3.4 Case Study (Mr Mwita Vs TANESCO)

Mr Mwita (Complainant) had power disconnected from his house for non payment of bills. The house was under occupation of a tenant. The Complainant settled the bills and agreed with power firm, TANESCO (respondent) not to restore power until a pre-payment meter was installed. The complainant paid for the meter installation charges.

Two years later, power was disconnected again for non payment and immediately the tenant terminated tenancy agreement. The complainant discovered that the meter was not installed hence the accumulated bills and disconnection. The complainant lodged a complaint , demanding TANESCO to:

(a) Clear the unpaid bill, (b) Pay him a rent he would have been receiving had the tenant not vacated (c) Pay Tshs 10mil. as general damage, (d) Pay for the cost of the complaint
