MISCELLANEOUS SERVICE ARRANGEMENTS

ADVANCED CALLING SERVICES

A. GENERAL

Advanced Calling Services (ACS) are optional services, offered in addition to regular exchange service, which allows customers to efficiently manage the call flow generated over their Exchange Access Line(s). Customers will be able to screen, redirect, or return selected calls. These services offer subscribers convenience, time savings, and a greater degree of control over the use of their telephones. Advanced Calling Services are available to residence and business customers where facilities are available. Individual feature availability may differ by exchange.

B. SERVICE DESCRIPTION

1. CALL REJECTION This service enables a subscriber to reject up to a maximum of six (6)preselected incoming telephone numbers from which he/she does not wish to receive calls. To select a telephone number, the subscriber dials a unique code and then constructs or modifies a telephone number screening list. To add an unknown telephone number to the list, a subscriber can activate a code immediately after receiving an unwanted incoming call. The Company’s equipment will screen incoming calls against the subscriber’s list and reject those on the list. Callers whose numbers are rejected are directed to a Company recorded announcement. If facilities are unavailable to provide incoming call screening via the subscriber’s list, standard call completion will occur.

2. CALL RETURN This service enables the subscriber to automatically redial the telephone number of the most recent incoming call. The Company’s equipment will make repeated attempts to establish the call for approximately a thirty (30) minute period, beginning

EFFECTIVE busy. If the most recent incoming call is blocked, the subscriber will get a Company recorded announcement indicating the number is a private number and the call cannot be returned. The service cannot be activated for calls originating from a line that is forwarded or from a line not associated with a telephone number, e.g., multiline hunting groups.

3. PREFERRED CALL FORWARDING

This service enables the subscriber to forward up to a maximum of six (6) preselected incoming telephone numbers to another telephone number. To forward a telephone number, the subscriber dials an activation code and then constructs or modifies a telephone number screening list. The Company's equipment will screen incoming calls against the subscriber's list and forward only those telephone numbers on the list. Calls forwarded by this service are subject to all applicable local and long distance charges. These calls are also subject to transmission limitations.

4. PRIORITY RINGING

This service allows the subscriber to provide up to a maximum of six (6) preselected incoming telephone numbers with a distinctive alerting signal or ring (or a distinctive Call Waiting tone if the subscriber has subscribed to Call Waiting), when the subscriber receives calls from them. To program a telephone number, the subscriber dials a unique code and then constructs or modifies a telephone number screening list. The Company's equipment will screen incoming calls against the subscriber's list and provide the Priority Ringing service for the preselected telephone numbers on the subscriber's list.

5. REPEAT DIALING

This service enables the subscriber to automatically redial the last outgoing telephone number dialed from that line. When the recalled telephone number is busy, the Company's equipment will make repeated attempts to establish the call for approximately a thirty (30) minute period, beginning with the subscriber's activation. Repeat Dialing is available on a flat rate basis.

6. SPECIAL CALL ACCEPTANCE

This service enables a subscriber to allow up to a maximum of six (6) preselected incoming telephone numbers to be accepted. To select a telephone number to be accepted, the subscriber dials a unique code and then constructs or modifies a telephone number screening list. The Company's equipment will screen incoming calls against the subscriber's list and allow only those calls to be completed. Calls from all other numbers will be routed to a Company recorded announcement.

7. CALLER ID

Caller ID - Basic (Number only) and Caller ID - Deluxe (Name and Number) are the available services.

Caller ID - Basic (Number Only) This service utilizes specific network capabilities to transmit and display the number associated with an incoming call to the called party’s access line. The number of the incoming call is transmitted during the silent interval between the first and second ring of the called party’s line. Caller ID subscribers must provide, and connect, their own compatible premises equipment in order to process and display the number transmission. The Company will forward all telephone numbers where technically feasible.

If a calling party has activated blocking, the number will not be transmitted to the display equipment of a Caller ID subscriber. Instead, the Caller ID subscriber will receive a privacy indicator. This privacy indicator notifies the Caller ID subscriber that the calling party chose to block number delivery.

8. CALLER ID BLOCKING Caller ID Blocking allows the subscriber to prevent the delivery of their calling data to a Caller ID subscriber on a per call basis (Caller ID Blocking - Per Call) or per line basis (Caller ID Blocking - Per Line).

a) Caller ID Blocking - Per Call This service will block the delivery of the caller’s data to a Caller ID subscriber for one call only and may be activated from all single party access lines by dialing *67 (1167 from a rotary phone) prior to placing the call. PER THE FCC CALLER ID ORDER, EFFECTIVE 12/l/95, CALLER ID BLOCKING - PER CALL IS PROVIDED TO ALL CUSTOMERS AT NO CHARGE.

As of l/1/97, per FCC Docket 91-281, per call blocking will be provided on calls originating from public, semi-public or other paystations used by the general public and party lines.

b) Caller ID Blocking - Per Line This service will automatically block the delivery of the caller’s data to a Caller ID subscriber on all calls and will be made available or offered, at no charge, to law enforcement agencies and domestic violence programs and Non- Published Residential customers. Per line blocking can be deactivated by dialing *82 (1182 from a rotary phone) prior to placing the call.

9. CALL TRACE This service enables the customer to initiate a trace of the last incoming call completed by dialing an activation code immediately after terminating the call. A Call Trace is considered successful when the Company’s equipment is able to record the incoming call detail (not the conversation). Incoming call detail includes: the calling number, the time the trace was activated, and in some locations, the time the traced call was received. Upon completion of a successful trace, the customer will be assessed a Call Trace fee that will appear on the customer’s next bill. The results of the trace are never provided to the customer directly. Call Trace information will only be given to appropriate law enforcement agencies. For further action to be taken, the customer is required to contact the Telephone Company Business Office during normal business hours, which will refer the customer to appropriate law enforcement agencies, or contact the law enforcement agency directly. In addition, the business office will contact the customer when two successful traces have been made to the same number within thirty days. Call Trace detail will be retained by the company and made available to the local law enforcement for ten business days after the trace has been initiated

Call Trace may not capture incoming telephone numbers marked “private” or “out of area” .

Only calls from locations with compatible signaling services are traceable using Call Trace.

10. ANONYMOUS CALL REJECTION This service enables a subscriber to reject incoming calls from which a privacy indicator is received. The service is activated by dialing a unique code. When the service is active, the Company will not complete calls to its customer when the calling party has activated Caller ID blocking services. Such calls will be routed to a Company recorded announcement.

The caller’s data will not be displayed if the called party is off-hook. The called party must be on-hook to receive the caller’s data. If the customer subscribes to both Call Waiting and Caller ID, and is on an existing call, a second incoming call information will not be displayed. Instead, the called party will receive the usual Call Waiting tone.

The caller’s data will not be displayed if the called party answers the incoming call during the first ring interval.

Caller ID services cannot be provided with any distinctive ringing lines having a maximum silent interval duration that is not long enough to allow transmission of the data message.

Identification of names, specific stations or extensions served by a PBX or Key System is not possible. The main directory number of the PBX or Key System will be displayed.

Caller ID - Basic and Caller ID - Deluxe cannot be provided if the calling party is from a multi-party line. The called party will receive an “Unavailable” display.

The Caller’s data will be unavailable if it is from another office that is not linked by appropriate facilities with the called party’s office.

The calling party has activated blocking.

Caller ID services do not display a directory number or name and number (if available) for operator assisted calls, calls marked private by the originator or calls originating from coin and party line stations.

Caller ID services cannot be provided if the calling party is from a multi- party line. The called party will receive an “Unavailable” display.

If a customer dials a “1-800” or other Automatic Number Identification (ANI) Service number, the telephone number that they are calling from will be revealed to the called party through ANI technology. Even if the customer has per line blocking or has activated per call blocking, the 800 number party has the right to obtain this information through ANI.

ANI information may not be reused or resold for other purposes without a caller’s consent, even where the called party has paid for the call.

Caller ID services are available on all long distance calls where technically feasible.

All calling data will be displayed to E911 through ANI technology, even if the customer has per line blocking or has activated per call blocking.

All calling data will be passed, even for customer who do not subscribe to Caller ID.

Per call blocking will be available to all customers. (The FCC Order overrules all state PUC/PSC decisions on Per call blocking.)

Where the calling party’s data can be forwarded from the central office originating the call to the terminating central office serving the called party;

The Company shall not be liable for any loss or damages arising out of error, interruptions, defects, failure, or malfunctions of ACS Services or equipment. Damages arising out of such interruptions, defects, failures, or malfunctions of the services after the Company has been notified, and has reasonable time for repair, shall in no event exceed an amount equivalent to the charges made for the service affected for the period following notice from the customer until service is restored.

LOW-INCOME ASSISTANCE PROGRAM (LIFELINE) (T)

The Lifeline Assistance Program was developed to reduce rates for low income customers. The Company participates in this assistance program to increase the availability of telecommunications services to all consumers in its serving areas. (T)

1. Lifeline Assistance

The Company shall provide Lifeline Service as defined in FCC 47 C.F.R. 54.401 (a) (C) on a non-discriminatory basis to all qualifying low-income customers. The Company's Lifeline service offering shall comply with all applicable federal laws, including but not limited to, 47 C.F.R. Part 54; the FCC's Lifeline Reform Order (Report and Order released February 6, 2012, WC Docket No. 11-42, et. al.), the FCC's Lifeline Modernization Order (Third Report and Order released on April 27, 2016, WC Docket No. 11-42, FCC 16-38, et. al.), and any subsequent orders. X.1 Application of Tariff

X.1.1 This tariff contains regulations and &arges applicable to the provision of attacknnent space for able television facilities on poles of Salm Telephone Cunpany, Inc. hereinafter referred to as the "Ccmpany " , and the provision of cable duct space for such facilities in underground conduits of the Cunpany.

Xl.2 The terms and conditions contained herein apply where the CATV operator, as a custaner of theConpany, proposes to install coaxial or other types of television distribution cables, aqlifiers and drop wires, wires, and appliances together with associated cable messengers, anchors and other appurtenances (hereinafter sanetimes collectively called the "quipnent") and desires to attach such quipment in cable ducts of the Conpany.

x.2 Definitions

x.2.1 Poles - All references to "poles" of the Company shall mean poles whichare either solely~ed by the many, are jointly ck7ned by the Company andanother, or are me-d by another who has granted the mpany exclusive use and control of space upon it's poles.

x.2.2 Pole Atta&nent - This termmeans any attachment by a CAlV firm to a pole med or controlled by the Canpany.

X.2.3 Cable Duct Space - This term shall mean individual cable ducts within a multiple-duct conduit system med by the Carrpany.

X.2.4 Esuipnat - the "equipment" referred to herein consist of ccaxial or other types of television cables, amplifiers and drop wires, wires and appliances together with associated cable messengers, anchors, and other appurtenances used in the provision of C&TV service.

X.2.5 Joint User - All references herein to "joint user" shall mean a utility canpany or municipality which, togetherwith the Company, jointly provides poles for common use in the service of the respective entities, and shall also inc ccxnpany or municipality which, together with the Canpany, percentage of a pole, or which cwns a pole upon which the obtained exclusive use and control of specified space.

X.2.6 Cable Television Gmpany or Operator (CATV) - All references herein to YATV Canpany and/or Operator" shall maan a canpany which provides NC77 service.

X.2.7 CATVService - All references herein to "CATV Service" shall mean the transmission, by means of coaxial or other types of distribution cables, of television audio and video signals frm a central point within an exchange of the Conpany to subscribers of a CATV canpany within such exchange.

x.3 Scope

x.3.1 Subject to the tariff, the Cunpany will

X.3.2 References herein to CATV‘equipment placed in the CBnpany's cable ducts shall man only cables and wires. No right to place aqlifiers, peer supplies or other related quipnent in manholes or mble ducts of the canpany is conferred by this tariff.

P x.3.3 The CATV canpany shall secure fran the proper franchising authority, a franchise to erect and maintain it's thoroughfare, provided such franchising authority exists and shall secure any and all consents, parmits, licenses, easements, or rights-of-way that may be legally required for it's cperation hereunder. The GYFV cunpany shall additionally provide to the Conpany a rmp depicting the franchised area in which pole attach-nents and cable duct arrangemznts may be applied for by the CATV canpany.

x.3.4 The C7YI'Vcanpany shall assist in, and bear the expense of securing any additional consents, permits, or licenses that may be rquiredbythe Coqmybecauseof CATV pole attachments or cable duct usage.

x.3.5 The franchises, consents, permits, licenses, easanents, and rights-of-my of the Canpany are for it's mm facilitiF%lBBf(d~ICE COMMISSION provision of it's other services. /‘- x.4 Application of Notification to Install

x. 4.1 At forty-five (45) days prior to the time the CaTv ampany desires to attach it's equipment to any of the Cmpany's poles, or to install any such equipment within a cable duct of the Conpany, the CATS operator shall mke written application on the form prescribed to the Canpany. The Ccmpany shall, inturn,notify the CATV vy in writing of it's notification to allow the installation.

X.4.2 Where the application for attachment involves joint-use polesr the GYI'V operator shall so indicate in it's application, and provide a copy thereof to the joint user. Permission to attach to joint-use poles shall ba subject to the Canpany obtaining approval fran such joint user when necessary.

x.4.3 Upon notification by the Conpany for pole or cable duct spice to be usedby the GOVcanpny, the QOVcarpany shall have the right, subject to the SPECIFICATIONS contained herein, to install, maintain and use it's equipment described in it's application, upon the poles or in the cable ducts identified in it's application.

x.4.4 Where costs are involved in the rearrangement of the Conpany's facilities to ac cam&ate the CATVconpany's equipment, the Conpany shall notify the CATV ccmpany, in writing, of the changes and rearrangements required and the cost for performing such. Approval of the application by the Conpany is subject to receiving authorization fran the CATV canpny to make changes and rearrangements detailed by the Conpany, at the CKI'V campany's sole expense.

x.4.5 The CATV conpany shall not have the right to place, nor shall it place, any additional quipnent upon any pole or in any cable duct without first making application and receiving the Coxpany's notification to do so, as provided for in this tariff; nor shall the CATV company change the position of'any equipment attached to any such pole or installed in any cable duct without the Cmpany's prior written approval. The provisions of this paragraph shall not restrict the attachnent of television drops to television crossarms or television cable Il-lz33enger. Unauthorized attachments or installation in cable duct shall be subject to penalt+&-&~Ef&MM~SS~C~ '?mke-ready'l charges set forth in this tariff. _ OF KENTUCKY

x.5.1 The C?iTV canpany, at its m cost and expense, shall construct, maintain and replace its attachents on the Canpany's poles in accordance with (1) such requirements and specifications as the Conpany shall prescribe and have on file with the Carmission, (2) EEI Publication Ml2 entitled "Specifications for the Construction and Maintenance of Jointly-Used Wood Pole Lines Carrying Supply and Comnunication Circuits", (3) the requirements and specifications of the National Electrical Safety Code, 1981 Edition, and any amendments or revisions of said specifications or code, and (4) in ampliance with any rules or orders nm in effect or thathereaftermaybe issued by the Public Service Canmission of Kentucky or OthtX

authority having jurisdiction. The cATvcanpany shallcanply,at its sole risk and expense, with changes and revisions in the above specifications and requirements.

X.6 Installation andMaintenance of QYI'VEquipnent

X.6.1 The exact location of the CATV ccmpany's attachments on poles and installation in able- ducts shall be determined by the Company in its sole discretion after a joint survey to be make, at such times as shall be mutually agreed upon, by representatives of the telephone canpany and the CRTV conpany. The Canpany my n-&e periodic inspections as conditions may warrant. Such inspections shall not operate to relieve the CATV canpany of any responsibility, obligation, or liability assumed under this tariff. When substandard installations are found which are created by the CATS cperator, the Canpany shall give notice of such to the CATVconpany,and the CATV ccsnpanyshallrenedysuch conditions within a reasonable time as directed by the Conpany. In the event the CaTVcompany fails to remedy the condition within the time prescribed, the Conpany may act to remedyitwith thecostof such to be paid bytheCAT"Vccqxny.

X.6.2 Where reasonable cause exists, the Conpany, with concurrence fran the CATVconpany,maymake the attachmentor replacement of the CATV's egu.ipnenttoConpanypoles. In such cases, the CATV cmpany will furnish all such materials and equipment, and will reimburse the Conpany for the entire installation costs incurred. The CYl?V coqany shall deposit with the Conpany, prior to such installation, sufficient sums estimated by the Conpanyto be adequate to reimburse it for such work. PUBLIC SERVICE COMMISSION

in accordance with the Canpany's established practices, and the CATV operator will furnish all materials and quipnent to be installed and pay, in advance, the Canpany's estimated costs of such work.

X.6.4 Where theC7Yl?Vccmpany1squipxent can be acconrmdated on Ca-qany poles QIT in Carpmy c=able ducts by rearranging or changing the Ccmpany's facilities, the CATvcanpany shall pay the Company the cost of making such rearrangements m changes. Strengthening of poles (guying) requiredtoac canmdate the attachments of the CATV cmqany and the bonding of theCaTV's strand to that of the Canpany shall be performed by the WI77 canpany at it's sole risk and expense. Such work may be performed by the Canpanywith concurrence fran the WI'Vcanpny, and the CaTVcanpanyshallpaythe Canpany the cost of all such work.

X.6.5 After initial attachment, when the Cmpany subsequently requires a change in its poles, attac~ents thereto or its conduit system for reasons unrelated to CRTV qerations, the CATV cmpany shall be given at lest 48 hours advance notice of the changes required and sufficient time to accanplish the CATV related change. If the QYIV operator is unable or unwilling to meet the Cmpany's time schedule for changes in attachments, the Cm~ymaydo the work and &arge the CRTV canpany its reasonable costs for performing the change of CMVquipnent. In cases of emergency, the Canpanymy, at the CATV canpany's sole expense, arrange to relocate or replace the facilities attached to Conpany poles by the CATV operator, transfer then to substituted poles olr perform any other work in connection with said facilities, that my be required in the maintenance, replacement, removal, or relocation of said poles the facilities thereon 0~: the equipment which may be placed thereon.

X.6.6 All required maintenance of CATV esGF--t shall be performed by the C?YIV operator. No entry shall be made into any facility housing the cable ducts without the written notification of the Campany. The Canpany reserves the right to require the presence of it's representative at the tim of any such entry, with the c-t thereof to be reimbursed by the QYI'V cxmpany. An estimate of such cost shall be furnished at the time the Cmpany gives its written notification for entry.

X.6.8 The CATV canpany shall, at its sole risk and expense, maintain all of its quipnent on Company poles or in Coqany cable ducts in safe condition and in thorough repair.

X.6.9 Nothing herein contained shallgiveto the CA'IV canpany the right lx place a crossam on any Canpany pole. If a crossarm is rquiredtoac mmmodate the facilities of the CRTV canpany, the CATV canpany shall state their reasons in its application for attachment.

X.6.10 The CATVcanpany shallnotatany time make any additions tot or changes in, the location of its attachments onpoles or quipnent in cable ducts without the prior poles or eguimt in cable ducts without the prior written consent of the Canpany, except in cases of emergency when oral notification has been obtained fran the Cunmyand subsequently confirmed in writing.

X.6.11 Ifthe CRIV mpany should rquire the location of its quipnent upon any public thoroughfare or other public or private property in the conduct of its business and the Canpany does not nave pole facilities so located to-fulfill QYiVreguirements andhas no immediate need for such for the Canpany's cm use, the Ccmpany will notify the CATV operator whether the Company is willing to place such pole facilities. Special rental charges shall be agreed to by the CATV CampanY prior to the Conpany~s placement of such pole facilities, and the rental charges specified herein shall not apply. The special. rental charges shall be based upon thetotaluse of the pole facilities by the CATV carpny. In the event such pole facilities are subsequently used by the Conpany for the provision of its other services, the special rental charges shall no longer apply, and the rental charges specified in this tariff shall apply.

X.6.12 Whenever, pursuant to this tariff, the CATV c2cxnpany shall bz required to remove its quipnent fran any pole, such removal shall be made within thirty (30) days follming the notice given by the Canpany to the CaTV, except as otherwise specifically provided. Upon failure of the CRlV mpany to remove such quipnent within thirty (30) days or as otherwise required, the Canpanyrray remove then and charge the WL'Vcanpany all costs associatedwith such removal.

X. 6.13 Whenever, pursuant to this tariff, CATV quipnent in able ducts shall be required to be removed, relocated or re laced, such work shall be performed by the Canpany after written QiTv CcmpanY,

X.6.14 The CaTv canpany can interset poles where the Conpany facilities are located except shall not locate poles, guys, or other facilities where they will interfere with access to -any poles.

x.7 Cost of Pole Replacements

x.7.1 Whenever the CATV canpany applies to attach to a @e that is considered by the telephone conpany to be insufficient in height or strength for ac commodation of CaTiT attachments, the Company shall notify the CATV operator of such fact and of the estimated cost to the QYIV canpany of replacing such pole with a pole which will accanmodate the attachments of the CaTV conpany and the telephone ccmpany. Within thirty (30) days of such notification, the CATV ccmpany shall either notify the Caqany (1) of its approval of such replacement or (2) of its cancellation of the application with respect to such pole.

X.7.2 In the event of CM?V's approval of such replacement, the Caqxny shall replace the pole and the G?I'V -ator shall pay to the Ccqxny in advance the charges canputed as follows:

PURSUAN C TO 8'37 KAR 5:011, X.8.1 Upon application for attachment or use of cable duct CATV conpany shall sub-nit evidence satisfactory to the C authority to erect and maintain its equiprent within highways, and other thoroughfares and shall secure any necessary franchise, license, permit, consent, easement or rights-of-way fran Federal, State, or municipal authorities or Mers of property naw or hereafter required to construct and maintain such equipment at the location of facilities of the Capany which it desires to use. In the event any such franchise, license, permit, consent, easement or right-of-way is revoked or is thereafter denied to the CATvccmpany

for any reason, permission to attach to Canpany poles or to use Canpany cable ducts so affected shall immediately terminate, the CRTV canpany shall forthwith remove its equipment fran Carrpany facilities.

X.8.2 upon notice fran the telephone canpany to the QYI'V canpany that the renoval or cessation of the use of any pole or cable duct has been requested or directed by Federal, State, or municipal authorities, or property CMYZS, permission to attach to such pole or to use such cable duct shall imnediately terminate and the CM'V canpany shall forthwith remove its equipmenttherefran.

x.9 Protection Against Claims for Libel and Slander, Cqyright and Patent Infringement

x.9.1 The CaTvcanpany shall indemnify, protect, andhold harmless the Caqxny fran and against any and all claims for libel and slander. copyright , and/or patent infringement arising by reason of attacbnent of 04Tv quipnent to Cpnpany poles or installation of CATV quipnent in Canpany cable ducts, pursuant to this tariff.

x.10 Limitations

x.10.1 No use, however extended, of the Canpany's poles or cable ducts under this tariff shall create or vest in the c4Tv carq?any any mership or'property right in said poles or ducts. Nothing herein contained shall be construed to canpel. the Can~ytomaintain any of its facilities for a period longer than that demanded by its other service requirements.

x.10.2 'Ibe Canpany reserves to itself, its successors and assigns the right to maintain its poles and conduit and to locate and operate its facilities in such manner as will best enable it to fulfill its other public service requirements. The Ccmpany shall not be liable, except for gross negligence to the CaTV ccmpany or for any interference with the operation of the equipment of the CATV canpany.

x.10.4 Failure to enforce or insist upon ccmpliance with any of the terms or conditions of this tariff shall not constitute a general waiver or relinquishment of any such terms or conditions, but the same shall be and remain atalltimes in effect.

x.10.5 Tne CATV canpany shall not assign, transfer or sublet any rights to make pole attachments or utilize cable ducts hereunder without the prior written consent of the Cxmpany except the CATV canpany can dispose of CRTV property in any way without prior consent.

x.11 Indemnity and Insurance

x.11.1 Except for case of negligence on the part of the canpany and other joint users, the CATV ccmpany shall indemnify, protect, and hold harmless the Cmpany and other joint users of said poles and conduit system fran and against any and all loss, costs, claims, demands, damage and/or expense arising out of any demand, claim, suit or judgment for damages to property and injury to ordeathof persons, including the officers, agents, and enployees of the CATV cmpany, the Canpany, and any joint user, including payment made under any Warktmn's Canpensation Law or under any plan for enployees' disability and death benefits, which may arise out of or be caused by the installation, maintenance, presence, use, or removal of said equipment (32: by the proximity of CATVquipnentto the Ccmpany or any joint user.

x.11.2 The CATVcan~y shallmaintain in full force and effect the following insurance policies or bnd in lieu thereof providing an equivalent protection: (11 Worker's Canpensation and Occupational Disease covering the 04TV canpany's full liability under the Worker's Ccqensation Laws of the Camonwealth of Kentucky. This shall include B@oyer's Liability insurance in the amount of $100,000. (2) Canprehensive General Liability insurance, in the amounts of $1,000,000 Canbined Single Limits or $1,000,000 each occurrence, and $l,OOO,OOO aggregate for any accident resulting in bodily injuries to or the death of one or more persons and the consqusntial damages arising therefran together with Property Damage Liability in the amount of $500,000 each occurrence, with an aggregate total limit of $500,000. pi

x.11.3 All policies of insurance shall contain wri to the effect that the amount of coverage of the thereby will not be reduced or terminated without written notice first being given to the Canpany. Certifijc#$R~

insurance, incorporating the above described endorsement, shall be delivered to a designated officer of the Cmqany and shall be approved by the Coqany before the CXTV firm is permitted to perform any work authorized pursuant to this tariff. Failure of the C&TV firm is permitted to perform any work authorized pursuant to this tariff. Failure of the CATV canpany to provide notice of renewals, changes in carrier, or a reduction in 01: termination of insurance coverage will be just cause for the Ccmpanyto terminate theCATV ccmpany's right to continue its pole attachnents. If renewal premiums are not paid by the CaTV cunpany prior to said 3O-day notice, the Coapany shall have the right to pay said premium and be reimbursed bytheCATVcanpanyupon demand.

x.11.4 The CaTV operator shall promptly notify the Coqmny of all claims and potential claims relating to damage to property or death of persons arising or alleged to have arisen in any matiner by or associated with, directly or indirectly,thepresenceor use of the CATV canpany's quipnent upon or within any facility of the many.

x.11.5 The CXIV conpany shall exercise special precautions to avoid damage to facilities of the Ccmpany on said poles and hereby assumas all responsibility for any and all loss for such damage. The CATV canpaw shall make an inmediate report to the telephone canpany of the occurrence of any such damage and shall reimburse the Cmpany for the expense incurred in making repairs necessitated thereby.

x.12 Surety

x.12.1 The C7VI'V canpany shall furnish a bond for each individual CATV system utilizing pole attachments under this tariff to guarantee the payment of any sum which may becane due to the Conpany for rental, penalty 1 and make-ready charges and work performed by the Cuqany, pursuant to this tariff, for the benefit of the CATV cmpany or as a result of default or forfeiture by the C&TV cmpany. The amount of such bond shall be based upon the following:

(1) For attachments to 500 poles or less, a bxd of $5,000 shall be furnished, except as provided in (4) b&w.

(3) After me year following the canpletion of construction of an individual CATV system and its placement into operation, the CAW operator my request that the required amount of bond be reduced. Upon the Conpany's receipt of satisfactory evidence that all mechanics, workmen, andmaterial rrenwho furnished services, labor or materials in the construction of such CATV system, and all taxing authorities, have been paid all amount due them, the Canpany will reduce the amount of kmd required to the follcrwing:

(a) For attackients to 500 poles or less, a bond of $2,000 shall be furnished.

(b) For attachments to poles in excess of 500, further surety in the amount of $2,000 for each 500 poles, or anyincrexnentthereof, shall be furnished.

x.13 Payment of Bills

x.13.1 All amounts payable by the CATVccmpanyto the Canpany under the provision of this tariff shall, unless otherwise specified, be payable within thirty (30) days after presentation of bills. Nm-payment of any such amount when due shall constitute grounds for termination of the @e attachment rights under this tariff.

x.i4 Termination of Attachments

x.14.1 If the WI77 carqny shall fail to canply with any of the provisions of this tariff, including canpliance with the specifications previously referred to, the maintenance of required insurance coverage and surety bond requirements, and the timely payment of any amounts due, an d shall fail for thirty (30) days after written notice fran the Ccmpany to correct such non-cmpliance, the Carpany, at its option, my terminate the CATV canpany's right to continue any or all use of poles '

X.14.2 Upon valid objection being made by or cn behalf of any CJOVeUXEYWl authority properly asserting jurisdiction, the Conpany may without notice, ar, where circmstances permit, upon five (5) days written notice to the QDV cunpany, terminate the provision of the pole attachmentand/or czable duct space as provided in this tariff.

x.14.3 ThecaTv ampany may at any time remove its equipnent attached to any pole m poles of theCanpanyand shall immediately give the Ccmpany written notice of such remval. The QYlV cmpany may at any time request removal of ~itsequipnent in the cable duct of the Carrpany. The Cunpany shall perform such renoval within a reasonable time, unless specific mitten authorization is given to the C?TV canpany to perform such work.

x.15 Notices

x.15.1 m Any notice reguired or authorized by this tariff to be given by theConpanyor the CM'Vcanpany to the other party shall be deaned to have been fully given when made in writing and deposited in the United States mail, postage prepaid, and addressed to such other party's principal business address last furnished by such party.

X.16 Rental Charges

X.16.1 The~TVcmpany shall pay to the Cmpany, annually in advance, the rental charges specified below. Annual billing shall be make in July of each year.

X.16.2 Fran the effective date of the permit for previously unbilled attachments aa: able duct usage, which shall be the date when the Canpany's facilities are made available for use by the QYt'V ccmpanyf to the date of the next annual billing, the annual rental rate shall be payable on a prorated basis with such fractional amount suhnitted with the application for attacbnent or cable du$$,m

X.18.1 Where pole attachments have been made without receipt of authorization fran the Ccmpany, a penalty charge of twice the amount of the annual rental rate shall apply, in lieu of the annual rental rate, fran the date of the last previous physical inventory of the pole attachments or inspection required pursuant to the rules of the ?Grltucky Public Service Carmission, whichever is most recent. Additionally, a special "make-ready" charge, qual to twice the amounts which would have been due and applicable if the attachment had bee? properly authorized, shall apply.
