Environmental Conditions

Mobile Plant for Site Remediation

The Environment and Resources Authority (ERA) regulates the environmental impact of enterprises through two key mechanisms. Smaller scale activities are regulated through a set of General Binding Rules (GBRs) which apply to all enterprises within a common group (e.g. Construction and Construction Products Group). Larger scale activities are regulated through an Environmental Permit issued on an individual basis by ERA. Certain enterprises of limited environmental significance (e.g. insurance companies) are exempt from control through a GBR or Permit. The environmental conditions set out in this General Binding Rule (GBR) are aimed at improving the environmental performance of small scale enterprises involved in the use of mobile treatment plants for the treatment of contaminated soils, materials and other products for the purpose of site remediation.

GBR Conditions and Permits

An Environmental Permit for operation must be obtained from ERA in respect of the provision of land remediation services. An application is to be submitted with details of the technical services to be provided.

An Environmental Permit applies to a particular site in accordance (as specified) with the agreed deployment form/application. The Environmental Conditions in this GBR:

� Apply on start-up of individual operations in various sites, as per approved permits;

� Do not override the requirements of any other legislation, including any possible need for development consent;

� Will be enforced through ERA inspections and penalties;

� Apply until such time as they may be superseded for individual enterprises by the requirements of an Environmental Permit, other legal requirements or the amendment of this GBR.

Operators have an obligation to understand and implement the requirements of this GBR.

General Requirements

� All businesses have a responsibility to protect the environment. All activities should be carried out in accordance with a proper management system that reduces risks of pollution, accidents and incidents. The operator shall become familiar with his legal obligations and good environmental practice.

� Staff shall be made aware of the importance of environmental

protection and receive appropriate training. All activities should be carried out by competent and technical personnel.

� Sites of operation shall be maintained in a tidy condition, free from litter

(whether arising from own activities or external sources).

� Any activity that threatens protected habitats or species is prohibited, unless that activity has received a specific permit from ERA.

� In the event of cessation of business activity on the site, all wastes

(including end-of-life or abandoned machinery, tanks and equipment), hazardous materials and mobile plant/s must be removed from the site.

1. Operational Conditions

1.1 The operator shall be authorized to use the following technology and

associated plant necessary to carry out remediation, as specified in the environmental permit:

� Air sparging; � Bioremediation; � Biosparging; � Bioventing; � Chemical treatment; � Soil vapour extraction; � Soil flushing; � Soil washing; � Solidification; � Stabilisation; � Thermal treatment; � Treatment plant for blending, mixing, bulking, screen,

shredding, particle size reduction and/or particle separation in order to facilitate remedial action.

1.2 The operator shall be authorised to carry out the following activities:

� Storage of any waste (on remediation site) that is awaiting treatment;

� Recycling/reclamation of organic substances which are not used as solvents (including composting and other biological transformation processes);

� Recycling/reclamation of metals and metal compounds; � Recycling/reclamation of other inorganic materials.

1.3 Commissioning of equipment and site reclamation shall not start

prior to the issuing of notification form issued by ERA. 1.4 In case remediation / reclamation cannot proceed on site, an

environmental waste management permit for the facility (receiving waste for treatment) is required.

2. Waste Management

2.1. The deposition within the site of waste arising from sources outside the site is not permitted, unless specifically approved by ERA.

2.2. No storage of waste (other than own-site inert waste) is permitted

for a period exceeding 6 months.

2.3. The storage of waste on garrigue or any other natural or semi-natural land is prohibited.

2.4. Wastes should preferably be collected for recycling/re-use.

2.5. The quantity of contaminated waste and substances to be

reclaimed shall not exceed the initial amount stipulated in the notification form, or as instructed by ERA;

2.6. The quality (type & content) of contaminated waste and substances

to be reclaimed shall not vary from those listed in the notification form;

2.7. On-site disposal of wastes by any means including burning,

disposal to drain or surface water, burying or deposition on land is strictly prohibited, unless specifically approved by a permit from ERA or the Water Services Corporation (WSC). Biodegradable waste, such as food or garden waste may be composted on-site.

2.8. Off-site disposal or recycling of wastes may only take place at a

facility licensed for that purpose (e.g. only inert waste may be disposed of at a landfill licensed for inert waste).

2.9. The transport of waste off-site shall be by means of a waste carrier authorised for that waste and should follow the appropriate waste transfer notification procedure;

2.10. Records shall be maintained for the disposal of all hazardous

waste, including quantities, dates, contractor name and manner of disposal. The records should be maintained for a period of 2 years and be made available, upon request by ERA.

3. Emissions to Atmosphere

3.1. There should be no point sources emissions to air; All sources should be clearly identified in the notification form;

3.2. All processes which generate significant levels of airborne

contaminants shall have effective local collection and dust suppression equipment, and shall discharge (after treatment where necessary) through a stack or vent located / designed in such a way as to avoid local nuisance.

3.3. Significant non-point sources of airborne contaminants shall be

identified and appropriate abatement measure should be installed.

3.4. Emissions from activities should be free from noise (and vibration) at levels that are likely to cause pollution outside the site.

3.5. Emissions from activities should be free from odours at levels that

are likely to cause pollution outside the site. 3.6. In the event of a local nuisance from emissions to air, the operator

must, at the written request of ERA, identify the specific cause of the nuisance and examine means for its elimination or minimisation including:

� Relocating / redesigning the stack(s) or vent(s) to a point where nuisance is minimised

� Use of additional abatement measures

� Replacement of fuel by a lower sulphur content or cleaner burning fuel

� Improved storage of materials and wastes

Time frames for improvement will be set by the Authority. ERA reserves the right to halt works on site until proper solutions, (deemed fit by the Authority) have been identified and implemented.

3.7. All abatement equipment and ducting shall be cleaned and

maintained on a regular basis and records kept of any such maintenance.

4. Effluent Discharge and Stormwater Management

4.1. The discharge of any type of effluent (including washwaters and

contaminated stormwater) to land, stormwater drains or sea is prohibited, unless specifically approved under a permit issued by ERA.

4.2. Foul sewer drains must be strictly segregated from stormwater

drains. 4.3. All discharges to the foul sewer (other than from domestic sewage

or equivalent) shall comply with the requirements of a license issued by the Water Services Corporation.

4.4. Effluents consisting of solids (from such sources as washing of

heavy vehicles etc.) must pass through an adequately sized settlement tank.

4.5. The volume of contaminated storm water should be minimised by

such means as

� Sweeping of dusty/dirty areas of the site on a regular basis

� Directing stormwater away from production/storage areas

� Installing sediment barriers in stormwater courses

4.6. Storm water from areas where significant contamination is likely (such as loading/unloading areas) must pass through an adequately sized settlement tank.

4.7. All reasonable measures to minimise wastage of water should be

implemented. Techniques to be employed include regular monitoring of water usage, identification of sources of high water usage, use of triggers on hoses and water efficient taps and appliances.

5. Storage

5.1. All wastes should be appropriately contained so as to prevent discharge to land, water or to air;

5.2. Wastes and contaminated material subject to remediation shall be

stored on impermeable surface and in locations were thorough clean-up and site reinstatement can be readily undertaken.

5.3. Inert material shall be stored on impermeable surface with sealed

drainage system.

5.4. No storage of waste, equipment or materials is permitted on property outside the site premises in which the activities are carried out.

5.5. Non-hazardous waste awaiting collection may be placed outside

the site premises for a period not exceeding 12 hours.

5.6. All wastes shall be stored within a designated and controlled storage area(s) prior to ultimate disposal; wastes to be recycled should be stored in a designated container or storage area and not mixed with other wastes.

5.7. Waste oils must be stored in a secure leakproof container and may

only be disposed of through a company authorised for the collection of waste oils or at an authorised site. Where waste oil generation exceeds 500 litres per year a record must be maintained of the quantities, nature, manner and date of dispatch of the oil.

5.8. The company shall ensure that surface and ground waters are

adequately protected from contamination by process materials, oils and/or wastes through the use of appropriate containment systems.

5.9. All bulk oil storage tanks shall be provided with an adequately

designed bund system with an impermeable base and walls. The capacity of the bund shall be a minimum of 110% of the largest tank or 25% of the full capacity of all the tanks within the bund. Filling and off-take points shall be located within the bund.

5.10. Bulk storage tanks for liquids and associated bunding and pipe

work shall be visually inspected at least once a month and certified by a warranted engineer on an annual basis.

5.11. Drums and containers of chemicals/oils shall be stored in

designated and secure storage areas. Storage areas shall be

bunded or otherwise designed so that surface and ground water cannot be contaminated by spillages.

5.12. Spillages of oil or other hazardous material shall receive immediate

attention to prevent escape to drain, surface water or land. Spilled material shall be disposed of in sites permitted under the relevant environmental regulations to accept such waste.
