MICRA Under Attack

California’s Medical Injury Compensation Reform Act (MICRA) has been one of the most important legislative reforms for California’s physicians community, and it’s continued defense will always been one of the California Medical Association’s top priorities.

Since 1975, MICRA has helped keep malpractice premiums in-check and ensures that California’s patients have access to affordable health care.

In early 2013, California trial attorneys launched an all-out attack on the law, committing more than $1 million to overturn the act, either through state legislation or public initiative. CMA will combat this effort, but needs your support.

What is MICRA?The Medical Injury Compensation Reform Act of 1975 (MICRA) is a series of statutes crafted to ensure that injured patients are fairly compensated, medical liability rates are kept in check, and physicians and clinics can remain in practice treating patients. The law has been targeted by the trial lawyers because it restricts the amount of money they can collect in damage awards.

Why is MICRA important?Today, MICRA is still working to restrain premium rates in California, while states without liability reform are seeing dramatically higher premiums. Because of MICRA, California has a system that is affordable, pays patients for their full economic and medical losses, and promotes patient safety and improved patient care.
