RESOLUTION

On October 23, 2015, the Puerto Rico Energy Commission (“Commission”)postponedthetechnicalconferenceintheIntegratedResourcePlan(“IRP”)reviewprocessbased, among other things, in the interest shown by several intervenors to presentalternativestotheIRPsubmittedbythePuertoRicoElectricPowerAuthority(“PREPA”).1TheCommissionnowestablishesthefollowingtimelineandproceduresfortheIRPreviewandapprovalprocess.

DiscoveryDeadline–ThepartiestotheIRPreviewprocessshallsubmittheirfinaldiscoveryrequestsnolaterthanFebruary29,2016.Additionaldiscoveryrequestsare not authorized beyond this date. However, all procedural matters regardingdiscoveryrequestsmadebeforeFebruary29,2016, includinganswers torequestsand motions to compel requested information, may be submitted beyond theFebruary 29, 2016 deadline in accordance with the Commission’s regulations,resolutionsandthedispositionsofthisResolution.

DiscoveryTerms–BasedonthecomplexityandscopeoftheinterrogatoriesbeingservedduringtheIRPreviewandapprovalprocess,severalpartieshaverequestedanextensionoftimetoanswerdiscoveryquestionnaires.Sincethepublicinterestisbestservedwhenallpartiesinvolvedinthisprocesshavetheinformationnecessaryto better assist the Commission in its review of the IRP, the Commission deemsappropriate to extend the twenty-day (20) term set forth in Section 8.03 ofRegulation 8543, known as Regulation on Adjudicative, Notice of Noncompliance,RateReviewandInvestigationProceedings.Therefore,allpartiesmustprovidetheanswerstoanydiscoveryrequestonorbeforeMarch21,2016.Thisincludesanyquestionnaireordiscoveryrequestservedbeforetheissuanceofthisorder.

TechnicalConference–TheCommissionwillholdatechnicalconferenceonApril6,2016.Inthetechnicalconference,PREPAshallpresentitsupdatedIRPproposal,as amended, and answer questions from the Commission and the intervenorsconcerningtheinformationcontainedinthefiledIRP.TheCommissionwill informthedetailsregardingthetechnicalconferenceatalaterdate(e.g.time,place,allottedtimeforquestions,etc.).

Intervenor and Amicus Briefs – Intervenors shall submit their written briefsstating their arguments and opinions regarding the filed IRP, including theirresponsetotheissuesraisedduringthetechnicalconference,nolaterthanApril20,2016.

AmicusbriefsshallalsobesubmittednolaterthanApril20,2016.

OralArguments–OralargumentswillbeheldonMay5,2016.IntervenorswillbegivenanopportunitytopresenttheirpositionsonPREPA’supdatedIRPproposal,asamended.Inaddition,theCommissionandallpartieswillbegiventheopportunitytoquestionintervenors’positions.TheCommissionwillinformthedetailsregardingtheoralargumentsatalaterdate.

PublicHearing–TheCommissionwillholdapublichearingas to the IRPreviewprocess onMay6, 2016. In the public hearing, any citizenwho is not a party oramicus to the IRP processmay express their opinion about PREPA’s updated IRPproposal, as amended, including, but not limited to, written comments. TheCommissionwillinformthedetailsregardingthepublichearingatalaterdate.
