While long term funds are required by applicants in the lower income segments for affordable EMIs, long term lending is perceived as high risk by lending institutions, thus pushing them to borrow from the informal markets at high cost. As such, the Credit Risk Guarantee Fund Scheme for Low Income Housing was formulated by Ministry of Housing and Urban Poverty Alleviation (MoHUPA), GoI on 01.05.2012, in order to provide guarantee to financial institutions and overcome the significant gap in flow of institutional credit to lower income segment in urban areas, which was notified in the Gazette dated 21.06.2012. All Scheduled Commercial Banks are eligible for availing benefit of Guarantee cover under the Scheme. The Bank has entered into an agreement with the Credit Guarantee Risk Fund Trust for Low Income Housing and has become an eligible Member Lending Institution on 07.06.2014. The following terms and conditions specifically are to be complied with under the scheme. The other terms and conditions as applicable to the existing Public Housing Loan Scheme are also applicable for loans extended under this Scheme. As per the 11th Five Year Plan estimates, due to the fast urbanization of the country, housing shortage in the urban areas is estimated at around 26.53 million units as at the end of 2012, mostly in Economically Weaker Section (EWS) and Low Income Group (LIG) segments. Purpose

Construction, acquisition and purchase of new or second hand dwelling units, home improvement by extension, upgradation, or repairs of existing dwelling units. Carpet area of housing unit not to exceed 430 sqft (40 sqm).

Eligible Borrowers

New individual borrowers in EWS/LIG categories and borrowers forming a group or housing society of at least 20 members in Urban areas, statutory towns, urban agglomerations and Planning areas as described in Annexure – I. Annual Income: Economically Weaker Section (EWS) – Rs.1,00,000/- as household income per annum. Low Income Group (LIG) – Rs.1,00,001/- to Rs.2,00,000/- as household income per annum.

Quantum of loan Not Exceeding Rs.5.00 lacs.

Rate of Interest Rate of Interest as applicable to PHL + 0.05%.

One time Guarantee Fee

A one-time guarantee fee, at specified rate of 1% on the total loan amount, shall be paid upfront to the Trust within 30 days from the date of first disbursement of housing loan or 30 days from the date of demand advice of Guarantee Fee, whichever is later.

The Guarantee Fee shall not be charged from the beneficiary as on upfront processing fee, however, the interest may be altered to cover upto 50% of the Guarantee Fee. Hence, 0.05% interest is loaded to the applicable Rate of Interest on account of Guarantee Fee payable to CRGFTLIH. The same shall be explained to the borrower. Guarantee Fee will be remitted from Head Office based on the sanctions and subsequent 1st disbursement made. Branches need not collect Guarantee Fee separately from the borrowers.

Product in CBS

A new Product Code 6250 - 2401 is created for the purpose of opening loan accounts under this Scheme. Branches shall open the eligible accounts ONLY UNDER THIS PRODUCT. Loan accounts opened in any other product WILL NOT be covered under this Guarantee Scheme.

Other condition

An undertaking to be obtained from the borrower as per Annexure – III.

Housing Loans not eligible under the Scheme

Housing loans for which Collateral Security other than the Primary Security of the house for which the loan is availed, and/or third party guarantee is taken are not eligible.

Housing loans covered by any other Guarantee, General Insurance or Indemnity by any Institution or Govt. are not eligible.

Housing loans of any borrower who has already availed a housing loan under this Scheme or any other Scheme, where the Bank has invoked the guarantee and the borrower has not repaid the loan amount due are not eligible.

Branches shall take care to input all the details pertaining to the borrower/loan in the loan application / CBS, such as:

i. Income level of the borrower ii. Category : SC/ST/OBC, iii. EWS/LIG, iv. Muslim/Sikh/Jain/Others v. Address of the Property with City and the State vi. Purpose of the loan

As per the Scheme, Housing loans to Urban EWS and LIG borrowers sanctioned on or after 07.06.2014 are eligible to be covered. Branches shall transfer all such eligible loans sanctioned after 07.06.2014 to the new Product Code 6250 - 2401 in CBS on or before 31.08.2014 to enable Head Office to remit the Guarantee fee and cover the loans under the Scheme. Guarantee Fee will be remitted to the Trust ONLY on the basis of the Accounts under the above Product and Branches are advised to ensure that all existing loan accounts eligible to be covered by the Scheme are transferred to the new CBS product immediately on or before 31.08.2014. All new loan accounts eligible under the Scheme must be opened in the new CBS product only.

Head Office, Credit & Recoveries Department shall compute the Fee payable on a quarterly basis for loans opened in Product Code 6250 – 2401 as per the guidelines and remit the same to the Fund along with the Guarantee Application Form and the details of the loans covered as per Annexure IV. Annexures to the Circular : Annexure I - Definitions as given by NHB Annexure II - Detailed guidelines of the Scheme Annexure III - Undertaking to be obtained from the borrower Annexure IV - Guarantee Application Form The branches are aware that the Bank has been conducting Housing Melas to create awareness among the public about the Housing Loan Schemes of the Bank and for scouting Housing Loans from the eligible customers / persons. Hence, the branches shall take keen interest on the subject and scout good number of housing loan proposals under the scheme from the eligible customers / persons. Clarifications required, if any, on this circular may be sought from HO : Credit & Recoveries Department through respective Regional Offices as per extant guidelines. (D. ANNEXURE – I

DEFINTIONS AS GIVEN BY NHB Planning Area “Planning Area” means a planning area or a development area or a local planning area or a regional development plan area, by whatever name called, or any other area specified as such by the appropriate Government or any competent authority and includes any area designated by the appropriate Government or the competent authority to be a planning area for future planned development, under the law relating to Town and Country Planning for the time being in force. Statutory Towns All places with a municipality, corporation, cantonment board or notified town area committee, etc-This category of urban units is known as Statutory Towns. These towns are notified under law by the concerned State/UT Government and have local bodies like municipal corporations, municipalities, Municipal Committee, etc., irrespective of their demographic characteristics as reckoned on 31st December 2009, Examples: Vadodara (M Corp.), Shimla (M Corp.) etc. Urban Agglomeration An urban agglomeration is a continuous urban spread constituting a town and its adjoining outgrowths (OGs), or two or more physically contiguous towns together with or without outgrowths of such towns. An Urban Agglomeration must consist of at least a statutory town and its total population (i.e all the constituents put together) should not be less than 20,000 as per the 2001 Census. In varying local conditions, there were similar other combinations which have been treated as urban agglomerations satisfying the basic condition of contiguity. Examples: Greater Mumbai UA, Delhi UA, etc.

ANNEXURE – II

Credit Risk Guarantee Fund Scheme for Low Income Housing in Urban Areas, 2012 (CRGFS)

Credit Risk Guarantee Fund Trust for Low Income Housing 1. OBJECTIVES OF THE SCHEME To provide default guarantee for housing loans upto Rs.5 lakhs sanctioned and disbursed by lending institutions in urban areas without any collateral security and/or third party guarantee to new borrowers in EWS/LIG categories, including borrowers forming a group or housing society of at least 20 members, in urban areas and is to be operational from the year 2012-13. To undertake securitization of the guaranteed loans and to do all other acts as may be necessary, either directly or otherwise in such manner as may be decided by Board of Trustees of CRGFTILH. To do such other acts and things as may be incidental to or consequential to the objectives. 2. DEFINITIONS For the purposes of this scheme:- 1) “Amount in Default” means the principal and interest amount outstanding in the account(s) of the borrower in respect of housing loan, as on the date of the account becoming NPA or the date of lodgment of claim application whichever is lower or such of the date as may be specified by the CRGFS for preferring any claim against the guarantee cover subject to a maximum of amount guaranteed. 2) “Base Rate” means the rate so declared by the lending Institution for the relevant time period/duration for which the housing loan has been extended. 3) “Bank rate” means the rate at which RBI lends money to other Banks or Financial Institutions. 4) “Collateral Security” means the security provided in addition to the primary security, in connection with the housing loan extended by a lending Institution to a borrower. 5) “Low Income Housing means a housing unit, for economically weaker and Low income individuals, of size upto 430 sqft (40sqm) carpet area. 6) “Material Date” means the date on which the guarantee fee on the amount covered in respect of eligible borrower becomes payable by the lending Institution to the Trust. 7) “Primary security” in respect of a housing loan shall mean the assets created out of the housing loan so extended and/or existing unencumbered assets of the borrower which are directly associated with the property for which the housing loan has been extended. 8) “Tenure of Guarantee Cover” means the period of Guarantee cover from Guarantee start date which shall run through the agreed tenure of the housing loan and for a maximum period of 25 years or loan termination date, whichever is earlier or such period as may be specified in the agreement between the lender and the Trust.

3. SCOPE AND EXTENT OF THE SCHEME Guarantee by the Trust 1. Subject to the other provisions of the Scheme the Trust undertakes, in relation to housing loan extended to an eligible borrower from time to time by an eligible lending Institution which has entered into the necessary agreement for this purpose with the Trust, to provide a guarantee on account of the said housing loans. 2. The Trust reserves the discretion to accept or reject any proposal referred by the Lending Institution which otherwise satisfies the norms of the Scheme. 3. Housing Loans eligible under the Scheme A) The Trust shall cover housing loans extended by eligible institutions to an eligible borrower in the low income housing sector for housing loans not exceeding Rs.5 lakhs by way of housing loans on or after entering into an agreement with the Trust, without any collateral security and/or third party guarantees or such amount as may be decided by the Trust from time to time. Provided that the Lending Institution applies for guarantee cover in respect of loan proposals sanctioned in the quarter April-June, July-September, October-December and January-March prior to expiry of the following quarters, viz, July-September, October-December, January-March, and April-June respectively. Provided further that, as on the material date 1. The dues to the lending Institution have not become bad or doubtful of recovery, and/or 2. The property/asset of the borrower for which the housing loan was granted has not ceased and or 3. The housing loan has not wholly or partly been utilized for adjustment of any debts deemed bad or doubtful of recovery, without obtaining a prior consent in this regard from Trust. 4. The borrower has paid the necessary fees and charges for the said property. B) Housing loans can be extended by more than one lending Institutions jointly and/or separately to eligible borrower up to a maximum loan upto Rs.5 lakhs per borrower and per primary security subject to ceiling amount of individual lending institution or such amount as may be specified by the Trust. C) The eligible borrower shall be required to submit an undertaking to the lending institution to the effect that she/he has not availed any other housing loan covered under this scheme nor any additional risk cover has been granted to the housing loan availed by her/him by Government or any general insurer or any other person or association of persons carrying on the business of Insurance Guarantee or Indemnity. 4. EXPECTED BENEFITS Benefits to Lenders

Credit Risk transferred to the Trust.

Capital Relief: Education in credit risk leads to reduction in risk weighted assets and hence lesser capital requirement for CRAR.

Mobilization of Funds through Securitisation. Benefits to EWS/LIG Households

Credit enhancement to EWS and LIG households will result in increased credit flow from lenders for this segment.

Increased availability and accessibility of Institutional loan/credit.

Affordable interest rates due to reduced risk and lesser capital requirements for

lenders. 5. ELIGIBLE INSTITUTIONS Lending Institutions which are eligible to avail guarantee cover under the Scheme are; 1. Scheduled Commercial Banks 2. Regional Rural Banks 3. Urban Co-operative banks 4. NBFC-MFIs 5. Apex Cooperative Housing Finance Societies registered under the State Co-operative Societies Act, eligible under RBGI guidelines 6. Housing Finance Institutions registered with NHB 6. ELIGIBLE LOANS – SCOPE AND COVERAGE ELIGIBLE BORROWERS: New individual borrowers in EWS/LIG categories and borrowers forming a group or housing society of at least 20 members in urban areas, Statutory towns, urban agglomerations and Planning areas as described in Annexure-I. MoHUPA has revised the income ceilings for EWS and LIG with immediate effect vide their letter dated November 14, 2012 as follows: Economically Weaker Section (EWS): Rs.100000/- as household income per annum, Low Income Group (LIG): Rs.100001/- to Rs.200000/- as household income per annum, ELIGIBLE LOAN AMOUNT: Housing loan amount not exceeding Rs.5.00 lakhs per person. ELIGIBLE ACTIVITY: Construction, acquisition and purchase of new or second hand dwelling units, and home improvement by extension, upgradation, or repairs of existing dwelling units. Involving a housing loan amount not exceeding Rs.5.00 lakhs per person Carpet area of housing unit not to exceed 430 sqft (40 sqm).

HOUSING LOANS NOT ELIGIBLE UNDER THE SCHEME

Housing loans for which collateral security other than the primary security of the house for which the loan is availed, and/or third party guarantee is taken are not eligible.

Housing loans covered by any other guarantee, general insurance or indemnity by any Institution or Govt. are not eligible.

Housing loans of any borrower, who has already availed a housing loan under this

Scheme or any other Scheme, where the Bank has invoked the guarantee and the borrower has not repaid the loan amount due are not eligible.

Any housing loan, which has been sanctioned by the lending institution with interest

rate more than the prevailing interest rate applicable for that eligible loan category or”2% over the base rate of lending institutions in cases where base rate is applicable”, whichever is easier. However, the Trust may revise such ceiling from time to time keeping in view the prevailing interest rate scenario, base rates of lending institutions and RBI’s Credit Policies, at that time.

MODIFICATIONS AND EXEMPTIONS

1. Ministry of Housing & Urban Poverty Alleviation reserves to itself the right to modify, cancel or replace the scheme.

2. The Trust shall have a right to alter the terms and conditions of the scheme in regard to an account in respect of which guarantee has not been invoked as on date of alteration.

3. In the event of the scheme being cancelled, no claim shall lie against the Trust in respect of facilities covered by the scheme, unless the provisions contained in Clause (1) and (2) of Section 13 of the scheme are complied with by the lending Institution.

7. GUARANTEE COVER Guarantee cover provided under the Scheme is as follows:

8. GUARANTEE FEE Quantum of Fee: One time guarantee fee at specified rate of 1% (or as specified from time to time) of total loan amount sanctioned. Payment of Fee to Trust: Fee shall be paid upfront to the Trust by Bank within 30 days from date of first disbursement or 30 days from date of Demand Advice of guarantee fee whichever is later or such date as specified by the Trust.

Charging of Fee from Borrowers: The guarantee fee shall not be charged from the borrower as an upfront processing fee. However, Banks may alter the interest rate to cover upto 50% of the fee, which should be clearly disclosed to the borrower. There shall be no annual servicing fee under the Scheme. Guarantee Fee once paid is not refundable, except in the case of excess paid or fees paid for ineligible housing loan. 9. GUARANTEE CLAIM INVOCATION OF GUARANTEE Lock-in Period: The lender cannot make any claim on the Trust for settlement

Within the period of 24 months from date of last disbursement, or Within the period of 24 months from date of guarantee cover coming into force, or 2 months after completion of house, whichever is later.

Lending Institution shall invoke the guarantee in respect of housing loan:

In case the loan is classified as NPA before lock in period expires, within one year of the expiry of the lock-in period, or

In case the loan is classified as NPA after lock in period expires, within one year of the loan being classified as NPA.

Subject to the guarantee being in force and recovery proceedings initiated. 10. SETTLEMENT OF GUARANTEE

The claim should be preferred by the lending institution in such manner as may be specified by the Trust in this behalf.

The Trust shall pay 75% of guaranteed amount on invocation of claim by lending

Institution within 60 days of applying for settlement of claim, subject to the claim being otherwise found in order and complete in all respects.

The balance 25% will be paid on conclusion of recovery proceedings by the lending

Institution.

On a claim being paid, The Trust shall be deemed to have been discharged from all its liabilities on account of the guarantee in force in respect of the borrower concerned.

In the event of default the lending institution shall exercise its rights, if any, to take

over the assets of the borrowers by taking permission of the Trust and the amount realized, if any, from the sale of such assets or otherwise shall first be credited in full by the lending institutions to the Trust before it claims the remaining 25 percent of the guaranteed amount. If the Trust so desires, it can retain the asset by paying remaining 25 percent of the guaranteed amount and may give it to the next eligible borrower or as the case may be.

The lending institution shall be liable to refund the claim released by the Trust together with penal interest at the rate of 5% above the prevailing Bank Rate, if such a recall is made by the Trust in the event of serious deficiencies having existed in the matter of appraisal/renewal/follow-up/conduct of the housing loan or where lodgment of the claim was more than once or where existed suppression of any material information on part of the lending institutions for the settlement of claims. The lending institution shall pay such penal interest, when demanded by the Trust, from the date of the initial release of the claim by the Trust to the date of refund of the claim.

The Guarantee Claim received directly from the branches or offices other than

respective operating offices of lending institutions will not be entertained.

Subrogation of rights and recoveries on account of claims paid:

(1) The lending institution shall furnish to the Trust, the details of its efforts for recovery, realizations and such other information as may be demanded or required from time to time. The lending institution will hold lien on assets created out of the housing loan extended to the borrower, on its own behalf and on behalf of the Trust. The Trust shall not exercise any subrogation rights and that the responsibility of the recovery of dues including takeover of assets, sale of assets, etc. shall rest with the lending institution.

(2) In the event of a borrower owing several distinct and separate debts to the lending institution and making payments towards any one or more of the same, whether the account towards which the payment is made is covered by the guarantee of the Trust or not, such payments shall, for the purpose of this clause, be deemed to have been appropriated by the lending institution to the debt covered by the guarantee and in respect of which a claim has been preferred and paid, irrespective of the manner of appropriation indicated by such borrower or the manner in which such payments are actually appropriated.

11. APPROPRIATION OF RECOVERY AMOUNT After invocation of Guarantee The amount received from the lending institutions shall be appropriated in the order in

which the guarantee fee, penal interest and other charges have fallen due. If the guarantee fee and the penal interest have fallen due on the same date, then the appropriation shall be made first towards guarantee fee and then towards the penal interest and finally towards any other charges payable in respect of the eligible housing loan.

Any amount recovered by lending Institution toward defaulted loan shall be paid to the Trust within 30 days from date of recovery. In case of delay, interest at 4% above Bank Rate for the delay after 30 days shall be paid.

After adjusting costs incurred towards recovery of amount by the lending Institution, the balance shall be appropriated in such manner so that losses on account of deficit in recovery of the housing loan between the Trust and the lending Institution are in the proportion. a) of 90% and 10 %, respectively, in the case of housing loans upto Rs.2 lakhs

b) of 85% and 15 %, respectively, in the case of housing loans above Rs.2 lakhs and upto Rs.5 lakhs.

Amounts realised by sale of assets by the lending Institution shall be first credited to the Trust before claiming the remaining 25% of guaranteed amount. In the event of severe deficiencies found in the matter of appraisal, follow-up, duplication of claim or suppression of material information by lending Institution, claim releases shall be refunded together with penal interest of 5% above prevailing Bank Rate from the date of initial release of claim by Trust to date of refund.

12. AGREEMENT AND TIMINGS FOR CLAIMING GUARANTEE A. Agreement by the Lending Institution: The lending Institution will have to enter into an agreement with the Trust in such form as may be required by the Trust, to be entitled for obtaining guarantee cover under the Scheme in respect of any eligible housing loans granted by it. Conditions imposed under the scheme to be binding on the lending institution. 1. Any guarantee given by the Trust shall be governed by the provisions of the Scheme as if the same had been written in the documents evidencing such guarantee. 2. The lending institution shall as far as possible ensure that the conditions of any contract relating to an account guaranteed under the scheme are not in conflict with the provisions of the scheme but notwithstanding any provision in any other document or contract, the lending institution shall in relation to the Trust be bound by the conditions imposed under the scheme.

(Our Bank has already entered into an Agreement with the Trust on 07.06.2014) B. Applying for Guarantee Cover: The lending Institution has to apply for guarantee cover for proposals sanctioned in the quarter April-June, July-September, October-December and January-March prior to the expiry of the following quarter, viz. July-September, October-December, January-March and April-June respectively. 13. RESPONSIBILITIES OF LENDING INSTITUTION

i. Specific use of prudent banking judgment.

ii. Use of business discretion/ due diligence in selection/evaluation of housing loan proposals and conduct the account(s).

iii. Safeguard the primary security against which the housing loan is availed in good and enforceable condition.

iv. Close monitoring of the account.

v. Due diligence and necessary actions for recovery of loan amount. Mere issuance of notice under SARFAESI Act will not be construed as initiation of legal proceeding. Further action under the Act is to be taken before submitting claims.

vi. The lending institution shall ensure that the guarantee claim in respect of the housing loan is lodged in time as specified by the Trust and there shall not be any delay to notify the default in the borrowers account which shall result in the Trust facing higher guarantee claim.

vii. The payment of guarantee claim by the Trust to the lending institution does not in any way take away the responsibility of the lending institution to recover the entire outstanding loan amount form the borrower. All necessary steps to recover the full amount shall be initiated.

viii. The lending institution shall, in particular, refrain from any act of omission or commission, either before or subsequent to invocation of guarantee, which may adversely affect the interest of Trust as the guarantor.

14. RETURNS AND INSPECTIONS The lending Institution shall furnish such statements and furnish such information, documents, receipts, certificates and other writings as may be required by the Trust in respect of any housing loan covered under the Scheme. 15. JURISDICTION OF THE COURTS The Competent Court in Delhi shall have exclusive jurisdiction to decide any question regarding the interpretation and construction of this declaration or administration of the Trust and the related matters. 16. CREDIT RISK GUARANTEE FUND TRUST To administer the CRGFTLIH Scheme, a Credit Risk Guarantee Trust Fund is set up under the Indian Trust Act 1882, with the Secretary, MoHUPA as the ex-officio Chairman. The Fund Trust will be managed by National Housing Bank which will also facilitate and oversee operations of the Scheme. The Bank has to enter into an Agreement with the Trust for obtaining guarantee cover under the Scheme in respect of eligible to housing loans sanctioned by Bank.
