Prosecution allegations

Your Honour.

As a result of information received, police attended at a jewellery shop on Port Road, Allenby Gardens and took possession of a brooch on the 11th April 2012.

The brooch was taken to the home of a Lady Cooper at North Adelaide where the

brooch was identified as one taken in a burglary a month earlier. The burglary took place on the 9th March 2012.

The proprietor of the jewellery store was questioned and as a result of information received from him, police questioned the defendant, Angas

Frampton. The defendant admitted that he had taken the brooch to the jeweller and had

received $600 for the brooch. He said that he had received the brooch from a man by the name of Carlos. He said he had paid $200 for it and that he knew

when he took it that it was stolen, or thought it very likely that it was stolen. He said that he believed that the brooch would be worth somewhat more than

$200.

It was put to him that the brooch was worth about $2 100. He said that he had no idea that it would be worth that amount.

The brooch was recovered in good condition. Investigations in relation to the burglary are continuing.

The defendant has three prior Court appearances, all in the Adelaide Youth Court

on 4 June 2004 when he was charged with assaulting police, offensive language and carrying an offensive weapon. All of the charges were dismissed without conviction.

2. On 11th April 2012 at Allenby Gardens, with intent to defraud, obtained money of the amount of

$600 by falsely pretending that he was the owner of the brooch.

Criminal Law Consolidation Act 1935

134—Theft (and receiving)

(1) A person is guilty of theft if the person deals with property—

(a) dishonestly; and

(b) without the owner's consent; and

(c) intending—

(i) to deprive the owner permanently of the property; or

(ii) to make a serious encroachment on the owner's proprietary rights.

Maximum penalty:

(a) for a basic offence—imprisonment for 10 years;

(b) for an aggravated offence—imprisonment for 15 years.

139—Deception A person who deceives another and, by doing so—

(a) dishonestly benefits him/herself or a third person; or

(b) dishonestly causes a detriment to the person subjected to the deception or a third person,

is guilty of an offence.
