The EUROPEAN FOOD FRAUD NETWORK

to facilitate exchanges of information between Member States. Since November 2015 the network is supported

by a dedicated IT system (AAC)

EU-WIDE COORDINATED CONTROL PLANS

In 2015, two coordinated control plans targeted to honey and fish. They provided information on the nature and scale of frauds for these commodities.

BTSF (Better Training for Safer Food)

Five specific workshops per year dedicated to food fraud: eCommerce and Investigation Techniques

Revised OCR Regulation

Proposal including the establishment of EU Reference Centres for food authenticity and Scope for the IT

system (Food Fraud): Animal Health, Animal Welfare, Plant Health

These initiatives have been welcomed by Member States, MEPs, consumer organisations and industry

The Food Fraud Network

• Members: Food fraud contact points (FFCPs) appointed by competent authorities as per Regulation (EC) No 882/2004 on official controls.

• Aim: • Facilitate administrative assistance and cooperation in the case

of suspicion of fraud with a transborder element

• Facilitate cooperation between the EC and MS as well as the tasks of coordination of the EC

• Learn from each other

• Advantage: rapid exchange of information

EU policy cycle to disrupt the activity of organised crime groups

• Funded by the Commission (DG Migration and Home Affairs).

• Operational actions lead by Europol. • The goal is to ensure effective cooperation

between national law enforcement agencies, EU institutions, EU Agencies and other relevant partners in the fight against serious and organized crime.

• One of the priorities is to disrupt OCGs involved in the production and distribution of counterfeit goods violating health, safety and food regulations and those producing sub-standard goods.

• Annual plans for field operations and training activities.• OPSON is an annual time limited action to seize counterfeit food and

drink at the borders partially funded through this cooperation.

Capacity building – train the trainer

• Better Training for Safer Food (BTSF)• Two new modules on new investigation techniques for official

controls along the food chain started in 2014.

• Course on investigation techniques to detect food fraud.

• Course on e-commerce in food, i.e. sales of food and food products on the internet.

• E-commerce advanced course started in 2016.

• An important innovation – participants include police and customs officers.

New official Controls Regulation

• Regular unannounced official controls directed at identifying intentional violations (fraud) (Article 8(2))

• Mandatory (instead of recommended) EU coordinated control plans (e.g. horse meat like cases) (Article 111(a))

• Sufficiently dissuasive financial penalties in case of intentional violations (balancing out the gain expected from the violation) (Article 136(2))
