The citizens of Clark County, after experiencing years of frustration at the lack of transparency,

incessant attacks on county staff, continued decisions that cost county taxpayers millions of

dollars that will never be recovered, willful contempt for the media, ostracism for simply

disagreeing with him, and continued favoritism toward one special interest group, hereby file

the following complaint of violations of the County Councilor Code of Ethical Conduct against

County Councilor David Madore. While this complaint is being submitted under the County’s

Rules of Practice and Code of Ethical Conduct as amended May 17, 2016, it is noted that the

various codes in the Code of Ethics are the same as attached to the 2014 and 2015 Rules of

Practice.

We are requesting the Board convene an Ethics Committee to investigate these charges against

Councilor Madore about violations of the Council's Ethics Code and report to the citizens of

Clark County their findings. If the Ethics Committee finds violations, we request appropriate

action be taken including removing Councilor Madore from appointments to Boards and

Commissions on which he serves. One such Board for consideration would be the Board of

Health; Councilor Madore has on a number of occasions created conspiracy theories related to

a number of Public Health functions, grants and programs that make the citizens question his

ability to serve on such a Board.

The following summarizes the ethics charges and relevant ethics principal which we believe

have been violated by Councilor Madore. Exhibits are attached which comprise the bank of

evidence, organized by charge. Also attached are the names of the 526 Clark County citizen

voters who signed a petition endorsing this ethics complaint.

Actions include unilaterally developing Alternative 4 with input from a single

special interest group, secretly developing documents and releasing them

without giving the public an opportunity to review and comment, giving

direction to staff with policies that did not exist.

Relevant Ethics Principle #1: A county councilor should be vigorously dedicated to the

democratic ideals of honesty, openness and accountability in all public matters involving county

government.

Evidence: Exhibit 1

Councilor Madore himself developed and continuously modified Comprehensive Plan Land Use

Alternative #4, not only micromanaging the process but also producing ambiguous, changing

and difficult-to-replicate information. Madore, with no expertise in comprehensive planning,

purposely developed planning assumptions to support that alternative which have been ruled

Invalid by his own hand-picked expert consultant.

On at least one occasion (October 20, 2015), Councilor Madore did not release important

documents relevant to Alternative 4 or its planning assumptions until minutes before public

hearings and meetings on the matter, giving the public no time to review and adequately

comment. On at least one occasion (the same October 20, 2015 hearing), this caused a public

hearing to be continued, inconveniencing many citizens who had taken the time to attend and

speak at the hearing.

On two occasions, Councilor Madore directed county Planning staff to use higher Rural

population growth rate assumptions that he claimed were based on the adopted 1994 Plan

which were not true. This also is borderline misfeasance as defined by RCW 29A.56.110, recall

of public elected officials.

Charge #1: Councilor Madore continues to violate Ethics Principle

#1 by actions that are dishonest and lack transparency, and he

continues to avoid accountability for his actions.

Relevant Ethics Code #2: Councilors should promote decorum, respect for others and civility in

all relationships.

Evidence: Exhibit 2

Starting in January 2016 and continuing throughout the Comprehensive Plan update process,

Councilor Madore falsely accused county Community Planning Director Oliver Orjiako of

misleading the comprehensive planning process, hiding a secret rural vacant and building lands

(RVBLM) model, and wrongfully inflating rural population forecasts. Madore further falsely

accused county deputy Prosecuting Attorneys Chris Horne and Chris Cook of wrongdoing

because of their denying Madore’s accusations against Dr. Orjiako.

These accusations were proven false not only by independent special investigator Rebecca

Dean, but a separate citizen investigation by Chuck Green. Portions of each investigation’s

report are attached in Exhibit 2 as evidence.

The RVBLM that Madore claims exists is actually a Geographic Information System (GIS) query

spreadsheet which was developed and modified under direct supervision and direction by

Councilor Madore in mid-2015. It was developed by the GIS division within the Assessor’s

office, and not the Community Planning department headed by Orjiako. Prior to 2015, the rural

population projection process was a simplified, GIS-based set of queries based on assumptions

that were documented throughout the comprehensive planning processes over the years.

It should be noted that at least nine (9) versions of Councilor Madore’s “Planning Assumptions”

that served as a basis for Councilor Madore’s Rural VBLM spreadsheet were developed and

circulated between October and mid-December 2015, making it almost impossible to track,

review or replicate his numbers.

Councilor Madore has openly defamed and held with contempt three of his fellow Councilors,

all of whom were fairly and properly elected and represent Clark County citizens. He has called

them the “liberal trio” and has even accused them of breaking the law without any evidence.

His comments incite those who follow him to show up and comment at council meetings, often

threatening or causing discomfort to regular citizens who honestly take the time to attend,

watch or even participate in county council meetings.

Councilor Madore wrongly accused Councilor Jeanne Stewart of casting a vote at a meeting she

did not even attend. While he has apologized, the accusatory post remained on his public

Facebook page for several weeks.

Councilor Madore continues to publicly express his contempt and disdain for the Growing

Healthier Report and the County’s Aging Readiness Report, both of which were adopted by

Clark County Commissioners, at the encouragement of Carol Levanen and Susan Rasmussen of

Clark County Citizens United, accusing them of “advancing Agenda 21”. Both of these reports

were developed with substantial community input and with input from experts in the health,

food quality, and aging community. As you can see in Exhibit 2, there is a long chain of emails

from Levanen and Rasmussen both making unfounded requests of Madore to remove these

adopted reports, and sponsored Food Systems Council, from the county’s website. Madore

complies with their request without an assessment or an investigation, directing Dr. Melnick to

comply with the CCCU request.

Councilor Madore has attacked a number of grants, programs and functions of the Public

Health Department with conspiracy theories which call into question his ability to serve on the

Board of Health.

There is an instance with the Shoreline Management Plan where the Dean report indicates

Madore and Don Benton staged an incident at a 2015 public hearing to publicly discredit staff.

That portion of the Dean report is also in Exhibit 2.

Councilor Madore invites comment on county-related business items via his public Facebook

page, but has banned hundreds of citizens from that same public Facebook page. He continues

to ignore and not respond to emails, requests for comments, and phone messages from the

media and Clark County citizens, while continually showing favoritism toward two special

interest groups, Clark County Citizens United and Chuck Miller's "Washington Citizens for

Responsible Government".1

Councilor Madore has several times called members of the group Clark County Citizens for

Good Governance (and other groups) who disagree with or oppose him on a variety of positions

and opinions that Madore make, a “hate group” simply because they continue to monitor,

disagree with and challenge Councilor Madore’s decisions and actions. Councilor Madore

continues to hold the county’s Newspaper of Record, The Columbian, with contempt, calling

them a “cancer on society”.

Councilor Madore has continued to take actions to incite people against those with whom he

disagrees, including county staff, resulting in a hostile environment not only for county

employees, but also citizens. A group of citizens attending the Hockinson Alternative 4 open

of Clark County several times during his term in office, especially

during 2016, calling them members of a hate group and banning

them from his primary means of communication, his public

Facebook page.

He is not promoting decorum or civility, and shows an amazing lack

of respect for those who disagree with his opinion or don’t do his

bidding.

Madore spoke against the process and county staff and those who disagreed with his

Alternative 4.

Councilor Madore posted a racist “Play the Race Card” meme on his public Facebook page and,

despite many community requests to remove it, the meme remains on his Facebook page.

Councilor Madore has launched accusations or has nitpicked contracts and policy relationships

with: Humane Society of Southwest Washington; Columbia River Economic Development

Council; Regional Transportation Council; C-TRAN; Cities of Vancouver, Camas, Ridgefield,

Washougal, La Center and Battle Ground; and most entities on the Oregon side of the river who

are part of the Portland/Vancouver metropolitan area.

With the Humane Society contract in 2013, Madore nitpicked the process to the point where

the Humane Society had no choice but to threaten to no longer serve the county’s Animal

Control needs when it came to housing strays and spaying and neutering. Madore claimed the

county could take on the Humane Society’s work for less money; however, a study showed that

it would cost the county over $1 million per year to operate it own animal control (stray)

shelter, compared to the $200,000 to $300,000 per year paid to the Humane Society for them

to do the same thing.2 The newest contract places the projected annual cost at a little over

$410,000 per year for three years, still much less than the $1 million Madore wanted to cost

the county by providing its own shelter.

Councilor Madore intervened in and interfered with the RTC’s 10-Year Transportation Project

Priorities list, attempting to move his personal priority project, the I-5 at 179th Street

interchange, ahead of all other regional projects in priority for no reason other than he wanted

to. In 2014 the Clark County Transportation Alliance (CCTA) put together a list of Clark County’s

legislative transportation priorities. That evolved into an updated RTC 10-Year Transportation

Charge #4: Councilor Madore has worked to sever relationships with

most of Clark County’s partner or stakeholder entities, often using

conspiracy theories to do so. This has caused irreparable harm to

the reputation of Clark County government and led to reluctance in

the willingness of former partner agencies to conduct business with

Clark County.

In 2014, in fact, the CCTA lobbied to add the I-5 at 179th Street interchange to this priority list

through RTC, as it had not appeared on the list bedore. When RTC adopted the transportation

priorities list in early 2014, David Madore stated: "the 179th Street project listed on the Alliance

statement is a high priority for Clark County" for their economic development. He "would like

to see at least that project … added to the list."3 In March 2014, when RTC was considering the

CCTA priorities list as part of their 10-Year Transportation Priorities list, Commissioner Madore

said “at this point he was not arguing what order to place it, just to put it on the list.”4

With the 2015 process, the county, led by Councilor Madore, tried to change the rules to force

the I-5 at 179th Street interchange higher on the RTC list: "DAVID MADORE MOTIONED TO

MOVE THE NUMBER 10 RANKED PROJECT, I-5 AT 179TH STREET INTERCHANGE, TO THE

NUMBER 5 RANK POSITION ON THE LIST. TOM MIELKE SECONDED THE MOTION." 5

The motion failed and the list was adopted, with Councilor Madore voting “no”, essentially

voting against the county’s own projects.

Councilor Madore continues to launch conspiracy theories about “resurrection of the failed CRC

project” with anything related to priority projects for which the City of Vancouver, Port of

Vancouver and CREDC desire to implement, including the I-5 at Mill Plain interchange

reconstruction project and the Mill Plain corridor improvements from I-5 to the Port of

Vancouver. Councilor Madore has accused Identity Clark County, Clark County Transportation

Alliance, and Governor Jay Inslee of a secret CRC conspiracy because these entities have all

identified the I-5 corridor crossing the Columbia River as a regional transportation priority.

Relevant Ethics Code #3: Councilors should actively practice stewardship of the county’s human,

fiscal and material resources.

Then-commissioner Madore along with then-Commissioner Tom Mielke pressed Clark County

Administrator Bill Barron to hire Don Benton as Director of Environmental Services, a position

for which he was totally unqualified, instead of seeking out a qualified person through proper

Human Resources channels. The resultant settlement of a lawsuit cost the county $250,000.

While he recently tried to blame a retired and departed County Administrator for this hire, he

was very obviously lobbying for Don Benton at the May 1, 2013 Board Time meeting and made

a Facebook post in October 2013 that further indicated his involvement with the decision to

hire Benton.

Councilor Madore continues to attempt to insert himself into the Human Resources hiring

process, including promoting Lisa Ross for county manager, a position in which she is fully

unqualified.

Councilor Madore continues to accuse the county manager of wrongdoing for his dissolution of

the Department of Environmental Services, even though the Home Rule Charter gives the

county manager that authority.

Councilor Madore hand-picked planning consultant RW Thorpe to critique Councilor Madore’s

own planning assumptions supporting his own hand-developed Alternative 4, costing Clark

County taxpayers $40,000. The consultant ruled much of Madore’s assumptions to be invalid,

and Madore then started publicly discounting and defaming the consultant’s work.

Councilor Madore’s baseless and false accusations against county staff have cost taxpayers

almost $200,000 in attorney costs for normal business operations6, a special investigation

based on accusations that he made against county staff, and legal counsel for the

comprehensive planning process.

Madore continues to push, and in fact during his term in office expanded, the Job Creator Fee

Waiver program which has given away $15 million in permit and traffic impact fee waivers.

Councilor Madore has continued to publicize the fee waiver program as a reason that Clark

County’s economy alternately is “the best on the West Coast” and “the best in the State”.

These claims are unsubstantiated. Using Washington State Employment Security Department

monthly statistics: 7

Based on total job creation, Clark County as a whole (unincorporated plus incorporated)

saw 6,000 new jobs in the year-to-year growth between December 2014 and December

2015. That is 3rd, behind King (31,300) and Snohomish (8,000).

Based on percent of growth, Clark County grew by 4.1% in that same year-to-year cycle.

That is 4th, behind Ferry (4.8%), Kitsap (5.2%), and Lewis (5.4%).

A 2014 audit as well as county staff and expert citizen groups have all reviewed and audited the

program, which have determined that there is no evidence the Fee Waiver program has been

responsible for job growth (an improving economy is responsible) and, in fact, the Fee Waiver

has achieved growth rates no better than Clark County’s cities which do not have giveaway fee

waiver programs.

The Fee Waiver program has not been shown to meet any of its ambiguous goals and is

reducing fund balances to levels where the county cannot match grant funds or will have to

delay transportation improvement projects for lack of funding. The Fee Waiver program has

resulted in subsidies to the Development Review program from residential developers as well

as taxpayers.

Relevant Ethics Code #5: Councilors should perform the duties of public office with fairness and

impartiality so to enhance the public confidence in county government.

As noted above in Charge #2 with evidence contained in Exhibit 2, Councilor Madore continues

to cater to two special interest groups, Clark County Citizens United (CCCU) and "Washington

Citizens for Responsible Government". Besides exchanges of hundreds of emails between

Madore and CCCU members, there is evidence that several emails from CCCU were sent to

Councilor Madore’s private US Digital email. He not only does CCCU’s bidding without

questioning their motives or accusations, he purposely ignores citizens and media

representatives who may not agree with his decisions, positions or actions.

An example of the favoritism toward CCCU was at the September 3 and 10 joint Planning

Commission and County Council hearings on the Comprehensive Plan. At the September 3

hearing, Councilor Madore stated “if you testify tonight, the idea is that you’ve been heard, so

leave an opportunity for someone else to testify on the 10th.”8

However, at the September 10, 2015, Councilor Madore allowed Carol Levanen and Susan

Rasmussen of CCCU to testify a second time. After Prosecuting Attorney Christine Cook raised

concerns, Councilor Madore questioned whether this was against the law, claiming “it is not a

hard and fast rule. I will not disallow (a second testimony) if citizens come down…This is not a

repeat, this is not an election” even though Levanen and Rasmussen testified both times on

behalf of CCCU.9 All other citizen groups adhered to the single-testimony rule.

There are also instances where Councilor Madore has held special one-on-one after-hours

meetings with CCCU representatives; Councilor Madore met with them the evening of

Charge #6: Councilor Madore continues to violate his Oath of Office

by catering to a special interest group and conducting business and

decision-making in a biased manner. Councilor Madore twice

encouraged people to use anonymous internet-surfing websites to

obtain the Columbian newspaper without paying for it.

September 20, 2015. CCCU members were seen bringing dinner in and storing it in the county

councilors’ refrigerator. There were at least two instances where CCCU members were invited

to the councilors’ table at a Board Time meeting in early 2014 and again in 2015.

Councilor Madore continues to call the Columbian, the County’s Newspaper of Record, a

“cancer on society”. On at least two occasions, in December 2015 and May 2016, Councilor

Madore through his public Facebook page publicized and encouraged his constituents to use

anonymous web-surfing media to obtain the Columbian without paying for it, which are not

only deceitful and dishonest but destroys the public trust in Madore as a county councilor.

Councilor Madore has several times made it clear how he tends to vote on policy matters,

including Alternative 4, prior to the public being able to comment and prior to public hearings

in which the decisions are being made, showing that he is not conducting office in an impartial

manner.

Councilor Madore has on a number of occasions called Judge David Gregerson “silly judge”

because he does not agree with the judge’s rulings, and continues to present non-factual

information as if he practiced law. His public Facebook posts incite inflammatory responses

from those who follow him, and Councilor Madore does nothing to dissuade them.

Charge #7: Councilor Madore has demeaned and defamed honored

members of city councils and the judiciary system, and continues to

make negative and baseless statements that reflect on the County

Council as a whole.

citizens” because she is an appointed member of the C-TRAN Board without any basis in reality,

because C-TRAN’s legal counsel filed a motion to recover some taxpayer-paid attorney’s fees in

a lawsuit ruled as frivolous.

Evidence: Exhibit 8

Several times during the Comprehensive Planning process which included the development by

Councilor Madore of Alternative 4, Prosecuting Attorney and Planning staff expressed

numerous concerns that Councilor Madore’s actions and words were putting the process in

jeopardy. This escalated to a point where County Planning staff requested legal opinions

regarding Madore’s direction to staff on Alternative 4 and its Planning Assumptions.

Charge #8: Councilor Madore has continually put the county at legal

risk by purposely ignoring legal opinions of the county’s counsel

(Civil Deputy Prosecuting Attorneys Chris Cook and Chris Horne) and,

in fact, creating his own opinions that he presents as his own legal

opinions. Councilor Madore continues to raise issues and

accusations without first investigating whether it is accurate.

On July 13, 2016, during the discussion about a referendum petition to belay the ordinance

adopting the 2016 Comprehensive Plan update, Councilor Madore repeatedly shunned the

expert legal advice of counsel that the petition is not allowed under state law, state case law,

and the Charter.

Madore has several times verbally and on his public Facebook page encouraged legal action

against the Comprehensive Plan, putting the county not only at legal risk but financial risk. He

continues to support a referendum on the Comprehensive Plan that is not allowed under state

law and under the Home Rule Charter.

In his zeal to micromanage the Growth Management Plan update process, Councilor Madore

repeatedly ignored legal counsel advice in development of, and defense of, Alternative 4.

Instead, Councilor Madore attempted to deflect public scrutiny with baseless accusations of

County counsel as well as County staff.

At the regular Council meeting on July 12, 2016, despite the Fee Waiver discussion being

noticed for public comment only (no action) and Council Chair Marc Boldt announcing as the

Fee Waiver agenda items was being introduced that “no action will be taken on this matter”,

Councilor Madore made a motion (an action) to request developer input on the program and to

advertise for the second public comment session. This action would be in violation of the Open

Public Meetings Act.

On a number of occasions, Councilor Madore uses hearsay or “postcard contact” to incite

accusations or implications of guilt without investigating whether there is any factual

evidence10.

These actions put the county at substantial financial and legal risk for continued costs to

taxpayers of legal counsel and defending the county, as well as legal risk that could tie up the

Comprehensive Plan and the county process itself in the legal system for years to come.

These actions also put the comprehensive plans of several small cities at risk by delaying the

effective date of the updated comprehensive plan and opening up for a potential rural land

rush those areas which were to be added to the urban growth areas of those cities, which could

cost those cities millions of dollars in land costs or, if these areas develop into rural estates,

hundreds of future jobs.

This document, authored by David Madore, was uploaded to the Grid less than an

hour before the 10:00 AM hearing on October 20, 2015. The public had no chance to

review or provide comment on this document, which was to be an important part of

the Preferred Alternative hearing and consideration.

October 20, 2015 minutes which shows Councilor Madore admits the “adopted”

VBLM model was the urban model, not the rural one. The supposed RVBLM, that

was developed by GIS staff in July 2015 under his direct supervision and direction,

was never reviewed by Planning Staff nor was it ever reviewed or adopted by the

County Commissioners/Councilors. Planning and Prosecuting Attorney staff have

always noted that the true VBLM has been subject to BOCC approval since the 1990s,

while the rural assumptions have been more simplified.

These are the 2014 and 2015 RTC 10-Year Transportation priorities lists.

Councilor Madore’s March 2015 Facebook post states “This evening’s RTC

agenda revealed that the most important economic development project in

our county, the $50 million I-5/179th Street Interchange, is not even on the

list of projects to fund” when it was on the 2015 list, and had also been on the

2014 list. He then accuses the City of Vancouver and Councilor Jack Burkman

of pushing a project to bring back the CRC: “Even he appeared to be guessing

that it is part of the CRC project that the voters and our legislature rejected. “

Madore led the effort to try to force RTC to change the rules to move his

project, the I-5 at 179th Street interchange, higher on the priority list without

justification to do so.

The 7-12-16 Board meeting was the first of two public meetings to take comment on

the fee waiver program (see agenda below). There could not be any action taken

because the meeting was noticed as a request for comment, not action. Chair Marc

Boldt stated specifically that "no action will be taken".

Councilor Madore made a motion (an action) to request the developers benefiting

from the fee waivers to state if and how the fee waiver program benefited them, and

to take out ads for more public comment. Taking an action where the agenda did not

state action would be taken, and where the Chair specifically stated no action would

be taken, sets the council up for a violation of the Open Public Meetings Act (RCW

42.30).
