Plated lot of record is non conforming. All existing non-conformities were in place when we purchased the house. Our use of the property is adversely affected by the application of the current code.

Many similar variances have been granted in this zoning district. There are many substandard lots in the neighborhood.

We have used the deck area since we purchased the house. We would be unable to utilize any of our backyard without the deck area.

We are replacing the existing deck with no additional square footage.

No negative impact to drainage will be incurred, we are replacing what is already · in place.

213 30th Avenue South, Jacksonville Beach Variance request.

This house was built in 1999 and sits on a small, non-conforming lot that is approximately 6025sqft.

We purchased this house in April 2014, and have not made any changes to the deck, pavers or shed

from when it was purchased. The lot coverage has not changed since we bought the house. The current

space between the house and detached garage consists of 3 areas. One area is covered by pavers.

There is a small area of poured concrete creating a walkway between the house and garage, aha the

third area is a wooden deck.

The original wooden deck is severely deteriorated and has created a safety hazard. The deck is warped

and numerous deck boards have popped loose and cannot be easily repaired.

We are requesting a lot coverage variance of 56.8% to ratify the existing non-conformities that existed

when we purchased the house. We are requesting a side setback variance of O feet to replace the

existing wooden deck that abuts the existing wooden fence on the west side. We are requesting a rear

setback variance of 1 foot 6 inches and a side setback variance of 1 foot 6 inches for the existing non­

conforming vinyl shed that was in place when we purchased the house. We are also requesting a side

setback variance of 1 foot for the location of the existing driveway.

Failure to grant the variance would result in severe hardship. We would not be able to actively enjoy

our deck area, and any change in size to the deck area wou.ld .make our current outdoor furniture non­

functional. Additionally, the current paver area is required to be able to utilize our garage. One of_our

automobiles is large, and does not fit in the garage, the other car cannot back out without the paver

area due to the curve of the existing driveway.

The lot coverage on the minimum 10,000sq foot lot for RS-1 would be under 35%.

We wish to replace the existing deck/concrete/paver area with a uniform material, most likely

permeable pavers. The cl,Jrrent deck edge runs parallel to the garage in a NW direction. We are going to

straighten the edge of the deck to be perpendicular to the side fence. We move the existing red colored

area to the black colored area.

We do not currently have any drainage issues and expect the same when we replace the areas.
