• Chapter 89.1070 of the Commissioner’s Rules defines the graduation options for students receiving special education services

• A student receiving special education services can earn a high school diploma by meeting the credit requirements, satisfactory performance or participation in state assessments, and for some students meeting IEP requirements.

Foundation High School Program Graduation Requirements

For students entering grade 9 in 2014-2015 school year and thereafter

• TAC 89.1070 (b)(1) • Completes the requirements of the Foundation High School Program

• Performs satisfactory on the state assessments

• ARD committee determines satisfactory performance on the state assessments is not necessary for graduation

• Summary of Performance

Code 34: Applies to all students who completed the curriculum and credit requirements for graduation, including satisfactory performance on the exit-level assessment or met Senate Bill 463 by passing 3:5 state assessments and required curriculum content was not modified or substituted.

Scenario:

Student is mainstreamed into the general education classes with accommodations. Completes a minimum of 26 required credit curriculum requirements with no modified instruction. Satisfactorily completed courses required for the endorsement. Passed state assessments or met Senate Bill 463 by passing 3:5 state assessments.

Code 35: Applies to students who completed the minimum curriculum and credit requirements for graduation, and participated in the state assessments and required curriculum content was not modified or substituted.

Scenario:Student is mainstreamed into the general education classes with accommodations. Completes a minimum of 22 required credit curriculum requirements with no modified instruction. ARD committee determined that satisfactory performance on required state assessment is not necessary for graduation or student met satisfactory performance on state assessments. Endorsement opt-out agreement was signed.(b)(1)

Code 54: Applies to students who complete the credit requirements with curriculum content modifications or substitutions through the student’s IEP and completion of IEP and full time employment with sufficient self-help skills to maintain employment without public school service.

Scenario:

Student is mainstreamed into the general education classes with modifications. Completes a minimum of 26 required credit curriculum requirements with modified instruction. Satisfactorily completed courses required for the endorsement. Passed state assessments or met Senate Bill 463 by passing 3:5 state assessments. Student has an employment IEP and is employed with city business.

Code 55: Applies to students who complete the credit requirements with curriculum content modifications or substitutions through the student’s IEP and completion of IEP and demonstrates mastery of specific employability and self-help skills that do not require public school service.

Scenario:

Student is mainstreamed into the general education classes with modifications. Completes a minimum of 22/26 required credit curriculum requirements with modified instruction. Student may have signed Endorsement Opt-Out Agreement or may have earned an endorsement. Passed state assessments or met Senate Bill 463 by passing 3:5 state assessments or ARD committee determined that satisfactory performance on required state assessment is not necessary for graduation. Has an IEP for job training and self-help skills and is currently learning employment skills and self help skills at a city business.

Code 56: Applies to students who complete the credit requirements with curriculum content modifications or substitutions through the student’s IEP and completion of IEP and access to services, employment, or other education outside of public education.

Scenario:

Student is mainstreamed into the general education classes with modifications. Completes a minimum of 22/26 required credit curriculum requirements with modified instruction. Satisfactorily completes courses required for the endorsement or may have signed endorsement opt-out agreement. Passed state assessments or met Senate Bill 463 by passing 3:5 state assessments or ARD committee determined that satisfactory performance on required state assessment is not necessary for graduation. Student was linked to services such as: Texas Workforce, Tropical Texas, supported housing, supported employment, etc.
