UP-15-03 PROJECT: Sentara Chesapeake Nursing Center APPLICANT: Sentara Life Care Corporation AGENCY: VHB, Inc. PROPOSAL: A conditional use permit to reconstruct and operate a Nursing and Personal Care Facility and a Group Housing for the Elderly on a 10.82± acre parcel. ZONE: O&I, Office and Institutional District. LOCATION: 776 & 778 Oak Grove Road TAX MAP SECTION/PARCEL: 0370000001020 BOROUGH: Washington

PLANNING COMMISSION RECOMMENDATION:

Planning Commission recommends that UP-15-03 be APPROVED with the following stipulations: (8-0; Williams/Small, Johnson excused)

1. The applicant/owner acknowledges and understands that Oak Grove Road will become divided roadway and further acknowledges and understands how that will affect the property subject to this use permit. Once the divided roadway is established on Oak Grove Road, the site ingress/egress will be limited to a “right-in, right-out” condition. The applicant/owner hereby acknowledges that Oak Grove Road will become a divided highway, and the applicant/owner agrees that it and its assigns shall not be entitled to a claim for damages associated with the construction of improvements to Oak Grove Road, including but not limited to, right in and out turning movements for ingress/egress to Oak Grove Road.

2. The applicant/owner shall dedicate, at no cost to the City, right-of-way along the parcel’s frontage on Oak Grove Road to a line 45 feet from the original centerline of Oak Grove Road. The alignment and sufficiency of the dedication shall be subject to the review and approval of the Director of Development and Permits or designee. The dedication, as depicted on the exhibit entitled “Preliminary Site Plan for Sentara Nursing Center” and stamp dated February 12, 2015, shall be made by deed or plat and shall be made prior to final site construction approval. The recorded deed or plat shall include a statement that “The applicant/owner acknowledge that the dedication may be used in the construction of a future divided highway, and the applicant/owner agree that it and its assigns shall not be entitled to a claim for damages to improvements in the dedication or reservation area or damages to the residue associated with the construction of improvements to Oak Grove Road, including but not limited to right in and out turning movements for ingress/egress to Oak Grove Road.”

3. The applicant/owner shall design and construct a left turn lane for the eastern entrance as shown on the exhibit entitled “Preliminary Site Plan for Sentara Nursing Center” and stamp dated February 12, 2015. The turn lane shall be subject to the review and approval of the Director of Development and Permits or designee and shall be constructed in accordance with City standards and criteria prior to site plan approval.

4. The applicant/owner shall design and construct the eastern entrance as shown on the exhibit entitled “Preliminary Site Plan for Sentara Nursing Center” and stamp dated February 12, 2015 to align with existing crossover and intersect at Oak Grove Road at a 90 degree right angle. The alignment of this entrance shall be subject to the review and approval of the Director of Development and Permits or designee.

5. The applicant/owner agrees to record private access easement for the benefit of the adjacent parcel to the east (identified as tax map parcel 0370000001010), prior to final site plan approval.

6. The applicant/owner shall install 30% more plant materials than required by the Chesapeake Zoning Ordinance where the front yard setback has been reduced to 21 feet as shown on the exhibit entitled “Preliminary Site Plan for Sentara Nursing Center” and stamp dated February 12, 2015. Such improvement shall be subject to review and approval as part of the landscape plan and shall be installed prior to the issuance of the first Certificate of Occupancy.

7. The applicant shall provide a letter to the City from the Department of Environmental Quality stating that there are no environmental issues with the site that would be detrimental to the proposed use, prior to final site plan approval.

Staff Presentation:

Mrs. Hanson stated that based on sound planning practices, Planning staff recommended that UP-15-03 be APPROVED with the stipulations as listed in the official agenda.

Proponent:

Bruce Robertson, 421 W. Bute Street, Unit 405, Norfolk, Virginia, appeared before the Commission on behalf of UP-15-03 representing Sentara Chesapeake Nursing Center.

Commissioner Williams moved that UP-15-03 be APPROVED with the stipulations as listed in the official agenda and as recommended by staff. Commissioner Small seconded the motion. The motion was carried by a vote of 8 - 0. Commissioner Johnson was excused.
