsible for animals, golf carts orwatercraft to which this policyapplies.

But you does not mean a person ororganization using or having custodyof your animals, golf carts orwatercraft in the course of any

business or without the consent ofany of you.

2. Any persons employed by any of youand other persons while they are usinga vehicle insured by this policy onyour premises and with the consent ofany of you.

Definitions

Actual cash value means the amount itwould cost to repair or replace insuredproperty with new materials availabletoday of like kind and quality, lessadjustment for physical deterioration anddepreciation, including obsolescence. Ouradjustment for physical deterioration,depreciation and obsolescence applies toall costs including the cost of labor andmaterial.

Bodily injury means:

1. Physical damage;

2. Sickness;

3. Disease; or

4. Death;

caused by an accident.

Business means any full or part-time:

1. Trade;

2. Profession;

3. Occupation; or

4. Activity;

including farming or ranching, engagedin for economic gain.

Business does not mean:

1. The rental, or holding for rental, ofpart of your premises for use as adwelling, unless the rental is to threeor more roomers or boarders.

2. The rental, or holding for rental, ofpart of your premises as a privategarage, office, school or studio.

Family member means a person who:

1. Resides in your household; and

2. Is related to you by:

a. Blood;

b. Marriage; or

c. Adoption.

Family member also means your ward orfoster child who resides in your household.

Farm or Farming means the ownershipor use of land for cultivation ofagricultural products. However, farm orfarming does not include the ownershipor use of land for the cultivation of apersonal garden.

Medical expenses means reasonablecharges for:

1. Medical.

2. Surgical.

3. X-ray.

4. Dental.

5. Ambulance.

6. Hospital.

7. Professional nursing.

8. Recognized religious methods ofhealing.

9. Prosthetic devices.

10. Funeral services.

A move begins when the leveling jacks orblocks are removed and utilities are dis-connected for the purpose of transporta-tion. A move ends when the leveling jacks

or blocks are installed and utilities arereconnected.

Personal injury means injury arising outof one or more of the following offenses:

1. False arrest, detention or imprisonment;

2. Malicious prosecution; or

3. Libel, slander or defamation ofcharacter.

Pollutant means any solid, liquid, gaseousor thermal irritant or contaminant,including smoke, vapor, soot, fumes,acids, alkalis, chemicals, metals, lead paintcomponents and compounds, and waste.Waste includes materials to be recycled,reconditioned or reclaimed. However,irritants and contaminants released by anaccidental fire on your premises are not apollutant.

Premises means:

1. The dwelling that is described on theDeclarations Page.

2. The other structures, including side-walks, driveways or other privateapproaches that serve your dwelling.

3. The grounds immediately adjacent toyour dwelling and other structures.

For purposes of SECTION II — Your Lia-bility Coverages, premises also means:

1. Vacant land, other than farm land,owned by or rented to any of you.

2. Land on which a one-family or two-family dwelling is being built for yourpersonal use.

3. Premises not owned by you but inwhich you live temporarily.

4. Your cemetery plots and burial vaults.

5. Any part of a premises occasionallyrented to you for other than businessuse.

Property damage means direct physicaldamage or destruction of tangible property

of others, including loss of its use, causedby an accident.

Ranch or ranching means the ownershipor use of land for the raising of livestocksuch as cattle, sheep or horses.

Residence employee means an employeeof yours who performs duties in connectionwith the maintenance or use of yourpremises, including household or domesticservices, or who performs duties elsewhereof a similar nature not in connection withthe business of any of you.

SECTION I — Your Property Coverages

We provide insurance only for insuredlosses that occur during the Policy Periodshown on the Declarations Page.

Coverage A — DwellingWe insure:

1. Your dwelling that is described on theDeclarations Page.

2. Materials and supplies for use in theconstruction, alteration or repair ofyour dwelling located within or imme-diately adjacent to your dwelling.

3. Any structure you own that is attachedto your dwelling, other than a struc-ture attached only by a fence, utilityline or similar connection.

We do not insure:

1. Fences.

2. Land including any cost to repair,rebuild, stabilize or otherwise restoreland on which your dwelling islocated either before or after a loss.

3. Your dwelling during a move.

4. Loss, including damage or remedia-tion costs, caused by or resulting fromthe presence of mold, mildew, orother fungi, their secretions, and dry

and wet rot of any kind regardless ofthe cause, condition or loss that led totheir formation or growth.

Coverage B — Other Structures

We insure:

1. Your other structures you own onyour premises that are separated fromyour dwelling.

2. Your other structures you own onyour premises connected to yourdwelling by only a fence, utility lineor similar connection.

3. Materials and supplies used in theconstruction, alteration or repair ofthose other structures located withinor immediately adjacent to those otherstructures.

We do not insure:

1. Land including any cost to repair,rebuild, stabilize or otherwise restoreland on which the other structures arelocated either before or after a loss.

2. Your other structures during a movefrom your premises.

3. Loss, including damage or remedia-tion costs, caused by or resulting fromthe presence of mold, mildew, orother fungi, their secretions, and dryand wet rot of any kind regardless ofthe cause, condition or loss that led totheir formation or growth.

Coverage C — Personal Property

We insure personal property you own oruse anywhere in the world.

The Amount of Insurance for personalproperty usually located at a dwelling thatyou own or rent, other than your dwellingdescribed on the Declarations Page, is10% of the Amount of Insurance for Cov-erage C – Personal Property or $1,000,whichever is greater.

While moving into a dwelling, for a 30-day period, you may apply the Amount ofInsurance for Coverage C – Personal Prop-erty to your personal property located inyour new dwelling.

If you request it, we will insure personalproperty owned by:

1. Others while the property is on thepart of your premises occupied byany of you.

2. A guest or a residence employeewhile the property is in any dwellingoccupied by any of you.

These provisions do not change theSpecial Amounts of Insurance.

Coverage C – Personal Property does notapply to your personal property insideyour dwelling during a move.

Special Amounts of Insurance Special Amounts of Insurance apply to thefollowing groups of personal property.These Special Amounts of Insurance donot increase the total Amount of Insuranceprovided by Coverage C – Personal Prop-erty. The Special Amount of Insurance foreach group is the maximum we will payfor any one loss for all property includedin the following groups:

Special Amounts Personalof Insurance Property Group

1. $250 Animals, including birdsand fish.

2. $250 Money, script bank notes,bullion, coins, metals, pre-cious metals includingplatinum, gold other thangold ware and silver otherthan silverware, prepaidinstruments includingstored value cards, smartcards and gift certificates.

3. $500 Personal property prima-rily used or intended forbusiness purposes whileaway from your premises.

4. $2,500 Personal property prima-rily used or intended forbusiness purposes whileon your premises.

5. $1,500 Securities, accounts,deeds, evidence of debt,letters of credit, notesother than bank notes,manuscripts, passports,personal records, tickets,and stamps.

This special Amount ofInsurance includes allcosts to research, restoreor replace the informationand the medium uponwhich it was recorded.

6. $5,000 Vehicles or conveyancesinsured by this policy.

7. $1,500 Watercraft, including theirtrailers, furnishings, acces-sories, equipment andengines or motors.

8. $1,500 Trailers, other than water-craft trailers.

9. $1,500 Memorabilia, souvenirs,trading cards, collector'sitems and similar articleswhose age or history con-tribute to their value.

10. $2,500 Tools for loss by theft,including mysterious dis-appearance.

11. $2,000 Jewelry, watches, furs,precious and semi-precious stones, for loss bytheft, including mysteriousdisappearance.

12. $5,000 Silverware, silver-platedware, gold ware, gold-plated ware and pewterware, for loss by theft,including mysterious dis-appearance.

Property We Do Not Insure

We do not insure:

1. Aircraft and any aircraft parts, equip-ment and accessories includingengines and motors.

But we do insure model or hobby air-craft not used or designed to carrypeople or cargo.

2. Land motor vehicles, including recre-ational land motor vehicles, all othermotorized land conveyances and anyvehicle or conveyance parts, equip-ment and accessories.

We do insure vehicles or conveyances,other than recreational land motorvehicles or conveyances, that are:

a. Not required to be registered foruse on public roads and are usedsolely for the maintenance ofyour premises immediately adja-cent to your dwelling describedon the Declarations Page.

b. Designed for assisting thehandicapped.

c. Golf carts.

3. Property separately described andspecifically insured elsewhere in thisor any other insurance policy.

4. Camper bodies, camper trailers ortravel trailers.

5. Data stored on any media includingdata stored in:

a. Paper records.

b. Electronic data processing tapes,discs or other software media.

c. Computer related equipment.

We do insure the cost of prerecordedcomputer programs available on theretail market.

6. Credit cards, electronic fund transfercards or access devices used solelyfor deposit, withdrawal or transfer offunds.

7. Materials and supplies used in theconstruction or repair of your dwell-ing or other structures.

8. Property in an apartment rented, orheld for rental to others, by any ofyou.

9. Property rented, or held for rental toothers, while that property is awayfrom your premises.

10. Loss, including damage or remedia-tion costs, caused by or resulting fromthe presence of mold, mildew, orother fungi, their secretions, and dryand wet rot of any kind regardless ofthe cause, condition or loss that led totheir formation or growth.

Coverage D — Additional Living Expenses

If an insured loss makes your premisesnot fit to live in, we will pay the actual,reasonable and necessary increase in yourliving expense to maintain your normalstandard of living while you live else-where. We will pay for the shortest timeneeded:

1. To repair or replace the damagedproperty.

2. For you to permanently relocate.

The total amount we will pay will notexceed the Amount of Insurance describedon the Declarations Page for Coverage D –Additional Living Expense.

If damage caused by an Insured Periloccurs at a neighboring premises, we willpay reasonable additional living expensesfor up to two weeks should civil authori-ties prohibit occupancy of your premises.

This period of time will not be limited bythe expiration of this policy.

We will not pay for expense due to thecancellation of a lease or agreement.

No deductible will apply to this coverage.

Your Additional CoveragesWe automatically include the followingadditional coverages:

1. Debris Removal. We will pay theactual, reasonable and necessary costfor the removal of debris of insuredproperty, other than trees, from yourpremises when deposited by anInsured Peril that applies to theinsured property.

The debris removal cost is included inthe Amount of Insurance that appliesto the damaged property. If theamount to be paid for the actual dam-age to the property plus the debrisremoval cost is more than the Amountof Insurance for the damaged prop-erty, we will pay up to an additional5% of the Amount of Insurance forCoverage A – Dwelling, or $5,000,whichever is greater, for debrisremoval.

We will also pay the actual, reason-able and necessary cost, up to $1,000for the removal of one or more fallentrees from your premises if the treesdamage an insured structure and thefalling of your tree or a neighbor’stree was caused by windstorm or hail,weight of ice, snow or sleet.

No deductible will apply to thiscoverage.

2. Emergency Repairs After Loss. Wewill pay any actual, reasonable andnecessary expenses for emergencyrepairs incurred in protecting yourinsured property from further damageif the damage was caused by anInsured Peril.

No deductible will apply to thiscoverage.

3. Emergency Removal of Your Per-sonal Property. We will pay whenyour personal property must bemoved because it is endangered by anInsured Peril. We will pay the actual,reasonable and necessary cost up to$250 to remove and return your per-sonal property to your premisesdescribed on the Declarations Page.

No deductible will apply to thiscoverage.

4. Emergency Removal of YourDwelling. We will pay when yourdwelling must be moved because it isendangered by an Insured Peril. Wewill pay the actual, reasonable andnecessary cost to remove and returnyour dwelling to your premisesdescribed on the Declarations Page.

No deductible will apply to thiscoverage.

5. Fire Department Service Charge(not applicable in Arizona, New Jer-sey and New Mexico). We will paythe actual, necessary and reasonablecharges, up to $1,000, for fire depart-ment services rendered when the firedepartment is called to save or protectproperty from an Insured Peril.

No deductible will apply to thiscoverage.

6. Trees, Shrubs, Plants and Lawns.We will pay up to 5% of the Amount

of Insurance shown for Coverage A –Dwelling for loss to trees, shrubs,plants and lawns on your premises.We will not pay more than $500 forany one tree, shrub, plant or lawnincluding the cost of removing thedebris of the insured property.

Coverage applies to loss caused byfire, lightning, explosion, riot, civilcommotion, aircraft and vehicles notowned or operated by any resident ofyour premises, vandalism, maliciousmischief or theft.

But we do not insure trees, plants,shrubs or lawn:

a. Grown for business purposes.

b. Located more than 150 feet fromyour dwelling described on theDeclarations Page.

No deductible will apply to thiscoverage.

7. Credit Card, Money TransferCard, Check Forgery and Counter-feit Money.

a. Credit Card and Money Trans-fer Card Coverage. If you arelegally required to pay for theunauthorized use of a credit cardor charge plate issued to you, wewill insure the loss. We will alsopay for loss which results fromunauthorized use of a moneytransfer card issued to you.

But we do not insure:

(1) use of the credit card ormoney transfer card by anyof you.

(2) use by someone to whomyou have given the card orplate.

(3) use unless you have met allthe terms under which thecard or plate was issued.

b. Check Forgery Coverage. Weinsure loss to you caused byforgery or alteration of a check.This includes all negotiableinstruments.

c. Counterfeit Money Coverage.We insure loss sustained by youthrough acceptance in good faithof counterfeit United States orCanadian paper currency.

We will not pay more than $1,500 forany one loss involving one or more ofthese coverages. Repeated lossescaused by any one person or in whichany one person is involved are to beconsidered one loss.

We do not insure any loss that arisesfrom your business pursuits or dis-honesty.

If a claim is made or suit is broughtagainst any of you for liability underthe Credit Card or Money TransferCard Coverage, we will defend you.We will defend at our expense withlegal counsel of our choice.

We may, at our option and at ourexpense, defend you or your bankagainst a suit to enforce paymentunder the Check Forgery Coverage.

We may investigate any claim or set-tle any suit as we think appropriate.

We will not defend after we have paidor offered to pay $1,500 for any oneloss involving one or more of thesecoverages.

No deductible will apply to thiscoverage.

8. Food Spoilage. We will pay theactual, necessary and reasonable cost,up to $500, for spoilage of food inyour freezer or refrigerator, on yourpremises, when the damage is causedby interruption of electrical service ormechanical breakdown.

A deductible of $50 will apply to eachloss.

9. Loss Assessment. We will pay yourshare of any assessment chargedagainst all members of an associationof property owners if the assessmentis made as a result of direct, suddenand accidental physical loss caused byan Insured Peril to the property collec-tively owned by all members.

This coverage applies only to assess-ments made against you as the ownerof your premises for losses whichoccur during the Policy Period shownon the Declarations Page. We will payup to $1,000 with respect to any oneloss regardless of the number ofassessments made.

This coverage does not apply to prop-erty that we do not insure if owned byyou.

No deductible will apply to thiscoverage.

10. Ordinance or Law.

We will pay the actual, reasonableand necessary cost, up to 5% of theAmount of Insurance shown on theDeclarations Page for Coverage A -Dwelling or Coverage B - OtherStructures for:

a. The increased costs caused by theenforcement of any governmentalrequirement regulating construc-tion, repair, renovation, remodel-ing or demolition of that part ofyour dwelling or other structuresdamaged by an Insured Peril.

b. The increased costs caused bythe enforcement of anygovernmental requirementregulating the construction,repair, renovation, remodeling ordemolition of the undamagedpart of your dwelling or other

structures if it is necessary torepair that part of your dwellingor other structures damaged byan Insured Peril.

We will not pay:

a. The costs to comply with anyordinance or law which requiresany of you or others to test for,monitor, clean up, remove, con-tain, treat, detoxify or neutralizepollutants.

b. For the loss in value to yourdwelling due to the requirementof any ordinance or law.

c. The cost to repair, replace,rebuild, stabilize or otherwiserestore land.

No deductible will apply to thiscoverage.

11. Locksmith Coverage. We will paythe actual, reasonable and necessarycost, up to $500, for locksmith ser-vices required because of a loss ortheft of any of your house keys.

No deductible will apply.

SECTION I — Insured Perils

We insure risk of direct, sudden andaccidental physical loss to the propertydescribed in Coverage A - Dwelling,Coverage B - Other Structures andCoverage C - Personal Property unless theloss is excluded elsewhere in this policy.

SECTION I — Exclusions

We do not insure loss caused directly orindirectly by any of the following. Suchloss is excluded regardless of any othercause or event contributing concurrentlyor in any sequence to the loss.

1. Loss intentionally caused by any ofyou or performed at any of yourdirection.

2. Loss of or to any property caused by,consisting of or increased by theenforcement of any governmentalrequirement regulating:

a. Sale.

b. Confiscation.

c. Seizure.

d. Occupancy.

e. Relocation or removal.

But we do insure loss arising out of agovernment action to prevent thespread of fire provided that a losscaused by fire would otherwise beinsured by this policy.

3. Loss caused by the use, sale, manu-facture, distribution, delivery, trans-fer or possession of any illegalsubstance or the illegal possession ofa controlled substance as defined byfederal or state law by any of you.Such substances include but are notlimited to lysergic acid diethylamide(LSD), methamphetamines, marijuanaand all narcotic drugs.

4. Loss caused by war, whether declaredor undeclared, including civil war,insurrection, rebellion or revolution.

5. Loss caused by:

a. The actual, alleged or threateneddischarge, dispersal, seepage,migration, release or escape ofpollutants.

b. Loss, cost or expense from anygovernmental direction or requestthat any of you test for, monitor,clean up, remove, contain, treat,detoxify or neutralize pollutants.

6. Loss caused by:

a. Flood water, surface water,waves, tidal water, storm surge,tsunami or overflow of a body ofwater from any source includingspray from any of these whetheror not driven by wind.

b. Water or sewage which backs upthrough sewers or drains or thatoverflows from a sump.

c. Water below the surface of theground regardless of its source.This includes water which exertspressure on or flows, seeps orleaks through any part of yourdwelling or other structures,foundation, sidewalk, drivewayor swimming pool.

This exclusion applies whether or notthere was widespread damage andwhether or not the loss was caused bya human activity or an act of nature.

This exclusion does not apply to ensu-ing loss caused by fire or explosion.

7. Loss caused by freezing, thawing,pressure or weight of water, ice orsnow, whether driven by wind or not,to a fence, pavement, patio, swim-ming pool, septic system, foundation,retaining wall, bulkhead, pier, wharfor dock.

8. Loss caused by any business activitybeing conducted with or without yourknowledge by any of you or anyresident of your premises.

9. Loss caused by vandalism, burglary,malicious mischief, theft or any otherunlawful taking of property if yourdwelling has been vacant for morethan 30 consecutive days immediatelybefore the loss.

This exclusion does not apply to ensu-ing loss caused by fire or explosion.

a. Freezing of plumbing, heating orair conditioning systems, fire pro-tection sprinkler systems ordomestic appliances.

b. Freezing of sumps or sumppumps and related equipment andpiping.

c. Discharge, leakage or overflowfrom the systems or appliancesdamaged by freezing.

This exclusion does not apply if youhave taken reasonable care to:

a. Maintain heat in your dwelling orother structure; or

b. Shut off the water supply anddrain the systems and appliancesof water.

11. Loss caused by:

a. Wear and tear, marring, scratch-ing, deterioration, rust or othercorrosion.

b. Inherent vice, latent defect,mechanical breakdown, manu-factured defect or mechanicalfailure.

c. Mold, mildew, or other fungi,their secretions, and dry and wetrot of any kind.

d. Smog, smoke from agriculturalsmudging or industrial operations.

e. Settling, cracking, shrinkage,bulging or expansion, includingresulting cracking of pavements,patios, foundations, walls, floors,roofs or ceilings.

f. Insects or domestic householdanimals or pets.

This exclusion does not apply to:

a. Ensuing loss caused by fire orexplosion.

b. Water damage caused by waterthat suddenly escapes from a

plumbing, heating, fire protectionsprinkler or air conditioning sys-tem or domestic appliancebecause of any of the above.

c. The cost of tearing out andreplacing any part of your dwell-ing or other structure necessary torepair the system or appliance.

But we do not insure loss to thesystem or appliance from whichthe water escaped.

12. Loss caused by continuous orrepeated seepage or leakage of wateror steam from within a plumbing,heating, fire protection sprinkler or airconditioning system or from within anappliance that occurs over a period ofweeks, months or years.

This exclusion does not apply to ensu-ing loss caused by fire or explosion.

13. Loss to animals, including birds andfish unless caused by fire, lightning,windstorm, hail, smoke, explosion,riot or falling aircraft.

14. Loss caused by breakage of eye-glasses, glassware, statuary, marble,bric-a-brac, porcelains and similarfragile articles unless the breakage iscaused by or results from:

a. Fire, lightning, windstorm or hail.

b. Explosion, riot or civilcommotion.

c. Aircraft, vehicles or vandalismand malicious mischief.

d. Theft or attempted theft.

This exclusion does not apply to jew-elry, watches, bronzes, cameras andphotographic lenses.

15. Loss caused by leakage from rain,sleet or snow or its resulting damagewhether or not wind-driven.

This exclusion applies whether or notthere was widespread damage.

This exclusion does not apply to ensu-ing loss caused by fire or explosion.

18. Loss caused by nuclear reaction,explosion, radiation or radioactivecontamination.

This exclusion does not apply to ensu-ing loss caused by fire or explosion.

SECTION I — Our Payment Methods

Coverage A — Dwelling

Total LossAgreed Loss Payment MethodA total loss occurs when your dwelling isdamaged beyond reasonable repair.

When a total loss occurs, your loss will beequal to the Amount of Insurance shownon the Declarations Page.

Partial Loss Actual Cash Value Payment MethodWhen a partial loss occurs, the amount wepay for loss to your dwelling will be thelowest of:

1. The actual cash value of the dam-aged portion of your dwelling at thetime of the loss.

2. The amount required to repair orreplace your dwelling.

3. The Amount of Insurance shown onthe Declarations Page.

We may make a cash settlement or repairor replace your dwelling with a dwellingof like kind and quality. We will give younotice of our intention within 30 daysafter we receive your proof of loss.

We will not pay contractor's fees orcharges for overhead and profit except tothe extent that they are reasonable,incurred and actually paid.

We will not pay for loss consisting ofactual or perceived reduction of marketvalue after your damaged dwelling hasbeen replaced, restored or repaired.

The damage to your dwelling will reducethe Amount of Insurance available duringthe Policy Period by the amount of thedamage. Your coverage will return to theAmount of Insurance shown on the Decla-rations Page upon completion of therepairs or replacements.

Coverage B — Other StructuresCoverage C — Personal Property

Total and Partial Loss Actual Cash Value Payment Method

The amount we pay for loss to your otherstructures or personal property will be thelowest of:

1. The actual cash value of the lost ordamaged portion of your property atthe time of the loss.

2. The amount required to repair orreplace your lost or damaged property.

Payment Methods — Specific Losses

Pairs, Sets or Series of Objects

In case of loss to a part of a pair, set,series of objects, pieces or panels, eitherinterior or exterior, we may:

1. Repair or replace any part to restorethe pair, set or series of objects to itsvalue before the loss.

2. Pay the difference between actualcash value of the pair, set or series ofobjects before and after the loss.

3. Pay the reasonable cost of providing asubstitute to match the remainder ofthe pair, set or series of objects asclosely as possible.

We will not be obligated to repair orreplace the entire pair, set, series of

objects, pieces or panels, either interior orexterior, when a part is lost or damaged.

Stolen Property

Before a loss for stolen property is paid orthe property is replaced, we may returnany recovered stolen property to you atour expense with payment for any dam-age.

SECTION I — Deductible

Any loss to insured property will besubject to the deductible shown on theDeclarations Page or elsewhere in thispolicy unless stated otherwise.

If your insured loss, other than loss causedby earthquake or hurricane, exceeds$5,000 the deductible will be waived.

SECTION II — Your Liability Coverages

Coverage E — Personal LiabilityIf a claim is made or a suit brought againstyou for damages because of bodily injuryor property damage, caused by an acci-dent to which this coverage applies, or if aclaim is made or a suit brought againstyou for damages because of personalinjury, caused by an offense to which thiscoverage applies, we will:

1. Pay up to the Limit of Liabilityshown on the Declarations Page forthe damages for which you are legallyliable.

2. Provide a defense at our expense byattorneys of our choice.

We may make any investigations andsettle any claims or suits that we decideappropriate. Our obligation to defend anyclaim or suit ends when the amount wepay in settlement or judgment for damagesresulting from the accident or offense

equals the Limit of Liability shown on theDeclarations Page. This insurance appliesonly to bodily injury and propertydamage that occurs during the PolicyPeriod and to personal injury only if theoffense occurs during the Policy Period.

If a claim is made or a suit is broughtagainst any of you by any other person ororganization for indemnity, reimburse-ment or contribution toward damages forbodily injury or property damageexcluded by this policy, we will not pro-vide coverage for that claim or suit.

Coverage F — Medical Payments To Others

We will pay for you, up to the Limit ofLiability shown on the Declarations Page,the actual, reasonable and necessarymedical expenses incurred or medicallydetermined within three years from thedate of an accident causing bodily injury.Coverage F — Medical Payments ToOthers applies only to accidents that occurduring the Policy Period shown on theDeclarations Page.

Medical Payments To Others applies only:

1. To a person on your premises withyour permission.

2. To a person on or off your premisesif the bodily injury:

a. Arises out of a condition in or onyour premises.

b. Is caused by your activities.

c. Is caused by a residenceemployee in the course of dutiesfor you.

d. Is caused by a domestic house-hold animal owned by you or inyour care.

A Medical Payments To Others paymentis not an admission of liability by any ofyou or us.

SECTION II — Your Additional Coverages

1. Claim Expenses

We will pay:

a. Expenses we incur and coststaxed against you in any suit wedefend.

b. Premiums on bonds required in asuit we defend, but not for bondamounts greater than the Limit ofLiability for Personal Liability.We are not obligated to apply foror furnish any bonds.

c. Expenses you incur at ourrequest, including up to $250 aday actual loss of earnings, forassisting us in the investigationor defense of any claim or suit.

d. Prejudgment interest awardedagainst you on that part of thejudgment we pay.

e. Interest on the entire enteredjudgment until we pay, formallyoffer, or deposit in court that partof the judgment that does notexceed the limit of our liabilityon that judgment.

2. First Aid Expenses

We will pay your expenses for firstaid to others at the scene of an acci-dent. We will not pay for first aid toany of you.

3. Damage to Property of Others

We will pay, at replacement cost, upto $500 per accident for Damage toProperty of Others caused by you,

provided that at the time of the acci-dent the property was being used byany of you or was in your care.

4. Loss Assessment

We will pay up to $1,000 per accidentfor your liability arising out of anyloss assessment charges against youas a member of an association ofproperty owners for compensatorydamages arising out of bodily injuryor property damage caused by anyone accident that occurs during thePolicy Period shown on the Declara-tions Page regardless of the number ofassessments made.

This coverage only applies to lossassessments charged against you asthe owner of your premises.

SECTION II — Exclusions

Coverage E — Personal LiabilityCoverage F — Medical Payments To Others

We will not pay for bodily injury orproperty damage:

1. Resulting from any act or omissionthat is intended by any of you to causeany harm or that any of you could rea-sonably expect to cause harm. Thisexclusion applies whether or not anyof you:

a. Intended or expected the result ofthe act or omission so long as theresulting injury or damage was anatural or foreseeable conse-quence of the intended act oromission.

b. Was under the influence of alco-hol or narcotics.

c. Was insane.

d. Is deemed not to have had themental capacity to form the legalintent to commit the act or omis-sion causing injury or damage.

This exclusion does not apply tobodily injury resulting from the useof reasonable force to protect personsor property.

2. Arising out of business pursuits ofany of you.

3. Arising out of the rendering or failingto render professional services.

4. Arising out of the actual, alleged orthreatened discharge, dispersal,release, escape of, or the ingestion,inhalation or absorption of pollutantsat or from any property you own, rent,occupy, sell, abandon or give away.

5. Arising out of loss, cost or expensefrom any governmental direction orrequest that you test for, monitor,clean up, remove, contain, treat,detoxify or neutralize pollutants.

6. Arising out of the ownership, opera-tion, maintenance, use, loading orunloading of:

a. Aircraft.

This exclusion does not apply tomodel or hobby aircraft not usedor designed to carry people orcargo.

b. A land motor vehicle designed,modified or altered for use onpublic roads, entirely or partiallyowned or operated by or rentedor loaned to any of you.

This exclusion does not apply ifthe land motor vehicle is not sub-ject to motor vehicle registrationbecause it is:

(1) Used exclusively on yourpremises.

c. A recreational land motor vehicleowned entirely or partially by anyof you.

This exclusion does not apply:

(1) To recreational land motorvehicles on your premisesexcept while used for farm-ing or ranching.

(2) To recreational land motorvehicles in dead storage.

(3) To a golf cart except:

(a) while used for farmingor ranching; or

(b) that is required to belicensed by applicablestate law.

d. Watercraft:

(1) Owned entirely or partiallyby, or rented to, any of you ifit has motor power of morethan 50 total horsepower, asrated by its manufacturer.

(2) Owned entirely or partiallyby, or rented to, any of you ifit is a sailing vessel 26 feet ormore in length.

e. Trailers.This exclusion applies only totrailers being towed by or carriedon a land motor vehicle.

This exclusion does not apply tobodily injury to a residenceemployee arising out of and in thecourse of employment by any of you.

7. Arising out of the entrustment by anyof you to any person of any aircraft,land motor vehicle, recreational landmotor vehicle, watercraft or trailer.

This exclusion applies only if exclu-sion 6. applies.

8. Arising out of:

a. The negligent supervision by anyof you of any person;

b. Any liability by statute imposedon any of you; or

c. Any liability assumed through anunwritten or written agreementby any of you;

with regard to the ownership, opera-tion, maintenance or use of any air-craft, land motor vehicle, recreationalland motor vehicle, watercraft ortrailer.

This exclusion applies only if exclu-sion 6. applies.

9. Arising directly or indirectly out ofwar, hostile or warlike action in timeof peace or war, whether or notdeclared, riot or civil disorder.

10. Arising out of the transmission of orexposure to a communicable diseaseby any of you.

11. Arising out of child care services pro-vided for a fee by or at the directionof:

a. Any of you.

b. Any of your employees.

c. Any other person actually orapparently acting on behalf ofany of you.

This exclusion does not apply to theoccasional child care services pro-vided by any of you or to the part-timechild care services provided by any ofyou younger than 19 years of age.

12. Arising out of any sexual act, sexualmolestation, corporal punishment, orphysical or mental abuse by any ofyou.

13. Arising out of the use, sale, manu-facture, distribution, delivery, trans-fer or possession of any illegal

14. Arising out of nuclear reaction, radia-tion or radioactive contamination.

15. Sustained by any person whoregularly resides on your premises.

16. Resulting from an act committed byany of you in the course of or infurtherance of any crime or offense ofa violent nature.

17. Arising out of the rental, or holdingfor rental, of any property owned byany of you.

This exclusion does not apply to therental, or holding for rental, of part ofyour premises shown on the Declara-tions Page unless intended for use as aresidence by three or more roomers orboarders.

18. Arising out of the ownership, mainte-nance or use of any farming orranching property.

19. Arising out of the care, handling, orriding of any animal other than adomestic household animal.

20. Arising out of any premises owned byor leased to any of you that is notdescribed in this policy.

Coverage E — Personal LiabilityWe will not pay for:

1. Liability assumed in an unwritten orwritten agreement in connection witha business of any of you.

2. Liability arising out of any written ororal statement made by any of you orothers on your behalf which is mate-rial to any financial transaction.

3. Damage to property owned, sold,rented to others, abandoned or givenaway by any of you.

4. Damage to property rented to, occu-pied or used by any of you or in yourcare, except property damagecaused by fire, smoke or explosion.

5. Bodily injury to any person eligibleto receive any benefits required to beprovided by any of you under anyworkers’ compensation, non-occupa-tional disability or occupational dis-ease law.

6. Bodily injury or property damageto any of you as defined in this pol-icy.

7. Arising out of liability assumed byany of you in any contract or agree-ment whether before or after theoffense occurs.

8. Caused by a violation of a penal lawor ordinance committed by or withthe knowledge or consent of any ofyou.

9. Sustained by any person as a result ofan offense directly or indirectlyrelated to the employment of this per-son by any of you.

10. Arising out of any of your businessregardless of whether it is a businessthat is owned or operated by any ofyou or employs any of you.

11. Arising out of civic or public activi-ties performed for pay by any of you;

12. Personal injury to any of you.

Coverage F — Medical Payments To OthersWe will not pay for bodily injury:

1. To any of you or any person whoregularly resides on your premises.

2. To a residence employee if bodilyinjury occurs off your premises and

3. To any person eligible to receive anybenefits required to be provided byyou under any workers’compensation, non-occupationaldisability or occupational disease law.

Damage To Property Of Others

We will not pay for damage:

1. Otherwise insured in this policy.

2. Caused intentionally by any one ofyou who is 13 years old or older.

3. To property owned by any of you orany person who regularly resides onyour premises.

4. Arising out of:

a. Any of your business.

b. Any act or omission in connec-tion with a premises owned,rented or controlled by any of youthat is not described in this pol-icy.

5. Arising out of the ownership, opera-tion, maintenance or use of:

a. Aircraft.

This exclusion does not apply tomodel or hobby aircraft not usedor designed to carry people orcargo.

b. Land motor vehicle.

c. Recreational land motor vehicle.

d. Watercraft.

e. Trailer.

This exclusion does not apply to:

a. Golf carts except while used forfarming or ranching.

b. Equipment usual and incidental tothe maintenance of your premises.

Policy Conditions

1. Insurable Interest, Amount ofInsurance and Limits of Liability.Regardless of the number of people ororganizations who have an interest inthe insured property, we will not beliable in any one loss for more thanthe lesser of:

a. The interest of a person ororganization insured.

b. The applicable Amount ofInsurance.

The Limit of Liability for Coverage E— Personal Liability will not exceedthe limit shown on the DeclarationsPage regardless of the number of per-sons or organizations insured orclaims made.

The insuring of more than one personor organization by this policy does notincrease the Amounts of Insurance.

2. Joint Obligations. The terms of thispolicy impose joint obligations oneach and every one of you. Thismeans that the responsibilities, actsand failures to act of any of you willbe binding upon all of you.

3. Concealment or Fraud. The entirepolicy will be void if any of you:

a. Intentionally conceal ormisrepresent any material fact orcircumstance;

b. Engage in fraudulent conduct;

c. Make false statements;

whether before or after a loss or claimrelating to this insurance.

4. What to Do When You Have a Loss.You or someone on your behalf mustpromptly report to the police anytheft, robbery or burglary loss afteryou discover the loss.

In the event of a loss or accident, youor someone on your behalf mustnotify us at once. The quickest way isto phone your insurance representa-tive or us. Please give your name, pol-icy number, how the loss happened,the extent of the damages or injuries,names of witnesses and all other perti-nent facts. You must promptly send usany demand, notice, summons orother legal papers you receive.

If we need other information to inves-tigate the loss, we will ask you for it.We may require this information inwriting.

If you have a loss, you must protectyour dwelling, other structures orpersonal property from any furtherdamage. If you fail to do so, anyfurther damage will not be insured bythis policy.

We may require that you submit to usa notarized statement of loss. Thestatement must be submitted within90 days of our request that you do so.You will be required to show us thedamaged property and submit toexamination under oath. You will berequired to cooperate with us in oureffort to investigate the accident orloss, settle any claims against you anddefend you. If you fail to cooperate,we have the right to deny you cover-age in this policy.

You may not, except at your own cost,voluntarily make any payment,assume any obligation or incur anyexpenses. This provision does notapply for First Aid Expenses or Emer-gency Repairs After Loss.

We will offer to make settlementwithin 30 days after we receive anacceptable proof of loss from you andthe amount of loss is determined asprovided in this policy.

5. Appraisals. If you and we fail toagree on the amount of the loss, thenboth you and we have the right toselect a competent and disinterestedappraiser within 20 days from the dayof disagreement. The appraisers willdetermine the amount of the loss. Ifthey do not agree, then the appraiserswill choose a competent and disinter-ested umpire. Then each appraiserwill submit his amount of the loss toan umpire selected by them or by acourt having jurisdiction if theappraisers cannot agree upon anumpire. The agreement of any twowill determine the amount of loss fordamage to your property. You payyour appraiser and we pay ourappraiser. You and we share equallythe expenses of the umpire and allother expenses of the appraisals.

In no event will an appraisal be usedfor the purpose of interpreting anypolicy provision, determining causa-tion or determining whether any itemor loss is insured by this policy. Ifthere is an appraisal, we still retain theright to deny the claim.

6. Other Insurance.

a. SECTION I — Your PropertyCoverages

If both this and other insuranceapply to a loss, we will pay ourshare. Our share will be the pro-portionate amount that this insur-ance bears to the total amount ofall applicable insurance.

b. SECTION II — Your LiabilityCoverages

This insurance is excess overother valid insurance exceptinsurance written specifically toinsure excess over the limits thatapply in this policy.

If at the time of loss, there isother insurance in the name of acorporation or association ofproperty owners insuring thesame property insured by thispolicy, this insurance will beexcess over the amount recover-able under such other insurance.

7. Our Right to Recover from Others.After we have paid a claim, except forMedical Payments to Others, we havethe right to recover the payment fromanyone who may be held responsiblefor the loss. You are required to signany papers and do whatever else isnecessary to transfer this right to us.Neither you nor anyone we insure inthis policy has the right to do anythingto prejudice our right.

You may waive your rights to recoveragainst another person for lossinvolving the property insured by thispolicy. This waiver must be in writingprior to the date of loss.

8. Legal Action Against Us. You maynot bring legal action against us con-cerning this policy unless you havefully complied with all of the policyterms. If you and we have failed toagree on the amount of the loss, thenyou may not bring legal action againstus until you have submitted andresolved that dispute throughappraisal as described in Condition 5.Suit must be brought within one yearafter the loss occurs.

9. Lienholder Interest. If you borrowedmoney to buy your dwelling, the per-son or business that loaned you themoney is called the lienholder. The

designation of a lienholder is consid-ered to be an acknowledgment by youthat the entity named has a legal inter-est in your dwelling due to an install-ment sales contract or other securityagreement. Your lienholder mayrequire you to name it on the Declara-tions Page as a separate insured partyfor any insurable interest it may have.

When a lienholder is named on theDeclarations Page, Our PaymentMethod will recognize the lien-holder's interest in your property. Ifwe elect to settle your loss or damagein money, both your name and yourlienholder's will appear on our pay-ment check. If you have paid off yourlienholder, please tell us so that thelienholder's name may be removedfrom the Declarations Page.

If your interest in your dwelling isterminated, Our Payment Method willrecognize only the lienholder's inter-est in this policy. No change in title orownership of your dwelling or anyacts of yours will cancel the lien-holder's interest in this policy.

You or the lienholder must let usknow promptly of any change ofownership or any increase in hazardwhich comes to you or the lien-holder's knowledge.

If you fail to pay any premium duefor this policy, your lienholder maybe requested to pay that premium.

If we require proof of loss and youfail to give it within 90 days, the lien-holder is given an additional 30 daysto do so.

10. Trustee Interest. If legal title to thedwelling described on the Declara-tions Page is held by a Trust, the fol-lowing provisions apply in addition to

the provisions contained in the Insur-ing Agreement:

a. SECTION I - Your PropertyCoverages

(1) With respect to Coverage A- Dwelling, Coverage B -Other Structures, and Cover-age C - Personal Property,you, your and yours meanthe Trust and beneficiariesof the Trust who reside inthe dwelling.

(2) With respect to Coverage D- Additional LivingExpenses, you, your andyours mean a resident of thedwelling who is a Trusteeand a beneficiary of theTrust.

(3) With respect to Your Addi-tional Coverages, you, yourand yours mean the Trustand beneficiaries of theTrust who reside in thedwelling, as their interestsmay appear.

b. SECTION I - Exclusions

All exclusions apply to the inter-ests of and losses sustained byany of the Trust, Trustees andbeneficiaries of the Trust.

c. SECTION II - Your LiabilityCoverages

With respect to Coverage E -Personal Liability and CoverageF - Medical Payments to Others,you, your and yours mean theTrust, the beneficiaries of theTrust who reside in the dwellingand the Trustees who reside inthe dwelling or are acting in thecourse and scope of their dutiesas Trustees.

d. SECTION II - Exclusions

All exclusions apply to theclaims made or suits broughtagainst any of the Trust, Trusteesand beneficiaries of the Trust.

11. Changes.

a. Policy Changes

(1) If any provision of this pol-icy is in conflict with anygovernmental requirementsat the time your policy iswritten, it is automaticallychanged to conform to them.

(2) If we broaden the coveragesprovided by this edition ofthe policy without additionalpremium charges during thePolicy Period, we will giveyou the benefit of thesebroadened coverages.

(3) The only other way this pol-icy can be changed is if wechange it in writing, whichwill be made a part of thispolicy. Any adjustment inpremium will be made atthat time.

(4) If your policy is renewed,we will furnish you any formrevisions applicable to yourpolicy.

b. Midterm Rate Changes

The premium you are charged forthis policy is based on informa-tion that you provided to us, andon information we gather fromother sources. You must immedi-ately inform us if any of theinformation you have provided tous changes, is incomplete, or isincorrect. Based on the changed,completed or corrected informa-tion, we may decrease or increase

the premium for your policy dur-ing the Policy Period.

Any premium increase ordecrease will be based on therules and rates in effect at theinception of the Policy Period.

12. Bankruptcy. If you become bankruptor insolvent, we will still insure youfor the period of time your premiumis paid.

13. Transfer of This Policy. You maynot transfer any interest in this policywithout our written consent. If youdie, this policy will continue in forcefor the remainder of the Policy Periodshown on the Declarations Page. Thispolicy will continue for other mem-bers of your family entitled to cover-age at the time of your death or foryour legal representative, but onlywith respect to the property insuredby this policy at the time of death.

14. Abandoned Property. We are notobliged to accept abandoned property.

15. No Benefit to Bailee. This insurancewill not benefit any person ororganization who may be caring for orhandling your property for a fee.

16. Inspections and ConsumerReports. We are permitted, but notobligated, to inspect your propertyand order consumer reports. Ourinspection does not warrant that theproperty is safe or healthful or incompliance with any law, rule, regu-lation, or building code.

17. Your Duties to Maintain PolicyAmounts of Insurance. It is yourresponsibility to maintain adequateamounts of insurance on your dwell-ing, other structures and personalproperty. But to help you do that wemay, but are not obligated to, adjustyour policy Amounts of Insurance. If

an adjustment is made, it will becomeeffective on the renewal date of yourpolicy and will be based upon datasupplied to us by recognized agenciesor organizations.

You will be notified in advance of thenew Amounts of Insurance. Paymentof your renewal is all that is necessaryto indicate your acceptance of thenew Amounts of Insurance.

If you want to change the newAmounts of Insurance, you may do soby contacting your insurancerepresentative.

18. Salvage Rights. If as a result of yourloss, we pay you in cash or byreplacement an amount equal to theactual cash value of your propertybefore the loss, at our option we havethe right, but not the obligation, totake legal title of your property.

19. Cancellation. You may cancel yourpolicy by returning the DeclarationsPage to us or by mailing to us a writ-ten notice telling us the advance datethat cancellation is to become effec-tive. If a lienholder is named on theDeclarations Page, we will mailacknowledgment to the lienholderregarding cancellation of the lien-holder’s interest in this policy.

We may cancel this policy for anyreason during the first 60 days weinsure you. After the first 60 days wemay cancel it if:

a. The risk has changed substan-tially since the policy was issued;or

b. If you or your representative:(1) Conceal, omit or misrepre-

sent any material facts orcircumstances;

(2) Make a false or fraudulentclaim;

(3) Fail or refuse to eliminateknown conditions thatincrease the potential forloss after notification by usthat the condition must beremoved; or

(4) Have not paid thepremium.

We will mail a cancellation notice toyou at least 30 days (10 days if youhave not paid the premium) beforethis policy is cancelled. We will maila cancellation notice to your lastaddress known to us or your insur-ance representative. We will also givethe same notice to your lienholder.

Your lienholder may cancel thispolicy if your dwelling has beenforeclosed or your lienholder hasotherwise acquired ownership of it.Your lienholder may then cancel thispolicy on behalf of all parties whohave an interest insured by this policyand upon surrender of this policy.

If there is any refund of premium dueyou, we will mail it to you with yourcancellation notice or as soon as pos-sible after we mail the notice. Thereturn premium will be calculated prorata. If you cancel, return premiumswill be subject to the “MinimumEarned Premium” shown on the Dec-larations Page of this policy. Pro ratacancellation means that we keep pre-mium only for the period of time youwere insured. If your premium isfinanced, that financing interest willbe recognized in any refund due.

20. Lifetime Continuation Agreement.We agree to offer to renew your pol-icy unless we mail to you, at least 45days but not more than 60 daysbefore the “To” date shown on theDeclarations Page, written notice ofour intention not to renew this policy.

If you do not pay the renewal pre-mium as we require, we will assumethat you have declined our offer.

We may nonrenew your policy onlyif:

You or your representative:

Conceal, omit ormisrepresent any materialfacts or circumstances; or

Make a false or fraudulentclaim; or

Fail or refuse to eliminateknown conditions thatincrease the potential forloss after notification by usthat the condition must beremoved; or

Have knowledge of anychange that substantiallyincreases the risk assumedby us; or

Have not paid the premium.

Continuation of the policy couldplace us in violation of the insurancelaws of your state.

21. Automatic Termination. If we offerto renew or continue this policy, butyou or your representatives do notaccept our offer, then this policy willautomatically terminate at the end ofthe current policy period. Failure topay the required renewal or continua-tion premium when due will meanthat you have not accepted our offer.

22. Notice of Cancellation or Nonre-newal. The Notice of Cancellation orNonrenewal will be mailed or deliv-ered to you and your insurance repre-sentative’s last address known. Ifnotice is mailed, proof of mailing willbe sufficient proof of notice.
