and the arbitrators are likely to be from multiple jurisdictions and to have different expectations of counsel conduct. This presentation highlights key conflicts and suggests ways to manage conflicting expectations and professional disciplinary rules.
2:30 Special Public Policy Issues that Arise in International Disputes Worthy
In some jurisdictions, public policy forbids use of arbitration even by agreement as a method of dispute resolution for certain issues. These issues may affect the arbitrability of a claim and result in problems in enforcement. This presentation identifies the most common disputes that may be subject to this problem and discusses management of the risk on the front end through contract drafting and in the early stages of the arbitration process.
