7. PUBLIC CONSULTATION 7.0 Introduction

The Ministry of Environment, Forest and Climate Change, (MoEFCC) Government of

India issued Environmental Impact Assessment notification S.O. 1533 dated September

16, 2006 mandating prior environmental clearance for for technical grade pesticides or

Agro chemicals manufacturing, API’s, Co-generation power plants and Chlor-Alkali

plant under category A for projects located outside notified industrial area/estate. The

proposed expansion project of M/s. Deccan Fine Chemicals (India) Pvt. Ltd., is located

at Sy Nos. 63-75, 80-83, 84-108 of Kesavaram village, 52-56, 146-150 of Rajavaram

village, Venkatanagaram Post, Payakarao Peta Mandal, Visakhapatnam District District,

Andhra Pradesh. The proponent obtained the terms of reference vide letter no. F.No. J-

11011/657/2007-IA II (I) dated 25.06.2014 and subsequently obtained amended TOR

vide letter no. F.No. J-11011/657/2007-IA II (I) dated 30.06.2015, from the MoEFCC,

which mandated public consultation. Accordingly the draft Environmental Impact

Assessment was submitted to Regional Officer, Andhra Pradesh Pollution Control

Board, Visakhapatnam District for conducting public hearing. The public hearing for

the proposed expansion was conducted on 15.07.2016 at 11.00 AM at project site. The

public hearing was chaired by Dr. N. Yuvaraj, Collector and District Magistrate,

Visakhapatnam and the member convenor was Sri R. Lakshmi Narayana,

Environmental Engineer, Andhra Pradesh Pollution Control Board, Regional office,

Visakhapatnam.

7.1 Advertisement

Press notification regarding the date, time and venue of the Environmental public

hearing for the proposed expansion project was issued in Andhra Jyothi (Telugu daily)

and The Hindu (English daily) newspapers on 14.06.2016. Copy of the advertisement is

enclosed.



Minutes of the meeting

The minutes of the public hearing is enclosed along with the attendance sheet. Concerns

expressed by speakers during public hearing and responses of the proponent are

presented in table 7.1. Response to written representations is presented in table 7.2.

The proponent informed that presently 50% of the employees in the plant are natives of this district. The proponent assured that locals will be prefered during recruitment for the additional jobs of about 700 due to expansion.


3 Sri Ch. Srinu, Sarpanch Venkatanagaram Village

While welcoming the proposed expansion, informed that the industry would take all necessary measure to prevent pollution on top priority. He requested the management to provide medical facilities in the villages and employment to the local educated youth. He further requested the management to pursue the possibility of supplying power to their villages from the surplus generation of the proposed power unit.

The Management assured to take all necessary environment/safety measures to protect the environment. Proponent assured that industry would install latest pollution control equipment like two stage scrubbing system, double condensor system, dry vacuum pumps to mitigate odor nuisance, electro static precipitators, bag filters to mitigate particulate emissions from boilers, and closed transfer of raw materials/solvents.



The proponent informed that presently 50% of the employees in the plant are natives of this district. The proponent informed that the expansion generates about 700 additional jobs, and that locals would be prefered for employment.

The Management assured that CSR funds would be utilized for the development of surrounding villages, and the development projects for improving health status, and educational qualifications will be identified in consultation with the local public representatives and revenue authorities.

4. A. Ramudu, Sarpanch, Kesavaram Village

While welcoming the proposed expansion project, informed that the local youth should be considered for employment opportunities and to ensure that uninterrupted power may be supplied to the existing RO plant, so that 24 hours water supply is possible to the village.

The proponent informed that presently 50% of the employees in the plant are natives of this district. The proponent informed that the expansion generates about 700 additional jobs.

The Management assured that CSR funds would be utilized for the development of surrounding villages, and that the development projects would be identified in consultation with the local public representatives and revenue authorities.

5 Smt Sanyasamma, Sarpanch, Sreerampuram Village

While welcoming the proposed expansion project, requested that the local youth would be considered for employment opportunities and to pursue the possibility of establishing a potable water plant as there is scarcity of drinking water in her village.

The proponent assured that locals will be prefered during recruitment for the additional jobs of about 700 due to expansion.

He said that even though some of the villages are not affected by pollution they would also be considered for employment. He further assured that there would not be any problem from local youth if they consider for employment opportunities in the proposed project.

The proponent assured that locals will be prefered during recruitment for the additional jobs of about 700 due to expansion. The management assured that all safety and environmental management measures will be strictly implemented to ensure safety to men and materials.

7. Sri. K. Diwakar Rao, Rajavaram Village

While welcoming the proposed expansion project, informed that the socio-economic status of the local people is improved due to the existing project and the situation would also be improved further due to the expansion of the industry. He stated that CSR activities would be taken up in his village and employment would be provided for skilled people. He also requested to provide education, medical and drinking water facilities to the local villages and requested to pursue the road widening considering the increased traffic.

The Management assured that CSR funds would be utilized for the development of surrounding villages, and that the development projects would be identified in consultation with the local public representatives and revenue authorities.

8. Sri. Y. Satyanarayana, Rajavaram Village

While welcoming the proposed expansion project, stated that since there are many fishermen families in surrounding villages employment opportunities are to be provided to them as the fish catch is getting depleted due to discharge of industrial effluent into the Sea which is affecting livelihood of fishermen. He also requested that proper safety measures are to be adopted to prevent fire accident in future. Finally he urged the management to consider the contract workers for regularization who are working since long time.

While opposing the expansion proposal stated that the greenbelt in the radius of 10 KM is affected and more greenbelt development is to be considered as the existing greenbelt is not sufficient after expansion and said that local people are prioritized in providing employment. He referred the occurrence of accidents resulting casualties. He felt that social audit to be conducted in the area to ascertain the socio-economic status of the people and the SC Colony, Gajapathinagaram adjacent to the industry is to be rehabilitated immediately to avoid any untoward situation regarding safety concern.

He informed that the industry provided employment to 10% of villagers and rendered 90% without any earning on their traditional fishing. He requested compensation from the industry. Since the industry occupied 230 acres of land, grazing grounds for sheep and goat became scares resulting in loss to the local people. He requested employment to the tune of 90% to the local people in the industry.

While welcoming the proposed expansion project, informed that both the State & Country are benefited as the industry is involved in manufacturing of Agrochemicals and requested the industry to provide employment to the local fishermen.

While welcoming the proposed expansion project, stated that the CSR activities are to be implemented in all the surrounding villages. He opined preventive measures are to be taken by the industry as the main occupation of the villages is agriculture and the crop in the surrounding




villages is getting affected due to pollution. Proponent assured that the Industry shall follow the standards prescribed by Ministry of Environment, Forest and Climate Change (MoEF&CC) with respect to emissions, effluents, solid waste.

While welcoming the proposed expansion project, informed that the socio-economic status of the local people is improved due to the existing project and the situation would also be improved further due to the expansion of the industry.


35. Sri K. Appala Raju, A. P. Mathsyakarla Sangam, Payakaraopeta Village

While opposing the proposed expansion project, informed that the fish catch is depleting due to discharge of industrial effluent into the Sea which is affecting livelihood of fishermen. He opined that the industry is providing employment to non locals instead of affected fishermen community. Thus, he requested the industry to provide proper employment to the fishermen and local people in order to improve their livelihood.


The total effluent will be treated in effluent treatment plant in compliance of Ministry of Environment Forest and Climate Change marine discharge standards prior to their disposal into the sea.

36. Sri V.Trinadh, Venkatanagaram Village

While welcoming the proposed expansion project, opined that industrialization is the only way to improve the socio-economic condition of the people.

The expansion would create employment both directly and indirectly that would improve livelihoods of rural families. 700 jobs will be created due to the expansion.

37. Sri T. Nagesh, Ex-Chairman, Grandhalaya Samstha, Payakaraopeta Village

While welcoming the proposed expansion project, stated that the fishermen were affected due to loss in catch. He requested the industry to treat the effluents to the marine discharge standards by following the protocols stipulated in the rules. He also stated that attitude of the people should change according to the times and supported the setting up and expansion of industries to improve

He urged the management to take care of farmers of Betel gardens which are getting affected due to pollution from the industry and also people from Kapu community would be provided with employment opportunities.

While welcoming the proposed expansion project, requested to provide permanent employment to fishermen and financial assistance to poor people.

While opposing the proposed expansion project, opined that public was not given enough opportunity to express their views freely and this type of culture was non-existent earlier. He further stated that the management of industry denied the basic right of workers to form union by resorting transfer of such employees to distant places. He alleged that there would be severe adverse impact on account of expansion of the industry over the surrounding villages.


40. Sri D. Anand, Mangavaram Village

While welcoming the proposed expansion project, stated that proper employment opportunities would be provided to the local people and requested to extend support for education in the surrounding villages.

The Management assured that CSR funds would be properly utilized for the development of surrounding villages in consultation with the local public representatives and revenue authorities. He stated that Industrialization is significant as the State of Andhra Pradesh newly formed. The above industry shall ensure to adopt all the prevention measures as directed by the Pollution Control Board in order to avoid pollution problems to the local surrounding villages and villagers. The CSR funds are properly utilized for environment point of view only by developing green belt and ensure to provide employment opportunities to the surrounding villagers. Instead of using groundwater, request to use the rainwater by providing rainwater collection pits. Medical camps are to be conducted in the surrounding villages at least once in a month. It is requested to recommend for necessary permissions to the above industry.

But, keeping in view of our State position and considering the employment opportunities of about 40 Crores of 15 – 35 years middle age group youth, she is supporting the same as the youth are waiting for employment opportunities and it is required to show employment opportunities. As the India has occupied 2% of area and 17% of population of the world, it is required to encourage the pharmaceutical industries which cater the needs of public; hence as an environmentalist she encourages the expansion proposal of M/s. Crores Liters of water rains in the existing area of 190 Acres of M/s. Deccan Fine Chemicals. Out of which, the water percolate into the ground is less than 15 Crores liters. Whereas, as per the Industry’s calculations, the water utilization per year is about 200 Crores Liters. As the difference is huge and affects the environmental balance, it is percolated into the ground for which arrangements to store the rain water, and should see that the rainwater is reaches to the ground. In the same way, the rainwater in the surrounding areas should also be preserved to the extent possible.

3. It is appreciable that 33% of green belt development

He stated that the public hearing proposed to be conducted on 15 of this month for the expansion proposal of M/s. Deccan Fine Chemicals is to be cancelled. This is very dangerous industry. Many accidents were occurred in this company. Minimum safety measures were not adopted. The Pollution Control Board itself reported that the pollution affect will be up to 10 km radius from the company and the air & water are completely polluted because of the industry.

1. Accidents occurred in the industry:

a. 24th January, 2016 – Accident occurred in the godown where medicines are stored. Due to which, the workers of the employs along with the surrounding Rajavaram, Gajapathinagaram, Pentakota, Venkatanagaram, Rajanagaram, Kesavaram, Srirampuram, Rajagopalapuram villagers ran away leaving their properties to save their lives.

b. 11th April, 2014 – In the reactor blast accident,

The proponent informed that presently 50% of the employees in the plant are natives of this district. The proponent assured that locals will be prefered during recruitment for the additional jobs of about 700 due to expansion. The Management is assured to take all necessary environment/safety measures to protect the environment. Extensive Infrastructure has been provided for fire safety. Proponent assured that industry would install latest pollution control equipment like two stage scrubbing system, double condensor system, dry vacuum pumps to mitigate odor nuisance, electro static precipitators, bag filters to mitigate particulate emissions from boilers, and closed transfer of raw materials/solvents.



two causalities were occurred on the spot and another 14 workers were injured. The management had not taken any preventive measures even after this accident. The surrounding villager’s health is affecting due to release of chemicals in the production of pesticides. For example, two children in SC Colony of Rajavaram, a nearby village of the industry are suffering with skin allergy and many other are suffering with skin allergies.

2. Safety measures:- The industry has totally failed in adopting safety measures. The industry is hiding many small accidents that are happening regularly, from the world.

3. Greenbelt: - Presently the industry is operating

in 40 Acres without any greenbelt. Now, the industry has proposed another 190 acres for expansion. In total the industry is establishing in 230 Acres. Out of 230 acres, as per EIA report, green belt is to be developed in 76 Acres. Till now there is no sign of green belt development and the industry may not fulfill the commitment in future also. Resulting total polluting environment.

4. Pollution Control Measures: Due to lack of

control by the Pollution Control Board, the surrounding cultivable lands & crop are affecting, due to release of industrial waste into the Sea, the fish catch is depleting and the fishermen livelihood was affected, resulting migration of villagers.

Proponent assured that the Industry shall follow the standards prescribed by Ministry of Environment, Forest and Climate Change (MoEF&CC) with respect to emissions, effluents, solid waste. The management assured to develop greenery in an area of 76 acres within the plant, and assued to assist the district administration in improving the greenery in the surrounding area. Proponent assured that total effluent will be treated in effluent treatment plant in compliance of Ministry of Environment Forest and Climate Change marine discharge standards prior to their disposal into the sea



5. Employment: The rehabilitants and surrounding villagers were assured providing of Jobs, but the same was not fulfilled till date. In the future expansion proposal, it was assured that about 600 jobs will be provided during the construction period and about 450 jobs will be provided after completion of the industry. As assured, all these jobs are to be provided to the rehabilitants and surrounding villagers.

6. The Labour Rules are not implementing properly.

The Management is not accepting to start Union and the management is taking revenge on the workers either by removing from the job or transferring.

7. The industry is not spending 2.5 % of CSR funds

allocated to provide common facilities in the surrounding villages.

8. The effluent treatment plant is not running

properly and the Pollution Control Board is not checking properly, resulting depletion of fish catch due to direct releasing of wastewater into Sea and the fishermen are left with no livelihood.

It is not genuine to go for expansion from 4750 Tons to 8665 tons with an investment of Rs.1200 Crores, without implementing pollution control measures and taking safety precautions even after the big fire accident happened on 24th January, 2016. The expansion of the industry without implementing safety measures and pollution control measures may lead to more accidents. Hence, it is requested to intervene and cancel the public hearing of M/s. Deccan Fine Chemicals proposed to be
