IntroductionThis is your Ford Insure Driveaway Private CarPolicy. It is made up of several parts whichmust be read together as they form yourcontract.

Please take time to read all parts of thisPolicy to make sure they meet your needsand that you understand the cover providedand the general exclusions and generalconditions that apply. If youwish to changeanything or if there is anything you do notunderstand, or any statement is incorrect,please let Ford Insure know.

The parts of this Policy are:

• this introduction; the General definitions;the Cover provided; the Generalexclusions and General conditions all ofwhich apply to all sections of this Policy;and

• the Cover Note

Any word or expression in this Policywhichhas a specific meaning has the same meaningwherever it appears in this Policy. Thesewords are highlighted in bold.

Allianzwill insure you in accordance with andsubject to the terms of this Policy.

Financial Services Compensation Scheme:If Allianz is unable to meet its liabilities youmay be entitled to compensation under theFinancial Services Compensation Scheme(FSCS). Changes to your circumstancesPlease tell Ford Insure about any changesthat may affect your Policy cover.

General definitionsThe terms below have their meaning shownnext to them and appear in bold throughoutyour Policy.

Cover NoteThe document issued by us showing that thisPolicy provides the cover you need by law tocomply with the relevant United Kingdom andEuropean Traffic laws. It shows who is entitledto drive Your Car and the purposes for whichYour Car can be used.

Excess The amount youwill have to pay if youmakea claim regardless of who was to blame. TheExcess amounts are shown in this Policy.

Market Value The cost of replacing Your Car at the time ofthe loss or damage, taking into account itsmake, model, specification, age, mileage andcondition.

This will not exceed the estimate of value thatyou last gave to us.

Period of Insurance The period you are covered for as shown on your Cover Note .

Policy The Driveaway Insurance Policy is thecontract of insurance between you and us.

Territorial Limits Great Britain, Northern Ireland, the ChannelIslands, the Isle of Man, Andorra, Austria,Belgium, Bulgaria, Croatia, Cyprus, CzechRepublic, Denmark, Estonia, Finland, France,Germany, Gibraltar, Greece, Hungary, Iceland,Italy, Latvia, Liechtenstein, Lithuania,Luxembourg, Malta, Monaco, Netherlands,Norway, Poland, Portugal, Republic of Ireland,Romania, San Marino, Serbia, Slovakia,Slovenia, Spain, Sweden, Switzerland and theVatican City.

It also includes travelling between thesecountries by air, rail or sea, including loadingand unloading.

We, us, our, Allianz Allianz Insurance plc.

You, your, yourself The insured named on the Cover Note.

Your Car Any car and accessories in, on or attached toit, as described in paragraph 1 of your currentCover Note.

Your Partner The person you are legally married to, haveentered a legal Civil Partnership with, or wholives with you at the same address in acommon law relationship.

Section 1 – Your liability to othersWhat is covered What is not covered1 Cover we provide for youWe will pay all the amounts you legally have topay as a result of using Your Car and any trailer,caravan or vehicle being towed by it if you:• cause the accidental death of, or bodily injury

to, any person; or• cause accidental damage to anyone’s property.In respect of accidental damage to property wewill not pay any more than £20,000,000including all costs (or any higher amount or anyhigher limit provided for by local legislation interritories outside the United Kingdom but withinthe Territorial Limits) for any one occurrence orseries of occurrences arising from one cause.

2 Cover we provide for other peopleWewill cover the following people for legalliabilities to others:• Anyone You allow to drive or use Your car as

long as they are entitled to drive by Yourcurrent Cover Note and are using Your carwithin the limitations of use specified in YourCover Note;

• Anyone travelling in, getting into or out of Your Car; and

• The employer of anyone you allow to drive oruse Your Car as long as they are entitled todrive and this use is covered by your currentCover Note.

3 Your legally appointed representativesAfter the death of anyone who is insured underthis Policy, wewill protect that person’s estateagainst any liability they had if that liability isinsured under this Policy.

Liability for causing the death of, or bodily injury to,any employee in the course of their employment byanyone insured by this Policy unless cover iscompulsory under motor insurance legislation withinthe Territorial Limits of this Policy.

Liability for loss of, or damage to, property whichbelongs to, or is held in trust by you, or is in yourcare, custody or control.

Liability for loss of, or damage to, property whichbelongs to, is held in trust by, or is in the care,custody or control of anyone you allow to drive YourCar and who is entitled to drive by your currentCover Note.

Liability caused by using Your Car on any part of anaerodrome, airport, airfield or military base whereaircraft can go.

Loss of, or damage to, any trailer, caravan or vehiclebeing towed by Your Car.

Cover under your policy is comprehensiveand all sections apply.

The General exclusions and Generalconditions at the back of this policyapply to all sections.

What is covered What is not covered4 Legal fees and expenses

If there is an accident insured under this Policywewill, subject to ourwritten agreement, arrangeand pay for:• a solicitor or barrister to represent anyone

insured under this Policy at a coroner’s inquestor criminal court; and

• defending anyone insured under this Policy ifthey are charged with manslaughter or causingdeath by careless, reckless or dangerous driving.

5 Emergency medical treatment If there is an accident insured by this Policy, wewill pay for emergency medical treatment whichis required under any compulsory motor insurancelegislation.

Section 2 – Loss of or damage to Your CarWhat is covered What is not coveredDamage to Your CarWewill, at your request, pay for:• loss of or damage to Your Car up to the MarketValue of Your Car; if we repair Your Car wewill endeavour to use suitable parts supplied bythe original manufacturer;

• the cost of replacing a child’s car seat fitted inYour Carwith a new one of the same or similarmodel if the existing seat is being used and isdamaged as a result of a road traffic accident;

• the cost of draining Your Car’s fuel tank due to accidental misfuelling and repairing anydamage caused to Your Car’s engine as aconsequence of it;

• the cost of protecting and removing Your Car tothe nearest Ford Accident Repair Centre (or otherrepairer if your vehicle is not a Ford), and the costof delivering Your Car back to you after it hasbeen repaired as long as your home is in theUnited Kingdom, Channel Islands or the Isle ofMan; and

• the replacement or repair of Your Car’swindscreen, windows or sunroof.

Replacing Your CarWewill, at your request, replace Your Carwith anew one of the same make, model and specificationif Your Car is:• stolen and not recovered within 28 days of you

reporting the theft to us; or• damaged to the extent that the cost of repair is

more than 50% of the price of an identical newcar at the time of loss or damage (based on themanufacturers last United Kingdom list price).

Wewill only do this if: • you have owned Your Car (or it has been hired toyou under a hire-purchase agreement or PersonalContract Hire agreement) since it was firstregistered as new;

• the loss or damage happens before Your Car isone year old;

• we have your permission or the hire-purchasecompany’s permission to replace Your Car; and

• Your Car is in current production and available in the United Kingdom.

Accidental Damage ExcessIf your claim is not for fire, explosion, theft,attempted theft, malicious damage or windscreenyouwill have to pay the Excess shown in thecategory of driver table below. These Excessesare additional to any other Excess that may apply (if there are any, this will be shown on yourCover Note).

Fire, Theft and Malicious Damage ExcessYouwill have to pay the first £500 of any claimmade for fire, explosion, theft , attempted theft ormalicious damage.

Windscreen ExcessIf your claim is only for repair or replacement of YourCar’swindscreen, windows or sunroof, or forbodywork scratched as a direct result of a damagedwindscreen, window or sunroof, youwill have to paythe first:• Nil for repair using our approved

repairer Autoglass;• £100 for replacement using our

approved repairer Autoglass; or• £200 for repair or replacement

using any other repairer.

Loss of or damage to Your Car following theft or attempted theft, if at the time of the loss ordamage Your Carwas unoccupied with the ignitionkey or other removable ignition device left in or onYour Car.Loss of Your Car resulting from fraud or deception orby using any counterfeit form of payment which abank or building society will not authorise.

What is covered What is not covered

If Your Car is on lease hire or hire purchase orPersonal Contract Hire, wemay be required to paythe owner for damage to Your Car. In that event ourpayment will be in full and final settlement of ourliability under this section

Obsolete and Spare PartsIf any part or accessory is not available, the most wewill pay for that part will be the cost shown in themanufacturers last United Kingdom price list, plus afitting cost.

If the part is not listed in the manufacturers lastUnited Kingdom price list, wewill pay the cost of anequivalent part plus the fitting cost.

If no equivalent part is listed, the most wewill pay is £250.

SalvageIf we are going to settle your claim by replacing YourCar or by paying you the Market Value, Your Carwill become our property.

If Your Car has a personalised registration youmayretain this subject to DVLA (Driver and VehicleLicensing Agency) or the DVA (Driver and VehicleAgency) (Northern Ireland) rules and regulations.

Any amount over £750 for loss of, or damage to,audio, communication, navigational, or in-carentertainment equipment unless it is standardequipment or a manufacturer fitted optional extrafor Your Carwhen built. Such equipment must bepermanently and securely fitted to Your Car andoperated by Your Car's electrical system only.

Wear and tear, depreciation, mechanical, electrical, electronic or computer failures,breakdowns or breakages.

The cost of reinstating or replacing data of any type that was held in or stored on any equipmentin Your Car.

Damage to tyres caused by braking, punctures, cuts or bursts.

Damage or destruction due to pressure wavescaused by aircraft or other flying objects.

Loss of value following repairs to Your Car.Loss of use of Your Car or other indirect loss.

Loss or damage arising from confiscation, requisitionor destruction of Your Car by, or under order of, anygovernment, Public or Local Authority.

Any damage caused deliberately by you or anyoneelse insured under this Policy.

Any loss or damage as a result of theft of or theunauthorised taking of Your Car by a family memberor anyone who lives with you, unless you reportthem to the police for taking Your Carwithout your consent.

What is covered What is not coveredWewill pay, at your request, up to:• £200 for personal belongings; and• £200 for wheelchairs, prams, children's push

chairs, buggies and carrycots,

while in or on Your Car if they are lost or damaged byan accident, fire, theft or attempted theft.

Wewill not pay for loss of, or damage to:• money including cash, cheque books, credit, debit,

cheque and loyalty cards;• tickets vouchers documents or securities

(financial certificates such as shares and bonds);• lottery tickets and scratchcards;• jewellery including watches;• mobile phones; or• goods, samples or business equipment which you or any person insured by this Policy carryin connection with any trade or business.

Wewill not pay for any loss following theft orattempted theft if Your Carwas unoccupied at thetime of the loss, unless:• Your Carwas locked and the ignition key or

other removable ignition device was not in or on Your Car, or

• your personal belongings were stolen from thelocked boot of Your Car if Your Car is aconvertible.

Section 3 – Medical expenses

Section 4 – Personal belongings

Following an accident involving Your Car wewill pay;

• medical, surgical and dental fees up to£200 for each person; and

• veterinary fees up to £200 for eachdomestic pet (for a maximum of two pets),

if they are injured while travelling in Your Car.

Wewill also pay you £30 a day for up to 30days if you have to stay in hospital.

Section 5 – Replacement locksWewill cover the cost of changing locks onYour Car if the keys, transmitter orimmobiliser key have been lost or stolenprovided you report the loss to the policewithin 24 hours of discovery.

The maximum wewill pay for any one claim is £500

Customer ComplaintsAt Ford Insure, our aim is to get everythingright, first time, every time. If a mistake ismade we will put it right quickly. To start theprocess of investigating a complaint all youneed to do is phone, email or send a letter tothe contact details below:

Once your complaint has been received it willbe treated with the highest importance.

Within five working days we will: • Confirm that we’ve received your

complaint:• Give you the name of the person who is

dealing with the complaint. They will havebeen fully trained to investigate and resolveit professionally, and they will be yourmaincontact throughout the process.

We will try to deal with your complaintstraight away, but if we need to investigatefurther in order to resolve the problem:• Within four weeks we will aim to give you a

final response to the complaint, with all thereasons for the actions or decisions, alongwith details of the Financial OmbudsmanService; or

• Explain why it is not yet possible to give youa final response, and let you know when wewill be ready to do so.

We hope that our response will never exceedeight weeks but if we have not provided a fullresponse within eight weeks we will explainwhy it has not been possible to give you a finalresponse, and let you know when we will beready to do so.

If we are unable to resolve the problem we willprovide youwith information about theFinancial Ombudsman Service which offers afree, independent complaint resolution service.

You have the right to refer your complaint tothe Financial Ombudsman, free of charge –but you must do so within six months of thedate of the final response letter.

If you do not refer your complaint in time, theOmbudsman will not have our permission toconsider your complaint and so will only beable to do so in very limited circumstances. Forexample, if the Ombudsman believes that thedelay was as a result of exceptional circumstances.

General exclusions applying to all parts of this PolicyThis Policy does not cover the following.1 Wewill not cover loss or damage or legal

liability directly or indirectly caused by:

• ionising radiation or contamination byradioactivity from any nuclear fuel orfrom any nuclear waste from theburning of nuclear fuel; or

• the radioactive, toxic, explosive orother dangerous properties of anyexplosive nuclear machinery or anypart of it.

2 Wewill not cover loss, damage, injury orliability as a result of:

• earthquake;

• underground fire; or

• war, invasion, revolution or any similar event.

However, wewill provide the cover youneed to meet the requirements of anycompulsory insurance legislation in force within the Territorial Limits of this Policy.

3 Wewill not cover any claim or damagearising while Your Car is being:

• driven by anyone who is notmentioned in the “Person or classesof persons entitled to drive” sectionnoted in your current Cover Note; or

• used for a purpose which is not permitted by your current Cover Note.

However, this exception does not apply to:

• claims under Section 2 (Loss of, ordamage to, Your Car); and

• the cover given to you (and to noother person) under Section 1 (Yourliability to others)

while Your Car is being used without yourauthority or by a motor trader for servicingor repair.

4 Wewill not cover any loss, damage orliability caused by riot or civil commotionoutside England, Scotland, Wales, theChannel Islands or the Isle of Man unlesswe have to meet any compulsory motorinsurance legislation.

5 Wewill not cover loss, damage, cost orexpense of whatever nature directly orindirectly caused by, resulting from or inconnection with any act of terrorismregardless of any other cause or eventcontributing at the same time or in anyother sequence to the loss.

For the purpose of this exception an actof terrorism means;

• the use, or threatened use, ofbiological, chemical and/or nuclearforce by any person or group ofpeople whether acting alone or onbehalf of or in connection with anyorganisation(s) or government(s)committed for political, religious,ideological or similar purposesincluding the intention to influenceany government and/or to put thepublic or any section of the public in fear; and

• any act deemed by the government tobe an act of terrorism.

6 We will not cover any loss damage or liability caused directly or indirectlycaused by pollution or contaminationunless the pollution or contamination is directly caused by a sudden individual,unintentional and unexpected incidentwhich entirely takes place at a specifictime and location during the Period of Insurance.

All pollution or contamination whichresults out of one incident shall beconsidered to have occurred at the timethe incident took place. This exclusionshall not apply where we have to meetthe requirements of any compulsorymotor insurance legislation in force withinthe Territorial Limits of this Policy.

7 Loss damage or liability arising out of oras a result of any agreement or contractyou have entered into.

8 Wewill not pay more than our legalliability under compulsory motorinsurance legislation for any claim, if thedriver of Your Car, at the time of theaccident

• is found to be over the permitted limitfor alcohol

• is unfit to drive through drink or drugs,whether prescribed or otherwise

• fails to provide a sample of breath,blood or urine when required to do so,without lawful reason

If we are obliged to make a payment insuch circumstances we reserve the rightto seek to recover any such amounts fromyou or the driver of Your Car.

General conditions applying to this Policy1 Taking care of Your CarYoumust do all you reasonably can toprotect Your Car from damage or theftand keep it in a good and roadworthycondition. Where required by law, YourCarmust have a current Department ForTransport test certificate (MOT). If weask, youmust allow us, or ourrepresentative, to inspect Your Car at anyreasonable time.

2 Claims In the event of a claim:

Youmust not admit fault or responsibilityor pay/offer or agree to pay any money orsettle any claim without our permission.

Youmust tell us at your first opportunityabout any claim or incident that may leadto a claim, and give us any informationrelevant to the claim that wemay ask for.

Youmust co operate with us at all times.

We can, in your name:

• take over, defend and settle a claim; and

• take proceedings at our own expenseand for our own benefit to recover any payment we have made underthis Policy.

3 Keeping to the terms of the PolicyWewill only give you the cover describedin this Policy if:

• any person claiming has met all theconditions as far as they apply; and

• any declarations made andinformation given to us on which thisPolicy is based is complete andcorrect as far as you know.

4 Other insurances No insurance shall be held to be effected if you have the benefit of otherinsurance covering the same loss,damage or liability. If you obtain thebenefit of other insurance covering thesame loss, damage or liability during thePeriod of Insurance the Policywill bevoid from the moment the otherinsurance is effected.

5 Compulsory insuranceIf the law of any country in which thisPolicy covers you says wemust pay aclaim which wewould otherwise not havepaid, then we are entitled to recover suchpayments from you.

6 FraudIf you or anyone acting on your behalfmake a claim which is in any way false or fraudulent claim or supports a claim by false or fraudulent statement, deviceor documents, including inflating orexaggerating a claim, youwill lose allbenefit under this Policy. Wemay recoverany sums that we have already paidunder the Policy.

7 ArbitrationIf we accept your claim but you do not agree with the amount wewill payyou, wewill refer the matter to anarbitrator chosen by you and us. Youcannot take any action against us untilyou and we have received the arbitrator’sfinal decision.

8 Changing your detailsYoumust tell us about any changes thatmay affect your Policy cover. If we are notinformed of any changes this may affectyour ability to claim under your Policy.Changes youmust tell Ford Insure aboutbefore continuing to use Your Car:

If you want to:

• change Your Car

• make any changes to Your Carthat make it different from themanufacturer’s standard UKspecification;

• use Your Car for a purpose notpermitted in your Certificate of Motor Insurance;

• add a new driver.

Changes youmust tell Ford Insure aboutat your first opportunity:

If you:

• change your address, or where younormally keep Your Car;

• or any other driver covered by yourPolicy, are convicted of a criminal ormotoring offence including fixedpenalty notices;

• or any other driver covered by yourPolicy, have a prosecution pendingfor any motoring offence;

• or any driver covered under yourPolicy become unemployed orchange occupation, including anypart-time work;

• or any other driver have had changesmade to the status of your or theirdriving licence;

• become aware of any physical ormedical condition of any driver which may affect your or their ability to drive;

• exceed your stated annual mileage; or

• or any driver covered under yourPolicy have a change of name due to marriage or via Deed Poll.

In some circumstances wemay not beable to continue your Policy following thechanges; where this happens youwill betold and the Policywill be cancelled.

9 Rights of PartiesA person or company who was not a partyto this Policy has no right under theContracts (Rights of Third Parties) Act 1999 to enforce any term of thisPolicy but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

10 Choice of lawUnless We agree otherwise:

• the language of this Policy and allcommunications will be English; and

• all aspects of this Policy includingnegotiation and performance aresubject to English law and thedecisions of English courts.

11 Car sharingYour Policy also covers Your Car whenyou are paid for carrying passengers forsocial reasons, as long as:

• Your Car is not built or adapted tocarry more than eight passengers (notincluding the driver);

• the passengers are not being carriedas part of a business of carryingpassengers; and

• you do not profit from the totalamount of money you are paid for the journey.

Persons (including his or herappointed representatives) pursuing a claimin respect of a road traffic accident(including citizens of other countries) mayalso obtain relevant information which isheld on the MID.

It is vital that the MID holds your correctregistration number. If it is incorrectly shownon the MID you are at risk of having yourvehicle seized by the Police. You can checkthat your correct registration number detailsare shown on the MID at www.askmid.com.You should also show these notices toanyone insured to drive under this policy.

Fraud Prevention, Detection andClaims HistoryIn order to detect or prevent fraud AllianzInsurance plc and Europa Group Limited mayat any time:

• Check your details against, or file yourdetails with, a range of registers and antifraud databases;

• Check your details with fraud preventionagencies,

and if you give us false or inaccurateinformation and we suspect or identify fraud,we will record this and share it with otheragencies.

Protecting Your Car and Belongings

Remove the ignition key or other removableignition device when you get out of the car,even when parking in your own drive or at apetrol station. Your policy may not cover you ifyour car is unoccupied with the keys inside itor on it.

Never leave a door unlocked or a window orsunroof open, even when just going into ashop for a moment or two. If you use the keyfob check the car has actually locked beforeyou leave it. Your policy may not cover you ifyou do not protect your car against damageor theft.

Don’t leave any belongings in your car. A thiefwon’t know that a bag or coat doesn’t containsomething valuable and might break awindow to get at it. If you can’t take themwith you, lock them out of sight. If you have aremovable sat nav remove the cradle as wellas the device plus any suction marks thatcould show that it is in your car.

Don’t leave money, credit cards or chequebooks in the glove compartment.

Never leave your car documents in the car;they could help a thief to sell it.

If you can, leave the car in a locked garage and lock your car and the garage. If you do not have a garage, try to park in a well-lit,open space.

At home, ensure your car keys are kept in asafe place, out of sight and away fromwindows and doors.

When parking in a public car park, look for onethat is well supervised, with restricted entryand exit points, good lighting and securitycameras. Wherever possible use Park Mark®

car parks – details of approved Park Mark® carparks can be found on www.parkmark.co.uk.

Etch the car’s registration number on all glasssurfaces – windows, sunroofs etc. Thievesdon’t want the expense of replacement.

If your car is not fitted with an alarm orimmobiliser, consider fitting one which isThatcham approved. Also think about fitting atracking device especially if you have a high-performance or an expensive car.
