7. PUBLIC CONSULTATION 7.0 Introduction

The Ministry of Environment, Forest and Climate Change, (MoEFCC) Government of

India issued Environmental Impact Assessment notification S.O. 1533 dated September

16, 2006 mandating prior environmental clearance for for technical grade pesticides or

Agro chemicals manufacturing, API’s, Co-generation power plants and Chlor-Alkali

plant under category A for projects located outside notified industrial area/estate. The

proposed expansion project of M/s. Deccan Fine Chemicals (India) Pvt. Ltd., is located

at Sy Nos. 63-75, 80-83, 84-108 of Kesavaram village, 52-56, 146-150 of Rajavaram

village, Venkatanagaram Post, Payakarao Peta Mandal, Visakhapatnam District District,

Andhra Pradesh. The proponent obtained the terms of reference vide letter no. F.No. J-

11011/657/2007-IA II (I) dated 25.06.2014 and subsequently obtained amended TOR

vide letter no. F.No. J-11011/657/2007-IA II (I) dated 30.06.2015, from the MoEFCC,

which mandated public consultation. Accordingly the draft Environmental Impact

Assessment was submitted to Regional Officer, Andhra Pradesh Pollution Control

Board, Visakhapatnam District for conducting public hearing. The public hearing for

the proposed expansion was conducted on 15.07.2016 at 11.00 AM at project site. The

public hearing was chaired by Dr. N. Yuvaraj, Collector and District Magistrate,

Visakhapatnam and the member convenor was Sri R. Lakshmi Narayana,

Environmental Engineer, Andhra Pradesh Pollution Control Board, Regional office,

Visakhapatnam.

7.1 Advertisement

Press notification regarding the date, time and venue of the Environmental public

hearing for the proposed expansion project was issued in Andhra Jyothi (Telugu daily)

and The Hindu (English daily) newspapers on 14.06.2016. Copy of the advertisement is

He further requested the management to pursue the possibility of supplying power to their villages from the surplus generation of the proposed power unit.

The Management assured to take all necessary environment/safety measures to protect the environment. Proponent assured that industry would install latest pollution control equipment like two stage scrubbing system, double condensor system, dry vacuum pumps to mitigate odor nuisance, electro static precipitators, bag filters to mitigate particulate emissions from boilers, and closed transfer of raw materials/solvents.

He also requested to provide education, medical and drinking water facilities to the local villages and requested to pursue the road widening considering the increased traffic.

While welcoming the proposed expansion project, stated that since there are many fishermen families in surrounding villages employment opportunities are to be provided to them as the fish catch is getting depleted due to discharge of industrial effluent into the Sea which is affecting livelihood of fishermen. He also requested that proper safety measures are to be adopted to prevent fire accident in future. Finally he urged the management to consider the contract workers for regularization who are working since long time.

While opposing the expansion proposal stated that the greenbelt in the radius of 10 KM is affected and more greenbelt development is to be considered as the existing greenbelt is not sufficient after expansion and said that local people are prioritized in providing employment. He referred the occurrence of accidents resulting casualties. He felt that social audit to be conducted in the area to ascertain the socio-economic status of the people and the SC Colony, Gajapathinagaram adjacent to the industry is to be rehabilitated immediately to avoid any untoward situation regarding safety concern.

The management assured to develop greenery in an area of 76 acres with in the plant, and assued to assist the district administration in improving the greenery in the surrounding area. was carried out on air, water and ground and the same is satisfactory. If possible, the survey on the villager’s health status, crop yield, ground water status etc., will be helpful as a gauge for environmental balance in future. She expects to include this kind of reports.

2. As per the District rain water calculations, about 75

Crores Liters of water rains in the existing area of 190 Acres of M/s. Deccan Fine Chemicals. Out of which, the water percolate into the ground is less than 15 Crores liters. Whereas, as per the Industry’s calculations, the water utilization per year is about 200 Crores Liters. As the difference is huge and affects the environmental balance, it is percolated into the ground for which arrangements to store the rain water, and should see that the rainwater is reaches to the ground. In the same way, the rainwater in the surrounding areas should also be preserved to the extent possible.

3. It is appreciable that 33% of green belt development

Many accidents were occurred in this company. Minimum safety measures were not adopted. The Pollution Control Board itself reported that the pollution affect will be up to 10 km radius from the company and the air & water are completely polluted because of the industry.

1. Accidents occurred in the industry:

a. 24th January, 2016 – Accident occurred in the godown where medicines are stored. Due to which, the workers of the employs along with the surrounding Rajavaram, Gajapathinagaram, Pentakota, Venkatanagaram, Rajanagaram, Kesavaram, Srirampuram, Rajagopalapuram villagers ran away leaving their properties to save their lives.

b. 11th April, 2014 – In the reactor blast accident,

two causalities were occurred on the spot and another 14 workers were injured. The management had not taken any preventive measures even after this accident. The surrounding villager’s health is affecting due to release of chemicals in the production of pesticides. For example, two children in SC Colony of Rajavaram, a nearby village of the industry are suffering with skin allergy and many other are suffering with skin allergies.

2. Safety measures:- The industry has totally failed in adopting safety measures. The industry is hiding many small accidents that are happening regularly, from the world.

3. Greenbelt: - Presently the industry is operating

in 40 Acres without any greenbelt. Now, the industry has proposed another 190 acres for expansion. In total the industry is establishing in 230 Acres. Out of 230 acres, as per EIA report, green belt is to be developed in 76 Acres. Till now there is no sign of green belt development and the industry may not fulfill the commitment in future also. Resulting total polluting environment.

4. Pollution Control Measures: Due to lack of

control by the Pollution Control Board, the surrounding cultivable lands & crop are affecting, due to release of industrial waste into the Sea, the fish catch is depleting and the fishermen livelihood was affected, resulting migration of villagers.

Proponent assured that the Industry shall follow the standards prescribed by Ministry of Environment, Forest and Climate Change (MoEF&CC) with respect to emissions, effluents, solid waste. The management assured to develop greenery in an area of 76 acres within the plant, and assued to assist the district administration in improving the greenery in the surrounding area. 5. Employment: The rehabilitants and surrounding villagers were assured providing of Jobs, but the same was not fulfilled till date. In the future expansion proposal, it was assured that about 600 jobs will be provided during the construction period and about 450 jobs will be provided after completion of the industry. As assured, all these jobs are to be provided to the rehabilitants and surrounding villagers.

6. The Labour Rules are not implementing properly.

The Management is not accepting to start Union and the management is taking revenge on the workers either by removing from the job or transferring.

7. The industry is not spending 2.5 % of CSR funds

allocated to provide common facilities in the surrounding villages.

8. The effluent treatment plant is not running

properly and the Pollution Control Board is not checking properly, resulting depletion of fish catch due to direct releasing of wastewater into Sea and the fishermen are left with no livelihood.

It is not genuine to go for expansion from 4750 Tons to 8665 tons with an investment of Rs.1200 Crores, without implementing pollution control measures and taking safety precautions even after the big fire accident happened on 24th January, 2016. The proponent assured that locals will be prefered during recruitment for the additional jobs of about 700 due to expansion. The Management assured to take all necessary environment/safety measures to protect the environment. Proponent assured that industry would install latest pollution control equipment like two stage scrubbing system, double condensor system, dry vacuum pumps to mitigate odor nuisance, electro static precipitators, bag filters to mitigate particulate emissions from boilers, and closed transfer of raw materials/solvents. Proponent assured that the Industry shall follow the standards prescribed by Ministry of Environment, Forest and Climate Change (MoEF&CC) with respect to emissions, effluents, solid waste.
