2 CITY OF RYDE PROCUREMENT

The ATTACHED report on formal procurement at the City of Ryde provides information as to Requests for Tender or Requests for Quotation that are currently in the market. The report also outlines those items of procurement (if any) that are to be reported to the next meeting of Council in accordance with the requirements of the Local Government Act and Regulations. This includes all procurement in the bracket of $50k - $150k in value (Request for Quotation) or exceeding $150k inc GST (Request for Tenders).

Some of these processes may be marked as being limited to selective respondents. Where this is the case, there has been a publicly advertised Expression of Interest process to establish select respondents or a panel of select respondents that are prequalified to undertake the required works.

4 CALL FOR MOTIONS FOR THE ANNUAL CONFERENCE OF THE LOCAL GOVERNMENT NSW - 16 to 18 October 2016

The Local Government NSW Annual Conference will be held at WIN Entertainment Centre, Wollongong on 16 to 18 October 2016. The LGNSW Board is now seeking input from Councils, including newly merged Council’s to guide the content of business sessions at the conference and is requesting Councils to ensure that the motions debate centres on advancing the sector wide policy agenda. This means that proposed motions should seek to be strategic, affect members state-wide and introduce new or emerging policy issues and actions. Furthermore, LGNSW has recently drafted a revised policy framework consisting of proposed Policy Principles and Position Statements which is outlined in the attached Policy Review Discussion Paper (ATTACHMENT 1). Councils are encouraged to consider the draft policy framework when drafting motions for this year’s conference. Councils should identify motions relating to the following overall categories:

1. Industrial Relations and Employment 2. Economic 3. Social Policy 4. Environmental 5. Governance/ Civic Leadership (eg. legislative and regulatory setting, elections,

participation, reform) The LGNSW Board has resolved that motions will be included in the Business Paper for the Conference only where they meet the following criteria:-

1. Are consistent with the objects of the Association (see Rule 4 of the Association’s rules – ATTACHMENT 2);

2. Relate to Local Government in NSW and/or across Australia; 3. Concern or are likely to concern Local Government as a sector; 4. Seek to advance the Local Government policy agenda of the Association and/or

improve governance of the Association; 5. Have a lawful purpose (a motion does not have a lawful purpose if its

implementation would require or encourage non-compliance with prevailing laws); 6. Are clearly worded and unambiguous in nature; and 7. Do not express preference for one or several members over one or several other

members. The Board has advised that it will not include motions in the Business Paper which do not advance the local government policy agenda. Therefore a motion will not be included if it is operational, rather than strategic; not local government business; focused on a local issue only or if the motion is consistent with past policies and actions of LGNSW or the Local Government and Shire’s Association.

The Board has advised all Councils to submit proposed motions by 22 August 2016. A report will be submitted to the Finance and Governance Committee meeting on 16 August 2016 for Councillors to consider motions proposed to be included on the conference business paper. The Committee will also be requested to make a recommendation of its delegates to the Conference at this meeting. The Committee’s recommendation will then be considered at the Council meeting on 23 August 2016. Councillors are requested to forward any proposed motions for consideration to the HelpDesk by Close of Business on 5 August 2016.

RULE 4 – OBJECTS OF THE LOCAL GOVERNMENT ASSOCIATION

4. The objects of the Association shall be in New South Wales and elsewhere:

(a) to encourage, promote, protect and foster an efficient and effective autonomous, democratic system of Local Government elected by and responsible to local communities with its position constitutionally guaranteed and with adequate resources including revenue from State and Commonwealth Governments;

(b) to promote, maintain and protect the interests, rights and privileges of Local Government in New South Wales and of the constituent members of the Association;

(c) to encourage and assist Local Government to seek out, determine, assess and respond to the needs and aspirations of its constituents;

(d) to encourage, assist, promote and foster the achievement and maintenance of the highest level of integrity, justice, competence, effectiveness and efficiency of Local Government;

(e) to develop, encourage, promote, foster and maintain consultation and co-operation between councils and Local, State and Commonwealth Governments and their instrumentalities;

(f) to develop, encourage, promote, foster and maintain the financial and economic well-being and advancement of Local Government and for such purposes to undertake, establish, acquire, conduct or dispose of any business, enterprise, undertaking or venture which in the opinion of the Association is necessary, desirable or convenient;

(g) to represent the members of the Association and Local Government generally in their dealings with State and Commonwealth Governments, with statutory and other corporations, with the media and with the public;

(h) to promote, support and encourage Local Government at a State and national level;

(i) to provide an industrial relations service to members including: (i) representing the interests of members in industrial matters before

courts and tribunals; (ii) assisting in negotiations relating to the settlement of disputes between

members and their employees; (iii) representing the interests of members in negotiating the establishment

of and/or variation of industrial awards and agreements; (iv) promoting training programs aimed at enhancing the performance of

Local Government. (j) to undertake or promote any activity which the Board determines to be for the

benefit and/or interest of members and local government in New South Wales.

6 LOCAL GOVERNMENT AND ELECTIONS LEGISLATION AMENDMENT (INTEGRITY) ACT 2016

The NSW Parliament has recently passed changes to the Local Government Act 1993 (LGA), the Election Funding, Expenditure and Disclosures Act 1981 (EFA), and the Local Government General Regulation 2005 which are designed to promote integrity in local government candidates and the election process.

The outcomes of these changes are given below:-

Caps will be imposed on political donations from single donors to candidates, third-party campaigners, registered parties and groups;

People will be disqualified from holding civic office in a Council if they have been convicted under the EFA while in office (or within 2 years of nomination), or have received another conviction carrying a sentence of 5 years or more or imprisonment within 7 years;

The loophole in the LGA that allowed Councillors to vote on some changes to environmental planning instruments without having to disclose their financial benefit, will be closed;

A legal process will be created so that a Councillor found to have breached their pecuniary interest obligations may be required to pay the Council an amount equivalent to the financial benefit the Councillor gained;

Local government election candidates will be required to disclose whether they are a property developer, or a close associate of property developers, on election candidate nomination and statistical forms; and

The returning officer for Council-administered elections will be required to submit all nomination papers to the Electoral Commission.

7 RYDE YOUTH COUNCIL MEETING MINUTES - 29 JUNE 2016

Ryde Youth Council advocates for the needs of young people and provides a mechanism for their participation and involvement in decision making on community issues. The young Councillors meet on a monthly basis. Attached are the minutes of the meeting held on Wednesday, 29 June 2016.

8 NOTIFICATION FROM NSW DEPARTMENT OF PLANNING AND ENVIRONMENT REGARDING PREFERRED PROJECT REPORT SUBMITTED IN RESPONSE TO SUBMISSIONS TO SECTION 75W APPLICATION TO MODIFY THE CONCEPT PLAN FOR A MIXED USE DEVELOPMENT AT SHEPHERDS BAY, MEADOWBANK (MP09_0216 MOD2)

The purpose of this CIB item is to advise the Councillors that NSW Department of Planning and Environment (DPE) has received Preferred Project Reports (PPR) in responses to the submissions received from the earlier notification of the proposed modifications to the Concept Plan approval for the entire site including Stage A development at Shepherds Bay.

Councillors are aware that the Shepherds Bay Redevelopment Concept Plan (MP09_219) was approved as a Transitional Part 3A Major Project by the NSW State Government in March 2013 with a later Modification Application being approved in October 2014. A Project Plan for a Residential Flat Building at the corner of Belmore Street and Rothesay Avenue, Ryde was approved (as Stage 1) at the same time and has now been completed.

The concept plan essentially specifies the following in summary:

Staging of the development (Stages 1-9 on the western side of Belmore Street and Stage A on an isolated site located on the south-west corner of Church Street and Well Street);

Building footprint and envelope; Maximum number of dwelling units (2005); Maximum number of car parking spaces (2976); Public domain and infrastructure works; and Provision of a community facility (1000m2).

Recently the Joint Regional Planning Panel (JRPP) has granted consent to four (4) Development Applications for the Stages 2-3, 4-5, 6-7 and 8-9. Development Application for Stage A is yet to be lodged with Council.

SHEPHERDS BAY REDEVELOPMENT STAGES

On 11 February 2016, the NSW Department of Planning and Environment (DPE) has advised Council of the receipt of a Section 75W application seeking further modifications the Shepherds Bay Concept Plan MP09_219. The documents forwarded to Council show the proposed modifications involving the following key components:

Relocation of the community facility from Stage 2-3 to Stage 8-9; Reduction in size of the Community Facility from 1000m2 to 500m²- with provision for

parking; Provision of 45 additional dwelling units to Stage 2-3; Provison of additional storeys to Stage 2-3 and Stage 8-9; Change to Stage A building envelope; Exclusion of Stage A from dwelling cap and car parking cap; and Modifications to certain conditions of the Concept Plan approval.

This Section 75W application has been publicly notified from 11 February 2016 to 11 March 2016. Following the exhibition, the DPE has received 324 submissions including submissions 5 government agencies namely Trasport NSW, Heritage Council of NSW, RMS and Sydney Water and City of Ryde Council. Council’s submission included the following in summary:

Inadequate information submitted with the applicant such as o an Updated Traffic Impact Report, o a Pedestrian Access management Plan, o an Updated Statement of Infrastructure Commitments that is attributed to

Stage A traffic impacts, o a View Analysis that justifies the additional building height for Stage A

development, o inadequate shadow analysis, o inadequate Urban Design Analysis,

No information identifying any genuine public benefits for City of Ryde. In response, the proponents have submitted two Preferred Project Reports, one for the Stage A development and the other for the rest of the site (stages 2-9). The documentation indicates two preliminary VPA offers as public benefit which will be subject to Council approval should the Section 75W application be approved through a subsequent application process. The DPE has commenced public exhibition of the PPRs on Friday, 8 July 2016 which will continue until Monday, 8 August 2016. The department has notified all of the adjoining owners/occupiers in the area shown on the map below. The DPE has invited Council to make a further submission.

9 WORLD ENVIRONMENT DAY - DARVALL PARK DISCOVERY

In celebration of World Environment Day, the City of Ryde invited local residents and cultural communities to Discover Darvall Park on 26 June 2016 (previously to be held on 5 June but cancelled due to severe weather events). This was the first time Council has held this event at Darvall Park and it was extremely well received by the community. A total of 523 registrations were received and all 5 guided walk and tree planting sessions were fully booked out well in advance. Fun, free and family-friendly activities were held throughout the day including guided walks, tree planting sessions, face painting, story time, kids bush activities, wildlife shows where the kids were able to get up close to many native animals, BBQ and roaming entertainment. In the spirit of World Environment Day selected guided walks and tree planting sessions were bi-lingual with Mandarin, Cantonese and Korean translations. This event successfully achieved the objective of being a culturally inclusive event. The environment and educational objective of this event was successfully achieved through community engagement in Darvall Park and its endangered Blue Gum High Forest, local flora, fauna and the ecology of this catchment area. City of Ryde and a number of local community organisations provided a variety of different environmental information stalls.

He resigned from the position after experiencing a conflict between his professional obligations and his Christian faith. He continues to work with governments to develop stronger public policies in relation to the international refugee situation.
